Democrat Officials Abuse Offices, Hitting Trump, DeSantis With Political Lawfare

New York Attorney General Letitia James has filed suit against former President Donald Trump, three of his adult children and his business empire, accusing them of large-scale fraudulent financial practices and seeking to bar them from real estate transactions for the next five years. The attorney general's civil suit alleges more than a decade of deception, including billions of dollars in falsified net worth, as part of an effort by Trump to minimize his companies' tax bills while winning favorable terms from banks and insurance companies. ... Trump has repeatedly asserted that James, a Democrat running for a second term in November, is on a political vendetta, noting that during her 2018 campaign for AG she repeatedly vowed to pursue legal action against Trump and said he should be "scared" if she was elected. During her campaign, James promised to target Trump for investigation and told voters her election would bring pressure on him similar to that posed by Special Counsel Robert Mueller.
Yeah, why would Trump imagine that he's been targeted by abusive prosecutors who are just out to get him? I mean, they're just on videotape literally telling people to vote for them so they can sue Trump. Literally:
Trump had fought efforts to force his deposition in the NY AG's case, but lost a series of court challenges on the issue. When he finally appeared for questioning last month, he invoked his Fifth Amendment right against self-incrimination more than 440 times, an aide to James said. "When your family, your company, and all the people in your orbit have become the targets of an unfounded, politically motivated Witch Hunt supported by lawyers, prosecutors, and the Fake News Media, you have no choice," Trump said in a statement explaining why he took the Fifth despite numerous past comments he'd made about such a move signaling guilt.

The first move former President Donald Trump's attorneys should do to fight back against New York Attorney General Letitia James' civil lawsuit against him and his family members is to push that she be recused and disqualified from the case, Harvard Law professor emeritus Alan Dershowitz said on Newsmax Wednesday after her announcement. "I like Letitia James," Dershowitz said on Newsmax's "American Agenda." "She's a very nice person, but she campaigned on the promise to get Trump before seeing any evidence, and so she is just fulfilling a campaign promise. You can't have prosecutors even civilly prosecute a defendant if they made a campaign promise."And it can't be a sham recusal either, as Kim Foxx executed, where she "recused" herself while having her subordinate, who continued reporting to her, arrange to let Jussie Smollett off the hook. I've been wondering: How can the state sue for Trump allegedly "defrauding" banks? The banks do not allege fraud -- the "victims" do not allege they've been victimized. What the hell kind of rogue prosecution is it where the prosecution claims that a non-complaining non-victim is a victim but they just don't know it, and then sues on "the victim's" behalf? Viva Frei is wondering about that, too.
He means remove the case to federal court, but that requires "maximum diversity" of all parties in a suit, who must all be from different states. That's not the case, so he can't do that.

Once Trump is served, he takes a few weeks to respond. He probably cannot remove the case since there are NY defendants, so no diversity. Now we're in mid-October. He moves to dismiss.
Don't worry -- they're not, by and large. They're just punching the clock until they can get appointed to a corporate board somewhere. They don't want to upset the Marxist-Corporate Oligarchy.
I have only skimmed this dog's breakfast of a complaint, but what popped out at me for the parts I looked are were the lack of damages allegations, much less ones against NY, the plaintiff. You cannot sue if you did not suffer a loss. None are pleaded in the parts I looked at. Other causes of action may have damages allegations - we'll see. But there are plenty of other grounds to move to dismiss that just leap off the page.
Let's get real - if they thought they had Trump they would have filed a criminal case, but they have to prove that beyond a reasonable doubt. A civil suit is a preponderance of the evidence. They had no criminal case. They chose civil "fraud" to impress dumb people.
So, the initial motion to dismiss will not be heard before the midterm - the real mission was accomplished by filing suit in time to influence the election, but not so early that this garbage case could be tossed out before the election. I expect the case will be dropped or tossed after a couple motion to dismiss rounds. Maybe there will be a small, piddling settlement the AG will claim is a victory. It's not a real lawsuit. It's lawfare. And I hope red AGs are taking note of the new rules.

Mmhmm. Most of Conservative Inc. at TownHall and National Review are frantically trying to prop up DeSantis against Trump, but contra to some Trump stans I don't think DeSantis is the absolute worst. He can win the nom- really, become the Caesar that Trump wasn't- by putting local FBI agents and cabal executives up at the Greybar Hotel.

I just believe a few things. The first is that Trump continues to be easily the most popular Republican to Republican voters, and it's not that close, especially in head to head matchups outside of Florida. The second is that Trump is going to announce on Wednesday November 9, and by doing that he's going to hoover up 75% of all the GOP money men within days (the remaining 25% will be funding hilariously bad "centrist" candidates in order to try to take out Trump like Liz Cheney). The third is that DeSantis isn't going to run in 2024.

More to the point of liability but that might be eliminated if you have warnings out depending on the state. Much of the laws revolve around obviously lethal booby traps as innocents could be affected.
But such things as barbed razor wire etc. are allowed which are booby traps in a way. Caltrops are kind of in a gray area if on your property (and out of the right of way) as they are not per se lethal (parking garages use a variant of it to stop exits for example) and one would not expect people to be driving through your yard anyway so accidental damage to the car might not be foreseeable. FWIW, there is a whole category of caselaw involving mailboxes as to what is allowed or not as far as design and construction to prevent people from trashing your mailbox.
Probably easier and safer just to put a game camera out to capture pictures of the car doing it.

NY State is kind of weird in that it has a mostly professional court system, in part, because the oligarchs, corporate CEO with their NYC hqs, and financial industry residing there demand it. Recently, it has behaved more admirably than many of the federal judges and circuits in following the law. For example, see the recent decisions on redistricting in NY state, allowing lawsuits to proceed against prominent Dems such as Cuomo, etc.
California court system has a similar professionalism when it comes to arbitration and mediation cases.

Think that would qualify as a genuine booby trap.
Aside from criminal laws restricting lethal booby traps, much of the risk comes from liability from injuries which is a whole complex maze of state by state common law. For example, could a landowner with livestock be held liable for having an electric fence that accidentally triggers a heart attack in a trespasser. Would it matter if warning signs or no trespassing signs were out? What about a child, is a horse an attractive nuisance that require more steps to protect the child from the electric fence, and so on.
As I said, there is a whole subgroup of cases involving mailbox construction and I can recall at least one case that imposed liability on a homeowner tired of his mailbox being destroyed that built it up to be impregnable. Someone hit it intentionally and was seriously injured from crashing into the mailbox and successfully sued over it.

Part of it is that the civil case interferes with a defense to a criminal case. If a judge in the civil case issues a decision unfavorable to Trump on classification then that can be applied as precedent to the potential criminal case in DC where a grand jury is already sitting.
Trump's lawyers are trying to argue that regardless of whether the information was or is now classified (Biden reclassified some of the material reportedly), the DOJ raid was unreasonable and lacked probable cause because the items were stored properly and as former president, he is allowed to retain ownership of the copies under the Presidential Records Act.
The whole classification issue is an attempt by the NSD of the DOJ to create a whole area of law where the bureaucracy can never be exposed for wrongdoing.

The DOJ did this in Alabama which makes it much more likely to cause them to lose both at the district level and the circuit level. Most people do not go to the extent of getting subpoenas quashed because it is expensive legal work but in this case, the group probably will.

It is not unconstitutional but Florida's vote would not count in the EC. But, as a common practice, it is relatively easy for Trump to change residences to NJ as states as a constitutional matter must allow changes of residency including voting/dl/etc with no more that a month or two notice. Cheney had to change his residence back to Wyoming in order to run with Bush in 2000 and 2004.

He could, yes. I think it's tougher for political influence the farther you get from the border. I'm not saying there is no cartel influence that far north. That's clearly not true. But the political strings they pull get more difficult the farther north you go.
