Julie Kelly: How the G-Men Got Their Patsies in the Whitmer Fednapping Case

How they put together the frame.

[U.S. District Judge Robert] repeatedly scolded Gibbons and Blanchard for what he viewed as wasting the jury's time on "crap" lines of questioning. Before the testimony of government witnesses last Wednesday, Jonker took the unprecedented step of limiting the amount of time for cross examination. Blanchard accused Jonker of openly favoring prosecutors while frequently interjecting and interrupting defense counsel. "Limiting us is unfair and it's unconstitutional, and it doesn't aid the jury in the search for the truth," Blanchard told Jonker on August 17 after the jury had been dismissed for the day. "It's creating a perception of how this case ends."

The Justice Department also sought a narrower definition of entrapment, essentially asking Jonker to make it harder for the jury to conclude the defendants were set up by the FBI.

Joshua Blanchard, Croft's public defender, noted the government collected 1,000 hours of recorded conversations between FBI assets and defendants but played less than two hours of clips for the jury; one clip was only four seconds long. "The FBI doesn't exist, it should not exist, to make people look like terrorists when they aren't," Blanchard said during his closing. "This whole thing has been a big FBI charade. This isn't Russia, this isn't how our country works."

The agents and informers they'd assigned to entrap Croft and Fox had failed, so they brought in "Big Dan" Chappel to create a fake militia and then a fake fednapping plot.

And then arrest people for the feds' own scheme.



Known as "Big Dan" to the government's targets, Chappel gradually stitched the group together and specifically solicited Fox, at the time living in the dilapidated cellar of a vacuum repair shop in a Grand Rapids strip mall. During two days of testimony last week, Chappel admitted he offered Fox a credit card with a $5,000 limit at least four times and suggested Fox could use the card to purchase weaponry to execute the kidnapping scheme. (Fox refused to accept the cards.) Fox and Chappel communicated daily for nearly four months, sometimes several times a day.

The government compensated Chappel roughly $60,000 in cash and reimbursements for personal items including a laptop computer, smart watch, and new tires for his vehicle. In December 2020, two months after the caper ended, the FBI gave Chappel an envelope containing $23,540. Blanchard accused the FBI of allowing Chappel to violate FBI rules by advancing the alleged conspiracy and taking an oath as the commanding officer in an FBI-created militia.

Five FBI informants were tasked with surveilling Croft, who has been on the FBI's radar since 2019 for "anti-government" comments on social media. During an event in Wisconsin, Jenny Plunk, the primary FBI informant assigned to Croft, shared a hotel room with her target. When the group began to splinter in late summer amid concerns over Croft's wild talk, Plunk's FBI handler urged her to remind the others of Croft's value. "Show them they were brought together by Croft and he has good ideas. Keep working to solve the differences in the group," FBI special agent Christopher Long texted Plunk on August 10, 2020. For her services, Plunk was paid at least $8,000.

24 I'm not sure it's fair to say they were "framed." When someone is framed, they DIDN'T DO IT but things are set up to make it look like they did. Didn't these guys basically admit they did what they are accused of, but that they were entrapped? I thought entrapment was basically their entire defense. Entrapment is something different than being framed. I do think these guys were staggering idiots who were bamboozled by the feds and they never would have done this on their own. They may have been dragged kicking and screaming into the scheme, but that's not being framed. That's entrapment.

Basically, you admit that you did the crime but then you assert, which you have to prove btw, that you would not have committed the crime without a) extreme coercion like a gun to the head or threatening your children, or b) that the pattern of the law enforcement was so persistent over time demanding that the defendant commit the crime that it constituted harassment of a degree enough to get you to break the law. Both are difficult to prove but impossible if you cannot access much of the FBI recordings or video as evidence.

Being stupid is a mitigating factor for sentencing but not a defense as such. My guess is that the FBI did psych profiles of the guys and configured their informants to push on vulnerable parts of each of the defendants' psyches by endless harassment to do the crime. That is why the FBI dare not release the recordings as it is probably a standard MO in such cases and fine tuned as to go after vulnerable patsies from recruitment, to cultivating the relationship, to crime.

Well we agree. Except there weren't any other charges to bring against the finders of the diary. They found a lost item and didn't return it. Tried to monetize it, knowing it was someone else's private property. Its a borderline case, but if they pled no problem. There aren't any other charges to push. Local and state police have used the low iq people as patsies for years to clear crimes off their books. Low iq makes many of them agreeable by wanting to please, easy to coerce and coach, and some degree of believing their status as a criminal might be enhanced. Skilled interrogators can push the buttons of these people to figure out how to get them to confess to crimes that they did not commit.

Here's some specifics on a part of the entrapment - the Government accused them of having an explosive device near Whitmore's home (a pipe bomb or something) How that came about - the FBI built the explosive device. The FBI gave the explosive device to these men. The FBI told these men to take it to a certain spot, and at that spot, the FBI had other men waiting to arrest them for having the FBI's explosive device on them.

Now that's pretty standard procedure for banana republicans and totalitarian regimes, but not the kind of thing we are supposed to allow here.

And a judge who has already heard every story of why the defendants need to be punished and/or read several briefs, etc. from both teams of lawyers many times. (Or his clerk did.)

It's the government. The agency doesn't want to & generally won't drag cases into a full blown trial without winning something. Two prior defendants walked and two pled guilty. Second trial, the judge had to "cut the baby in half." (Maybe not had to but the psychological odds were also against two remaining defendants.)
