The left, the media, and NeverTrump -- but, as is so common, I repeat myself thrice -- is yet again on the exact same messaging page, repeating the same Misinformation: To wit, that Trump has the warrant, and if there's something faulty in it, he should release it.

Implication: He hasn't released it, so it's perfect.

Here are some of the usual Misinformation Specialists pushing the claim that he has the warrant... without any evidence that he has the warrant, apart from seeing assholes on Twitter speculate he has it.

Now one can say, "Well that's not proof, those are two interested parties making that claim."

Well, one's a lawyer, though. There are professional consequences to lying. (Are you done laughing? I mean, there are consequences if you're opposed to The Regime.)

And also: If they're lying, where's the denial from the FBI and DOJ?

Are the FBI and DOJ going to allow them to spread this Dangerous Malinformation without rebuttal?

I'm really tired of the alleged "Smart Set" on Twitter. Every single day you see them popping off their perfectly-ignorant, uninformed opinions. They do not read cases, they do not read original documents. They just read twitter.

Their "informed opinions" come from other perfect imbeciles on Twitter, who also know nothing.

But they just keep repeating the same uninformed, unsourced guesses and speculations -- no one bothering to track down any citations or authorities for the claims -- and they take comfort in the fact that Everyone On Twitter is Saying It, So It Must Be True.

By the way, none of them will delete their tweets or apologize for having spread misinformation with such perfect confidence. The perfect confidence that only the shallowest of ignorant imbeciles can possess. The people who are so stupid and so incapable of critical thought that the most basic, fundamental self-check -- wait, how do I know I "know" this??! -- never occurs to them, ever.

Update: According to this Twitter user, Eric Trump says the FBI "showed" the lawyer the warrant from "ten feet away," too far away to actually read, and refused to leave a copy.

I don't know if he's claiming this, or if he is claiming it, if it's true.

It would explain things, though -- how the FBI would claim they technically "presented" the warrant -- from ten feet away! -- but did not actually let anyone read it.

So if the warrant say "Search authorized for ALOHA SEPTEMBER files," and that's a secret codeword classification, who knows, maybe then the warrant is sealed, to protect the codeword?

9 The search warrant itself (i.e. this is what we're looking for and where we can look for it) isn't as important as the affidavit in support of the warrant. The affidavit sets forth the probable cause and could include references to informants, both named and unnamed.

The warrant only names the area to be searched and vaguely will describe the items being searched for. You don't get the affidavit.

Should be flatly illegal in all cases. This "sealed" crap is exactly that. "Sealed" warrants, "sealed" indictments and the like have no place - none, for any reason - in a country comprised of citizens. If the state is going to go after a citizen, the state *must* tell the citizen why, what it is looking for, where it intends to find it, what he is being charged with, etc.

A "sealed warrant" should not exist. That it exists at all tells you all you need to know about the meaning of "citizenship." It does not exist. You are a subject, nothing more.

In that first court appearance, he wasn't allowed to know the reason he was in court, as the warrant had been SEALED.

84 I've been practicing law for a long time and never before now heard of a warrant that was "sealed" FROM THE TARGET OF THE WARRANT. Warrants can be sealed from the public, sure. But I've never heard of a situation where agents come to your home, tell you they have a warrant to search your shit, but refuse to show you the warrant on the grounds that it's sealed. If such a thing actually exists, surely it would be limited to only the most extraordinary circumstances.

If that is true then this was an illegal search. There has to be copies of that warrant someplace other than with the fib. The court has to file it, while they can keep it sealed there is still a warrant someplace. Trump can demand that they produce it or file a civil suit against the Court that issued the warrant.

Since the argument is apparently over whether DJT has classified documents (he apparently declassified them) in his possession or not, I am sure that the Feebs stupidly put some of that information into the warrant itself to justify withholding it from the media and Trump's lawyers.

I also have a hard time believing the claims being made that the FBI left with 15 boxes of what some are saying are documents. If nothing else, you'd think in this day and age anything worth keeping safe would be on an encrypted thumb drive or SSD in an innocuous location.

But... yea, the Feds are sorting through the stuff they took looking for anything they can pin on Trump.

218 A shirttail relative of ours was the target if an FBI raid on his house. They stripped it down and hauled off everything they could carry. He was a great coin, stamp and jewelry collector and had display cases all over his house with all the things he collected. It was like a museum in there. The feds took it all. He maintained until his dying day that they robbed him blind. He was kind of a crank so I never quite believed him UNTIL our police chief who is a good friend of hubby told us that he was there that day and saw it all happen just like it was told to us. He also said that there were, unto this day, several federal warrants out for this guy whose been dead for five years.

The Feebs are the ones that screwed up. First, any warrant proceedings will be outside of the rotten DC circuit and courts. Second, a wholesale search of a vast property indicates a probable violation of the particularity requirement and the general fishing expedition indicates possible constitutional violations--see Chimel v. California and its progeny. This was a political black bag job, not a valid law enforcement warrant. Joe is right. The police may still force their way in but by refusing to consent to the search--you retain the right to have the search proceedings and seizures thrown out. If you meekly allow them in, the po po will argue that you consented to the search.

Be vocal, make sure you object, call your lawyer, etc. but object and repeatedly state you do not consent to the search. The po po will not protect your rights--you must do so unequivocally.

It's perfectly admissible if she consented to the search, which she did if she let them in anyway (at least, that is how it will be argued). Never, ever consent to a search. If they have a warrant, they'll execute it. If they don't but force their way in and search anyway, your lawyer can throw a ton of obstacles into their path. If it's a big case, none of that will matter because you'll be railroaded anyway, but it's the right procedure nonetheless.

Refuse to consent to the search, demand the warrant, declare your intention to remain silent, and if they break the rules then they break rules. Work with your lawyer to sort it out after the fact, but consent to nothing.

When she got there she asked to have the warrant, they refused, at first even refusing to let her look at it..they didn't give her a copy and the search items as well as the probable cause were "Sealed"..Trump would need to go to court and get a judge to require the information be divulged. Same thing with an inventory of what was taken...she wasn't allowed to observe or even remain inside the bldg. Was forced to stand outside.

Regarding classified information--there was one sealed warrant during the time period searched involving a magistrate's order involving classified information. That is out of thousands. There were two involving classified information warrants that were sealed by a district court judge.

Ditto on the warrants. Sealing a warrant does not mean that Trump's attorneys may not see it btw as it only means that it will not be publicly released. The judge has discretion to release the warrant to whomever they please.

Interesting "what if". The constitutional issue is if the Article II qualifications "trump" a congressional act. Idictment, trial schedule, and a conviction, followed by an appeal. I think the Dems want their "conviction" as close to the 2024 election as possible before the US Supreme Court can hear the appeal, leaving each state to decide whether Trump can appear on a statewide ballot, or not.

We have Judges in multiple states stopping anti abortion laws from taking effect. Yes, they will eventually get overturned, but how many children will die while that is happening.

Part of lawfare is using the DELAY built into the system. All they would need is ONE Judge somewhere to rule that he could not be on a ballot, and unless the Supremes jumped in IMMEDIATLY.... something they seldom do... it would take months to resolve...
