Your humble Cob would also like to say a Prayer of Thanksgiving. The SCOTUS overturning Roe vs. Wade, thank you Lord may more of your children be saved from the death of abortion. On this last Saturday of June just remember these simple rules: 1) Opine and/or bloviate. 2) Do not run with sharp objects. 3) Don't piss in our pool. 4) Be kind to one another. 5) Yes, have a wonderful weekend! Posted by: Ignoramus at June 25, 2022 09:01 AM I read an opinion piece on that topic the other day. Posted by: Ignoramus at June 25, 2022 09:01 AM (i0slg) A lot of us would make the case that overturning the "Chevron" precedent would be even more important than overturning Roe v. Wade. They may not go that far, but even trimming it back a bit would help us a lot. For those unfamiliar with the ruling, the Chevron Precedent gave all Federal Agency decisions the power to act on their own without specific authorization from Congress, and protected them from being challenged in Court. (it's more complex than that, but that's a one sentence explanation) This, in the early 80's, is what supercharged the Bureaucracy and allowed it to take over so much of American society. In the EPA case, Congress some time ago passed a Clean Air bill, authorizing the EPA to regulate a long list of harmful industrial gases, a list which was quite specific, things like NOX and carbon monoxide. CO2 was NOT on the list, but the EPA has taken the position that "oh Congress meant that too, so we can now regulate that." The Conservative legal position is "No, if Congress wants you to control that, Congress needs to pass a bill telling you that you have the power to control that."

Amidst all the moaning about Dobbs, it's pointed out, again at Insty, that the number of people who really care is quite small. And there's this very pithy insight:
I think support for the cultural universe Roe was rooted in has been declining for a long time. Attitudes toward the Population control have shifted in the Marxist heartland of China, Russia and Western Europe. Children of Men, not Soylent Green, is our new nightmare movie. The AZ senate was in session and there was an attempt to break into the building, broken windows, pushing on/breaching doors. Police had to use tear gas. The senate went to a secure room to finish their votes (last day of session). I read one member comment he was very comfortable sitting next to 3 people open carrying. There are now 2 abortion laws on the AZ books. The one from the territorial days is as harsh as you would expect (thankfully), the new one was signed last March. "Early in the pandemic, Jared Polis said he’d be as happy as anyone to lighten the heavy hand of state government once COVID was retreating. Having created, amended or extended roughly 400 executive orders since March 2020, the governor told The Denver Post he’s ready to let go of the unprecedented authority he’s maintained." Something that we all know, but it bears repeating - the George Floyd riots were NOT "spontaneous riots" caused by outrage - they were all paid for demonstrations organized and directed by members of the Dem Party, at least some of the Tech Billionaires (Men like Tom Steyer and Bill Gates) and with an assist from their Chinese government "friends". It was all a big push to make the country seem ungovernable and drive Trump out of office.
Today, the people who organized and paid for those riots know that it would discredit their own administration, so they will not allow it. There will be a few renegade anarchists who can't resist acting out (such as at the AZ legislature last night) but overall, there is very little they can do. So far so good. No pipes for a few more days. I'm gonna roast a certain kitten for lunch if he doesn't stop bothering me. At least he's off playing with one of his toys. It happened because the local leftist governments *wanted* it to happen, because they believed it furthered their Leftist political goals. Remember when the Mayor of Seattle ordered her police to abandon on of their stations and turn it over to the rioters? She was behind it, all the way. When the local government finally got tired of it and saw that it was causing more harm to them than good, they ended it. Local officials can *always* stop this kind of thing, if they want to. The woman just doesn't want to be "burdened" by a baby, as Obama put it. It's ridiculous to pretend that's a "healthcare" decision. It has nothing to do with health. Posted by: Captain Obvious, Laird o' the Sea at June 25, 2022 09:34 AM Equipped. in the 18 century, "regulated" meant equipped in this context. A "regular army" was one where everyone had common equipment (rifle, powder horn, uniform, etc), as opposed to the "irregular army", which was more ad hoc (brings what you gots). When they said "the Continental Congress regulated the army", it was not an imposition of rules and regulations, but rather that they funded equipping (arming) them. Ever few years when I was a kid we'd visit a little town in Missouri called Brookfield where my dad's mom lived. For this, they actually have some legal and constitutional basis: the founding fathers were worried about whether things could ever get back to normal, but clearly stated that the executive gets very powerful abilities during a national crisis. The problem is defining such a crisis, which nobody has ever done. Posted by: Christopher R Taylor at June 25, 2022 10:20 AM (llsW/) 317

One summer, whilst hanging with a friend who lived in the country and had a BB gun (the kind where you load the bbs at the end of the barrel) we discovered if you catch a bunch of lightning bugs and drop them in the barrel, pump once and pull trigger it makes a very cool splatter of lightning goo all over. Only lasts a second or two, but still cool.

Nobody believes me on this. But in my kidhood in the French Quarter, pre-Daylight Saving and pre-air-conditioning, there were fireflies. My brother and I would play in the patio until past dark. Fireflies darted around, and we caught a few in Tang jars -- with the lids punched so they could have air -- and watched them wink on and off. We let them go before we headed inside, though. But though the scheme of disciplining the whole nation must be abandoned as mischievous or impracticable; yet it is a matter of the utmost importance that a well-digested plan should, as soon as possible, be adopted for the proper establishment of the militia. The attention of the government ought particularly to be directed to the formation of a select corps of moderate extent, upon such principles as will really fit them for service in case of need. By thus circumscribing the plan, it will be possible to have an excellent body of well-trained militia, ready to take the field whenever the defense of the State shall require it. This will not only lessen the call for military establishments, but if circumstances should at any time oblige the government to form an army of any magnitude that army can never be formidable to the liberties of the people while there is a large body of citizens, little, if at all, inferior to them in discipline and the use of arms, who stand ready to defend their own rights and those of their fellow-citizens. This appears to me the only substitute that can be devised for a standing army, and the best possible security against it, if it should exist."

A few people asked about green being worn at protests yesterday. Apparently, green (scarfs) apparel has been around for quite a while as scarfs were used in South America by activists fighting to decrimilize abortion. (Green as a color of health and hope.) Obviously, the U.S. has expanded to Tee shirts v. scarfs as a symbol for pro-abortion activism.
Banking that the majority of voters will not be entirely opposed to abortion and/or strict limitations AND utilizing the color green from South America abortion activists is planning ahead for the mid-term elections. Posted by: Lola at June 25, 2022 10:30 AM (NIYa7) 355

I looked outside and heard the birds singing and did not see an angry mob so all is good here. Yesterday I had to replace a pair of computer glasses that were falling apart as they were in a twice used frame. Two years ago, after moving here went to LensCrafters. $450 for regular glasses. Tried to go there and sign on the door, masks required so walked away. Went to local chain, no masks. People great. Fixed 2 pairs of backup glasses that needed repair and asked for cheapest frames for computer glasses as I only wear them inside. $600! I bought a couch for $699 2 years ago. I bought a washing machine 4 years ago for $450. Why, back in the day, I could buy gas for $2.25 a gallon. This is getting ridiculous. A lot of us would make the case that overturning the "Chevron" precedent would be even more important than overturning Roe v.

Why do these idiots want to put an end to pro life centers which help women who Choose to have their babies but need help? If they were really pro choice they would be touting these as a possible alternative so that women, especially young women, would be making an informed choice.
Instead, it's their way only that is allowable. Why? Why so committed to this? Posted by: Sharon(willow's apprentice) at June 25, 2022 11:05 AM (Y+l9t) 488

U.S. Army strength in 1936 was 167,816. In 1945 it was 8,266,373. The ramp up was helped by the CCC where Army officers and NCOs, were deployed from 1933 to 1936.

I think leaked to prepare for the mid-terms and targeting of certain states - California, PA, Arizona, another one or two - in particular & by groups/movements like Indivisible.

Are you supposed to whisper ? Holmes' opinion actually says "falsely shouting" but that gets left out when he's quoted because (I suppose) the person quoting it knows that that would make it inapplicable to matters of opinion. Apparently the standard now is (or is supposed to be), if the speech is likely to incite a riot or other lawlessness, said speech is not 1A protected.
Huh. Seems quite subjective, especially in today's culture. Say "men are men" and you might have a riot. Or more seriously and sadly. "Go Protest" and be accused of starting a riot. Posted by: AmericanKestrel at June 25, 2022 11:09 AM (K0jo2) 497

I seem to remember some shady support character named Peggy. Russian or from the Balkans? Nowdays they are all from Kulkatta (Calcutta?), India. They prefer names like Bob, Roy, etc. They have no idea what an area code is. They cannot explain why supposedly in Houston TX the call has an area code for Illinois. After giving me a bunch of personal details such as phone #, address, DOB, age, they tell me they cannot give out personal information when I ask them for the last two characters of my Medicare card. However they want the whole number from me.
I love to waste their time. It means they are not successfully scamming some other clueless old person. Posted by: Ciampino spamming Peggy at June 25, 2022 11:11 AM (qfLjt) 503

AK, Brandenburg is actually a pretty good decision. To qualify as unprotected speech, the speaker must be specific as to the proposed actions and propose imminent action with some actual evidence that the speaker intends harm. On the individual level, it is akin to true threats versus bloviating before the state can arrest.

This was overturned but the idea of hate speech is still being used? I confess to a large amount of ignorance in legal matters.
No, you are exactly correct. Hate speech laws and campus "speech codes" are blatantly unconstitutional yet they still get enacted and enforced. Posted by: Oddbob at June 25, 2022 11:17 AM (nfrXX) 510

It was about 10 years ago that a mutual classmate who has always had her finger on the pulse of alumni matters breathlessly informed me that Rich Levine was transexual. It was news to her at that time, suggesting that his supposed transition was relatively late in life. At the time I considered it to be a quirky and bizarre event, and he was practicing in a non-mainstream specialty (Adolescent Medicine), so not much of a threat. Little did I know that he would then came to prominence as PA's COVID czar, and later become the face of officially sanctioned insanity, anointed as a four-star admiral in the Public Health Service. He is a groomer and a fraud. No word how his wife and kids feel about the new Dr. L.

Where do "fighting words" fit in?
Hopefully whig is still thread-slumming and will give a better answer but IIRC, the "fighting words" doctrine is from another case (looked it up: Chaplinsky) and the Court has been quietly walking that back too. So a direct, immediate threat like "I'm gonna beat your ass" is not protected speech but a simple insult like "Your mother is a whore" (probably) is. Posted by: Oddbob at June 25, 2022 11:40 AM (nfrXX) 518
And yes, you're right again. Any particular incident has its own circumstances that will bear on whether the speech is protected or not.
