71 At one point near the end of more than two hours of testimony, Goodell was questioned by Rep. Rashida Tlaib (D-Michigan), who asked whether Goodell and the league are “willing to do more” to punish Snyder.

After initially asking whether he would recommend Snyder’s removal as owner of the Commanders, Tlaib followed up by asking Goodell: “Will you remove him?”

“I don’t have the authority to remove him, Congresswoman,” Goodell responded.

An NFL owner can be removed only by a three-quarters (so, 24 out of 32) majority vote of fellow owners, although Goodell does have the ability to officially recommend such a vote.

80 Sounds like "The Singing Nun" shouldn't have left the convent:

In April 1985, Deckers and her companion Annie Berchet were found dead in a flat at Waure near Brussels. Both had taken an overdose of barbiturates. The tragedy happened after the Belgian authorities demanded the tax from the monies earned during her fleeting 15 minutes of fame. The convent took a large share of the royalties from her success, as did her record company.

This apparently left the former nun in such a state of depression that she took her own life. In a joint suicide note, Deckers wrote: “We are going together to meet God our Father. He alone can save us from this financial disaster.”

110 The self-flagellation thing always seems ludicrously unnecessary. God judges the heart. When i see these kinds of displays, or the annual Filippino ritual where guys nails themselves to the cross, I don't see God looking down in mercy; I imagine Him doing something akin to yelling at His tv -- saying, "Didn't you read the parts about 'not praying loudly in public for the ears of men'? Or the part about going into a closet to pray? Sheesh."

133 Biden's “Build Back Better” efforts have been a phenomenal failure so far, but maybe that's because Americans just don't understand a good thing when they see it?

This has been Biden's argument on the state of the economy lately, as he persistently argues that there is no threat of recession because the US jobs market still “strong.” There is no mention from the White House regarding the fact that covid stimulus spending artificially drove up retail demand and created a temporary spike in jobs. If they were to admit that layoffs are about to ramp up because the covid checks are gone and people's credit cards are maxed out because of inflation, then Biden would have nothing left to brag about.

148 At this week’s conference, the justices are taking an especially close look at two cases — this week’s newly relisted cases.

We begin with a case that is a potential blockbuster. In Moore v. Harper, the speaker of the North Carolina House of Representatives, Timothy Moore, asks the Supreme Court to consider what has come to be known as the “independent state legislature” theory — which holds that the Constitution gives state legislatures alone the power to regulate federal elections in their states, without the oversight of state courts. Moore notes that the Constitution’s elections clause states that the “Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof.” Moore argues that unlike other constitutional provisions, the clause does not refer to the state itself, but a particular institution of government.

"There's now polling out that shows that Donald Trump is actually paying a price for what these hearings are showing," he said. "So it's having an impact even among Republicans."

More importantly, Luntz is GOPe to the core, so when he stirs up DeSantis vs.Trump, I start to get suspicious...Luntz was then asked about a New Hampshire poll showing the state's primary voters for the first time prefer Florida Gov. Ron DeSantis to Trump in a hypothetical 2024 matchup, and the pollster argued that it marked a big shift away from the twice-impeached former president.

Posted by: Muldoon at June 23, 2022 09:59 AM (kXYt5)

Meh, you've got it wrong IIRC.

It's the old notion of the body/spirit divide. The spirit yearns to follow God and his laws. The flesh is weak though, so your sins reoccur.

The flagellation is a rejection of the flesh and the sins it's prone to. The flesh must be mortified, so, that your soul may live free according to the Will of God.

Something along those lines.

It's a totally foreign concept today, where the body and it's desires have taken primacy in the public mind, and the spirit's ignored until right before death, with a, "Hey Christ, you're my guy. All those sins I committed all my life again and again even though I knew they offended you. You'll forgive those, right? You're my Savior. so, here I go to Heaven. Wheeee!"

212 Bruen: Today, we decline to adopt that two-part approach. In
keeping with Heller, we hold that when the Second Amendment's plain text covers an individual's conduct, the Constitution presumptively protects that conduct. To justify its
regulation, the government may not simply posit that the
regulation promotes an important interest. Rather, the
government must demonstrate that the regulation is consistent with this Nation's historical tradition of firearm regulation. Only if a firearm regulation is consistent with this
Nation's historical tradition may a court conclude that the
individual's conduct falls outside the Second Amendment's
"unqualified command."

A softer version of self denial is found in our abstinence and fasting. In the end if not long before we all will suffer but it is supremely important how we suffer thus the old adage to suffer well by giving it up to God. It derives too from

236 Bruen: If the last decade of Second Amendment litigation has taught this Court anything, it is that federal courts tasked with making such difficult empirical judgments regarding firearm regulations under the banner of "intermediate scrutiny" often defer to the determinations of legislatures. But while that judicial deference to legislative interest balancing is understandable—and, elsewhere, appropriate—it is
not deference that the Constitution demands here. The Second Amendment "is the very product of an interest balancing by the people" and it "surely elevates above all other interests the right of law-abiding, responsible citizens to use arms" for self-defense. Heller, 554 U. S., at 635. It is this balance—struck by the traditions of the American people—that demands our unqualified deference.

251 Dr. Seamus sat quietly with the elderly woman, noting the concern in her eyes and her slow fumbling with the rosary beads in her hands as she stared at her aging husband in the hospital bed .

The goodly doctor was an affable fellow, one who had trained not only in the finer points of medicine, but also in the timeless art of the bedside manner. The well-being of the spirit, he reasoned, was often as important as the lifeless lab numbers on the papers of the patient charts. Hospice care, the sad moments when family members were struggling and saying their final goodbyes, was one part of the job he never enjoyed.

He patted himself down searching for his Dollar Store reading glasses, like a Catholic with a nervous tic, unawares of the pair perched atop his head of thinning hair. Eventually he stopped his self-frisking sensing the futility of the search, and squinted as he searched the supply cabinet an liberated a few pills from a sample blister pack and quickly scribbled a note on his prescription pad....

261 Bruen: While we do not now provide an exhaustive survey of the features that render regulations relevantly similar under the Second Amendment, we do think that Heller and McDonald point toward at least two metrics: how and why the regulations burden a law-abiding citizen's right to armed self-defense. As we stated in Heller and repeated in McDonald, "individual self-defense is 'the central component' of the Second Amendment right." McDonald, 561 U. S., at 767 (quoting Heller, 554 U. S., at 599); see also id., at 628 ("the inherent right of self-defense has been central to the Second Amendment right"). Therefore, whether modern and historical regulations impose a comparable burden
on the right of armed self-defense and whether that burden is comparably justified are "'central'" considerations when engaging in an analogical inquiry

They insist that banning firearms is actually really popular, so it shouldn't take them more than a couple of years.

About a quarter of the U.S. population lives in states expected to be affected by the ruling, the high court’s first major gun decision in more than a decade

think it is relevant to recount the mass shootings that have
occurred in recent years? ... The New York law at issue in this
case obviously did not stop that [Buffalo] perpetrator."

===========

Why is that troubling? "NY law did not stop a mass shooting that the dissent explicitly calls out," is a pretty good point. The "safety" issue goes out the window when you can point to a material instance that the left itself pushes as a cause for gun control that actually works against the argument.

331 Since Heller and McDonald, the Courts of Appeals have devel-
oped a “two-step” framework for an alyzing Second Amendment chal-
lenges that combines history with means-end scrutiny. The Court re-
jects that two-part approach as having one step too many. Step one is
broadly consistent with Heller, which demands a test rooted in the Sec-
ond Amendment’s text, as informed by history. But Heller and McDon-
ald do not support a second step that applies means-end scrutiny in
the Second Amendment context. Heller’s methodology centered on
constitutional text and history. It did not invoke any means-end test
such as strict or intermediate scrutiny, and it expressly rejected any
interest-balancing inquiry akin to intermediate scrutiny. Pp. 9–15.

Yes - the Justices ruled that such restrictions must be subjected to "Strict Scrutiny", which is a legal term of art meaning that a full analysis must show that there is *no* other possible way of achieving the stated goal, except the restrictions proposed. Practically speaking, almost no bureaucratic requirement can withstand strict scrutiny.

The central holding of Braun appears, "if the restrictions weren't in effect when the 2nd was ratified, it's unconstitutional." "And we looked at the regulations in effect, there weren't many, and we're strictly limiting allowable regs to exactly those."

So the states can't argue "imminent but generalized danger to public safety" justifies infringing in any way the right to KEEP arms in one's home.

Because that's a direct infringement on the right to self defense. Also, it specifically rejected the "but the police can protect you!" argument.

407 Breyer's idiotic "dissent" perfectly encapsulates the farcical illegitimacy of the judiciary's current status and behavior, in general and overall.

It is - obviously - absolutely *no part* of their role to apply their small minds to the consequences of policies and laws. Period. That is the job of the accountable political branches.

They are glorified clerks, nothing more. When they are anything more, the system ceases to exist. There is no point and no sense to having representative government if policies enacted by same, in response to popular will, are simply suggestions for an unelected and extremely unfit side body to veto or rewrite.

The judiciary has no competence (technical or constitutional) to consider anything other than whether a statute violates the constitution - and even *that* function is self-appointed and dubious. The American system is long gone, only inertia preserves whatever desirable things remain. The lawlessness, arrogance, and totalitarian small-mindedness exemplified by Breyer - but in less outlandish form exhibited by all of them - are sickening and ridiculous.

Well, with this ruling the pro-2A groups just need to find a friendly Federal Judge (I know, it's NY, so what are the odds?) who can slap a restraining order on any law they pass to try and challenge it. Many people on the left warned NY about this policy when they put it in place, because before now there was no explicit SCOTUS ruling on how far the States could go. Now, because NYC pushed too far, the SCOTUS has blown up the entire game.

I understand because I feel the same way but I take the position that it will work itself out. That doesn't mean there won't be stupid crap that happens with gun owners but it will find its level like water. That's the price of freedom.

423 406 New York Gov. Kathy Hochul is speaking at a press conference: "We are not powerless to respond to this."

Fortunately, now, neither are we.

424 421 And this is why the ratchet only moves one way. Our side always says "Well, we fought the good fight and lost. On to the next battle" whereas Dems say "We are not done fighting and we will fight this until we win."

Sadly, this is an example of why this country is moving towards Rule by Judges and abandoning Rule by Legislature. The path to the future, for both sides, is to fight like hell to control the Judiciary, and then use the Judiciary to control the country. The Left started playing this game 80 years ago, we're just now catching up.

Yup, normally they concede before it gets to SCOTUS. Give that one guy his carry license so his case is moot. Not sure what happened in Bruen.

Unfortunately, it is because the left are a bunch of brats who are in a constant state of tantrums. The right is too busy working, defending the country, raising families and contributing to society that we can't stop what we are doing to commit to a lifetime of adolescent insanity.

430 Someone should tell Breyer that the American places with the strictest gun control don't necessarily have the least "gun crime."
Posted by: Baldy at June 23, 2022 10:39 AM (fTupD)

Breyer doesn't try to explain "which" gun violence he's saying is dangerous and which is totes okay - the kind the State can bring to its citizens or the kind its citizens bring to others. Because if ALL gun violence is dangerous, then LE and NG units and the military would be disarmed.

But this is the typical liberal conceit, its really American citizen's guns and the possibility of violence from that ownership that Breyer detests, the rest of the guns out there and THEIR potential violence he's fine with...

431 Seems to open up issue with the machine gun ban as well as the NFA... albeit a stretch, but I'll take any light I can.

As someone mentioned upthread, the supes -- even Scalia in Heller -- have been unwilling to say out loud what the 2A is really supposed to be about.

Posted by: Oddbob at June 23, 2022 11:19 AM (nfrXX)

432 I would think that in rural, upstate NY people are for the most part in support of gun ownership by responsible individuals.

Posted by: FenelonSpoke at June 23, 2022 11:20 AM (FZ2cV)

433 Because people who live in the Adirondacks want to be able to protect their families and to be able to hunt if they are a hunter. Kathy Hochul will lose the support or anyone who isn't a progressive.

434 To what exactly is Kochul responding?

Posted by: runner at June 23, 2022 11:31 AM (Lo80G)

435 Meh, you've got it wrong IIRC.

Wheeee!"

437 The notion of self-punishment because of feeling unworthy of Christ's death and resurrection ("...in penitence...") seems, to me, to run contrary to the gift of redemption given to those (sinners all) who accept it. Maybe a physical form of a humble brag...?

But I'm no expert on the saints or theology.

Late to the thread (I was at work earlier): I am a lay Dominican and self-mortification is still taught as a one of postures of prayer as exemplified by St. Dominic. I don't know how much it is actually practiced, but it is a form of penance for sins.
