NIH Scientists and Bureaucrats Received $350 Million In Drug Patent Royalties Donated from the Big Pharmaceutical Companies They Regulate and Boost Since 2009 But Are Slow-Walking Reports of How Much They've Received in the Past Five Years

They're fighting to keep all of the monies NIH employees are taking from private businesses secret, even though these are supposedly public employees and there is an obvious conflict-of-interest when they take money from companies they are, for example, granting emergency-use authorizations to that could be worth, literally, billions of dollars.

They are fighting to withhold any details of the amounts paid from the last five years, and even for the years they disclose, they will only report the total sums dispersed to NIH employees in aggregate -- they refuse to say who got how much.

The National Institutes of Health received verified royalties amounting to $134 million from 2009-2014, with more yet to be revealed.

The NIH is in the midst of fulfilling a Freedom of Information Act request detailing the royalty payments of its various leaders since 2010.


Open the Books CEO Adam Andrzejewski announced the revelations on Monday. The nonprofit organization filed the FOIA request last September, receiving 1,200 pages of heavily redacted royalties from 2009-2014 that add up to 22,100 royalty payments to 17,000 NIH scientists. With the redaction, it is impossible to tell how much each scientist received, only the aggregate total of each department, which adds up to $134 million.

Another set of 1,800 royalty pages, meant to cover 2015-2020, has yet to be handed over to Open the Books, but it estimated that payments reached a total of $350 million by 2020. The nonprofit organization is also in a lawsuit against the Department of Health and Human Services for failing to comply with three FOIA requests, including this most recent one.

In 2005, Fauci admitted that it was strange for public servants to be taking money from companies they were supposedly regulating and donated money he received that year to charity, he claimed.

You can bet no one's donating the money since then to charity, because they're fighting like tigers to keep these payments hidden from public view.

Since the NIH documents are heavily redacted, we can only see how many payments each scientist received, and, separately, the aggregate dollars per NIH agency. This is a gatekeeping at odds with the spirit and perhaps the letter of open-records laws.

We found agency leadership and top scientists at NIH receiving royalty payments. Well-known scientists receiving payments during the period included:

Anthony Fauci, director of the National Institute of Allergy and Infectious Diseases (NIAID) and the highest-paid federal bureaucrat, received 23 royalty payments. (Fauci's 2021 taxpayer-funded salary: $456,028 ).

Francis Collins, NIH director from 2009-2021, received 14 payments. (Collins' 2021 taxpayer-funded salary: $203,500)

Clifford Lane, Fauci's deputy at NIAID, received 8 payments. (Lane's 2021 taxpayer-funded salary: $325,287)

In the above examples, although we know the number of payments to each scientist, we still don't know how much money was paid -- because the dollar figure was deleted (redacted) from the disclosures.

It's been a struggle to get any useful information out of the agency on its royalty payments. NIH is acting like royalty payments are a state secret. (They're not, or shouldn't be!)

Consider how NIH is using taxpayer money to try and keep taxpayers ignorant and in the dark:

1. NIH defied the federal Freedom of Information Act law and refused to even acknowledge our open records request for the royalty payments. We filed our FOIA last September.

2. NIH used expensive taxpayer-funded litigation to slow-walk royalty disclosures (releasing the oldest royalties first). Although the agency admits to holding 3,000 pages, it will take ten months to produce them (300 pages per month). With Judicial Watch as our lawyers, we sued NIH in federal court last October.

3. NIH is heavily redacting key information on the royalty payments. For example, the agency erased 1. the payment amount, and, 2. who paid it! This makes the court-mandated production virtually worthless, despite our use of the latest forensic auditing tools

NIH is essentially telling you, the taxpayer, to pay up and shut up. They'll run things. They have forgotten that they work on behalf of the American people.


The agency has become a lot more secretive since 2005.

In 2005, the Associated Press successfully used FOIA to crack open the NIH royalty database. They found 900 scientists collected $9 million in royalties. Furthermore, 51 scientists NIH royalty recipients were then working on experiments involving inventions for which they were already being paid.

Among the 51 scientists doing experiments involving inventions for which they were being paid royalties was Anthony Fauci, then- and current director of the National Institute of Allergy and Infectious Diseases. Fauci received $45,072.82 between 1997 and 2004 for a patent license on an experimental AIDS treatment. NIH funded that treatment with $36 million.

To this day, Fauci continues to receive NIH-approved perks without a lot of accountability. For example, in February 2021, Fauci received a $1 million prize from the Dan David Foundation in Israel for "speaking truth to power" during the Trump administration.

Today, NIH is a revolving door of tens of billions of dollars in government grant-making coupled with hundreds of millions of dollars in private -- non-transparent -- royalty payments.

There needs to be a lot more sunshine on this potentially unholy alliance.

When a federal bureaucrat pops up on television giving us health instructions, who has paid them and for what research and technology? When a patient agrees to a clinical trial or experimental treatment, what financial interests are involved?

Rather than relentless redactions and prolonged court battles, it's past time for the government to disclose royalty payments as a matter of routine.

NIH needs to come clean with the American people and open the books on the line-by-line royalty payments to the agency and its scientists.

Note: We reached out to NIH for comment and received no response.

Just highlighting this:

While we at least know about that one -- because it was publicly awarded, instead of secretly insinuated into Fauci's bank accounts -- civil servants should not be allowed to accept "prizes" which amount to, in essence, a cash bounty (or bribe) awarded by a partisan organization for taking a political position for or against the president.

Fauci's been a government bureaucrat all his life. He joined in 1968, straight after his medical residency.

Why would he have royalties in any private company's patents?*

Remember, Anthony Fauci has previously lied under oath, or, let us say, made false statements while testifying to Congress. He claimed that all of his financial records were publicly available.

In fact, they're almost entirely redacted.

So yes, they're "available," in redacted form where everything is blacked out.

And I imagine that all of his "royalty payments" from the pharmaceutical companies he's granting little favors and EUAs to would be in those blacked-out sections, huh?

41 Have read most of Kennedy's "Real Anthony Fauci." Hyperbolic in places and badly in need of editing, but it lays out a good case for the structural problems. Chief among them goes beyond the direct (more visible) corruption of NIH and other direct regulars, but the "Principal Investigators" themselves who run the major trials at the major research institutions.

Most of them are run by researchers who build their fiefdoms from Big Pharma cash, and get lots of little grifts along the way. Creates huge incentives to get favorable results for patented medications, and to design studies to tank results for generic competitors.

There is such a thing as "medical ethics" but is there anything like a "research Code of Ethics" that anyone actually tries to codify and enforce?

IIRC, Fauci did a very brief residency (just a year), at his med school's hospital, before jumping into "public service" as a government bureaucrat. So he basically went straight from school to the NIH.

I forget which company it was, but I heard about one of those big engineering companies like Raytheon or 3M where it was tradition to give new engineers a sort of joke card with a dollar bill inside. The card would say something like, "This is payment for the patents you're going to create for us."

There was some software named NASTRAN. It was a fortan routine written by NASA/NACA I forget which. Well, there were some funky things that went on between the government and MSC so a bunch of companies sued for a claim on some of the software because we kind of all paid for some parts of NASTRAN. The claimants won and relevant parts were sent to a company that formed around offering an alternative called NX Nastran. I think there were some mandated cost restructuring too but I forget.

MSC will probably just buy them out eventually, all these companies like siemens and MSC and dassault are just getting bigger gobbling up smaller tools.

I do have a huge problem when the same scientists use their positions to push the exclusive use of expensive, profit-harvesting drugs over cheaper, more effective drugs.

In Germany, corporate inventors do get a royalty on patents on which they're an inventor. I was talking to our European attorney and he said it was a pain in the ass. He was always having to referee fights among scientists as to who should be an inventor. And the old bulls would block implementation of any new technology because it would take away their rice bowl.

I worked for Siemens for a little while. What a joke of a company. For their software testing of medical devices, they don't call it testing. If you called it testing, then you'd have to adhere to certain standards they weren't prepared to adhere to.

Most of their software was written by Engineer types (think EE, not Software Engineers.) It showed. Most of those old farts took a couple of C classes 30 years ago and never updated their skillset. Reading most of their brand new code was like reading 40 year old banking code.

At least there was a pretense of accountability back then. The feds (actually, the taxpayers) paid a $3 million wrongful death settlement to the family, and an FBI official went to prison for destroying key evidence in the case.

If the same thing happened today, Merrick Garland would have just thrown Randy Weaver in prison indefinitely on some trumped-up bullshit charges (after publicly smearing him as a raaaaacist and white supremacist terrorist), and the FBI official who destroyed evidence would have been promoted to be head of the FBI.

233 In defense of the money paid by companies to the NIH, those monies are licensing fees for NIH inventions that companies develop into products and make a profit on. It is a return on NIH research where those licensing fees fund NIH functions and a capped amount goes to the the inventor. Not an excuse but there is always bureaucracy and limited number of employees that can handle these FOIA requests. Especially when they involve licensing matters that may include business confidential information.

Well, now I remember what I still find mind-blowing - "bonuses" for federal employees. WTFF? If you don't like your government job, quit and do something else.

The most important and effective govt. work is done by people who do it as a public service. They're not looking for "bonuses", or even awards. I well recall the (polite) snickers from all of us when at a certain job the career guy sort of sheepishly said we all qualified for some award. He didn't bring it up again.
