Pennsylvania Commonwealth Court Strikes Down Lawlessly-Imposed 2020 Mail-In Ballot Scheme as Unconstitutional

A statewide court declared Friday that Pennsylvania's expansive two-year-old mail-in voting law is unconstitutional, agreeing with challenges by Republicans who soured on mail-in voting after then-President Donald Trump began baselessly attacking it as rife with fraud in 2020's campaign.

Not so baselessly now, eh?

The decision, by a five-judge Commonwealth Court panel of three Republicans and two Democrats, could be put on hold immediately by an appeal from Gov. Tom Wolf's administration to the state Supreme Court.

Here's Newsweek, full of cope:

With the Pennsylvania Supreme Court ruling that the state's 2019 law to expand mail-in voting is unconstitutional, former President Donald Trump has praised the decision.

Trump has been an outspoken detractor of mail-in voting, having claimed that mail-in ballots were fraudulent and cost him the 2020 presidential election. Lawsuits against ballot counters that took these ballots were also filed, although nothing has come out of them as of 2022. After multiple investigations and independent findings, the vast majority of mail-in ballots were legitimate, despite the former president's repeated claims of voter fraud.

Oh, the vast majority? I'm so reassured. I'm so reassured that only about 5% of votes were faked in an election decided by less than 5% of votes.

And they always ignore the fact that they deliberately made it impossible to determine which votes were fake by deliberately turning off even the most basic security measures, like signature and address matching. They're saying "There's nothing in the record to prove these votes were fake" when they took every deliberate step to eliminate the record completely.

So yes, "there's nothing in the record." You destroyed the record.

According to a Commonwealth Court filing released Friday, the court ruled that Act 77, allowing residents to vote by mail in Pennsylvania, violates Article VII, Section 1 of the Pennsylvania constitution.

The Commonwealth Court denied the Pa. Department of State acting secretary's application for summary relief.

In the ruling, Commonwealth Court President Judge Mary Hannah Leavitt wrote, "If presented to the people, a constitutional amendment to end Article VII, Section 1 requirement of in-person voting is likely to be adopted. But a constitutional amendment must be presented to the people and adopted into our fundamental law before legislation allowing no-excuse mail-in voting can be 'placed upon our statute books.'"

Note that a Wisconsin judge had previously ruled that the drop-boxes deployed by Democrat governor Evan were also unconstitutional and illegal.

So that's two.

It will be overruled. Assuming the report I read earlier on this was correct, the PA Supreme Court, in 2020, permitted getting rid of signature matches and whatnot. They were in on the steal and they have the final word.

Also as I warned back in December - prescription meds. I've seen lots of people worried they can't get their blood pressure or thinners meds. Just the start. I'd guess that also means the prices will skyrocket when they are available.

Speaking to a cattle rancher the other day in Montana He usually spends $35K for winter good grass hay, this year he spent $80K for alfalfa. Steak will be $25 a lb by summer and the beef will not be as good. Thanks Joe.

104 Act 77 permitting no excuse mail voting was actually passed by the PA legislature prior to COVID and signed into law by Democrat Gov. Wolf. In it, the Republicans got some things (i.e., signature match, no party line voting). Then the Democrats sued the Commonwealth, and the then 5-2 Democrat controlled Supreme Court chucked out all of the stuff that the Republicans negotiated into the bill, leaving no excuse mail voting just before the 2020 election (without, again, all but one of the security provisions that the Republicans had in the original bill). It was, of course, an operation. There is no use negotiating legislation with Democrats - they'll just find a way to get the stuff they like and tell you to fuck off with the stuff they don't like.

114 The (R) PA legislature currently says they want to rewrite the mail-in law, but they can't because the (D) governor will veto it. That smells like failure theater, obviously, but it's also probably true that he'd veto it.

If the current law is overturned, we'll at least have a chance to hold their feet to the fire when they start trying to pass a new version of it.

We'll probably never get at the deeper question of why Republicans were ever trying to facilitate mail-in voting in the first place, but if we can stop them on the do-over, that's better than nothing.

Because here's the thing; who will enforce that ruling?

If the DOJ of the state is Democrat and/or the SoS is Democrat, nothing will be done. If one of the two is Republican it's likely still nothing will be done. There are no penalties for any of that stuff that makes a difference and it's not clear who is in charge of arresting people who are in violation. Like when the observers were locked out of observing in Philly precincts. The cops went "What me worry" shrugged their shoulders and walked away.

The courts said that it was illegal but so what they judges weren't going down there to arrest anyone. And the SoS (a Democrat in the case of PA) didn't give a shit.
We can't rely on the precinct captains and the observer system anymore.

The lesson of 2020 is that if you wait until after the election the courts won't get involved. Trump didn't lose any cases, the courts refused to hear any evidence.

And it shouldn't have been Trump getting ahead of this, it should have been the RNC. The DNC spent 4 years putting this illegal laws in place not Biden.

You have to have allies to be able to do this. His own party was against him. Law firms would not represent him. Look at the "quality" of his lawyers. And, really, if anyone had told you beforehand that multiple states would simultaneously stop counting votes in the middle of the night, and that courts and most of the public would just shrug their shoulders, would you have believed them? The fraud was blatant to the point of preposterousness. I don't think a legion of angels would have changed the outcome, let alone some lawyers.

Mail in voting has never been legal in PA, and they don't have early voting. It is the most "election day voting" state in the country.

Winning PA doesn't take a change in election laws, which the governor can veto (which happened anyway).

It just needs the illegal voting mechanism used in 2020 to be eliminated.

The courts didn't stop the DNC from illegally changing election laws. If they could get them changed the RNC should have been working to prevent them. And the state legislatures also dropped the ball.

Look at all the changes that have been made since the election in states across the country. They should have been doing all of this between 2016 and 2020 when Elias and Abrams were making all the changes.

Just yesterday, the VA legislature voted to outlaw groups like Zuckerberg from flooding their state with outside money. That should be happening everywhere.

IIRC, the ballots cast in a federal elections must be retained for 2 years. This would ensure the legitimacy of the count could be reviewed. Of course, a big part of the 2020 steal was destroying the records, whether it was "losing" or trucking ballots to the dump (Georgia was caught doing that), or "losing" the electronic votess stored on usb flash drives -- after they used "found" flash drives containing votes to enable Democrats such as VA Congressman Abigail Spanberg to "win" days after the election.

There is a way to disqualify state electors, if a single Senator objects to a count and the subsequent vote is won. But the real prevention is not allowing false electors in the first place.

Pennsylvania's state legislature should never have certified the vote. It was in their sole power to Stop The Steal in Pa, and they wimped out. The SecState rode roughhouse over the state Constitution, and they let it happen.

The ploy is that you must have a majority coming out of the committee for the nomination to advance. The senate committees are evenly represented by Dems and Reps. So, if all Senate Republicans take a walk like the Dems did with Coney Barrett, the Dems cannot advance the nomination to the floor. Nice- I think Texas also outlawed drive by voting and ballot harvesting. The Texas mail in voting laws have always been pretty sensible- you basically have to certify why you can't vote in person before they'll send you a mail in ballot. (maybe that changed in 2020 but I'm not sure)

The Dem primary was a shit show. None of the factions' preferred candidates (Warren or Sanders, Harris) or the rich spoilers (Bloomberg, Hickenlooper) could move the needle. It was an abject disaster. I increasingly believe that Biden literally failed his way to the top. The concrete batch plant has to show that 1)their mix is appropriate, and 2) put the right mix in the truck. Cheating was all of the above--changing votes adjudication of votes, illegal access to Democracy Suite by outside partisan groups to monitor voting, discarding Republican mail in ballots as spoiled, hiring ballot harvesters (probably paying for ballots as well), fake floater mail in ballots votes by non existent people, harvesting votes in jails, old folks homes, etc. Signing up and voting ineligible voters. Oh Mylanta, I was THERE for that fiasco. It was so obvious that they hadn't figured out who was going to "win" beforehand. There was a (nearly literal) emergency powwow of the national DNC trying to figure out what the heck was going on with the local rubes-I mean, "officials" around 9:30 that night. There were people running around, physically checking phone lines and switchboards. Had the assignment not been so short notice, I would've brought popcorn.

We could easily have every returned ballot scanned and in a database, but do we necessarily want that? How long until that thumb drive is leaked out into the internet?

440 Finally. Now have them explain how the Hart Verity voting systems (and others NOT Dominion related) utilized in many countries were secure and the votes produced accurate. (Keep in mind, Philly and Pittsburgh were/are state voting distractions. They're expected to 'cheat.)

Start in Delco - small and highly populated - where the Council took CTC $, purchased new HV voting machines that weren't always used as originally intended; added roughly 70 computers; hired an outside consultant to 'assist' with the local election, and rented, decorated and outfitted a huge building (NOT the county courthouse) in which to counts the votes. Further, it also, hired a printing company from Michigan to print the mail-in ballots, allegedly providing the names and addresses of all legal requesters, and also to mail them in a timely manner to said individuals - which went completely awry, of course.

And thanks to widely utilized mail-in voting, it now takes weeks to find out any (school board, dog catcher, etc.) allegedly accurate County voting results.
