Authoritarian-But-Incompetent White House Withdraws OSHA Vaccine Mandate After Supreme Court Drubbing

The Biden administration’s COVID-19 vaccine-or-test mandate for large employers is officially being scrapped Wednesday, according to the Occupational Safety and Health Administration.

The federal workplace safety agency's mandate has been forcing businesses with at least 100 employees to require vaccinations or weekly testing for their workers.

While OSHA said it had made the decision to remove the mandate, the agency was not withdrawing the vaccine-or-test option as a "proposed rule."

"OSHA strongly encourages vaccination of workers against the continuing dangers posed by COVID-19 in the workplace," a statement from the agency said.

I don't know what that means. Just going by what words usually mean, I guess they're taking the rule out of the category of operative effect and leaving it as "proposed," but not yet implemented. I think they hope that companies will continue to impose their rule on the strength of their "strong encouragement," even if the rule itself is no longer in effect.

Meanwhile...

The podcast Morning Rising made an interesting point about corporations and their basic stance against general freedom: Companies don't like taking the heat for either imposing a mandate, or not imposing a mandate. So behind the scenes they tell the government to impose a mandate. Or, less often: forbid mandates.

Either way, they demand that the government act, so that they can point to the government as the bad guy.

This may be good for business, and this sort of cowardly blame-shifting may be how corporate stooges routinely advance themselves, but this is anti-freedom. The government cannot intrude into the lives of citizens or of corporations even if the corporations themselves ask the government to, and the GOP -- always eager to do their deep-pocketed corporate pals a solid -- cannot do Big Business a favor if it means reducing liberty and imposing burdens and mandates on individual citizens.

If you remember, there was a lot of chatter that "companies want Obamacare" in 2008 -- yeah, I bet that's true, in the sense that companies did not want to argue with employees about health care benefits, they actively wanted the government to impose a one-size-fits-all solution, this is it, no more no less, no arguing no negotiating, so once again they can point to the government as The Bad Guy if employees didn't like their health insurance.

This is no reason to accede to their anti-democrat demands. I don't give a shit if every boss in the country wants to give up liberty to avoid some arguments with his employees.

We do not suspend the Constitution so that bosses and corporate CEOs will have fewer headaches at work.

And this is just one data-point suggesting why it's time for conservatives to split from their opportunistic, anti-freedom, conformist, pro-government-control, and very left-leaning corporate/mega-business "partners."

So we got Obamacare and vaccine mandates because our Very Good Corporate Friends and our Very Loyal GOP Representatives got together and agreed to sell us out, without bothering to let us know they'd struck this bargain.

Our interests are not aligned. Period.

They haven't acted as partners -- they've used us and betrayed us again and again and again.


It's time for a bit of payback on that score.

Anyway they have a deep dive into info that was just released on effects of vaccine on pregnant/lactating women. Too early to make a judgement on either the data which may be incomplete or their analysis. But I would think if this were a true trial and not a rollout to the whole world, based on what they report, a true trial would have been paused, at least for those pregnant/breast-feeding. I have the utmost sympathy for those pregnant women who are forced to take the jab or lose their job. Especially if the job is providing the insurance to cover the birth.

To the extent they wanted it, it's the same as it was with Obamacare - Take the issue off the table as far as competition goes. When the government mandates something, there's no competitive advantage or disadvantage anymore. Everyone competing for the same pool of employees has the same rules.

I think that was more complex, since companies with older workers want socialized medicine to reduce their costs and prevent new entrants from having a competitive advantage (like, GM wanting it since healthcare is a problem for them compared to foreign or younger companies.)

I wonder if the same thing is going on with masks and mandates where some companies favor it for some competitive reason.

Car dealers want to be closed on Sunday, for instance, if and ONLY if all other car dealers are closed on Sunday. (You sell the same number of cars in a week, but your costs are lower). You can't legally collude with the other dealers to agree to close on Sundays, but you can lobby the government to make you all close on Sundays.

Same with vaccines. They would love it they could force all their employees to get vaccinated if and ONLY if they didn't have to worry about some other company poaching their vaccine resistant employees. A vaccine mandate from the government takes care of this.

The last day at my company is 1 Feb 2022. Now, I've got absolutely nothing against the company; they've been very good to me, and they're good to me on the way out as well. My department is being phased out, so I'm not the only one out the door.

That said, I knew that the end would eventually come when I didn't get vaxxed. Company wouldn't let me go into the office without it, and my last day inside the office was 31 May 2022. Worked remotely, but you do lose a lot when you're not interacting with colleagues, so that didn't help my case when the decision was made to shut the area down.

This whole C-19 situation taught me a big lesson. Put not your trust in princes, or corporations. I can get a job, in this market, fairly easily - I think. I don't want to compromise my principles, however. I think I need to find a way to strike out on my own.

Agree that it's a bad idea, but employers brought this on themselves. They started doing it decades ago when they started cutting back on salaries. "Hey, throw them some 'free' insurance instead. What can that cost?" And when Baby Boomers were young, and most people were still paying docs in cash, it was a pretty cheap benefit to provide.
Then more and more started getting health insurance, driving med costs up, and Baby Boomers started aging and using doctors A LOT, and here we are! Companies can't afford their own health care costs, and health care is way too expensive.
So yes, these companies want Uncle Government to bail them out.

I sit on a fair degree of executive meetings. I would say some of it is cover for things these liberals want to do or support because they agree politically. Many are hyper partisan but hide it in order to give a fig leaf for their alleged business reasoning. A lot of these executives also went to the same Ivy League schools. They also need that government cover to shield them from shareholder lawsuits. Especially when their actions have a negative impact on shareholder equity.

Let that sink in. And believe me, numerous other non-governmental entities such as the NFPA and ANSI took that ball and ran with it. Of course, yes, for financial gain.

But I've worked with, and for, more than one member of those various committees, including a few that are very influential on industrial and automation safety. They're not personally getting rich - but they are "called", like an old time Baptist Preacher, to that work. They pay their own expenses to do it in many cases.

The firefighting chemical (used from the 70s) never degraded (it's a forever chemical), so it built and built in the water supplies, so its effects are gonna show bigger and bigger as the years go by. And that chemicals' effects take a while to hit. So, folks don't get the degradation to cancer in their 20s...some of this takes 10-15-20 years...so, you build it up for 15-20 years and then see the effects on the people who had it 15 years ago now...and then they get worse, but now it's blamed elsewhere...

I'm not a lawyer, but here's how I see it: Two months ago, my employer announced plans to implement the mandate starting in January. So they are in a situation now, where the mandate they were claiming as authority has been suspended by the Supreme Court, who explicitly stated that the mandate will probably be declared unconstitutional. At the time, the administration encouraged companies to do it anyway.

I think that puts my employer in a box where they can't claim to be doing it now on "private company" grounds. If they proceed, then they are acting as government agents, following an illegal directive to implement a policy that is unconstitutional. I'm telling my boss that further enforcement will expose the company to liability for denying our civil rights as agents of the government.

It's funny to me, the coordinated assault on Rogan. It's been going on for months, in major media organs, and especially from other celebrities coming out of the woodwork like Young, and it's just vitriolic. Rabid.

I know part of it is that he's a prominent Covid-19 heretic. But I think that only partly explains it.

I think the bigger part is that he's the biggest podcaster there is right now, and these old-line media types absolutely hate the new online guys who work outside their gatekeeping system. And not just because they are protecting their ricebowls, but because they deeply resent seeing these guys making their fortunes on huge audiences, when they never even sucked the dick.

I believe a whole lot of the crazy hate is that they're treating Rogan as a stand-in for all the scabs who never paid their dues in the established system. It has to hurt, debasing yourself like that for years, and finding out it was completely unnecessary.

I would drop "bold." They all tend to do what everybody else is doing. See, e.g., TQM and every other management fad that's come down the line. Diversity officers. All that shit. Clearly, that's the hard part. But it is interesting that Durham has done at least 1 indictment so far in the Virginia where he used to be the US Attorney and not DC where its impossible to get fair treatment against Democrats.

Durham is not an idiot and he's not doing this for the money. He's working his ass off with a 4 man team while Mueller had 40 and spent 10 times the money and took the same amount of time to basically produce dick.

He may not get as much as everyone wants but it won't be for lack of trying.
