Authoritarian-But-Incompetent White House Withdraws OSHA Vaccine Mandate After Supreme Court Drubbing

Joey Waffles.

The Biden administrationís COVID-19 vaccine-or-test mandate for large employers is officially being scrapped Wednesday, according to the Occupational Safety and Health Administration.

The Biden administration's COVID-19 vaccine-or-test mandate for large employers is officially being scrapped Wednesday, according to the Occupational Safety and Health Administration.

The federal workplace safety agency's mandate has been forcing businesses with at least 100 employees to require vaccinations or weekly testing for their workers.

While OSHA said it had made the decision to remove the mandate, the agency was not withdrawing the vaccine-or-test option as a "proposed rule."

"OSHA strongly encourages vaccination of workers against the continuing dangers posed by COVID-19 in the workplace," a statement from the agency said.

I don't know what that means. Just going by what words usually mean, I guess they're taking the rule out of the category of operative effect and leaving it as "proposed," but not yet implemented. I think they hope that companies will continue to impose their rule on the strength of their "strong encouragement," even if the rule itself is no longer in effect.

Meanwhile...

The podcast Morning Rising made an interesting point about corporations and their basic stance against general freedom: Companies don't like taking the heat for either imposing a mandate, or not imposing a mandate. So behind the scenes they tell the government to impose a mandate. Or, less often: forbid mandates.

Either way, they demand that the government act, so that they can point to the government as the bad guy.

This may be good for business, and this sort of cowardly blame-shifting may be how corporate stooges routinely advance themselves, but this is anti-freedom. The government cannot intrude into the lives of citizens or of corporations even if the corporations themselves ask the government to, and the GOP -- always eager to do their deep-pocketed corporate pals a solid -- cannot do Big Business a favor if it means reducing liberty and imposing burdens and mandates on individual citizens.

If you remember, there was a lot of chatter that "companies want Obamacare" in 2008 -- yeah, I bet that's true, in the sense that companies did not want to argue with employees about health care benefits, they actively wanted the government to impose a one-size-fits-all solution, this is it, no more no less, no arguing no negotiating, so once again they can point to the government as The Bad Guy if employees didn't like their health insurance.

This is no reason to accede to their anti-democrat demands. I don't give a shit if every boss in the country wants to give up liberty to avoid some arguments with his employees.

We do not suspend the Constitution so that bosses and corporate CEOs will have fewer headaches at work.

And this is just one data-point suggesting why it's time for conservatives to split from their opportunistic, anti-freedom, conformist, pro-government-control, and very left-leaning corporate/mega-business "partners."

So we got Obamacare and vaccine mandates because our Very Good Corporate Friends and our Very Loyal GOP Representatives got together and agreed to sell us out, without bothering to let us know they'd struck this bargain.

Our interests are not aligned. Period.

They haven't acted as partners -- they've used us and betrayed us again and again and again.

It's time for a bit of payback on that score.

Oh, and meanwhile: Joey Waffle Cone's having a big day!

There were anti-vaccine mandate protests in the US and around the world over the weekend:

Note that antifa opportunistically took advantage of the cover of the protests to begin their usual campaign of violence and mayhem and attacking cops.

If those antifa attacks on cops look insurrectiony to you, that's because you have Racist Eyes. Those are just mostly peaceful assaults.

31 Businesses don't want to be left to determine policy like clot shots - they are afraid of being sued either way.

But right now they can't hire talented people, so the companies I've been working with don't want to have a mandate since it reduces the number of available employees to choose from.

So, if the GOPe does want to do a solid for Big Business, and the people, they can affirmatively BAN mandates.

Anyway they have a deep dive into info that was just released on effects of vaccine on pregnant/lactating women. Too early to make a judgement on either the data which may be incomplete or their analysis. But I would think if this were a true trial and not a rollout to the whole world, based on what they report, a true trial would have been paused, at least for those pregnant/breast-feeding. I have the utmost sympathy for those pregnant women who are forced to take the jab or lose their job. Especially if the job is providing the insurance to cover the birth.

To the extent they wanted it, it's the same as it was with Obamacare - Take the issue off the table as far as competition goes. When the government mandates something, there's no competitive advantage or disadvantage anymore. Everyone competing for the same pool of employees has the same rules.

I think that was more complex, since companies with older workers want socialized medicine to reduce their costs and prevent new entrants from having a competitive advantage (like, GM wanting it since healthcare is a problem for them compared to foreign or younger companies.)

I wonder if the same thing is going on with masks and mandates where some companies favor it for some competitive reason.

Posted by: naturalfake at January 25, 2022 05:11 PM (OMayC)

64 This is about companies wanting the government to look like the bad guy. Companies want the government to be their cartel enforcer. Car dealers want to be closed on Sunday, for instance, if and ONLY if all other car dealers are closed on Sunday. (You sell the same number of cars in a week, but your costs are lower). You can't legally collude with the other dealers to agree to close on Sundays, but you can lobby the government to make you all close on Sundays.

Same with vaccines. They would love it they could force all their employees to get vaccinated if and ONLY if they didn't have to worry about some other company poaching their vaccine resistant employees. A vaccine mandate from the government takes care of this.

The last day at my company is 1 Feb 2022. Now, I've got absolutely nothing against the company; they've been very good to me, and they're good to me on the way out as well. My department is being phased out, so I'm not the only one out the door.

That said, I knew that the end would eventually come when I didn't get vaxxed. Company wouldn't let me go into the office without it, and my last day inside the office was 31 May 2022. Worked remotely, but you do lose a lot when you're not interacting with colleagues, so that didn't help my case when the decision was made to shut the area down.

This whole C-19 situation taught me a big lesson. Put not your trust in princes, or corporations. I can get a job, in this market, fairly easily - I think. I don't want to compromise my principles, however. I think I need to find a way to strike out on my own.

They really, really, really want everyone to get the vaccine. Oh yeah, and the booster. But they aren't going to mandate it. Yet.

Oh, and they're not going to hire anyone going forward who is not vaccinated.

Posted by: sniffybigtoe at January 25, 2022 05:12 PM (UuD2k)

Agree that it's a bad idea, but employers brought this on themselves. They started doing it decades ago when they started cutting back on salaries. "Hey, throw them some 'free' insurance instead. What can that cost?" And when Baby Boomers were young, and most people were still paying docs in cash, it was a pretty cheap benefit to provide.
Then more and more started getting health insurance, driving med costs up, and Baby Boomers started aging and using doctors A LOT, and here we are! Companies can't afford their own health care costs, and health care is way too expensive.
So yes, these companies want Uncle Government to bail them out.

At the same time, businesses can point to government saying that the feds will simply impose it, but they can make lives easier for employees through their own "self-mandate" somehow. 121 Ace, per a certain school of economics, cartels are created to stop competition so to allow higher profits at generally lower quality, but unfortunately cartel members cheat on each other unless there is some greater power to enforce their agreements.

Generally the greater power is government via regulation and oversight.

As you describe ACA that means the businesses don't have to worry about health care, the changing regulations, and being undercut by competetors since the Feral Gov. will take on that "burden"

I am not sure if the OSHA mandate is the same thing, I think it is an attempt for most businesses to get in good with the Feral Gov. and not be dragged by the state governments they have to appease

==
Oh they're still screwed. Even if there was still a mandate they were screwed. Obeying an illegal osha reg does not insulate you from civil liability for violating an employee's rights. Your employer may pretend that it does, but it doesn't. That law tells them what to do. It does not eliminate the third party's rights. That's why they tried to trick everyone into signing away their right to privacy in order to be able to apply for an exemption. It was on the form you signed. If you did.

Bombshell Cover-Up: Cancer Diagnoses in the Military Rose Over THREE-FOLD Since Jabs Were Introduced
Daniel Horowitz @RMConservative
I can share with you from attorney Thomas Renz that the number of cancer diagnoses in the military's DMED system went from a 5-year average (2016-2020) of 38,700 per year to 114,645 in the first 11 months of 2021. This is a predominately young population.
Unlike VAERS where the naysayers can suggest that anyone can submit, this is only by military doctors and quantifies every single ICD code in the military for tri care billing of Humana. This is the ultimate defined and finite population with excellent surveillance.
Actually i got that wrong. One of the whitsleblowers just told me it was through October, not November. So this is 10 months of data off the chart vs. prior 12 month years!

Obviously health care workers are exempt from this since they are the only group for who the mandate was upheld.

The reason why big business wanted the mandate was because it gave them legal protection from these claims. Now they are running completely exposed. I'd sue their pants off. 284 As to supporting/pushing mandates, in addition to the universal intellectual and moral and civic rot well demonstrated by corporate types for years now, I would rack it up to the usual Oligopolistic Imperative: support/accept/promote mandates and other regulatory burdens that hinder smaller competitors.

That's part of it, but it's not all of it. Part of it is just human nature. Let me give you an example.

OSHA has something called the General Duty clause. Simply stated, the idea - codified in law - that you have to not only comply with their rules, but quite literally any other industrial standard. Let that sink in. And believe me, numerous other non-governmental entities such as the NFPA and ANSI took that ball and ran with it. Of course, yes, for financial gain.

But I've worked with, and for, more than one member of those various committees, including a few that are very influential on industrial and automation safety. They're not personally getting rich - but they are "called", like an old time Baptist Preacher, to that work. They pay their own expenses to do it in many cases.

303 The pernicious link between health insurance and employment got its start during WWII, when wage controls had companies start to offer other "benefits" to lure scarce workers. Of course back then it wasn't a significant issue, but it was something.

The rest of the story unfolded much later. Medicare/Medicaid was a major ratchet turn, O-care the final one. Lots of pathologies interweaved. This latest chapter is mostly non-financial, unlike the others, but truly sickening. The destruction of medical judgement and independence, turning doctors and others into technicians of a scientifically unhinged State.

Issue is that base water supplies have not changed for years. Same as the chemicals they have used for years. Thus, Cancer rates should be consistent as those things did not change, but were discovered as potentially causing cancer.

But private companies mandating its use as a condition of employment had no protection under the emergency auth. I've read trial lawyers saying they expect this to parallel the asbestos suits.

He can't. When a fairly good part of why you get up in the morning and go through the day is based upon the rock solid belief that the Great Pumpkin is coming, you've got limited choices. Simply saying to yourself "nope, I was wrong, every waking moment of my life" isn't really an option for most people. What about people who have kids or grandkids and were scared into getting the vaccine? Are they subhuman or did they do something wrong?

I don't know the details on aborted babies, and I recall there was some argument over whether that was really an issue early on, but if you used a technology that relied on murdered children to attempt to prolong your life, you absolutely did do something wrong.

Beyond that, if you were compelled to get the jab, I pity you because you're going to bear whatever the consequences of that decision turn out to be (various heart issues, maybe sterilization, assorted other maybes we won't know until the Pfizer casualty data has been fully published). And you didn't get much benefit since deaths *from* covid are super rare.

But the folks bragging about it? They clearly seek social acceptance and need to be hit with something bigger than the government's propaganda campaign if they are to be corrected.

425 400 The firefighting chemical (used from the 70s) never degraded (it's a forever chemical), so it built and built in the water supplies, so its effects are gonna show bigger and bigger as the years go by. And that chemicals' effects take a while to hit. So, folks don't get the degradation to cancer in their 20s...some of this takes 10-15-20 years...so, you build it up for 15-20 years and then see the effects on the people who had it 15 years ago now...and then they get worse, but now it's blamed elsewhere...

If I were a conspiracy nut, I'd say DoD, when the govt was secretly funding a virus in China in 2017 that would take out the "immune compromised" (aka cancer) folks the most, probably thought it was a great idea to get off the hook from their future VA costs...

484 I think they hope that companies will continue to impose their rule on the strength of their "strong encouragement," even if the rule itself is no longer in effect.

I'm not a lawyer, but here's how I see it: Two months ago, my employer announced plans to implement the mandate starting in January. They insisted they didn't have a choice; they were bound by the administration's mandates. That means they are acting as agents of the government, taking away rights that the government can't take away themselves.

So they are in a situation now, where the mandate they were claiming as authority has been suspended by the Supreme Court, who explicitly stated that the mandate will probably be declared unconstitutional. At the time, the administration encouraged companies to do it anyway.

I think that puts my employer in a box where they can't claim to be doing it now on "private company" grounds. If they proceed, then they are acting as government agents, following an illegal directive to implement a policy that is unconstitutional. I'm telling my boss that further enforcement will expose the company to liability for denying our civil rights as agents of the government.

I agree about the smelly jackasses.

But the velocity is nowhere near panic levels. It's just that most people still think 1000 points is set your hair on fire time. Which may have been the case in 1990 when DJIA was at 2500. When it's at 35,000 it's not really that big of a deal.

It's funny to me, the coordinated assault on Rogan. It's been going on for months, in major media organs, and especially from other celebrities coming out of the woodwork like Young, and it's just vitriolic. Rabid.

I know part of it is that he's a prominent Covid-19 heretic. But I think that only partly explains it.

I think the bigger part is that he's the biggest podcaster there is right now, and these old-line media types absolutely hate the new online guys who work outside their gatekeeping system. And not just because they are protecting their ricebowls, but because they deeply resent seeing these guys making their fortunes on huge audiences, when they never even sucked the dick.

I believe a whole lot of the crazy hate is that they're treating Rogan as a stand-in for all the scabs who never paid their dues in the established system. It has to hurt, debasing yourself like that for years, and finding out it was completely unnecessary.

I would drop "bold." They all tend to do what everybody else is doing. See, e.g., TQM and every other management fad that's come down the line. Diversity officers. All that shit. Conformity is the order of the day, not boldness. Lack of conscience maybe but that's not the same thing as boldness. Otherwise I completely agree.

Clearly, that's the hard part. But it is interesting that Durham has done at least 1 indictment so far in the Virginia where he used to be the US Attorney and not DC where its impossible to get fair treatment against Democrats.

Durham is not an idiot and he's not doing this for the money. He's working his ass off with a 4 man team while Mueller had 40 and spent 10 times the money and took the same amount of time to basically produce dick.

He may not get as much as everyone wants but it won't be for lack of trying.

Yep. Next - he'll be demanding nobody do a cover of his songs without his express permission. Sorry, Neil, that's not how it works. You don't get a dime unless they both record and distribute it - and even then, you're just in for a set percentage. That's the agreement you signed on for.

That would be logical. But few entities are logical. Most media still censors comments, under the guise of limiting liability. Yet, under the rules of common carrier, the best way of limiting liability is to exercise no censorship at all. The phone company has never been liable for what anyone says over the phone.
