Split Decision: Supreme Court Upholds Injunction Against Biden's OSHA Vaccine Mandate;
Fake "Conservative" Justices Uphold Mandate for Health Care Workers Mandate

Breaking, via @Techo_Fog.

The Court is deciding whether to uphold or strike down -- "stay" -- a temporary injunction. The injunction is currently suspending enforcement of the OSHA mandate.


A bit confusing there -- the government wants to "stay," or suspend, the injunction. The injunction itself is staying, or suspending, enforcement of the law. So the government wants to enjoin the injunction.

The Supreme Court says "Nah, we'll leave the injunction in place." Meaning, the mandate cannot be enforced. The courts will have a full trial on the lawfulness of the mandates later, but for now, they're assuming it will be found to be unlawful and are suspending its enforcement.

An injunction is a remedy sought before an actual trial when there is claimed to be irreparable harm that will be suffered before the trial can be held. Injunctions are decided on quick-and-dirty hearings, with lower evidentiary standards and expedited procedures.

To win on a motion for an injunction, you have to show, most importantly, that you'll suffer an irreversible harm that cannot be later remedied at a full trial unless you are granted the injunction (for a contrary example: losing money isn't an irreparable harm, as you can always be compensated at any point in time, but being forced to take a vaccine you don't want would be a bell that can't be unrung), and that you're likely to succeed on the merits when the full trial is held and concluded.

The lower courts found that the plaintiffs would in fact prevail on the merits.

The Supreme Court now agrees.

Specifically, they're likely to prevail on their argument that the mandate is "unlawful."

They find that the Brandon Administration's contention that Congress silently authorized OSHA to have the power to enforce a national vaccine policy is stupid. The Supreme Court will allow the argument that Congress perhaps intended, without explicitly stating, some minor provisions or limitations in the stated law.

But for major parts of the law, they expect that Congress will speak clearly. And audibly. And not "silently" and through implication and emanations and penumbras.

This isn't a guarantee the Court (or the lower courts, first) will rule the mandate unconstitutional when they get around to ruling on the merits -- they could all be dazzled by new arguments later -- but that's the way to bet.

Still no word on the mandate on health care workers.

Update: Even though it is now a well-known fact that hospitals are calling in covid-infected doctors and nurses into work, and therefore there can be no rational basis for depriving anyone of their right to refuse a vaccine, the "conservative" justices picked for us by the neoliberal Federalist Society did what they always do and sided with the liberals.

52 Reading through the opinions quickly, its not clear at all to me that Congress granted CMS the authority to require workers to be vaccinated. The majority points to, as the dissent says, a "hodgepodge" of regulations, but no clear statutory mandate.

At a guess, SCOTUS blinked here because it generally agrees that healthcare workers should be vaccinated, and worked backwards. Roberts wants to split the baby, and he dragged Kavanaugh along with him (the latter being the most disappointing).

Doubtful. Ron Klain (Biden's Chief of Staff) went this route (using the OSHA rule) because they couldn't get congress to pass a mandate. If they could have, they already would have.

Klain, a Harvard Law grad, was a little too cute for his own good though, and his grand plan didn't work.

It hasn't gotten much media coverage but there was a settlement in New Jersey yesterday that should get some plaintiffs' lawyers chomping at the bit.

NJ agreed to pay $53 million to the families of 119 veterans who were infected with the virus when the state moved covid-infected patients into their care facilities.

IIRC, the state of NY immunized its nursing homes from suit when Gov. Nipple Rings started doing this, but there are a lot of other states where the nursing homes were not given immunity, and now they are going to be facing massive claims, like the NJ ones were.

In general, I don't think medicare and medicaid pay a whole lot, usually it's a very small percentage. I wonder if it would be cheaper/better for a hospital to offer a fee for service cost to those on medicare or medicaid, and not accept any government money, then to lose a bunch of nurses and doctors who don't want to get the shot.

I think that would only apply to patients arriving through the ER under EMTALA.

The problem is that in normal times, most hospitals are half empty. And even though Medicare and Medicaid pay shitty rates compared to most private carriers, it's still enough to cover the marginal cost of filling those empty beds. Most hospitals could not go without that reimbursement.

A friend who lived in the country had that problem which was exacerbated by his choice to use an Advantage plan.

Finding a good doc who accepts Medicare in Big City is not a problem. Big Medical facilities are in bed with the govt which means they take Medicare; therefore, the docs associated with that facility also take Medicare.

The end result is one can easily obtain a good primary who is associated with a good medical facility.

If it gets to the SC, I would suspect DoD civilians will lose. Not that I think they should, but I think that's the way the court will rule, using past precedent. The hope should be that the governmental unions stop the policy before it gets that far. That path is much more likely to succeed.

576 Small practices in general don't like any kind of health plan (they are NOT insurance. Insurance is a bet. A Health care plan is shared risk) because of the time it takes to get paid.

And the hassles the Ins. cos put them thru to get paid. And much of the time they don't get what they think they should get for their time/trouble. It's particularly aggravating for Medicaid/medicare. As they pay way less than most drs can afford which is why they all have banded together to share the costs.

Since it began medicare has been forcing how the health care system operates.

Ballots, not votes are certified. Votes are not required to have any correlation to certified ballots.

My Dad is being discharged today out of the hospital with Covid and double pneumonia. They called it covid pneumonia. Of course, they can't tell you if its delta or omicron, but I am beginning to be increasingly suspicious that these new variants are being purposefully released in the atmosphere. There is no logical reason for the exponential uptick in cases.

636 My Dad is being discharged today out of the hospital with Covid and double pneumonia. They called it covid pneumonia. Of course, they can't tell you if its delta or omicron, but I am beginning to be increasingly suspicious that these new variants are being purposefully released in the atmosphere. There is no logical reason for the exponential uptick in cases.

Agreed. It's all a hoax. They gave him 5 rounds of remdesivir, which I believe was not meant to help him and it didn't. He actually got worse. The doctors were in lock-step with the narrative. Little punks. The nurses are tired of the bullshit and I think its just a matter of time before they leave en masse. They are truly are bearing the weight of protocols that don't work and horrific patient outcomes that they have to take home with them. Every nurse I saw in the ER looked shell shocked. I slipped him some ivermectin and HCQ in his bag before he went upstairs to die...and he's going home today.

I had about $600 in medical expense ( annual physical and blood work) . I try not to think about the math.

What we have are health care plans. Negotiated by the coordinating company/group. They are shared risk.

At any one time only x number of members are making claims and only so many will make claims. They can figure this close enough to optimize their premiums so that they can make money. They operate in a group so that they can share any large out of the ordinary payouts in anyone place/time. Such as a tornado or tsunami hits one town that has a lot of members.

Health insurance is a bet. The actuaries figure the odds someone will get this or that disease and base their premiums on that. They only payout on a specific disease or diseases. Usually catastrophic one such as cancer or major accident and such. They do not cover trips to the er or other procedural stuff. They payoff for specific illness.
