Senate to "Shelve" Build Back Bolshevik Bill
Democrats Plot Nuking the Filibuster to Take Charge of Voting Laws Throughout Country

Too much funflation to bear.

So they're shelving the bolshevikization of the economy, but will instead "aggressively" focus on the bolshevikization of elections instead.

I hope -- pray, really -- that Republicans have forty-one votes to filibuster that nightmare. But who knows what the "reasonable" Republicans might decide to in the service of Collegiality.

And I have to tell you: I think the "rules change" discussed here is a suspension of the filibuster rule for a vote on a federal takeover of state election laws.

He doesn't have the votes as Manchin remains noncommittal

Schumer is still holding out hope for action on voting rights this year, multiple sources tell us. They are hoping for agreement on a rules change between four moderates who have been meeting -- Tester, Kaine, King and Manchin 2/

A spokesman to Schumer, however, says they are "still trying to do both."

All four of those people are Democrats -- well, except for King, a Maine "Independent" who caucuses with Democrats.

So they're not huddling with Republicans working on a compromise.

No, they're scheming about a "rule change," with only Democrats involved.

What could that be other than a nuclear option vote on the filibuster?

And yeah, I did all of that speculating pointlessly, because it is now reported: they're pressuring Manchin to agree to the nuclear option for a "voting rights" bill.

Senate Democrats are escalating pressure on Sen. Joe Manchin (D-W.Va.) to get behind using the "nuclear option" to change the filibuster and break a months-long stalemate on voting rights legislation.

The flurry of talks - including dedicating a closed-door caucus lunch to the issue despite a public focus on passing President Biden's climate and social spending bill - comes as Democrats are facing intense pressure to pass election legislation though there isn't yet a clear path forward.

A group of Democrats, tapped by Senate Majority Leader Charles Schumer (D-N.Y.), met with Manchin Tuesday as part of rolling discussions. But Manchin, simultaneously, is pushing for rules changes to be bipartisan and holding talks with Republicans, who are unlikely to support the sort of reform needed to get voting legislation passed.

Underscoring the frustration within the caucus, Sen. Raphael Warnock (D-Ga.) spoke out during the Democratic lunch, and separately on the Senate floor, about the need to pass voting rights legislation before taking up the Build Back Better legislation and that it would be "irresponsible" for Democrats not to act.

Manchin has previously resisted these demands. I don't know of a reason why he'd suddenly give in, now that he's sort of calling the shots on the Democrat side of the Senate, but who knows, maybe he will decide to be magnanimous in victory.

Clarification: They would only need Democrat votes to nuke the filibuster.

It would work like this (sort of, I'm shaky on the exact process): They would present a motion stating that the filibuster will be set aside. The parlimentarian would rule the motion out-of-order. But then they would vote to overrule her ruling, which only takes a simple majority. If they have all fifty Democrats voting, Kumala would finally be Positioned for Success to cast the tiebreaking vote to overrule the parlimentarian and set the filibuster aside, or end it.

I assume what they're pitching Manchin is the idea of keeping the filibuster generally -- he's opposed to scrapping it -- but just suspending it for this one Very Special Vote Because Reasons.

They do. Their thoroughly rotten boroughs are what they are, but they may be facing a broad-spectrum bloodletting next year, including in places where they have only moderate control. Federalizing elections and systematizing the fraud will help with that.

I agree that the Republicans will have a majority in '22, regardless of this bill, so why on earth would the Dems give them a gift like getting rid of the filibuster? At the very least, the Republicans would reinstate the filibuster were they so inclined, but I don't see why they would be.

I thought that BBB was the way for Dems to actually point to a legislative accomplishment that can save them from the Red Wave, but I guess they're abandoning that for outright election theft as the tried-and-true way to retain power.

They need a federal mandate for unrestricted mail in voting because the public at large now sees it as outright fraud. A referendum in Utah will probably be on the ballot to eliminate mail in voting that has strong support from the voters. Voters in Georgia want to strictly limit absentee voting and completely get rid of drop boxes.

Even if they manage to twist Manchin's arm for this, it is very likely to be ruled unconstitutional. SCOTUS ruled that states have absolute authority to run elections as they see fit in their quest to ensure Trump lost his legal challenges. So now they are stuck.

I remember when John Thune was recently on one of the DC shows - maybe even Levin. He was asked what he was doing to get Manchin to switch parties, and he said that he begged, pleaded, and would even show up at his door offering to mow his lawn - whatever it took. They also say that cops don't prevent crime - one of them noted that Detroit now has about the same population and area as Portland, twice as many cops, and yet still has much higher crime rates. (Because I can't think of a single difference between Detroit and Portland, other than the number of cops.)

One frequent poster on Portland Reddit, who hates the cops and wants to abolish them, began a sentence with the following hilarious phrase:

I dunno about car theft, but vehicular robbery was big business in the Bay Area. Rental cars were targeted aggressively outside of San Francisco, and it was no holds barred within the city itself.

It got so bad that my big tech company started forbidding the use of rental cars when visiting the home office in SV. We took cabs or Uber. it was expensive, but it was cheaper than the constant equipment replacement and car repair from break-ins. Like most big companies, we were "self-insured" which means we paid for it when it happened. It was so common that the expense couldn't be managed and they just banned it. Take a cab and bring all your shit with you.

It is...the VRA of 1965 is the thin fig leaf that these knuckle heads are trying to use, but unless a specific law passed by a state can be shown to violate that, and none will be, the Feds can't impose changes. And they can only get the state to change the law or amend it if it is found to violate that Act, not institute their own as a substitute.

By the way, the VRA of 1965 only applies to non-constitutional laws passed by states that discriminated against specifically a certain race, religion, creed or sex...it has zero to do with anything else and its been ruled to be very, very narrow in scope by subsequent SCOTUS rulings.

There's a reason they don't have mail-in voting in Europe, and it's the same reason why Jimmy Carter's UN commission on voting said that voting by mail is the type of voting most susceptible to fraud: because it's the easiest way to cheat.

Tens of thousands more mail-in votes in AZ were mailed back than the state had records of having mailed out. And that was just in one county. Tens of thousands of mail-in votes materialized out of nowhere.

The only people who look at a situation like that and say "hey, we need more of this and we need to make it federally mandated" are f*cking cheats, IOW, Dims.

Nope, already been ruled to be way to narrow in scope by subsequent SCOTUS rulings to allow the Feds to suspend elections or elections laws just by invoking it, or decide to write the laws for the States themselves. Any question on a state's election law constitutionality must be sued under the Act and then proven to be so in order to get the election law amended...and will be enjoined until that can happen.

We do not use lawfare enough (although yesterday the Fifth Circuit issued a blistering decision on the return to Mexico policy that the Biden Administration was trying to suspend, so Texas is doing its part). I'm less sanguine about the specific scenario you lay out, because I think a lot of the VRA litigation has been about the expansion of the VRA beyond what the act actually says, so if Congress were to pass a new act, the old stuff would be moot -- it's more about the interpretation of a law, not about the Constitution. But hell yes, tie it up in court.
