It had may too many gears (something like 12) and was constantly gear-hunting and never stayed still. The state has more power than Feds on health and safety. So if you live in a blue state, your gov can screw you. In a red state, he could screw you too, but re election would be a thorny issue. Also, a gov has to deal with the fact that hospitals can't staff if they fire even 10% of their work force. They don't have a lot of extra bodies. So they have to cut services. People die. The federal government only has those powers when interstate commerce is involved or crossing national borders. The injunctions against federal contractor mandates, medicare provider mandates, and overall employer mandates comes from the idea that vaxx is not commerce and so the federal government agencies certainly do not have that power (leaving open the question whether Congress does) Under past precedents, Jacobson v. Mass, states have the police power to make a citizen take a vaxx dose even if they already had the disease or be fined. Later decisions extended that to even include sterilization (see Buck v. Bell). That is because the states can act, under reserved powers via the 10th amendment, to protect the safety, welfare, and health of its citizens under the police powers doctrine. Police powers are not all encompassing. Police powers should be limited and not broad. Emergency powers should be extremely short in durations and due to actual emergencies. We have stretched all to the point where too many conservatives just say the state has all these broad police powers to do what they want. Jacobson gives too many courts an out. It should be distinguished on the basis that the smallpox vaccine being mandated in Jacobson was differently situated than the COVID-19 jabs (all of which are based on new science, with unknown side effects, with long-term studies waived under an EUA).

For the most part, regarding government powers, court decisions are based on the idea that the political system is responsible for most of your daily life. Generally, when courts get involved, everything gets reduced to a legal case that often makes the problem worse (abortion is an example) or affirmative action decisions for example. So, when people want a vaxx mandate overturned now, they have left the states and local governments with this power for over 120 years or so. Vaccine mandates for schooling, jobs, etc. have been around for years and thus the precedents are there for it to be applied for a bad vaxx.
