Federal Court Blocks Another Biden Vaccine Mandate, This One Demanding That Federal Contractors Get the Jab

The judge ruled that the grant by Congress to the Executive of authority to procure goods and services obviously did not include the power to force people to get vaccinations against their will.

A federal judge in Georgia issued a nationwide injunction that prevents the U.S. government from enforcing a COVID-19 vaccine mandate on federal contractors, temporarily shutting down the last remaining vaccine requirement by the Biden administration.

U.S. District Judge Stan Baker in Savannah, Georgia, said Congress did not clearly authorize the president to use procurement to impose a vaccine requirement on contractors that will have "vast economic and political significance."

The lawsuit was filed by the states of Georgia, Alabama, Indiana, Kansas, South Carolina, Utah and West Virginia as well as a trade group for contractors.

Cities and States derive their police power (the power to regulate) from their respective State Constitutions, so those questions will have to be decided by the State Courts on a case by case basis.

The cases in Federal Court are saying that the Federal Government has no power under the Constitution to make these kinds of orders.

Remember - with these mandates, Time is of the Essence. But when it gets set for trial, the Courts can easily make sure that it doesn't even come up for argument for at least 6 months, maybe a year.

Giving an injunction and setting it for trial "someday" is the Judiciary's standard model for killing anything time sensitive that it doesn't like.

I'm the last person to scaremonger and it's probably nothing but I went past a local hospital in Phoenixville, PA today and I've never seen the parking lot so packed with cars. Maybe people are all deciding to get elective surgery before Christmas or something, but it was standing room only. The past two years the parking lots have been a ghost town.

75 I think the decision in the Sixth Circuit may be a bit better, since it didn't really lean on "political and economic significance" so much as on it being a violation of administrative procedures (which it is, and obviously so - the way the contractor mandate is structured is completely batshit insane and flatly illegal).

In this case, the question is whether the administration even has the legal authority under the Constitution and existing statutes to issue the mandates and numerous courts have answered no.

Believe last week, lost in the mix, another judge issued an injunction for the military because the vaccine that was approved by FDA and the EUA vaccine are not the same.

This is even though we (3,500 to 4,000 employees) have been working from home since April 2020 and the decision was made recently that we will continue to do so indefinitely, probably forever!

Now tell me, what the heck does this have to do with public health? I'm in my early 40s and my wife and I are trying to have a second child. We actually discussed the possibility of me quitting my job and selling our house.

nope, the tide has turned. The Federal mandates are dead, and they're not coming back. The Georgia Federal Judge has taken a page out of the Hawaiian Judge's playbook and issues a Nationwide Block on the rule - no Judge on his level can overrule that, it has to go to the next level up, a court of Appeals. And the 6th Circuit has consolidated all of the mandate cases, and they are sounding very negative about upholding any of them.

Without federal cover, then private companies mandating the shot are on the hook for liability and then there are various state laws that may apply in your state such as conscience laws.

Dude, a lot of these lawsuits will be filed at the state level without the federal cover for their acts. Same as the fact of not liable in one case does not forestall liability in another. As the information about side effects expands, the real possibility is something like the Big Tobacco lawsuits by state AG's. I would not want to be an investor in the pharma companies involved in it as there is increasing information that the trials for the vaccine were conducted in a fraudulent manner. That may well prevent use of immunity under the Cares act for them.

Not to mention the extremely slippery slope of "religious exemptions." If you do what a lot of companies do, which is issue a lengthy questionnaire about what you believe, for how long, what other medicines you take, etc., then there is a serious problem. In the case of a private firm, you're getting firmly into "religious test' territory, which is against the Civil Rights Act. If you're a government agency, you're afoul of the Establishment Clause. If you're a federal contractor, you're on the wrong side of both.

There is a reason I have been waiting until the last minute to file for an exemption.

Somebody I know well, wrote to the admin of a large hospital corp pointing out that it is not ethical to coerce one in to accepting medical treatment vitiates consent, is clearly criminal conduct, motivated by nothing more than a desire to participate in a government reimbursement program. Two days later the CMS mandate was blocked and the hospital put the brakes on its action. However, not before they coerced thousands to get the shot, and now have the names of thousands of others who refused. The latter are now marked.

Yes, in fact, any contractor that tries to persist can be brought to that court under contempt charges of ignoring the injunction. If worried about it, I would immediately consult an employment lawyer about options because a lot depends on your state law, employment contract, and possible protected status under ADA, religion, etc. It is cheaper to do this now than later while you still have your job and often a letter on your behalf via a lawyer to corporate counsel can work wonders on its application to you.

In a rational system, he probably shouldn't be able to do this, but Liberal Judges over the last 20 or 30 years (the so called Hawaiian Judges) have been doing this for a good 20 or 30 years now, and no one ever moved to stop them from doing it. So now it's an established power, established by practice, not black letter law.

Does not work this way Martini. For the commerce clause to be employed, it has to be a matter of commerce--under the precedent of Jacobson, states can mandate vaxxing because they have 'police powers' to regulate for the health,safety,and welfare. The FedGov does not have plenary powers so it has to rely on the commerce clause. Given the injunctions, the administration does not have the power for agencies, absent congressional statutes possibly, to mandate a vaccination. So, any contractor relying on that cannot claim Cares act immunity unlike medical and perhaps pharma companies (see fraud mentioned above), and cannot claim that federal govt agency actions under commerce clause prohibit state lawsuits to hold contractors liable for damages under state law.

I never found the fascination with Disintegration either TBH. Thought it was dull and plodding, but I suppose that was the current zeitgeist he managed to tap. Much preferred the debut up to Head On The Door. Kiss Me x3 probably would have been better with some judicious editing. Losing Tol was a bigger blow than I'm sure Robert is willing to admit.

The military is the outlier though. Whole different world. They are as a matter of course denying all exemption requests. Absolute insanity but no recourse whatsoever for servicemembers. The problem with this is that the defendant is supposed to reside, do business, or otherwise be located in the main within the District that court is presiding over the plaintiff's request for a TRO or injunction. This is why Justice Thomas complained about nationwide injunctions - it defeats the whole concept of the Federal District court system.

Even 5 star classics don't necessarily have solid front to back winners. And of course, it's all subjective. You can be groundbreaking and still have some duff songs. One reason I'm glad to see a lot of artists going back to approx. 40 minute format instead of trying to fill a CD just because they can. Some of the best albums ever were between 30-40 minutes.

I'd really never heard of myocarditis before Covid. But I find it kind of funny that pre-vaccine, the Branch Covidians were all saying that Covid is not just killing old people (When it clearly was just killing old people) but that it was also striking down perfectly healthy young athletes by giving them myocarditis.
Now, post-vaccine, when some studies and anecdotes come out about vaccinated athletes and myocarditis, the Branch Covidians are all saying that myocarditis is not a big deal, and in fact, might not exist at all.

They ditched the synth-heavy stuff after Presto in 1989. From Roll the Bones through Clockwork Angels (6 albums) they returned to their late 70s form for the most part. Their final 2 albums are outstanding.

Peart's family tragedies were in the late 90s -- before they released Vapor Trails.

Gave her no real directions at all, and she decided "ok this first time I'll just go totally over the top, and then they can tell me what they really want." So she did the first take that way, and asked "okay now how do you really want me to do it?"

And she was shocked when they said "oh no, we think that was exactly what we were looking for! No need to do it again!"

Wolfus, you did fine at resistance but you were pragmatic about it. Best not to be a martyr if one can avoid it.

In my case, I took the J&J one shot before the whole vaxx mandate and side effects blew up. Had a pretty bad reaction similar to when I had Covid prior to that and of a similar type. Given I have long standing autoimmune issues, still self doubt whether I did the right thing but my job required at the time being around a lot of people.

Probably the fact that I have to take a lot of anti inflammatories for my condition prevented hospitalization when I had covid and lightened the side effects from the vaxx. Won't take a booster obviously.

Totes agree. That album was half luck, and there's an example. She totally saved that - the song without her would have been meh at best. DSOTM is a perfect album, they were never that on-point and concise again.

Most of them were already facing big lawsuits over Covid from the families of employees who died in the initial Covid surge. Whether the businesses actually thought the vaccine was working, or just cynically wanted to look like they are following the latest and greatest "science," the vaccine mandates became part of their defense in those suits.

I'm a YUGE Moodies fan, but not sure I'd put that one on the list. OM is a bit too-too, but Mike was always borderline. I've listed/reviewed Threshold of a Dream as a 5-star on Allmusic, any songs that almost crash and burn (Mike again) are saved by fantastic arrangements.

I tried, I really did. I own most up to Permanent waves. Saw them on Farewell to Kings. Could never move past Geddy's vocals - although he did calm down a bit as they moved into the new wave period. Oh well, more for the rest of you guys.

Same as lawmakers, the only peer group that most executives care about is their own. They literally have very little skin in the game which is the fault of corporate capitalism.

Exactly. I am not putting my future in the hands of a court system which is completely unreliable and mostly woke and left-wing. Especially since if I fought this, I'd likely be fired and then unemployed and trying to get a new job in an industry where every business will require "vaccination".

So knowing that, I submitted my "religious exemption" and will wait to find out if it is accepted and will then submit to weekly testing. It's bullshit, but this is the new normal. If I had any hope left that there were thousands of others like me who were willing to quit and force the company's hand to get this shit ended, I'd join them. But I have no hope left about anything. I see the reality for what it is.

I was sad that I didn't get to see them until 1978, and even then people were "they're still together?". My first taste of music beyond the Beatles was a friend's big sister listening to Threshold of a Dream - parts of which I hated as a 14 year old.

The last time I saw the Moodies it was just the 3 by then, I think it was around 2011. It was March and absolutely freezing at the Saratoga Winery. It was Graeme's 70th birthday, he danced a jig. Justin could still hit the notes for Tuesday afternoon just fine. Clean living I suppose. And in CA I'm not sure I've ever attended a show where pot wasn't everywhere.

One beauty of the Anthology series is that people who claimed Pete Best was unfairly fired were served solid audio evidence that he was a shit drummer with one trick (some sort of roll) up his sleeve.

But, as a Beatles bio once pointed out - and, I thought, very accurately - until they were signed to EMI, the Beatles were essentially a 50s cover band. Had Ringo not come along, they might well have stayed small-time and not launched the British Invasion.

The administration was counting on people soul searching over whether they'd risk their livelihood over getting the jab. It's entirely understandable. They expected a court challenge, so they set a relatively aggressive deadline (especially if the mandate is to be "fully" vaccinated, two weeks past 2nd dose).

I got jabbed back in April & May, thinking it was a ticket back to something like normalcy. About a month later, mask mandates at the office were back in place thanks to new CDC "guidance" (i.e, after "fully vaccinated" people kept testing positive).

458 I've been pointing out since day one of his announcement that if the gov't suddenly levies a new requirement on contract employees, in order to remain working on the contract, that new requirement requires a justification for each and every individual contract (IOW, if your contractors are working from home, you would have to say, "sorry, but that won't apply" - it can't be just a blanket thing that applies to EVERYONE), and it requires the gov't to cough up funding and work time to achieve the requirement. Which it has to then write into EVERY STINKING CONTRACT. I was there when they imposed Security+ on contractors, and it took a while because they had to justify everything, then put it in writing, then cough up more money for the contract.
