Gilbert-Lowry responded by banning Lohr from all women’s soccer home games for the remainder of the year, citing “last Sunday’s actions and your continued level of disrespect to me.”

NEW YORK, Dec 7 (Reuters) - Starbucks Corp (SBUX.O) on Tuesday lost its bid with the National Labor Relations Board (NLRB) to delay a union election at three of the coffee chain's locations in Buffalo, New York. Workers received ballots in the mail in November and began sending them in. The NLRB will count them up on Thursday, but the company had tried to delay the tally with its objection to parts of the election process. The NLRB decision means that a vote count will go forward.
A German court convicted a 67-year-old electrician of aggravated, dangerous and simple assault for removing the testicles of several men at their request, causing one person to die, the dpa news agency has reported. A Munich regional court sentenced the man to eight years and six months in prison. The defendant, whose name was not released for privacy reasons, had initially also been charged with murder by omission but prosecutors later dropped that charge. The defendant had admitted during the trial to offering “castrations” on sado-masochistic websites and said several men paid him money for torturing them and removing their testicles, dpa reported.

One night a few years ago I was driving in a residential neighborhood along Lake Michigan. It was misty out, looked like it would look in a cheap horror movie. Someone who'd seen the movie wrote that Zhukov's character made a certain amount of sense. He'd been out of the capitol for quite some time, and Stalin only called him back to Moscow shortly before Stalin's death. As a result, he hadn't had to constantly worry about an inadvertent comment that might get him on Stalin's hit list. So that, coupled with his status as the hero who saved the Soviet Union in the Great Patriotic War, would have meant that he was the only one of the cast who hadn't spent the last several years jumping at his own shadow.

Not an option. The worst you could give was "poor". Got the book from my late father in law, George Conklin, Marine AWSC-8, all across the pacific until a final six months on Okinawa until 1946. My uncle Elmer Glidden Marine Pilot in the pacific, and my still anon father Army motor pool in the Alutens, months in a field hospital.
No military historian by any means, but Pacific action interests me.

Jamaica is a little sad off-resort, and iffy, but some of the resorts there are very nice! just ... stay on them.
since I like to be able to freely move about islands I visit, I REALLY like Aruba. if you haven't been, it's honestly one of the best Caribbean islands to visit! so lovely, tons to do, great resorts, great beaches, and above all else - GREAT PEOPLE! very safe! I would so move there.

He refused to comply with a lawful subpoena to appear before Congress - they do have the power to compel you comply because they are invoking the will of the people of the United States to hear witnesses in matters before Congressional committees. He could have just invoked his 5th amendment rights, and there is nothing that Congress can do at that point.
Instead, he's being shrewd. He's making them present the evidence they are using to issue this subpoena, and they are compelled by law to present it to him, in full. They don't want to, so they are trying to get the right to see the evidence compelling testimony squashed. I think they lose under the 4th amendment. But whether he can "publicly" publish that evidence is a different story, which is what he wants - we'll see...

I've had to shoo them off a highway once. Friends live about 20 miles from me and had maybe 80-100 elk cross the road in front of their car a few days ago.

We did get to go to Pearl Harbor in August 2019. Unfortunately, the Arizona was closed at the time so we could only take a boat ride by it. Still spent two days at the museum. Love the story of Dorie Miller!

The SCOTUS held that the Congress can indeed conscript or raise an army in conjunction with declaring war, without regard to CONSENT by American citizens, and in the manner or criteria as so proscribed by Congress, to defend the United States of America. I happen to think this ruling was wrongly held with regards to compelling service. Nothing in the Constitution compels service in the military to fight and serve in any war. But under certain restrictions, I can get behind an amendment to the Constitution that compels service.
But nothing in the Constitution compels compliance to healthcare. The one lone Constitutional case suggested that incurring a small fine was not the act of compelling (Small Pox).

Funny you should mention that. There was a Lustron built right next to my Grandparents. He hated it, called it "that goddamned tin house". I'm not sure he was trying to be funny or not. It was initially a vacant lot in 1930s suburbia, and he and the other property owner discussed purchasing it so as to have a common area for kids to play and whatnot. Then one day after the war a flatbed trailer had been parked in front of the lot. What could it be? Yeah.
The damned tin house. The guy that built it was tighter than bark on a tree. He didn't have fire insurance, "what could catch fire?" Not sure that's a good idea. He was so cheap he wouldn't subscribe to the newspaper, and just read gramps paper when he was done with it. Eventually they became good friends.

I did the stingray thing not the town. My wife wanted to do it in memory of Steve. So we get out there and the stingrays are like big floating puppy dogs but my wife is freaking out. I'm trying to get more squid out of a bucket to feed them, I hear a scream and look back to my wife who's trying to ascend to the peak of a nice old Jewish lady's back. So I get back there and try to get a picture of her feeding one of the things but every time they sweep in she panics, the rays are like nom nom nom, ... aaaawww. But that was fun for me at least. The rays are pretty cool

I do a fair bit of hiking. I've encountere3d cougars three times, black bears twice. Badger, once, but it had also been very recently killed by a cougar.
They are shy around people.
Saw two grey wolves crossing a highway last year. Deer come into town here and wander around. Elk stay further away but they are everywhere. A rancher here raises buffalo for the meat and hides.
Most of the critters are alert but I agree, deer are dumb as stumps.

Don't want to get into a huge discussion of police powers but generally speaking the federal government, unlike states, does not have plenary police powers to regulate for health, safety, and welfare of people. Those plenary police powers are reserved for the states from the 10th amendment. Instead, most of Congressional police power comes from the commerce clause and the difficult argument then becomes whether a sufficient nexus has been made between interstate commerce and the federal action proposed. NFIB v. Sebelius 7-2 majority put a lid on commerce clause power by adopting Randy Barnette's argument that making people engage in commerce was beyond Congressional power. But, then the 5-4 majority upheld the tax mandate as valid. Under that understanding, Congress could nominally tax you for not being vaxxed but not mandate a vax for you. Unclear about whether states could do the same as Jacobson predated right to privacy which includes the right to die.

I think any honest reading of the Constitution (which the 5th Circuit did a while back re the OSHA mandates) determines the federal govt. has no power to compel vaccination (save for maybe immigration laws and that sort of thing) of the populace.
As has been noted, state govts are another matter. There's been a lot of other, contrary court decisions (any honest reading of consistency and logic) since that smallpox case, so there is a question there.
We're probably going to end going down that road, I'm afraid and we'll find out what SCOTUS says.

The idea that a nominal fine is in and of itself, not compulsion, is what the SCOTUS rests on in a great deal of these cases - they've even looked the other way on the 2nd amendment on this. Thus, I can see the current SCOTUS suggesting that a nominal fee for non-compliance as an 'emit ius' or a purchased right - even though that concept is unconstitutional in and of itself.
If not listed or specifically mentioned in the Constitution, then the States may institute such laws to govern their citizen - to allow the commerce clause to negate idividual or state rights by the SCOTUS (Wickert vs Filburn) is an unconstitutional means to get around this troublesome amendment.

I taught scuba and snorkeling and did commercial diving in the Caribbean and was around sharks all the time. I'd feel safer doing a night dive in San Juan harbor than waking the streets of Old San Juan after dark.

That was how I did it.i'm not a particularly strong swimmer. I went on 4 cruises and snorkeling was the main reason I went. One time I did something called Snuba or Skorkel where your snorkel was attached to a 20 foot hose that went to an air tank that floated on the water. You could go down twenty feet and breathe just like with a snorkel. There had been a 30 minute lesson before they took you out. It was easy and you could see things like seahorses, urchins, and starfish that were on the bottom.

I just got RFK, Jr's new book "The Real Anthony Fauci" yesterday. I can highly recommend it. You can open the book at random and find pages and pages of endnotes after each chapter.
At the beginning, he dedicates the book to a long list of scientists and physicians who helped him. Robert Malone and Vanden Bossche are #2 and #3 on that list, behind Dr. Harvey Risch.

I'm glad I served, I met a lot of good people, and even enjoyed it most of the time (+ I looked spiffy in summer weight BDUs), but I'm also glad I got out without any negative consequences.

That sounds cool. The only option I've seen are these diving suits, really miniature diving bells that are over your upper half and have windows in the helmet to look out. Those excursions are always way more expensive and look too complex to have fun. But just you floating is real peaceful and relaxing though. I could probably sleep that way. I can see the coral and spidery things walking around on the bottom but it would be nice to get closer.

Not exactly on the top of my to do list but I've spent a fair amount of my life on, in and under the water and been around a lot sea creatures with sharp teeth and the truth is 99% of the time they want nothing to do with us.
I'm not kidding when I say I would rather do a night dive in San Juan Harbor that is full of sharks thanks to all the fishing boats cleaning their catch and dumping the unwanted parts overboard than I would want to be walking in Chicago or NYC or Baltimore or any other America big city after dark. Sharks and other sea creatures are pretty predictable. Humans not so much.

The reason for the blindness on the US side wasn't tactical. It was logistics. Pulling off the raid required not being detected, which is why the IJN went via the Aleutians. But it also required logistics that the US just didn't think the IJN could pull off. As far as the US was concerned, the IJN might as well have been aiming for the West Coast. Both were believed to be out of reach.
As it turned out, the Americans were wrong about the Japanese being able to reach Hawaii. But from what I understand, the Japanese even being able to get their ships in range of the harbor was a very near thing, and was at pretty much the utmost limits of their capabilities.

That's so sweet. My friend just told me her daughter was driving over the pass before thanksgiving to catch a flight in Goleta and she hit a turkey. It messed up her car something awful. It was a very traumatic time. I am friends with farmers families that were put in an internment camp. They all had their land returned after the war. The white farmers took care of their ranches and returned them to the Japanese families when they returned. The grandchildren and great grandchildren are running the farms to this day. They are patriotic Americans and I don't know what to say about it. I couldn't imagine what they went through.

When the Zeros swoop down to strafe the P-40s and one of the P-40s is rolling then the wing lifts up, it veers into the other parked P-40s, and the guys go running for their lives.
That was not planned. The vortex generated by the low flying Zero caused the lightweight replica P-40's wing to lift, it was remote controlled and motorized plus rigged with a charge. And when it went out of control everybody started running for their lives.
They kept it in the movie because it was so dramatic.

, I only flew in the carrier scenes and formation shots. I have a couple page write up which I am putting the mail to you and it tells the story or at least my involvement. Side numbers on the Kate I flew are 314 316, 317 and 318. Did the only carrier landing that appears in the movie in K-318. It was only a touch and go not an arrested landing as the Navy would not allow that.

Your history books are mostly correct. There is though, a bit of grey area in German Heritage settlers, Citizens, who were caught up in the nets. Some rural, some urban. But pretty much on-par with the Japanese internments, out West. Hoover's FBI then, was about as much to integrity, as the Trump Era FBI was, now.

It was a Friday night and the bar I was working at was fairly new. A member of the local beer board that controls the beer permits came in to "check the place out".
A band was playing and a customer sitting in the booth adjacent to the beer board member's table kept yelling for the band. The board lady got pinch-faced and came and told me I needed to "do something about that man."
I eventually had to ask him to leave, even though I had no problem with him, in order to appease her. I still regret that.
I think if that happened these days I'd tell her that there is a band playing and people are going to have fun. If she didn't accept that, I'd grab her by her dyke hair cut and shove her face in the public restroom and give her a swirlie.

The Schwarzschild black hole analogy is pretty good, and paints a pretty cool picture. Gravity does wild things with space and time, as Uncle Al Einstein figured out. This is but a "coordinate dependent description" (the real physics doesn't depend on any such global coordinate system imposed).
Inside the black hole, space and time get flipped. The radial direction is time and time is the radial direction. Inside, the singularity is now "time like" meaning it exists in the future (of everyone who falls inside) and not a position in space one can point at.

The surprise was twofold: The specific date and the fact it was 'merely' a raid. Army and Navy were preparing for an expected invasion in the spring. The first of three shiploads of medical supplies actually left San Francisco on Dec. 6.
They knew large numbers of Japanese Infantry had been pulled from China and shipped South; but also knew there was no way troop transports could cross Pacific in Winter. The troops in the Islands were always on some level of alert for signs of invasion.
Towards that end ... over 25 yrs. ago Nat'l Geographic got permission to dive and photo the Arizona. They found the portholes closed and locked. That was never done while docked but were left open to 'air out' the between decks. There for damn sure wasn't time to close and lock them once the attack began.

With bankruptcy courts, an informed outside power decides how to revive or sell the current assets. Do we just let it all collapse, or renegotiate or even cancel "unfair debts".
Many WW2 debts and more since were just cancelled. Way back in high school my friends and I would joke about "the debt is cancelled". imo all Western Gov's should cancel all China related debt, or actually, take that debt as partial payment for their global plandemic. That would be a good start ... also take Mitch/Biden/Pelosi et al assets they acquired via China treason.

This is to avoid the unfortunate depredations against said aliens that occur, with some regularity, under those conditions.
A significant % of those ethnic Japanese interned after Pearl Harbor were either subjects of Imperial Japan, or dual nationals. Or in families with one or both of those situations. Geneva requirements were not the primary motivation for removals, but the Geneva rationale was vindicated (even the Manzanar museum lets slip some direct testimony by interned Japanese-Americans that they felt safer in camp than at home after 12/7/41).
The primary rationale for internment was espionage/sabotage fears, which while they proved unfounded, were not based on blind fear or imaginary threats.

Highly recommend a UToob video documentary on a German POW camp, at Concordia, KS (you can look it up using those words). Pretty classic and fairly typical. Once the hard-asses were separated, prisoners had nice quiet lives and often became friends or surrogate sons for local families, several post-war marriages resulted.

I was reading over Ace's earlier thread about Yosemite Alec Baldwin, and his possible criminal culpability there. Specifically, the "depraved heart" thing. While that is interesting and fun to think about, that is a bridge to far, along with "felony murder". The equivalent of involuntary manslaughter is about as far as you can go there -- I think that case could be made, and they should try it.
That got me interested in this "depraved heart" business. Some states will call that 2nd degree Murder. Other states different things.
Here in SC, there are no different degrees of murder. There's just murder. Criminal homicide falls under two categories, murder and manslaughter, the latter divided into voluntary and involuntary.
Voluntary manslaughter is sort of, say Cletus and Bubba are in a bar, and Cletus calls Bubba's mama a whore, and Bubba starts whupping his ass. Cletus ends up dead after Bubba knocked his head against the wall or something. That's usually what ends up as voluntary manslaughter. Not murder. Bubba didn't intend to murder Cletus, but he was provoked into a rage, and ended up killin' Cletus.

One little-known - and it seems, assiduously unexamined - similar action in WWII was removal of Italian-Americans from "strategic" port locations, such as Fisherman's Wharf and San Diego's Little Italy. Very difficult to find solid info on it. No internment, just exclusion areas.

I had a "great-uncle" (heavy German heritage) that fought in WW1, and a few that fought (all for USA) in WW2 ... the Midwest has a lot of old German heritage settled from the 1800s. I never heard of any being questioned over American loyalty. They largely escaped being cannon fodder for the kaiser, or whoever was using the proles as slaves at the time.

My town is actually made up of 3 islands, only one of which is still occupied. The Navy still has a part of of one and the other is completely unoccupied but the town and the state are talking about turning it into a state park.
That island was also a German POW camp in WWII. The last German U-boat was sunk not to far from here just off the coast. It doesn't get talked about much now but the war wasn't really that far away.

Luciano was an avid pro-Allied sort (ah, an America where even the mobsters could be patriotic), and his control of the docks ensured the Axis stuff was snuffed out. Luciano even volunteered to parachute into Sicily as part of Operation Husky, to help, with, ya know, um, local connections.
US declined the offer, but Luciano provided specific connections in some areas that in fact were used by arriving American forces (locals nicely pointed out all the German positions and other intel).

I've told this story several times, but a neighbor who moved in the area after he retired was a German immigrant. He was a POW in a camp in Georgia after his U-boat was sunk. He liked things so much here, that after he was repatriated, he immediately started working on getting back here, and succeeded.
Basically, the POWs were well-fed and taken care of, and loved it. He got to work on local farms, and just loved the hospitality. Nobody tried to escape, and even ratted out any gung-ho true believer types who might've fucked up the good thing they had going.
German officers got the VIP treatment. They'd take them into town for Sunday dinner. Some of that "S'mo pie, sugar?" worked magic on them.

Had a gf whose mother grew up on a ranch in the area (north of Goleta). She told me the sheriff came around to all the ranches, told them to black out their windows, and the local men set up check-points on some roads, with their shotguns.
It was also the major reason for the panic and "Battle of Los Angeles" two days later, in which panicky anti-aircraft crews lit up the sky over LA in response to phantom attackers.
There's a book, title escapes me now, about another contributing factor to the LA festivities. A flight of anti-submarine aircraft from the east coast was coming into LA, and it is believed this was misinterpreted. Interesting little book. It's mostly about the pilot and his eventual sinking of a U-boat off North Carolina, and his eventual friendship with the surviving U-boat commander.

I disagree because the paradigmatic difference between compulsion by tax (Obamacare) and *this* (non)-vax mandate is that what you are being compelled to take/do is harmful. Being forced to take an experimental drug that is causing all kinds of problems -- being kept on the downlow by the Gubmint-Media Complex -- runs into all kinds of substantive and procedural due process problems. There's certainly no rational basis to compel someone to take an experimental mRNA treatment that does not prevent infection and actually makes things worse.

I thought there was internment for some German-Americans and Italian-Americans. Not sure what the qualifications were, but some were interned.

As publius notes, in general a German POW's life here was quite nice. Farm labor, usually. Small towns, nice people, they often became part of the community.
The Camp Windsor story (Sonoma County) was that 2 young POWs "escaped" (i.e., disappeared). Quite the ruckus and concern in the area, sheriffs out, I think posses looking, etc.
Found them on the beach (not sure, assuming near Jenner at the mouth of the Russian River), just relaxing. That was their objective - to see the Pacific. Pretty good "duty" for a member of the German military in WWII.

That German POW was named "Konrad". He was a hoot. Anyway, he told the story of his capture, after their U-boat was defeated. They were taken onboard an American ship. They were scared to death. Then he watched as his captain was *piped aboard* the American ship, will full honors.
All our guys snapped a salute to the German captain, as he walked aboard, defeated, and the last man to leave his doomed ship. He walked straight up to the American captain, delivered a smart salute, clicking his heel. The American captain retuned that salutue, clicking his heels in return. They shook hands.
The German captain then asked for permission to address his men, which was granted. He told them something to the effect of, men, you have served the fatherland well and I'm proud to have commanded you. The war is now over for you. Do what the Americans say, and you will be treated well, the American captain has given me his word of honor.
The American captain then escorted the German captain below deck. And they did just what their captain told them, and they were treated well.

Of course in the case of Japan, ethnicity was seen as, and largely was, coterminous with nationality, which was the whole problem - or at least the basis for the concern.
If there were any actual "ethnic" basis to it all, the US wouldn't have almost immediately started recruiting from the relocation camps (including for vital and sensitive things like the intel school in MN). Also, there would have been no "loyalty oath" issue. If swearing an oath could change your status (and it could and did), then ..... ethnicity wasn't really the issue.

A German guy named Klaus had a German restaurant in Irmo, SC.
Met his younger brother there, possibly the youngest (survivor) U-Boat captain of WWII. In the last days of the war, at the age of about 19, he beached his boat to save his men.

Niven was I believe a liaison officer at that time, and was traveling to connect with an American commander on the northern "shoulder" of the Bulge. The Skorzeny sabotage teams had created great paranoia and extra precautions among the American forces.
Niven was stopped at a checkpoint and asked to name the winner of the 1940 World Series.
His alleged answer: "I haven't the faintest idea, but I do know that I made a picture with Ginger Rogers in 1938".
If true, surely the best version of the "do you know who I am???" thing on record.
