"QAnon Shaman" Sentenced to Nearly Four Years in Jail -- For... Trespassing

They also claim he "obstructed" the functioning of Congress -- a charge that has never before been laid against any protester disrupting a congressional vote or hearing.

And he "obstructed" Congress for like, what, an hour and a half?

Non-violently, of course.

Though they're apparently charging him with... other people's violence.

Because he made himself "emblematic" of the whole event, by being a striking, photogenic person that the media loved putting on the front page.

While most antifa who attacked people at the RNC weren't even charged, and those who were charged were sentenced to time served.

He's been rotting in solitary confinement for 10 months. And now he'll spend 31 months more in jail.

For... "parading in a public place."

The sentence matches one imposed by a judge on a former mixed martial artist Scott Fairlamb, who was filmed punching a police officer during violence, who was sentenced last week to 41 months in prison.

Parading is just as bad as punching a cop.

And also, no antifa or BLM "peaceful protesters" punched a cop.

Lamberth said he believed Chansley, who made a lengthy speech before he was sentenced, had done a lot to convince the court he is 'on the right track.'

Chansley's attorneys asked the judge for a sentence of time served for their client, who has been detained since his January arrest. He appeared in court in a dark green prison jumpsuit, with a beard and shaved head.

'He made himself the image of the riot, didn't he?' Lamberth said to Chansley's lawyers. 'For good or bad, he made himself the very image of this whole event.'

"Making yourself the image of the event" is now a crime, or an intensifier to the crime of parading. In the first degree.

You might think, "Well, they have to punish a violent offender, right?"

Nope. Cheney committed no violent acts. Not even charged with any violence.

He was there supporting, encouraging and advancing that violence. He any everyone else in the masses of fellow travelers should be punished to the fullest possible extent of the law. The only miscarriage of justice here is that so many participants will walk away free.

I thought that the folks who brought you WWII put on an excellent case. The woman had been driving on the wrong side of the road while looking into the rear view mirror applying her make up. The jury was out longer than I expected when they sent out a question concerning the mechanics of calculating punative damages. I was young and not totally beaten by life into cynicism as I am now so I was outraged that the plaintiff was going to collect on such a flimsy suit. The Toyota samurai saw the writing on the wall and settled. When the judge told the jury that their services were no longer required, they were outraged because they were going to find for the Rising Sun. They sent the punative damages question out just because they were curious.

Yep, there was tons of photographic evidence of this guy attending BLM/antifa rallies for a solid 2 years. Even without the ridiculous makeup, the tats were a giveaway. But, just like all the video evidence we have of 1/6, it's all ignored or discarded. Why and how did he manage to get placed up front and the media was ready for him at every turn? Whoops, sorry. And of course there's the video of him calmly discussing things with Cap Police, and then exhorting his colleagues to behave, or something, as I recall.

I still have no real idea what happened that day, I mean, the relevant parts of what happened. There was some violence, and lots of idiocy. Involving a small number of the protesters (it wasn't hundreds or thousands going into the Senate chamber).

I do know from years in the building that the Cap Police were idiots to allow any entry of any kind - simplest thing in the world to seal off that building. But the Cap Police being incompetent is not news to anyone familiar with the place.

The video was sent to the state via a phone-to-phone Apple technology that only works between iPhones. They sent it to the defense via E-Mail per defense request. They are asserting that the receiving device compressed the file and that the difference is the defense's fault.

I am not 100% certain, but I seriously doubt this. The sender likely compressed the file to cram it into an E-Mail or to save bandwidth. This might have happened transparently, but am not sure. The typical flow of this kind of operation would be "compress-then-send" not "receive-then-compress" because the receiver wouldn't need to do so.

This is maddening. These people use high-tech evidence all the time, have no knowledge or mastery of it, and let people's lives hang in the fucking balance while they engage in cargo-cult button mashing in what is essentially deference to magic.

One six ounce sirloin later, along with garlic smashed 'taters and a side of steamed broccoli, well, I only left one tiny bit of broccoli on the plate in surrender. They put a plate of good food down in front of me, for free. And I was appreciative. Tipped the waiter a $20 for the excellent service. Store in Pasadena, TX. Clean, well run and good food. Not "great". But certainly, good.

I have a hard time believing any of these video files were viewed/transferred using anything but a PC. He's already saying thumb drive. You literally have to open the file and save it off as some other format/resolution. You can alter the compression algorithm accidentally, but you can't lower the resolution by simply transferring the file.

The file itself will say when/how it was last saved. This is making my brain hurt.

No, not at all. If there is a full-resolution video file added as an E-Mail attachment, it might well get compressed prior to transmission. There a bunch of possible reasons for this - attachment size limits on the sending E-Mail service, bandwidth management settings on the phone, etc. Lots of possibilities for the phone to very helpfully recompress the file to get it out the door.

And this is why you shouldn't be throwing digital evidence around willy-nilly without a forensic record or chain of custody that guarantees that you didn't degrade or otherwise fuck up the evidence.

This is totally astounding. At every level. It's unreal that they treat digital evidence this way.

It's all about smoke on the water right now, in hopes of obscuring the truth. The judge has a serious problem, and needs an immediate hearing. How trustworthy is any of this video evidence? Where did it come from? Why did the prosecution not give it to the defense? How can the jury see this stuff again? Oh my lord, Rittenhouse is on the line here!

HLN is straight up propaganda on that case. They have a commercial encouraging you to watch the trial, showing a camera slowly going down a nice, suburban tree-lined street, then cut to three mug shots of redneck white men. Oh, they never say "poor black kid lynched by MAGAT white motherfuckers," but that is certainly the impression you would get as a casual viewer.

The media of any stripe needs to die.

Wrong. If an attachment exceeds max size, you get a failed send not an automatic compression.

I've said it a zillion times. The Judge needs to order the Jury to deliver a Directed Verdict of Not Guilty, vs. "mistrial w/ prejudice". Mis w/P is appealable by the State. A Jury Verdict is NOT, and takes Double Jeopardy off the table, safe for Fed Civil Rights charges, which will surely follow.

407 I'm binge-rewatching The Wire right now and last night I watched one of the early episodes where the cops are standing around a dead body bitching about crime lab guys not showing up because they're tied up at a city councilman's house doing a full forensic because someone stole his lawn mower or some such thing.

The Wire is hard to watch for this reason, but its one of the most painfully accurate depictions of corruption and abuse of power ever put on film.

In a prior life worked on the streets of Baltimore. Several seasons after it was initially on HBO I binged watch The Wire.
Fwiw if I'd worn a microphone and a GoPro camera while investigating crime in Baltimore.....The Wire IS reality. A faithful and accurate depiction of life on the street, as well as the media, education and government morass in Baltimore . To me The Wire is as much documentary as it is a dramatic HBO series.

Nobody should still be prisoner, held in solitary, without any clear path to trial, over what happened.

416 Something I'm amazed at them getting away with is the House taking away committee membership of Republicans. I always thought that the majority got to chair the committees and had the majority of members on the committee. And that the other party chose who those members would be and the other party could not say anything about it.

Now I come to find out that the House can control what members of the minority party serve on committees. I can't recall in 50 years of ever hearing that happen until lately.

I wish the GOP had some balls because if they get the majority they should immediately start kicking people off the committees.

Sadly the won't because they're gutless. Which is why they're not getting any vote from me. I'll vote for local folks I know for the state legislature and such but national elections? Forget it.

While Trump might not have been the one laying the traps, he organized the event to bring his supporters into the waiting arms of those who were setting the traps.

There is no chance that he did not see this coming a mile away. Which is why he did not go with the crowd to the Capitol Building as he planned to do. He knew they were being set up, that they were being entrapped, and 14 days later, holding the power of the pardon, he left office leaving these people in legal jeopardy.

Want to know why I voted for him in 2020 and will not vote for him in 2024, this was the final straw, among a mountain of them, that convinced me that Trump is not the man for the job.
