We are all slowly waking up to the fact that this has been a huge mistake on our part, perhaps one of the biggest mistakes we've made. (although giving up the Education Establishment might be even bigger)A lot of this is our fault. Because back in the day, our parents watched news footage of hippies throwing rocks at buildings and Black Panthers walking up and down carrying weapons and thought "oh no, we can't have this" and voted for every "law and order" bill that was placed before them. Pansy-ass liberal judges who let dangerous felons walk also contributed to this reaction. This resulted in longer prison sentences and mandatory prison sentences, and "three strikes" laws. And created a new breed of hyper-aggressive prosecutor who will go to any length to put somebody behind bars And we helped create the post-legal environment we're now complaining about. Don't let the Wisconsin prosecutor's description of Rittenhouse's shooting casualties as "heroes" fool you. Thomas Binger is as much our creation as he is the left's. Put another way, we played a big role in creating the weapons the left is now using against us. We didn't notice that these new measures were giving more and more power to government officials along increasing danger of potential abuse. We also should have heeding the warnings about the PATRIOT Act, but 9/11 was still a raw memory and we were in no mood to listen to objections. We never thought that someone would ever say "Terrorists, you say? Hey, then this would apply to domestic terrorists, too, wouldn't it?" No, I haven't forgotten the War on Drugs. It's very much like the War on Terror: ill-conceived, never-ending, expensive, and ultimately futile. Time was that the right was all about law and order and the left about civil rights. It's funny how we seemed to have switched places. This is a fact I have become keenly aware of lately. Heard some climate expert (alleged) interviewed on NPR who was saying that according to his models, for every 1.5 degrees the earth's temp's rises *1 billion* people will have to move/be displaced. This was based on migration and extinction of other animals. Does that make any sense even at face value?! The average temperatures in a given location vary by more that from year to year, right? All I could think of was that Brit scholar whose models said we'd have millions die in the first few months of covid -- and then that didn't happen, and there's been no accountability for the lives ruined, fortunes lost thanks to his crappy "modeled" predictions. This is correct as far as it goes. Once we tackle this one, our next subject will be looking at our support of the Military-Industrial Complex. To have the rank-and-file serve our country so admirably yet have its leadership so utterly fail us needs to be assessed as well. I've always said that it's important to at least look at the arguments from the Left and not dismiss them out of hand because of the source. They will see blind spots that we just can't. Every government program or agency is eventually weaponized by the left while the right is asleep at the wheel. No exceptions to this rule. The right does what it thinks is right, takes the win when it can, and then goes on about its business of living life. The left has no life other than being left and marching ever leftward to destroy and corrupt everything it touches. That is the left's sole purpose; it's entire reason for being. They don't feel pity or remorse. They absolutely will not stop, ever, until we are dead. To this day the right does not understand this because it's so alien to them.

I agree that we've gone too far to authoritarianism in the name of law and order, and this places us in a situation of needing to not throw out the baby with the bathwater.
Reflexively going too far in the other direction will give Democrat social saboteurs exactly what they want - defunded police departments, and felons able to rampage with impunity. What we need to do is start pushing police and justice reform with an eye towards accountability, reining in or dismissing overzealous prosecutors, getting better public defenders, and increasing privacy protections for jurors. Let's make it a civil rights based crusade, to better protect the innocent from overzealous prosecutors, and ensure that everyone has a fair day in court. While we're at it, let's put more emphasis on the right to a speedy trial also. There's no reason why someone should wait more than six months (which should be the outlier on the long end) from the time of the crime to the time of their trial. The prosecution's argument is that if not for that act, Rosenbaum wouldn't have chased. If not for shooting Rosenbaum, Huber, Jumpkick Man, and Grosskreutz wouldn't have tried to subdue Kyle. If the defense had the high resolution video, they could have had their expert examine it to rebut this theory. Too many laws, and a deliberately uneven application that allows them to nearly always find *something* they can charge you with, if the system decides it doesn't like you or you've offended the Important People.

In terms of precedent, the only good thing that can come out of the Rittenhouse trial is the prosecutors' disbarment.

We're still very much a Common Law system. Look how powerful the Supreme Court is. If anything, "laws" based on a history of court decisions tend to be relatively opaque and ambiguous.

To be fair, it really doesn't matter what laws are on the books if you have bad actors in charge.
I don't think the "law and order" movement has anything at all to do with Rittenhouse being dragged into court while the real criminals are hailed as heroes. I might disagree, in that for criminal matters you need a criminal lawyer--it's like hiring a pediatrician to do surgery, everyone has specialties. Criminal cases have a language all their own. And it helps enormously to hire a known defense lawyer from that particular area--the criminal bar all know each other. I'm not above coining a new phrase every now and then - or re-using an old one. I'm a big, big fan of National Populist - which is where I think a portion of us is going. Social Republican is my attempt to describe the bulk of Republicans I worked with, right after 9/11. They identified, hard, with the GOP. But they were for anything other than individual rights. And they were four-square behind the Patriot Act because - "9/11". When asked questions like "what in the Hell do you think a Clinton would do with these powers" they'd just ree as hard as any damn Liberal. Their political philosophy was about as deep as my pecker is long - so not very. Mostly Boomers. Pt. 1 One thing to keep in mind on any institutions, they are man made and therefore susceptible to human corruption. Marriage for example is an institution that depending on the individuals involved, and the end result can be heaven, hell, or something in between over the years. Police--depends on the individuals involved, Churches and synagogues, same, government bureaucrats, same.
One person is not the institution even though the institution is made up of multiple persons. In pure libertarianism, all institutions more or less repress human potential. In pure totalitarianism, good is only possible by everyone being forced by institutions to think and act correctly. If everyone thinks and acts correctly then nirvana is reached more or less in Roussean terms as people are literally unable to think bad thoughts or want to commit bad acts so the leadership is simply a benign enlightened ruler (Borg queen). In democracy or republics, ideally, we get to select (or select representatives) to create institutions that more or less the majority wants but to make it stable, we accept some limits of the majority via institutions. You know, all over the world there's structures and manmade artifacts stretching back centuries at the ocean's edge. In HI there's plenty of examples on most of the islands, some functioning on the tides. Strangely in a millennium, there's been no rise in sea levels. Pt2. What makes up regimes and institutions though are people and people vary on what is good, what is true, what is beauty, what is right and what is wrong. Thus, the mundane truth is that as a society, you try to reach something like utilitarianism--greatest good for the greatest number which is intellectually unsatisfying as a criteria. But, Rousseau's analysis of what is good in a regime is a pretty fair summary: A well governed nation acts to benefit its citizens by increasing wealth of its citizens individually and increasing numbers. But, Rousseau's analysis of what is good in a regime is a pretty fair summary: A well governed nation acts to benefit its citizens by increasing wealth of its citizens individually and increasing numbers. I know I'm a few days late, but I wanted to thank OregonMuse for posting this, and I couldn't find an email address to send my thanks personally.
This sort of introspective self-criticism is so desperately needed on both sides of the aisle these days, and the fact that I don't *ever* see it on the left is one of the reasons I still call myself a conservative. So thank you. I know it's just a blog post, but it meant a lot to me, because it perfectly mirrors what I've been feeling the last few years, and it's comforting to know there are other folks out there who feel the same way.
