The judge does in fact suspect that Littlefinger is trying to derail the current trial because he knows he's losing. Littlefinger is engaging in tedious questioning to establish, stupidly and falsely, that if you have your gun on a sling, it is IMPOSSIBLE that anyone can take it from you or turn it against you. He's claiming this so as to claim that Rosenbaum posed no threat. He's now talking about Full Metal Jacket rounds in order to claim that they can go through a body and injure people behind their targets, to prove recklessness. He wants to claim hollow points won't exit a body and therefore it was reckless to not use hollow points. Littlefinger now claim that FMJ rounds were designed so that when you shoot one target they will continue travelling and hit bonus targets. Yeah. That's why they were made. The judge stops him here. An expert witness called by the prosecutor to the stand could make such a claim (but wouldn't, because it's it's false and stupid), but Littlefinger has been testifying even though he's supposed to be asking questions, and the judge just stopped him and said "You've been testifying for a while now." He also pointed out that FMJ do not automatically hit bonus targets, which severely understates it. Now they break for lunch. Blago points out that no matter what bullets Kyle used, Littlefinger would have claimed they were the "wrong bullets." If he had used hollowpoints, he would have said Kyle was looking to kill people.

There are a few things that we're afraid the prosecutor will bring up, or may bring up. But given the prosecutor has overstepped himself twice -- and has been yelled at, angrily, by the judge, for his "astonishing," "brazen" misbehavior -- he might have to recalibrate whether he can bring up these touchy subjects. This is stuff that may or may not be relevant -- prior bad acts by Rittenhouse. You cannot bring up prior bad acts of a defendant to prove they acted in comportment with previous bad behavior except for in a couple of limited exceptional cases (such as if your previous bad acts constitute a "signature" which is so similar to the act you're accused of it tends to prove you did it). You can bring in bad acts to establish your state of mind was culpable. But this is treacherous ground, especially because the prosecutor has been twice warned. Does he go ahead and gamble and bring this stuff up, knowing the judge might toss the case out if he disagrees it's admissible? At the very least he'll have to ask to approach the bench and ask permission to introduce this material, instead of saying YOLO and just injecting it into the case without alerting the judge. One of MSNBC's many, many Diversity Racists is handling the day's events with the calm and equipoise with which she handled election night a week ago.
Defense is moving for mistrial with prejudice based on intentional bad-faith attempt to contrive a mistrial, because the prosecutor knows the trial is "going badly" and is "coping" by "prejudicing the defendant's ability to have a conclusive confrontation" at the current trial.
Judge wants prosecutor to brief him on what evidence he has that Kyle waived his right to the fifth amendment by speaking to the media. Littlefinger tap-dances to justify his actions. Littlefinger is suggesting that it's wrongful to put out antifa fires without being a paid Kenosha fireman. He's against Vigilante Firefighters. Sorry this is getting tedious. Littlefinger wants to establish that when Kyle was told BY ANTIFA to stay off the streets, and did not stay off the streets, he provoked them, and thus justified the attack by Rosenbaum. This is an upside-down world-- Rittenhouse is on trial for being an illegal vigilante, but Littlefinger insists that the orders of antifa street vigilantes MUST BE REPECTED AS THE LAWFUL ORDERS OF THE STATE. Littlefinger is doing the "A Few Good Men" thing. He's claiming that because Kyle said there was "no friction" with the crowd, there was no reason to carry the AR-15 to render medical aid. The real answer is: There's no such thing as perfect safety; people carry guns when they have no particular reason to fear danger. Also, what would he do with the gun? Leave it on the street? But Kyle isn't saying that. So this stupid gotcha is semi-effective, at least for Karen. The basics of Littlefinger's line of questioning is that Kyle knew the crowd was hostile and so going on the streets shows his recklessness and willfulness in Defying Antifa's Martial Law. Littlefinger is now questioning Kyle's My Cousin Vinnie-like "I shot the clerk?" statement. When someone said "You pointed a gun at me," he sarcastically said, "I did?" Littlefinger keeps calling this a lie. The Rekieta commentators are going BERSERK over the defense attorneys refusing to object as the prosecution asks for one speculative answer after another (asking what other people thought or believed). Kyle Rittenhouse is on trial for walking around without antifa's permission, similar to how the J6 defendants are on trial for "parading." Only some protesters are allowed to "parade" in federal buildings.

Yeah, I forgot that part in my first reply. Critical, basically, 'cause you're hitting five percent odds, and the d20 is usually the biggest dice on the table in terms of side number. Technically, you could get "more critical" by rolling a standard d6 twice, and needing to hit six both times, but then you're being extra stat nerdy.

Sometimes they are, sometimes they aren't. And either way, that idiot had no business blathering on about them during questioning, as he's either lying or doesn't know what he's talking about.
Regular FMJ ball rounds are the responsible projectile choice in this situation; they will overpenetrate less than softpoints or most hollow points (which in this caliber are usually open tips that are an artifact of how they draw match jackets, not for expansion), at least in people or common building materials at any range under 150-200 yards or so.

I think pretty much every guest he's got on was against putting Kyle on the stand - but that seems to be defense 101 stuff. Sure, it could have gone horribly wrong. It's even possible that they had no intention of putting him on the stand, until they saw how Binger was acting. This could have been a gamble to see if they could get the reaction they did. You can't set rules for when you'll hold or fold in a poker game until you're in the middle of it.

The Judge is acting on the basis of avoiding appealable actions. If he puts the prosecution in jail for contempt and the prosecution essentially refuses to fall into line then he would *have* to declare a mistrial wherein the prejudice of said mistrial would be an appealable issue.
Prosecution is doing everything to get another bite at the Apple. Judge is doing his best to shut that down.

In a lot of states, you cannot use a .223 as a hunting round for deer sized game and larger due to the lack of a humane kill. It was essentially developed from a varmint round (the .222 'triple deuce' cartridge) that people used to kill gophers, prairie dogs, etc. From that, it was lengthened a bit to hold more powder so it became a compromise round from the original varmint round and the .222 Remington Magnum which is now essentially defunct.

Where do you live?
In the states were I have worked the assignments were random draws. Done by the clerk at the time of filing. No the senior judge did not assign cases. Now there were always rumors about the occasional case getting steered. BUT, you don't even want to know how many murder trials were presided over by non competent judges. They actually send the new judges off to school for a couple weeks to take a crash course on how not to fcuk up a murder trial in my area.

The .223 was viewed only as a personal protection round when the idea was that war would be a nuclear event--something like an upgrades .30 Carbine. Even in WWI and WWII, bombs, artillery, mortar rounds, and machine guns were the primary cause of death, not personal firearms. Haven't seen that extended to Korea or Vietnam but my unscientific guess is that it is likely to be true even there.
So, if a good enough cartridge exists, then the military is concerned with other factors--availability, training, logistics, wear and tear on rifles, costs, their retired buddies at defense contractors, etc.
That being said, the 6.8 SPC, 6.5 Grendel, and at short ranges, the .300 Blackout do pretty well as an upgrade to the .223 if you are trying to stuff the cartridge into an AR spec receiver. At distance, using a larger receiver, the .308 and its derivatives work pretty well as do some of the new 6 to 7 mm cartridge work. 6mm ARC, 6.5 Creedmoor, some of the 7mm short fat rounds, etc.

When you go into fully automatic fire, the 308 was almost impossible for even a strong soldier to control. Much easier to lay down automatic fire with 5.56 and keep it controlled.
Also, the ability to carry almost twice the ammo and larger magazines by using a smaller, lighter bullet is a huge advantage.
It made sense to go with something smaller, they just overdid it on some bad assumptions.

I'm not sure how true it is, but I've read that one of the reasons that the .223 was adopted was because it's more likely to cause debilitating injuries than fatalities. This wasn't a humanitarian thing, of course - it's to put more stress on the enemy's supply lines by forcing them to evacuate their wounded, provide medical care, etc.
It's at least plausible. Modern warfare is extremely dependent on logistics.

The FAL is controllable with 7.62 Nato and I presume the G3/Cetme used by the Germans and Spanish was as well. But they were modern designs and not invented at Springfield Armory. Dunno about the AR-10 but the FAL and AR-10 at trials did better than the m14 so the Ordnance guys kept inventing reasons why these rifles would not do. Which is why we got the AR-15/M-16 in part because of General Curtis LeMay who needed a replacement for old M1 and M2 Carbines used to secure the safety of airfields.

I've heard that, but I personally believe its urban legend and there's just zero evidence that the military wanted a rifle round to just injure and not kill in order to tie up enemy resources.
Most potential enemies back then (like the USSR or Vietcong) can barely feed soldiers, must less give them first class care. They would just be left on the battlefield to die (and not take any resources) but be able to keep fighting.

As far as military is concerned, more modern light machine guns fill the gap. Some company even reversed engineered and corrected the notorious M-60 faults so it is now a pretty reliable light machine gun from all accounts.

Sorry this is getting tedious. Littlefinger wants to establish that when Kyle was told BY ANTIFA to stay off the streets, and did not stay off the streets, he provoked them, and thus justified the attack by Rosenbaum.
This is an upside-down world-- Rittenhouse is on trial for being an illegal vigilante, but Littlefinger insists that the orders of antifa street vigilantes MUST BE REPECTED AS THE LAWFUL ORDERS OF THE STATE.
Littlefinger is doing the "A Few Good Men" thing. He's claiming that because Kyle said there was "no friction" with the crowd, there was no reason to carry the AR-15 to render medical aid. The real answer is: There's no such thing as perfect safety; people carry guns when they have no particular reason to fear danger.
Also, what would he do with the gun? Leave it on the street?
But Kyle isn't saying that. So this stupid gotcha is semi-effective, at least for Karen.

I was just there last Thursday after my left vitreous suddenly detached while I was sitting right here. Thankfully, it didn't tear or detach my retina. So I'm extremely grateful for that. Now I just have to live with the floaters, wiggly lines, flashes and shadows. I keep thinking someone or something is creeping up on my left side, which is unsettling. But I can live with it.

I witnessed more than a few dumpster fires here in Minneapolis during these last two years. The only time I've seen someone put out a fire was when a mythically large black guy -- who'd been protecting a salon just fifty feet away -- finally went out there with a fire extinguisher, said nothing, put it out, started walking back, and stopped when they started booing, turned around again, and stared everyone down.
It's absurd to suggest that people shouldn't be afraid so long as they're a "good guy" like a protestor friendly medic. Just being there is danger enough. Everyone is danger of a beat down whenever things so sideways as they often do.

It's light and small so you can carry a ton of ammo without running out of room or getting weighed down.
It's good to 300yards without elevating.
You can shoot it all day long without shoulder fatigue.
The fact that it more likely wounds than kills probably didn't even tip the scales after those three.

My granddad was a combat engineer in Europe in WWII. He would have agreed with this statement 100%. He wasn't big on war stories - he saw everything from combat to concentration camps, and didn't like dwelling on it - but he would talk at length about the logistical challenges of supplying guerillas, resistance, etc. Wars are won and lost in the supply line.
Funny story my grandma enjoyed telling. As a combat engineer, Granddad was in it a lot. After the war, she said it took until about 1948 for him to stop instinctively rolling out of bed and going for cover when an airplane would fly by at night. She said, "I'd hear a plane, then a thump, and I'd have to say, 'Raymond, get the hell up off the floor and get back in bed!."

Remember that the vast majority of rounds an infantryman fires in an engagement aren't aimed directly at an enemy, something like 70-80%. They're fired as suppressing fire, just to keep the enemy's head down so you can bring in the real killers: high explosives. So the only thing that really matters for most of your shots is that the bullet be supersonic, to produce that crack overhead. And a smaller/lighter round means that you can produce a lot more suppressing fire per pound of ammo.

For example, you never object to relevance unless you don't care about the questions and the jury won't either. If you do so, then you open the door to let the other attorney essentially preach to the jury about why the defendant's preference for one type of bullet over another matters. A good defense attorney will often appeared bored until the line of questioning drags to a halt by either another minor objection such as facts not in evidence, improper form of question--attorney is testifying, and so on.

I believe that there was contemporaneous info that the 55 grain bullet, at the velocity generated in the full size M16 barrel would result in the bullet yawing in soft-tissue and many times breaking up, thereby creating a more lethal wound than a simple FMJ that stayed intact and simply passed through. It meant the Geneva convention requirement for non-expanding bullets, but clearly not necessarily the intent to avoid overly inhumane injuries, as asinine as that is for warfare.

I've had a vitrectomy in my left eye. Still can't see out of it very well. If you can live without the surgery then don't do it.
Plus it hurts like hell for days after the surgery. Imagine closing your eye, then poking your eyelid... you know the pain you get in the back of you eyes when you rub it too hard? Yeah thats what it feels like 24/7. They sent me home with Oxycontin - I took 1 and threw the rest of the bottle away.

Kyle hasn't said anything damaging, he's answered every question reasonably and politely. I think it greatly helps his image with the Jury to let them see Kyle retain his composure under a great deal of pressure. (while watching Binger lose his)

Again, his theory, and what he will likely close with, is Kyle didn't need to be there. In fact there were moments in time when he could have left, he didn't. He was only there for fame by showing up with a gun knowing he couldn't use it to defend property, so he only brought it to use against someone.

He's giving them the rationalization that will allow them to stick their noses in the air and refuse to acquit this kid. Which gets a hung jury, and a mistrial. Probably the difficult part for us as layman viewers watching a video looking at just the defense/prosecution and witness. We can't see/read the other team, the judge or the jury. And we get agitated when it goes off into the weeds instead of staying snappy and on script like a Perry Mason episode.

I'm not sure why it was a bad idea.
I'm with Whig. None of us are in the court room. We cannot see the jury. Maybe the jury is getting very bored with this and the defense atty knows this is working against the DA. We simply do not have all the information.
At this point, I think the best you can say, is that Kyle taking the stand has not appeared to harm in any way, and he has held up quite nicely, and hopefully taken away from the jury that since he didn't testify he must be guilty.
Now they may still think him guilty, but it won't be because he didn't testify.

The only problem with that approach is that it is contrary to Wisconsin case and statutory law involving stand your ground--it is simply playing to emotion rather than the actual instructions that the judge is giving the jury. Branca has the four elements that the prosecution has to meet to disprove self defense--none on them involve having a firearm on hand for self defense.

He was prepared, and all of his early answers were sharp, but all of the high drama with the judge, and lunch break, probably slowed him down a little bit, and being deep in the weeds on these timeline questions would be monotonous for anyone which is kinda the whole point.

Presumably to build up the idea that the shootings were the ultimate bad decisions that night and a direct result of all his bad decisions that led up to them. That he created the scenario through his own bad decisions, and it would not have existed without them.

One of the more horrifying situations is when you have an interest in the case and you can see an attorney for your side going off the rails. It is like a horror movie or a bad accident where you want to scream NOOOOOOO but you cannot speak to stop what is going to happen. Judges see it often and depending on experience will know the precursors to an attorney going off the rails. A kind one might stop them in the interest of justice. A stern one lets the attorney make a fool of themselves.

Last time I was sued my attorney said basically the same thing. Told me he wanted the jury to like him and know that he respected their time. The plaintiff's attorney literally put the judge to sleep (bailiff had to go over an nudge him awake). Throughout the proceedings my attorney would get up, ask a few pertinent questions, then sit down. Jury came back in my favor within 35 minutes.

The defense attorneys are doing what they think is necessary in the courtroom and letting the ADA bore the jury to death. At this point, I think that a mistrial is about the best outcome the prosecution can get. The only concern for me right now is the gun charge--the law is vague enough that the jury could unite to punish him on that. I think the provocation approach in WI law to overcome self defense is dying by inches in the courtroom with every breath that ADA is uttering.

I served on a jury like this. Case was a total waste of time and all the jurors felt that way. we came back with a not guilty in less than 20 minutes. The prosecutor looked like somebody punched him in the gut.

I don't think it is AI so much as it is an algorithm that adds/subtracts pixels, smooths out the image, makes it more visibly appealing, etc. In other words, it has the capacity to introduce what is not really there in the video, depending on the algorithm. Did the hand touch the gun before he shot the pedo? The answer shouldn't depend on algorithm generated "evidence."

Best evidence doctrine. The best evidence is the original item. When analog was the thing, it was easy to show that it was a true and accurate depiction. With digital, the question is whether it can be edited or changed by either persons or AI in this case as to not be a fair and authentic copy of what transpired.

Yes, interpolation, and that can mean two different things in this context.
Pixel interpolation is adding new pixels "in-between" the original pixels and doing some calculations that adjust color, brightness, sharpness, etc. It makes the larger image looker somehow more clear but more blurry at the same time, and it does introduce "new (data) information" in image.
Frame interpolation is like the "video smoothing" that newer HDTVs do when presenting older 24 frame per second films on a 60 frame per second screens. Same thing is true in terms of adding new data in the video stream.

When "enhancing" raw video the computer - which is technically artificial intelligence - has to decide what the pixel "should" look like v what it does look like.

You have to demonstrate chain of custody first to disprove outside editing. Then you have to have someone explain the algorithm etc which generally calls for an expert witness. Then the opposing party can call their own expert and get time to actually study the evidence or a copy of it for signs of editing, artifacts (unintentional noise in the digital whatever), and so on. Complicated stuff.
Orin Kerr is one of the Volokh Conspiracy law profs that blogs on technical issues and the law. I know about the process to get it authenticated but the technical means I haven't studied.

Oddly, makes the spoliation of that evidence more crucial potentially to an outcome. The prosecutors didn't spoliate it tho, a third party did. So not clear cut.

We had people HERE who were saying He went looking for trouble and he found it - before the trial started. When you make arguments, some of them are not legal. They are working on the type of mindset that doesn't like mess and conflict and thinks it takes two to tango and if he wasnt there this wouldn't have happened. That's wrong. IF Binger had wanted the tape admitted, he could have done it on direct during his case in chief. He is trying to use it to rebut which has strict limits on the prosecution without going through the authentication process. Judge was right to refuse at this point.
Binger is living proof that proper prior planning preparation prevents piss poor performance.

Yep, and that's the problem. Those "bi-predictive" frames often don't "predict" correctly, so you end up with distortions in the enhanced video.
And even small distortions can be very misleading. The judge is right not to let it be shown unless the state can produce a computer expert who can testify that there is no distortion. And we know that's not going to happen.
