The Lead Prosecutor in the Kyle Rittenhouse Political Prosecution Said That Rittenhouse Chased His Antifa Attackers. Then He Showed Video Of Antifa Chasing Rittenhouse.
Update: It Gets Worse.

Essentially they're hoping the jury is just very pro-antifa and poisoned against Rittenhouse and will ignore the actual evidence and simply convict Rittenhouse against the strength of the evidence.

It's a joke. The judge should have already thrown this out.

Assistant District Attorney Thomas Binger made it a point to start off his opening argument on Tuesday that the evidence in the trial will show it was actually Kyle Rittenhouse who first chased Joseph Rosenbaum and killed him during the riots in Kenosha last year.

In the video recorded by Washington, [the second witness called by the prosecution] captured Rittenhouse being chased by Rosenbaum, not the other way around.

Apparently the prosecution's completely dishonest claim is this: At one point in the video, both men are walking, neither chasing each other, and Rittenhouse is behind Rosenbaum at some distance. They're both walking the same way. No one is chasing anyone.

But because Rittenhouse is behind Rosenbaum, the prosecution wants to claim this constitutes Rittenhouse "chasing Rosenbaum first." Even though the actual video shows only one chase, one sequence where people are rushing and running, and in that sequence, Rosenbaum (the antifa terrorist) is clearly chasing Rittenhouse.

Disgraceful. Maybe it's time to adopt antifa's tactics and just rip this fucking corrupt government down.

This video helps Rittenhouse. Which is probably why the FBI has been playing games with the video.

Unseen footage taken by the FBI from the night of the shootings in Kenosha, Wisconsin, surfaced on Tuesday during day one of Kyle Rittenhouse's trial. According to Jack Posobiec of Human Events, the FBI allegedly had an HD version of the video but never told the Rittenhouse defense it existed.


In footage obtained by Human Events, the FBI appears to have taken aerial footage of Rittenhouse and the other participants involved in the shooting. Some of the footage, which is black-and-white and grainy, was shot from an FBI surveillance drone.


The FBI footage was shown to the jury during the testimony of one of the agents who captured the footage with the drone, FBI agent Brandon Craimin. However, the FBI allegedly testified, in private, that they were in possession of another version of the video in HD that they did not supply the members of the defense, according to Human Events. When asked for a copy of the tape, the FBI allegedly denied the defense's request, saying that the video no longer existed, according to the report.

After prosecutors questioned Craimin about the aerial footage, the defense cross-examined the witness and asked for the tail number of the FBI plane. However, prosecutors objected. Judge Bruce Schroeder then asked to sidebar the issue and discuss the aerial footage, and jurors left the courtroom.


The lead lawyer representing Rittenhouse, Mark Richards, then said he believed that there was other video footage, captured by the FBI, that was no longer available. Richards reportedly said it is "preposterous" that the FBI allegedly lost the footage.

"I don't get this," [Judge] Schroeder reportedly went on to say. "This is a criminal prosecution... if there is going to be cloak and dagger stuff. What’s going on?"

The prosecutor is having a bad day. Today, his own witness -- this is supposed to be a friendly prosecutorial witness that helps him build a case against Rittenhouse -- established that Rosenbaum had hostile intent during the confrontation.

I have two versions of this video. Your choice. The first one is just the video itself. The second video is the video, plus some legal commentators (including Nick Riketa of Riketa Law) reacting to it live.

The second video has some chatter you may find annoying. However, their reaction to the key statement makes it worth it.

But, your choice.

Rosenbaum explicitly threatened Rittenhouse's life prior to the shooting.

This case should be thrown out.

Nick Rickieta is livestreaming the trial. In the caption description, he says the defense had a "BAD" (all caps) day yesterday. I guess today is going better.


One last bit. Jeffrey Toobin apparently declared it "incomprehensible" that the judge ruled that Kyle Rittenhouse could call the arsonists and looters he shot arsonists and looters, but that the prosecution could not call them "victims."

Well first of all, Toobin's an idiot who was absent the day they taught law in law school, because the protections in criminal court are there to protect the criminal defendant himself from unfair bias -- not to protect third parties who are not on trial, such as the arsonists/looters/pedophiles who were shot.

If Kyle Rittenhouse thinks it's a key part of his defense to establish those men were arsonists/looters/pedophiles, he can do so. The third parties in the case have no right to be protected from unfair bias in the trial, because, get this, they're not on trial.

Beyond that very elemental misunderstanding of who the protections afforded criminal defendants are there to protect (spoiler: it's the criminal defendant), apparently there is a rule for the specific case based on prior federal precedent.


An annoyed judge essentially said that the Sad Fat Public Masturbator Jeffrey Toobin should go back to what he's good at, which is pressuring the much-younger daughter of colleagues whom he's having an illicit extramarital affair with to have an abortion, and stop babbling about law, which he knows very little of.

He plays a fat sad chronic masturbator lawyer on TV, for the very undiscriminating audience of CNN, but he's not really a fat sad chronic masturbator lawyer. Not the "lawyer" part, anyway.



I don't know what they're talking about, but I'm going to guess this is about the (well known) rule that you can admit evidence of someone's prior violent acts to explain a defendant's state of mind in a self-defense case -- "I knew he had been committing violent actions, therefore, it was reasonable to think he intended to commit violence against me, so my use of deadly force to protect myself from a reasonable fear of deadly violence was itself reasonable."


You can bring in a lot of evidence that would otherwise not be relevant for state-of-mind reasons. You can't bring in prior bad acts to say "This guy was an asshole, he just deserves it," but you can say "This asshole was behaving violently, so my state-of-mind was that I had a reasonable fear that he was going to kill me, so I shot him."


That's not first week law school and it's not first month.

But it is first year.

And this very basic rule is "incomprehensible" to Spanky McChickenChoker over here.

That guy definitely tried to provoke a shooting at the gas station earlier in the night, and Kyle not only shot in self defense but has discipline and accuracy most cops would be envious of. (all the bystanders and local dogs survived)

Also, the video of the cops thanking Kyle AFTER the shootings should have been enough to stop this from going to court.

And it should be noted that a defense attorney rarely gets a clean sweep on an MJOA, because all the state needs to do is clear a very low hurdle to get to the jury. The beyond a reasonable doubt standard is the higher one for the jury to decide.

The defense may get an "adverse inference" instruction in which the jury is told that if evidence has been "destroyed" they may infer that the evidence was exculpatory and that's why it was destroyed.

A cop accused my wife of knocking over a light pole at a bank. I'm thinking an actual pole with lights on it. I told him there's not a single scratch on her car, and can I see the video evidence? He refused.

So on trial day we see a very lightweight pole about three feet tall, already barely standing, that she tapped into and it fell over. Judge said guilty.

We did beat the hell out of the bank it occurred at. I took a verbal bite out of that VP's ass that may not heal for another decade. The VP called the cops on me but they didn't come.

Will it work ? Dunno'. Works in every county court-house. Because most people look at that shit - just like the threads we have here about "dude takes matters into his own hands" - and we always have those folks that want to talk about how there's no place for vigilantism.

It's a calculated strategy by the prosecution. Has nothing to do with the law. And everything to do with the psychology of the typical Upper Midwest WASP. Violence occurred, punishment must be rendered, and nobody is purely right or wrong. Even while getting shot at.

If the law had an option of "guilty, but minimum sentence", this thing would be over before the judge could stop it. Because that would make the jury feel better.

Yeah, it didn't sound like it. It was more of the same with the prosecution witnesses helping the defense. The defense got the lead detective talking about how one arm didn't have to turn over his phone. Plus there were other things the DA was doing. I'm not sure how that was a bad day for the defense.

It should never have been brought in the first place. It's bullshit -- both legally and morally. Regardless of one's opinion about whether Kyle Rittenhouse should or should not have been in Kenosha that night, once those asshole criminals started trying to murder him, he had every right -- both legally and morally -- to defend himself.

And as every witness so far has shown beyond any doubt, there is not a shred of evidence that Rittenhouse used more force than was necessary, or that he didn't try to avoid the conflicts. He was chased and attacked and even then he still tried to avoid shooting these assholes. In fact, he showed remarkable restraint under the circumstances.

I hope he has a good civil lawyer, and sues the prosecutor and every other asshole involved in this travesty for malicious prosecution.

Yes, and ahead of time from what I heard. It was NOT shared. The current version is supposedly edited and there may be more available. The only definitive thing I heard from the agent they had is the high resolution footage mysteriously vanished. This is probably a 4k/60fps drone, and with the raw files you can bring out a lot of details. We also don't know if they were capturing RAW photographs, but his lawyer is an idiot.

He says the bleeding behind the eye should stop. The "feather" thingy I'm seeing is a string of vitreous attached to the retina. He said "Hopefully when it pulls away it won't tear the retina."

Sorry, that sucks bigly. For some weird reason in my early 30's I started getting serious floaters (not good for an artist) and my eye pressure was going through the roof. I went for checkups every 6 months for a few years, but the doc finally just figured I'm like that, and not necessarily a candidate for glaucoma. Floaters eventually went away.

I'm praying you're going to be ok, can't say it's not scary AF. Eyesight is precious.

If anything at all gets wonky with your vision go immediately to an ophthalmologist. If they catch it before it detaches you will retain the current focus in that eye that you have. If it detaches it won't ever fully lay down and there will always be some distortion because of this.

That happened to me and it took a few days to get the appointments and then get the surgery. Since then I've recovered almost all my original sight except a small piece like I said where it's distorted.

I believe the burdens of proof; or at least the way they are applied is a bit different in cases of self defense than in other criminal cases. The State accuses Rittenhouse of shooting these 3 men; well, he does not contest that, admits it freely. However, his Defense is that he was justified in shooting them because of their actions towards him. The State has to prove beyond a reasonable doubt that his actions were reckless and do not meet the standard that would justify the shooting. If the State cannot do that, then the Jury should find the defendant innocent, but I don't think there's a point where the Judge should step in and make the jury's decision for them.

Also testimony in today's trial established that Rittenhouse fired 4 shots in quick succession at Rosenbaum. It might be quite difficult to say which was "first", and if Rosenbaum began to collapse at the first shot, it could easily have been the 4th shot that hit a portion of the back.

Juries decide facts, judges decide laws. If the judge finds that, as a matter of law, the prosecution has not introduced enough facts to support the charges, then dismissal is appropriate.

All juries are supposed to do is apply the facts that they find to the law as the judge instructs them. That's the entire point of the charges given to the jury.

That's terrible! Glad the surgery took care of it. Eyes are weird, fragile and durable (for what they do) at the same time.

Back when I was in 1st grade, I got stabbed in the eye with a pencil (kids). I understand it was a close call, and I wore an eyepatch for months.

After? It's like I have a color filter on one eye - or if you know photography it's got a different white balance. So colors are warmer on one, cooler on the other. If I think about it too hard - things can almost shimmer, but I guess my brain compensates. Oddly (at least the last time I took the test) my color perception was perfect - which is beyond weird for an over 50 male.

The witness is lying, because Mr. Jones was being perfectly reasonable that night." Then the defense can introduce, "Oh really? He's a nice guy? Because I have here court evidence (like convictions and charges) that says otherwise!"

The prosecution in this case is either 1) relying on the jury being intimidated/corrupted, 2) crazy as bedbugs, or 3) actually setting this up for a fail for some reason.

I loved back in the day once in awhile Law and Order (with Jack McCoy and Jill Hennessy), when McCoy would ask a question about how or what, and Hennessy would counter with some NY state or USSC case, and once in awhile I knew what she was referring to better than she was (through the writers, of course).
