My girls, from the same breeder yet would start to bark, then look at the TV and go "is THAT what this is about?" and go back to sleep. Weird.

16 The legality of the vaccine mandate will be assessed under what is called the major rules doctrine (also known as the major questions doctrine). Under this doctrine, the courts look to (1) whether the agency action is a major rule; and (2) whether Congress has clearly authorized the agency action.

It isn't a major rule, because we are not calling it a major rule.

17 Founding YES keysman and all-round cool AF Prog-rock guy Tony Kaye has released his very first solo album, "End of Innocence" in commemoration of the heroes and victims of 9/11.

Tony Kaye did two crucial stints with YES, from 1969-71 and 1983-94. In his long and varied career, Kaye also played on the first Flash album, his own group Badger's terrific one-and-done album "One Live Badger", the hard-rock group Detective (they played the music of "Scum of the Earth" in the classic WKRP episode) and late-era Badfinger. In more recent times, Kaye has been with the YES sister-band CIRCA and released many fine modern Prog albums with them (check out "Valley of the Windmill"!) , while often appearing as a special guest in concert with his old YES-mates.

"End of Innocence" is very cinematic/sound-tracky with elements of prog, classical, jazz and ambient elements.

Here is "Let's Roll":

https://tinyurl.com/4kwvadfs

As a YES-head, I've always wished for a Tony Kaye solo album and this does not disappoint. Cover art by Roger Dean.

Yes, hard to believe he hasn't done anything really since Badger, then again he's been working on this album for almost 20 years? Prolific he's not. I hope it does well, but unfortunately it's going to be a hard sell even in the prog community. Way too many take progressive anything too seriously.

No doubt it's going to be better than The Quest, which already sounds every bit as depressing as H&E, just better production values.

The "demo" version that was floating around the internets for years had some very, very neo-con imagery attached to it. Assuming that Kaye approved of the video portion (as I understand it, he did) , I'm going to cut him some slack. He wasn't the only one bamboozled by the neo-con line at the time. My hand is in the air.

But in the long run, man am I ever psyched that my dude finally did a solo album. Lovin' it, despite the somber subject matter. Lot of people don't know he attended the Royal Academy of Music the same as Wakeman. It shows, here.

I don't know if it's still floating around out there, but there's some hilarious video of Rick and Tony during the Union tour. I think the only fun Rick had on that was getting with Tony and pranking anybody that would hold still long enough. Can't remember if Rick was sober at that point (I've got his books, but can't remember) but they'd have been a handful after a few pints.

And that's pretty professional TBH, Tony could have been bitter after losing his gig to Rick. Then again, he had the last laugh being with Yes during their most lucrative phase by far - even if he wasn't actually playing on the album.

195 I keep seeing these "actress without makeup" shots on social media. And they usually look great (sometimes better than when they're all painted up).

But what they consider "no makeup" is different than how I define it. They have cosmetics on, just less than usual. Women define makeup differently than men do. For us its "any crap you put on your face to look different than God made you" and to women its "this particular product used in this manner".

No makeup to me is "just woke up in the morning and took a shower, nothing extra added"

I've been looking in the $500 - $1000 range. My only hesitation with an Asus is that that was the brand of laptop I had before this, as did my son. Both laptops developed issues with the hinges. As best I can tell, the screws holding the hinges to the back cover would loosen slightly, and the flexing eventually caused the hinges to break off the cover. Same thing happened with my Acer.

234 Rollerblades have no effective braking method. A sort of modified spin out - suitable for the younger and most athletic - is about it, from any sort of higher speed.

Those, like me, who see them as free ice time/skating workout, have challenges finding the right place. Surface has to be good/perfect (unlike for walkers, runners, bikers, strollers, .....). Hills need to be few, and of limited grade.

If you can find a good place, and you opt for the sensible yet torturous balance (wheels/bearings slow enough to provide a workout and avoid high speeds, but not so slow they're psychologically intolerable), a great option.

Going fast, thru obstacles/hazards, is for the highly skilled, young, and non-risk-averse, to put it politely.

I've had that happen with an Acer and HP, but never my Asus. They've kind of become my go-to laptop manufacturer because I've had good luck with them, honestly. That said, I usually add the extended warranty coverage for as long as I can because I use the mofos, and I generally come out ahead after they company has to replace hinges, power ports, USB ports, batteries, etc.

If you don't get one with a solid state drive, make that your first additional purchase. It's amazing how much faster they make things.

FWIW there's an i7 Asus Vivobook with an SSD at Office Depot for $570 (down from $850) right now, too.

He really was a very good actor in that, both vulnerable and tough and although everybody makes fun or "I coulda have been a contender" the scene with Rod Steiger as his brother and he in the back of the taxi is terrific. And I liked the Bernstein score too. A ver good movie aboout a flawed person standing up for what is right even after a beat down.

248 So the Paiute are gonna be able to come after the Lakota?

And I think is just one of dozens of cases of "nations" who have very big and very serious beefs with the Lakota.

Why, it's almost like the stone age humans inhabiting North America (who were not native, if we're going to press the point) behaved like every other assortment of humans since the species arose. Empires, wars, conquest, slavery, genocide, land grabs, alliances, coping strategies, on and on.

But of course it's somehow important that the civilization that invented all of the standards norms and values allegedly violated in dealing with these stone age humans - to whom, like the wheel, written language, and every almost every other component of civilization - they were all alien concepts, needs to now immolate itself over these historic events.

She said something on that same day about systems being in place to prevent Trump from whatever. She was part of it, too.

It's scary to think of where we are as a nation. I'm not sure the republic is still alive, honestly. I wonder if we've just go so much momentum that we'll keep running for a few more years before we realize that we're done.

254 Thanks! I'd probably want a larger drive - 512 ideally, but could settle for 256. Needs more memory, too (unless Windows 10 has suddenly gotten very efficient).

And that's the first I've heard of "Windows 10 Home in S Mode". From my quick search, S Mode restricts you to apps from the Microsoft store (though it looks like you can switch it off).

I had never heard of Windows S, but apparently you have the option of switching over to regular Windows 10. The S mode is their attempt to have an Android-like environment where you don't need antivirus and can only run programs from their store. hahaha, yeah, thanks MS.

At this point, just one question - surely he or the JCS has come out with *some* kind of statement? Strikes me that this particular (pretty much unprecedented) s**t-storm requires an instant place-marker statement, at the least.

Asus OEM's for many manufacturers. I roll my own, and ALWAYS get an Asus MB. Not everything they do is gold however (routers for one). My laptop is also an Asus - so is my IPS monitor - the latter 2 are 7-8 years old and doing fine. Heck when I Think about it I built my PC in 2013 with state of the art everything, and it's still fire breathing enough to do video editing without skipping a beat. Don't know about the hinge issue - not a problem for me. Probably depends on model, they have a zillion. Laptops are getting progressively shittier year after year.

269 The snippet I saw, and then the follow-up snippet, about Milley going over the chain of command thing with the NMCC just don't add up. The follow-up (not sure of source or motivation) seemed designed to correct the instant and spectacular implication that Milley was insubordinate and attempting to subvert Goldwater-Nichols (80s law setting out chain of command).

But yeah, "reminding" the NMCC of the proper chain of command is absurd on its face - as if they wouldn't know - and also makes no sense in the laughable make-believe universe in which Trump was erratic, since it would be in fact the CIC originating the orders.

But so, so, so much of American public life now, even on the highest-profile and important topics, is just jaw-droppingly stupid. A "president" saying unvaccinated people are a threat to vaccinated people. Just a fresh, spectacular example.

The Aztek was a tragedy because it turned out that it was a really good car with some pretty innovative things that were lost in its looks. I laughed at them and never would have considered one, but I met a friend who had one and got it for next to nothing because no one wanted those butt-ugly designs. I still wouldn't buy one because I have a pesky need to enjoy looking at the things in my garage, but it's a shame how they were handled.

If GM had jumped on it after the first year and cleaned up the lines to make it more traditionally SUVish (the Trailbl@zer comes to mind) they wouldn't have been able to keep them on the lots.

300 Nah, Miklos, as free ice time/workout, for hockey players they're very good (they were invented for this purpose, I think at U of MN).

There are (were?) even rollerblade rec hockey leagues. Ridiculously dangerous for joint injuries, always seemed to me, even though non-contact. Ice - as long as you're fully armored up - is a very forgiving surface, since your energy is dissipated by sliding when you fall (unless you're too close to the boards or net).

Played most of the team sports, not all, throughout my life, hockey both seemed and has been the least injurious one. Now, take rec league soccer against Salvadoreans. As many injuries as a college rugby tournament.

rhomboid, I start with the premise that Pelosi set up a phone call, and of course Milley is going to take it. She babbled a bunch of crazy nonsense and he humored her. Beyond that, I'm from Missouri -- show me that if he agreed with anything she said, he was telling the truth or that he did anything in response.

As for the phone call to his Chinese counterpart, I don't doubt that took place and that it's not unusual. He probably talks every once in a while to his Russian counterpart too and to lots of other countries' top generals. I seriously doubt that he said he would give the Chinese advance warning of an attack, or even said anything that would be misconstrued as such.

This sounds like a Vindman-like manufacturing of mountains out of molehills for some other purpose. Things that happen inside the Beltway.

Keyboards and monitors on laptops have gotten uber crappy. And people don't complain. The difference between a 5-7 year old laptop monitor and a 2020 is startling. Same brand, awful. And with keyboards I can barely tolerate the ones on a laptop - right now I'm typing away on a mechanical keyboard with cherry blue switches. Clackity-clack-clack-clack. Love it. But I was broken in on an IBM XT.

I knew the main researcher/assistant who worked with Woodward on his Powell book (if memory serves), waay back in the 90s. He gave me a copy, don't think I read it. Already had my own read on Powell. But never did torture my friend about Woodward's reputation for embellishing his tales.

And I vaguely recall that the SecDef, at the climax of the Watergate episode, right before Nixon's resignation, was reported to have done something along the lines of one of the versions of the claim about Milley talking with the NMCC. It wasn't still Laird then? Anyway, he "refreshed" the understandings of high-level members of the chain of proper procedure, which even then pre-Goldwater-Nichols went through the SecDef, of course.

I still wouldn't buy one because I have a pesky need to enjoy looking at the things in my garage, but it's a shame how they were handled.

I owned nothing but German metal from the mid 70's to about 1998. I bought an Infiniti because commuting from San Jose to San Francisco in a Porsche was killing me. But I became enamored with a car that was never, ever in the shop. Ever. Sold the Porsche in 2010, had bought a new Infiniti a couple years earlier. Bought wife Lexus, and now I've got one. Comfy, fast, handles like a SOB (RC coupe) runs and runs. Not on first name basis with shop manager. Very cool.

I almost bought a 2002 back in 1979, but opted for a Scirocco - kind of glad I did. Best friend's brother worked at BMW shop in San Rafael CA, so I got familiar with all models. I guess that Kugelfischer fuel injection was a bitch. So the tii is cool, but I might opt for the carbureted version and buy a modern carburetor. I loved those cars, as well as the 3.0 CS. Built like a boat inside. Uber swank. Oh yeah, my mom had a 1977 530i for a few years (talked her into it), that thing was a hoot. 4 wheel drifts all day long at any speed, even school zone speeds! I'd do that again.

She is asking me for help in filling out her application for the National Honor Society and answering the question as to what qualities she possesses that make her qualified.

So I made her read Micah 6:8, then describe to me what it means, then describe what it means to do justice, love mercy and walk humbly with God.

Then I asked her if she possessed those qualities, the desire to do right, to show deference and compassion to those that haven't, and to be a willing, faithful servant to ideal truths bigger than herself in a principled way without seeking self-glorification.

Then I asked her to give me examples of those things, and then concluded that if she is fit for the Lord's honor society, she certainly was for the National Honor Society.

She said "Why can't you just be like other dads?" I said "Because I don't want you to be like other kids."

IIRC they were the last new car to be sold with a cassette player, which tells you a lot about their original demographic. Which is me now, I guess.

Well, see kids, when a political faction is very very stupid and irresponsible, it will use any means to achieve its destructive, indefensible goals (opposed even by most of its own "base"). So, why not a budget reconciliation bill?

I kind of think it's not gonna happen, but if it does, I will be watching to see if the Border Patrol does a Mpls/NY/Seattle PD number, and sort of melts away. I would expect, and almost hope, it would.

Yeah, I got an RC F Sport. I love it. The 4 wheel steering is extra terrestrial. Takes a bit to get used to, as it switches at speed. I bought it right after the lockdowns started, and dealers had started panicking. Got it for an absolute steal - I had been waiting for fall which is traditionally the best time as new models are coming in. Glad I got it, the price has gone up $10k easy. Oh, I had been looking at the GS, but this is probably my last mid-life crisis (second one) so WTF. Oh, and the Mark Levinson sound system? Yeah. I'd snap up an old SC though. Not fast, handles like a boat, bus *so* cushy and awfully sweet with top down driving up the coast.

I'm sure the Military drivers come from Transportation units. And are not child molesters or MS-13 members getting military training. It may take them time to recognize a voice or a forehead in the mirror.

However, the answer to children that are discipline problems is not "Get in the aisle and push it away, maggot."

There is another path.
"Please join me up here in the penalty box. How was your day? Do you have a favorite course? Any you dislike? Oh, by the way, here is why (physics analysis or story of bad things happening) I want you to not do that." etc. Problem solved.

438 Rand Paul has also called for Milley to go.

Harking back to a (tragically, and obviously) completely different America, just on the "center of controversy/distraction in a key public role" basis, Milley should retire.

He's clearly not there with a death-grip on the ramparts, defending against the current scourges (he's openly endorsing them). Whatever his precise culpability (which I'm willing to assert even now is "non-zero") for the debacle at the end in A'stan, he was involved and at the the helm when it went down.

Clearly, obviously, and unambiguously, a situation where a responsible leader steps aside, especially the JCS Chairman. He's not being framed on absurd charges - like Trump, over and over. He was/is at the center of many bad things, and whatever his varying degree of culpability for them, he is now far past a distraction, and unsuitable as the nation's top uniformed officer.

The .22shorts don't make anywhere near the noise of a .22lr going off. I knew of one person, years ago, who lived in a smaller city and had squirrel problems, getting into bird feeders, getting inside the roof of his house, etc.

He would go out and plunk them with .22shorts, and none of his neighbors, squirrel lovers all, never knew. They are really quiet.

Traded it in in 2001 when son of Doof was 2 and we needed a more family friendly vehicle. Got a 2001 CR-V.

I miss that Prelude

They're hard to get away from once you own the brand. I started with a B2600i 4x4 back in the 90s and then just kept buying them. Even the Ford ones (we had a 6 wagon for a while) were pretty good, although you'd find Ford stamps all over the place.

The new ones are fantastic and I'm glad you're experiencing them. They're a tiny little company that doesn't have much market share, but people seem to become fairly dedicated to them once they have one.

I'd probably buy a new 6 if I had to get a sedan tomorrow. I don't know how they make their interiors so nice at the price.

And also, do we need to have a ceremony for Benedict Arnold, since he was clearly just operating as he did cause he didn't agree with Washington's military choice? Maybe name one of the problematic bases after him perhaps.

And do those in boot camp get to decide the drill sergeants order for assembly are unwise, and just ignore them and substitute their own? Sounds like that may be an issue in the whole "Chain of command" thing.
