The Morning Rant

talking ape.jpg

ANOTHER DAY, ANOTHER POWER GRAB

Here's Tucker Carlson on the latest outrage from the Biden Administration:

It's a pretty righteous rant about the CDC director's decision to extend the eviction moratorium, and who gave the CDC authority over landlords and the houing market? I agree with Tucker that this is an outrageous overreach, but I have a beef or two with how he's arguing his case.. The first is that Tucker is presnting it his audience as if it were a new thing, some new form of tyranny that the Biden Administration thought up just now. But this is misleading. What Tucker is describing actually has a name, administrative law, and it's been going on over a century, informally since the end of the 1900s, and formally with the passage of the Administrative Procedures Act (APA) in 1946.

I don't think this country's founders ever envisioned regulations with the force of law being written (enacted) by unelected bureaucrats, but that's the country we're living in. This applies to any federal agency, but my favorite whipping boy is the EPA who can come in and designate all or part of your property as a "protected wetland" and too bad about your development plans you were counting on to bring in income for your retirement, but they're now illegal. Or, worse, you need to spend many thousands of dollars to bring your "wetland" up to EPA specs, otherwise you'll be subject to heavy fines.

Often with no appeal.

So what about due process? Congress enacted the APA specifically to establish fair administrative law procedures to comply with the constitutional requirements of due process. But I've heard enough horror stories to wonder how effective these protections are.

Second, despite Tucker's protestations of the illegality of this, I'm not sure it will hold up in the long run. We've been living with administrative law for decades. Some Republicans have grumbled about it on and off, but, like any other federal program or agency, once it's in place, it will never go away. It's now a feature of the landscape. There is, for lack of a better word, "precedence" for this power grab. It's outrageous that SCOTUS has already ruled against this but they're going ahead with it anyway, but what the CDC director wants to do is only different in degree, not in kind, from what has gone before. The Biden administration is doing what it can get away with. As Tucker said, who is going to stop them? Mitch McConnell?

There's a scene in the underappreciated science fiction movie Outland where the beleaguered Federal Marshall O'Neil (Sean Connery) appeals to the people he is trying to protect for help. "What about your men?" one of them asks. "My men?" responds O'Neil. "My men are shit."

That's pretty much how I feel about the Republican Party right now.

Administrative law is a malformed chimera and an appalling mess. It needs to be eliminated. Congress enabling the Executive agencies to write their own laws, all haphazardly, and then enforce them on whatever terms they decree is a disaster. It - along with most of the agencies themselves - need to be destroyed. Each and every one of those enabling acts - and there have been many - passed by Congress needs to be repealed by Congress.

And while we're in fantasy land, the Dallas Cowboys cheer squad will blow me this evening.

The Broward Teachers Union confirmed Thursday that three teachers and a teacher's assistant have died from COVID-19 within the last two days.

Union president Anna Fusco said those teachers were on summer break when they got the virus. [...]

Fusco said at least three of the four were not vaccinated, but one had been recently cleared by a doctor to get the vaccine.

Naturally, the hero overcomes the challenges and prevails, more or less. TPTB don't actually want to solve problems--they want to find scapegoats to blame things on when everything fails.

I knew that would come up, and, in fairness, I did say somewhat more innocent than the 1950s or 60s. In any event, Arbuckle was framed by a grifting pimp and an ambitious DA who thought he could ride the case straight into the governor's mansion.

As well, Virginia Rappe, the "starlet" Arbuckle supposedly "raped" was not the gonorrhea-ridden slut of popular fiction. She was more successful and less trampy than people want to believe. Greg Merritt's Room 1219 clears away the myths on that bit of Hollywood Babylon.

one of my favorite movies, one that now is being called "neo-noire" . The car chase is famous because it's not only good, but more importantly *no* *one* had ever filmed a car chase like that before. Look back at movies before then and almost any car chase scene is people inside cars looking back with a screen behind them making them look like they're moving. This one was real, it was mesmerizing - and now it doesn't seem so special when we see it because *every* director who filmed a chase scene after that copied the techniques first used in Bullitt. It was one of those movies that changed the way every other film director worked.

57 Congress enabling the Executive agencies to write their own laws, all haphazardly, and then enforce them on whatever terms they decree is a disaster.

Congress doesn't even write its OWN laws - they use activist groups to do the actual writing, and then they just put an authoritative face on it. These enabling laws are just saying the quiet part out loud.

Using human shields like politicians to hide the smarmy, extremely anti-human activist groups is as old as the Trojan Horse. We know a little bit about this process thanks to the internet and bloggers specifically, but in the end, little people like us get fucked.

Outland is basically a remake of High Noon set in space. You do remember it correctly as the company execs are allowing drugs to be pushed in order to up miner productivity. In High Noon, the authorities make it clear that the marshal is on his own dealing with the thugs. In neither case, the people that should be upholding the rule of law are doing so, as a result, both law enforcement officers are alone to solve the problem using brute force.

The states. Here's how I reckon it could easily work.
1. The feds mandate an internal passport (vaxport today, something else tomorrow).
2. States that comply will impose exit controls - no passport, no exit.
3. The states that do not comply will do neither inbound nor outbound controls.
4. The states that comply will form partnerships with each other. If someone from a complying state enters another complying state, then they are waved through and enter like before. If someone enters a complying state from a non-complying state, they are subject to passport inspection.

There. Done. And America fractures immediately.

When did this change.? Well , not surprising it was under Obama. He appointed Bloomberg's nanny health commissioner Dr. Thomas Friedan as director who rapidly made huge changes in staffing and mission. Soon it was issuing edict on all sorts of things like trans-fats and bike helmets and wellness .... He also purged all the Bush people and brought in people that love Science!

Trump made the mistake of not following up with a massive purge of his own, either thinking it was just another bloated govt. agency or too busy too deal with it. It's just racism. The notion of 'reverse racism' implies that racism is natural in one direction - white on black - but abnormal and unnatural in the other direction - black on white - and so a new term is needed. It is not. The premise is flawed. There is no such thing as, 'reverse racism' - there is just plain old-fashioned racism. The term itself is racist because of what it implies."

He blinked for a few seconds and said, "Huh. I never thought of it like that. I need to think about that." I dunno if he came around to my way of thinking or not.

My guess is when this order comes down in a month or two, what the Biden Cabal will do is ask a bunch of states to "voluntarily" set up Wu-flu vaccine papier checkpoints to further acclimate people to the idea. Some will resist and while the legal process is grinding, watch for the usual suspects (Hawaiian judges, ACB) to give the standard "no standing" delay.

This might be a way to get a non-compliant governor like DeSantis under control by declaring his state "under rebellion" and send in the Feds to try to extinguish any small flicker of liberty left.

You don't understand, non-implemented rules are the best rules. Because they eventually turn everyone into a criminal. So when they want to start loading people onto cattle cars for their last trip, they will have an excuse. These are lawbreakers! Which can be applied to anyone they want.

Same groups that have done everything else. Facebook, Instagram, Twitter, your local church group.

They know they can't just make it actual law, so they rely on their very extensive snitch network to video tape themselves harass people who they think don't have the injection and then post it to their activist groups to organize and hound the so-called threat from living a normal life.

Worst of all this, is that destroying other people's lives is FUN to them.

But you also need to draw some of those people from the existing staff because losing the institutional memory/knowledge will render you powerless, too. Posted by: Village Idiot's Apprentice. Asymptomatic raycist at August 13, 2021 11:06 AM (3D/fK)

289 Super easy, barely an inconvenience! Just close all of the roads that cross a state a line that you don't want (or can't) control and route all traffic onto Interstate Highways and whatever US routes you wish to remain open. Sure, it may result in detours running hundreds of miles, but those line crossings are superfluous and unmanageable in the current emergency. It is just a temporary measure anyway, and everything revert after the crisis passes...

They'd still have to man and/or patrol the blockaded roads, or the barriers would be torn down quickly. Plenty of pissed-off farmers with heavy equipment out there.

341 "Racial inequality is evidence of racist policy."

That means that the disproportionate number of blacks in things like the NBA and NFL and Olympic track teams, etc., is the result of racist policy.

So either we must eliminate the NBA, NFL, Olympic track teams, etc., or we must make sure the teams are racially representative of the nation -- which means majority white, with only 13% blacks.

There is also a disproportionate number of blacks in the rap industry. To achieve racial equity there, we must make sure that only 13% of rappers are black.

Also, a disproportionate number of government employees are black. To achieve racial equity, we're going to need to fire a whole lot of black people from their cushy government jobs.

But I'm sure Kendi's okay with this, right? His racket won't be affected (thanks to all the idiot lefty white women) so he's safe.

It just demonstrates that the problem wasn't the Taliban. The progress they're making - if it's real - is only because people are willing to let them do so. They have to be fought off with heavy weapons for every inch of territory, but the moment you leave they come right back and do so quickly and without apparent effort.

So what does that tell you? It tells me that the *people* of Afghanistan are down with the Taliban, are happy to have them, and are welcoming them back. They certainly aren't interfering. So the problem is the people and population at large, not those nasty Taliban fighters who are oppressing them.

TL;DR: nation-building was a stupid idea without vanquishing the population first.

This is how it works:

The Biden regime can mandate and implement something immediately. It takes Y1 long for it to be challenged and ruled on. Meanwhile the regime works on switching it with something identical to what's being challenged in X1 time

Yn > Xn for all n

After Y1 the regime immediately implements the result of X2 and Y2 begins.

run this out to n = infinity

This is NOT a bitchy type question; I really don't know the answer. Aren't the yearly flu vaccines non-sterilizing? They are administered during the flu season...

I'll take a stab at this. The flu vaccine is developed for the flu that they THINK will be predominant that season. They're almost always wrong. I did a quick search, and it seems that the flu vaccine is sterilizing, however they just guess what strain is going to dominate, which is why people get the flu.

The Safeway stuck out as I had shopped there in 1989 or so and it hadn't changed a lick in 20 years or so. The feeling where you see a scene in the limited POV of the camera and your mind just fills in *all* the peripheral information is weird.

I still get pissed off when I think about my old unit getting the shit IED'd out of them over there for literally no good purpose whatsoever. The same people responsible for wasting those lives will just as happily waste them in the same fashion in Appalachia, the plains, and the Rockies.

410 I'm a little late to the game here, but I don't even get how the eviction moratorium is a concern of the federal government in the first place, under the Constitution (yes, I know).

Renting a piece of real estate is a purely local, i.e. intrastate, transaction. That transaction is not interstate commerce, and rightly considered does not even "affect" interstate commerce. Proof of that is the difference in rental prices in different states. So even if Congress had enacted the eviction moratorium by an enacted law, this Justice would rule that unconstitutional. Much less so when a bureaucrat out of her lane decrees it.

P.S. I'd have answered Pussy Galore (Honor Blackman?) for Who Dis, but for her name at the bottom of the last pic. But she hit the Grand Slam! (Elbows, Leggy, Busty, and Cheeky)
