Kim Gardner -- the Soros DA Who Hounded the McCloskeys and Used Them for Soliciting Donations -- Repeatedly Fails to Show Up in Court to Prosecute an Accused Murderer, Resulting In Him Being Set Loose Back on the Streets

St. Louis Circuit Attorney Kim Gardner is under fire after a judge drops murder charges against an accused killer.

The unusual move came after the prosecutor from Gardner's office, who was assigned the case, didn’t show up to court. Now the chairman of the St. Louis Aldermanic Public Safety committee wants to call Gardner in front of his committee to explain the incident.

Judge Jason Sengheiser wrote a scathing order dropping the murder charges. The accused killer, Brandon Campbell, was released from jail and is still at large.

The judge noted in his order that the prosecutor who was assigned to the case was on maternity leave for three months and said the office hadn't replaced her.

The judge sharply criticized Gardner's office for the mix up saying, "The Circuit Attorney's Office has essentially abandoned its duty to prosecute those it charges with crimes."

My understanding is that her office has a very high turnover of attorneys, which may be part of the problem: if the case was shuffled among new attorneys then it's entirely possible that the one currently responsible didn't realize that the case was due in court that day.

IIRC the prosecution failed to appear THREE TIMES ... supposedly leaving the judge no choice. The ass hat should have immediately ordered the arrest prosecution of the D.A. instead.

The prosecutor has to turn over any witness statements, exculpatory evidence, autopsy report, lab test results, etc. Defendant needs that to make an informed plea or go to trial. It was already continued thrice. Sanction for not tendering discovery after 3 court dates was dismissal of the indictment. Double jeopardy did not attach so he will be charged again. Judge did nothing wrong.

Nowadays, the city itself is pretty small, in terms of population and land area, and tax base was hollowed out after deindustrialization of downtown in the '60s, and most commercial companies settled in the suburbs.

No one is arguing the people in charge are completely inept and deserve some sort of penalty. But who's to say the court didn't fuck up? Ever serve in jury duty? shit happens all the time and the court is in charge of the scheduling. That shit happens all the time, it might be the wrong bureaucracy is getting blamed.

I don't think society is well served allowing a murderer to walk, surely this gauntlet could have been thrown down on a lesser case to make the point. Imagine if say your son or daughter was murdered by this man and this is what the judge did to you.

It's not the judge that was the problem. There are rules that have to be followed (don't laugh).

It was at least three times that no prosecutor showed up, plus no response to various orders. The judge didn't dismiss "with prejudice" so they state could refile. However the state re-filed the charges after the defendant had been release. This is 100% on the soros da.

The prosecutor has to turn over any witness statements, exculpatory evidence, autopsy report, lab test results, etc. Defendant needs that to make an informed plea or go to trial. It was already continued thrice. Sanction for not tendering discovery after 3 court dates was dismissal of the indictment. Double jeopardy did not attach so he will be charged again. Judge did nothing wrong.

Its the same argument the Left used when letting people go because they weren't read their Miranda rights after being arrested.

I'm skeptical of law enforcement and government in general, just think there has to be a better way to handle a scheduling fuck up like this when murder is in the backdrop. Seems more about the judge feeling his time was wasted and wanting to make a point than feeling the constitution was in jeopardy.

I wouldn't chalk this up a win for justice if it was my kid that was murdered by him.

I just pray that his son, while having the same "values" is too decadent and lazy to follow in dad's footsteps. Yep. The state has the burden of proof. If the state fails to meet that, for whatever reason, at the time and place set for trial (and it looks here like the state didn't even request a continuance), the defense counsel move to dismiss and the judge wouldn't have a choice but to grant it.

I had to clean men's and women's restrooms at a restaurant with a bar. The women's restrooms were always a filthy sty. I also had to mop the floor at least once on Friday or Saturday nights, because they couldn't hold their liquor.
