Wow, Trump's "conservative" justices actually voted conservatively for once. Thank God for small favors. "Ballot harvesting" is a I-can't-believe-this-was-ever-legal practice of paying hard partisans to "harvest" the ballots of third parties, supposedly to "help" them vote. Most people strongly suspect that the "ballot harvesters" are simply collecting the ballots of dead people and out-of-state people and simply casting votes themselves. Numerous races have gone from Republican leads to Democrat "victories" when the Democrat-paid "ballot harvesters" suddenly turn in thousands of ballots in the closing moments of vote counting. The Arizona law also requires votes cast by voters who vote in the wrong precinct to not be counted. This is, again, an area rife with fraud. The only chance a criminal impersonator has to be caught casting a false vote in someone else's name is to be recognized at the precinct by the poll worker -- or recognized not to be the voter in question. Permitting fraudsters to cast votes in other precincts where the person they're supposed to be is not known to anyone seems intentionally designed to permit Democrat fraud.The 6-3 decision was written by Justice Samuel Alito. Justices John Roberts, Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett joined in the majority with Justices Kagan, Sotomayor, and Breyer in the dissent, which was written by Kagan. What it boils down to is the Court upheld the state's ability to prohibit third-party collection of mail-in ballots, otherwise known as "ballot harvesting" and said that the state can also disallow votes cast in the wrong precinct. That’s a huge blow against the Democrats because of how they have utilized ballot harvesting. Many believe that they are able to use it, perhaps questionably, to change the nature of elections. Republicans have been fighting against it for some time to make elections more secure. Democrats had tried to argue that the restrictions disallowing votes in the wrong precinct were somehow racially discriminatory. The court rejected that argument and it's a good thing. The very argument is itself racist -- to suggest that somehow people of color don't know what precinct to vote in.Responding to the Democrats' (and the 9th circuit's) claims that these "restrictions" disproportionately hurt minorities, the Court found that everyone had an equal opportunity to vote either in person or by early voting, and, in any event, the state's strong interest in insuring that only legal votes be cast and counted would trump the very minor "disparate impact" the laws may (or may not) have on minorities. The Court notes as a starting matter that Arizona "makes it quite easy to vote." That is true. And it seems to me that if your state "makes it quite easy to vote" and yet you insist on creating ways for people to vote without identifying themselves, you're only trying to make it "quite easy" to cast fraudulent ballots. The big thing here (aside from the result) is the Court's utter rejection of disparate-impact style analysis with respect to Sec. 2 of the VRA. The Dem's attempt to shoehorn employment discrimination law and attach it to Sec. 2 was extremely pernicious -- SCOTUS express rejection of such an approach will help in future cases around the country, and may actually scuttle the DOJ's effort to bring Sec. 2 VRA claims against the new Georgia law.

Even if it doesn't directly facilitate fraud, allowing voting in other precincts removes one of the ways in which the legislature can encourage local governments to clean up their voter rolls, and voter rolls which are hopelessly out of date create confusion and give judges an incentive to simply throw up their hands and say, "count it all!" so it enables other types of fraud as well as bureaucratic incompetence.

@7 - The Court distinguished between disparate treatment and disparate impact. Disparate treatment makes sense, and can be redressed based on equal protection law.

Said it earlier this morning, but this is important.
It means the DOJ case against Georgia is dead, the new Florida law, and the (soon to be) new Texas law, will stand. Arizona will be enacting addition legislation soon, and PA just had a new law vetoed. WI and MI are starting to make noises, and NH also passed a new law with minor changes. The cross-precinct thing is weird to me. Precincts are hyper-local. Except for very odd conditions where you're *right* on the line, it's pretty damned hard to go to the wrong place. The wrong place will be further away. You'll have to do *more* work to cast your ballot in the wrong place! And it isn't like voting locations are a secret, or that your official election mail doesn't tell you where your polling place is. How was wrong-precinct voting even a thing that needed to be addressed?

Another problem with mail-in voting (not that this was specifically addressed here, it just occurred to me) is around the handling of duplicates. If you get a duplicate (which would have been possible for me in the last election, since the DMV troll and the elections troll entered my address slightly differently and so I got two ballots), there are four ways to handle it:
You can reject all, you can accept all, you can accept the newest and reject the oldest, or you can accept the oldest and reject anything subsequent. Most systems choose door #3 and accept the latest and reject any prior. This makes sense from a systems standpoint - if you foul up a ballot and need a new one, it should cancel out the old one. It's fairly safe. But it is also ripe for insider fraud. I can just run off duplicates, fill them out however I like, and send them through the system. Ballot harvesting is appalling, but laws against it are meaningless if they are not enforced. Take as an example Colorado. In CO, ballot harvesting is illegal. Ballots must be dropped off by you or a member of your immediate family. Strangers aren't allowed.
Yet it still happens all the time, almost laughably. The guy in front of me when I dropped my ballot in '20 must've pushed 15 of the damn things through the slot. This would be easy to catch - the drop-boxes are monitored and so they had him on camera. It's just that no one cares. So saying, "sure, you can make harvesting illegal" is all well and good, but unless someone actually wants to enforce that, it doesn't matter. The wrong place will be further away. You'll have to do *more* work to cast your ballot in the wrong place! To the point where it would be hard to question federal involvement in any state elections, and that the authority for electoral processes lies with the legislature. Article 2 spells it out very clearly, that the authority rests with each state's legislature to select electors. Why is that? because legislatures have to hammer out laws when no one knows ahead of time whose ox is being gored, so the laws are presumed to be fair. If the phone is actually dead and off, then you probably have to search for it the old-fashioned way: methodically, with your hands and eyes. Include places that make no sense like the refrigerator and the microwave and the cupboards and the laundry appliances.

As I said earlier this morning, while the ruling is correct here, the stipulation of so much idiotic baseless nonsense continues to render the judiciary pretty farcical. There is no "burden" whatsoever on the voter. The eligible voter has the ability to have their vote counted, it is the voter's responsibility to vote. Traditional secured absentee ballots completely - completely - cover all conceivable meritorious claims about voting inconvenience or impracticality. The "court" should have obliterated the concept of "burden" for voters, as a start. "Early voting" and "harvesting" are absurd on their face, indefensible, even more obviously so than opposition to a rigorous/constant culling of voter registration rolls. What you *could* do, though, would be to calibrate the device to the WiFi to determine signal strength as a function of distance from the access point. Then you can log in, see it connected at 30% strength, and infer a circle of x feet from the AP. That might work, and would be pretty easy to implement. SCOTUS set up a few tests today which are positive for affirming voter ID. The state has a prevailing interest in ensuring who you are, and therefore electoral integrity. If they provide ample opportunity for people, all people, to gain and possess ID used in voting processes there is no harm. They made it clear the voters has some responsibility, and must make some effort. Under those conditions there are not any racial or economic disparities. None.

Paper ballots, at most, electro-mechanical tabulation. No electronics at any stage. One day for voting. Voter ID. Complete transparency at all stages (now something that can be taken to an extreme degree, via web video streaming). Culling of voter registration rolls. That's it. That's all that's needed. Concept of "burden" on voters, for decades now, is ridiculous on its face, and should be excluded from the discussion. Many countries use exactly/mostly the formula above, and they have never have a hint of election integrity trouble. The US would never, never recognize elections the way they are run in many key US states today (have pointed this out a thousand times). How would the VRA actually apply? The election is over, and checking the results cannot possibly disenfranchise anyone or have a disparate effect along racial lines. What are the mental gymnastics they're going through there to justify it?

Back in the Burning Times days, I used to opine that when things get bad for Average Joe, they get really, really bad in the inner cities. The result isn't a big bad civil war, because before it gets to that point, the cities will be worse than last summer. The complete breakdown, to the extent that it happens, will result in gangs and militias controlling turf in our major cities like Beirut or Belfast. There will be some states (let's call them red) that will get it together, and there are other states (call them blue) that will not get it together. People and businesses will migrate from blue to red. This takes decades, but at the end we have a stronger federal system with a smaller central government. I believe it was the district that Will Hurd abandoned. Mr. Hurd is a black former FBI/CIA (? one or the other) who won a traditionally hispanic seat somewhere around or south of San Antonio. I know he had the largest gop held seat along the Texas border. He almost always sided with the dems. With his seat open the fake republican was actually a dem hispanic that was counting on his name to get elected.
