Supreme Court Rules That the NCAA Cannot Act as a Cartel to Deny Payments to Student Athletes; Notes That There Is No Anti-Trust Exemption for the NCAA

Oh, we're taking anti-trust law seriously now?

Any chance that tech monopolies who are clearly coordinating in a cartel will get a look-see anytime soon?

Anyway, now college players will be paid like professionals. Which is basically what most of the Division I football and basketball players are.

Now, as of yet, the ruling does not go so far as to say colleges can pay their moneymakers a salary. But it does open up the definition of what "educational expenses" schools can pay.

...

Under current NCAA rules, students cannot be paid, and the scholarship money colleges can offer is capped at the cost of attending the school. The NCAA had defended its rules as necessary to preserve the amateur nature of college sports.

...

The case doesn't decide whether students can be paid salaries. Instead, the ruling will help determine whether schools decide to offer athletes tens of thousands of dollars in education-related benefits for things such as computers, graduate scholarships, tutoring, study abroad and internships.

I don't really see how you can limit the payments to just "educational expenses." If the NCAA's decree is being struck down as the illegal actions of a cartel, how can you then say "Well they can't impose that decree, but they can act as a cartel to impose this slightly-less-restrictive one?"

That makes no sense. If it can't act as a trust, then it can't act as a trust. Period.

kavanaughantitrust.jpg

Well, if the Supreme Court thinks the NCAA is an illegal trust which cannot conspire to forbid payments to athletes, wait until they hear about the NCAA acting as a cartel to force schools to let men compete with women.

Nah, just kidding. They'll probably claim there's no standing to press that suit.

Meanwhile, this 42 year old will be competing at the Olympics, because it's perfectly normal for 42 year old women to still be of Olympic power in strength sports.

Ted Cruz asks the right question: If we've decided the woman's category is now intersex, why bother having segregated women's sports at all?

Let them compete with the men generally.

Enjoy watching the Olympics at home, loser!

19 I've been making the same point that Ted Cruz is making forever now. It's especially applicable when whiny things like that new purple headed Victoria's Secret model complain about "equal pay for the same thing." Well it's not the same thing--"she" didn't make the men's team. So let's equalize, shall we? No more men's and women's National Soccer Teams. Just a US team, and let all 37 genders be eligible, and pay them all the same. Let's see how much xhe likes it that way.

41 This is an absolutely spectacular development, and has been a long time coming. Collegiate athletics are a major conduit for minority and female enrollment. These historically-excluded groups have few opportunities to achieve and succeed due to the generally poor public education systems that serve those communities. The poor primary and secondary educational opportunity is evidence of systemic oppression that is perpetuated by supremacist local government. Colleges offer an opportunity to level the playing field with enrollment, and this ruling will improve representation by increasing demand for subsidized compensation.

This is an unalloyed good. For far too long, the oppressive structure in this country has treated minority and female enrollment for athletics as a necessary evil to improve programs, and have used unpaid labor in a manner that is distressingly similar to the slavery system on which this country's founding and development depended. This is a wonderful development in achieving restorative justice in all aspects of our national life.

59 Before everyone starts in on how the NCAA is making all this money off of the student athletes, etc. please understand that the NCAA is a non profit organization that was created originally back in the very early 1900s to provide safety rules and regulations for college football players. At that time, college football was averaging 9-10 deaths a year. The NCAA is made up and governed by ADs, presidents, etc. of all the member schools , which numbers in the thousands in the three divisions it covers. It has an executive director and some adminstration, but 99% of the NCAA is run, governed and rules are made by the above people.

This pay the poor players bullshit was started and fomented by the Democrats. Their entire goal is to remove any and all sports from colleges because it takes time and bodies away from their organizing for power efforts. Besides this latest lawsuit regarding giving athletes all this extra stuff, the player likeness issue is coming up for a vote That is where if a players image is used in any kind of ad or promotion for a school, they must be paid for it. It will allow players to sell themselves to the highest bidder for advertisements by businesses.

The shine wears off that argument when you realize the Universities are worthless, they contribute nothing, they educate nobody, and they in fact produce the most ignorant fuckin' swine on offer anywhere in the world.

116 Continued: The NCAA profits are returned back to all member schools which is what pays for all the scholarships, competition, student athlete insurance, and other perks they get. After the exec. director and staff receive their salary and all other expenses for the physical building, etc. are paid, all additional money is returned to the schools. The AD's, retired coaches, presidents, etc. who serve on the NCAA BOD, committees etc are all volunteers and receive no pay.
So as of now, a student athlete will be eligible to receive a scholarship, a stipend, additional food, beverages, etc. during the semester while training, a computer, paid internships, travel abroad( Harbaugh of Michigan is dancing at this one) medical care, psychological care, athletic wear outside of uniforms, tutoring, outside pay for any photos, advertisements, etc. I'm sure there is stuff I haven't even thought of. All because they can throw a football, basketball ,etc. and give their school exposure . Remember the money made from ticket sales, television rights, etc. all goes into a giant pool which then is either sent in membership dues to the NCAA OR is budgeted to pay the government mandated Title IX sports

125 rule one of cartels is that the members cheat on each other.

A cartel is an agreement between players to fix production or prices to allow the members to provide lower quality goods at a higher price, and to stop innovation that would upset the market. In a way it is a form of rent-seeking.

However, in any sort of free economy they members cheat on each other, and the only real way to prevent that is to make a third party with power (a government) responsible for enforcing the rules. This is a form of regulatory capture.

126 My wife had a full scholarship for track all through school. On days where she had a meet, they gave her $8 for the whole day for food and other expenses. They would also have a crappy sack lunch if you were at the right place early enough.

She is extremely grateful for the experience and she got a great education.

When I hear about how she was basically going hungry during full day meets because her family was poor and she didn't get much from the school for food, it pisses me off.

Oh, and the crappy school doctor who examined her ankle a few times when she was complaining about issues completely missed the fact that she was slowly tearing through tendons. It wasn't until she got a real doctor to look at her that she found out she basically had no tendon left and they had to rebuild her ankle tendons through several surgeries.

136 the fun thing about regulatory capture is that there is two types: one where the members are more powerful than the government the members call the shots in closing out all but the most controlled opposition for their benefit. Where the members are not more powerful than the government the government calls the shots, the members become controlled and everything is run for the governmental authorities' benefit.

173 The semi-professionalization of college football is a cancer on our society. I'm less concerned with college athletes getting paid whatever than I am with the incredible wastage associated with athletics departments sized to cater our mass-market semi-pro football entertainment needs. That factoid along the lines of the "Highest paid public employee in state X is college Y's football coach" is true for way too many X's.

Posted by: Match Checksout at June 21, 2021 12:54 PM (dYe5S)

174 So if the athletes can get paid, that means they can sign a contract. could said contract include language that limits the athlete's transfer options? that just became a thing - transferring without penalty, or waiting a year to play at the new school.

Haha. I grew up when (1980s) our local university (SMU) had the best team money could buy. The Pony Express, we called it. Twin threats of Eric Dickerson and Craig James. SMU got the "death penalty" for that, but about every 2 years another school would get busted for the same thing - Texas, Rice, Texas A&M, TCU - everyone was doing it.

"Preserve the amateur nature of college sports" LOL that's a good one!

This is true. Many of the smaller colleges have a fee they charge all students to help fund the athletic department.:0
Ohio State, the one I'm most familiar with, has made a profit the last few years (except until 2020 due to Covid) That profit was then donated back to OSU's general fund for scholarships for the general student population. Big colleges, like OSU, will separate their athletic dept from the university itself so that the athletic dept. has to maintain their own budget and not drain resources from the main university . Ohio State and Ohio State Athletics are two separate entities, both are 501c3s. My guess is the SC's ruling requiring this increased allowance for educational purposes maintains the line the 501c3s have to stay in.

Today in downtown Sacramento, five decapitated bodies were found outside of the Northstate University Dental College campus, in what appears to be the newest round of retaliation murders in the struggle to control dental services in Norther California. Authorities have no leads at this moment, but are asking for witnesses that may have seen a number of individuals with perfect occlusion running from the scene.

Everyone has been asking that question. What's the point of having any gender-class sports categories at all if you're gonna just let men compete in womens' sports?

Note: there are no women pretending to be men competing with men.

And on other news, my Kindle has just decided to brick and is displaying the front ad and won't change or shut off. I guess I'll wait until the battery runs out on this one ad in like 9 hours and hope when I recharge and start it again it will work.

I think the heart of the problem is that these schools have created an accreditation system which makes an exception for schools to discriminate against certain groups, run athletic depts., and all kinds of stuff. And the gov. pays them in the form of student loans, research grants, and other ways. The whole system is rotten.

296 Prediction, bidding wars will commence for star athletes and a lot of smaller, less competitive, or less well endowed schools might have to drop to Div III (no scholarships etc.).

In reality, this move by Scotus means a more uniform standard for colleges because there is no such cap on educational and other benefits given via scholarships, fellowships, grants, etc. The Ivies tried to cartelize student aid offers and got successfully sued for that behavior as well.

BTW, non profits are NOT and SHOULD NOT be considered more virtuous than investor owned corporations. Someone up thread mentioned correctly that the goodies that would accrue to investors are instead directed towards those within the non profit via salaries, benefits, travel, etc often to an absurd amount. Often the boards of these non profits being businessmen themselves see no problem with outsized salaries and benefits for non-profit executives because they themselves often screw over their putative bosses--the investors.

I know they did it, but like modern day chaplains it has to be a challenge.

The TLR version, is that a trademark can't describe the goods it's being used for. It's supposed to identify the source of the goods. For example, if there was more than one Washington football team, the others couldn't even describe themselves as Washington football teams without infringing on the Washington Football Team's trademark. A lot of companies don't get this, and need to be talked off the ledge when their marketing-tested awesome trademark idea gets kicked back. I'll be happy to bore anyone with details at the NoVaMoMe.

394 Let's face it, the Olympics began being a slush fund for the 3rd world.

Someone's gonna pay for all the stuff and I'd bet that the money comes indirectly from US.

And since they want more "equal" representation and all they had to start including some of the more easier "sports" so that even some dinky 3rd world team can win SOMETHING.

It's just been affirmative action for countries is all. Been that way since about the 60s.

And personally they should just have a sport and whoever can do the best gets on the team. by having separate men/women's teams they admit right there in the open that men and women can't compete against each other in most athletic contests.

Sure there are some and that's all good. Let's stop this sexism.

So basically double digits will be exploiting their kids and other kids at age 8 and up. It's already happening for clicks.
POS football coaches put a small kids against a beast for illegal tackling drills off of the small kid getting knocked out. Yes, this is the extreme example, but it's out there.

I suspect (though I don't know, because I don't have any smart home stuff) that the Nest device will work without internet, but only as a dumb thermostat.

The way they managed to make a lot of these inscrutable devices useful is by simplifying them and removing the interface. If you've ever tried to program a traditional programmable thermostat, you know how arcane that crap is.

Instead of dealing that kind of indecipherable brain damage, they created nice UIs that run on your mobile phone. Programming is suddenly intuitive and easy, as is reporting. But it also means that get *anything* to work properly, you have to have a cell phone or tablet to connect to it. And that means that it's online. Even if the device itself is locked out, your app can get the data and then forward it happily along.

414 Will be interesting to see if smaller schools can be competitive at all with the Big Boys.

In the Seventies the NCAA increased football competiveness by reducing scholarships in a couple of ways. Until then, big schools would sign more top-level skill position high school players than they could reasonably use, just to keep good players out of other schools in their conference.

I hate it. It's a self-esteem sport to me. What's notable is when a a team DOESN'T score. 101-100 is around 100 goals total?

And too often there is no real separation. Five nights in a row of Team A vs Team B is 113-111, 98-97, 97-98, 111-113, 101-100.

422 The only way it works to pay college athletes is if you have a ranked pick system. The top high school athlete may be picked by the Akron Zips in the first round over Ohio State. Otherwise schools with money will always lead. So it becomes Ohio State and Alabama and everyone else. If the player declines to sign with Akron, then no pay to him at his choice school. Or Akron gets paid by Ohio State.

Baseball kinda has that problem. I like to watch to study the mechanics of the players: how they throw, how they swing, how they run, etc. It's instructive even to watch less accomplished players, whose mechanical flaws are more apparent.

I don't (and didn't, before BLM) follow any teams, and didn't much care who won/lost, I just watched the game for the above consideration.

426 Women's sports will be devastated by the SC ruling because they rely upon football revenue to even exist. Once the money starts flowing to the men who actually earn it, then the the women will have to come up with a new grift.

There are only maybe two college women's basketball programs which are self-sufficient, and no teams in any other women's sports are. Men's sports outside of football and basketball will be hurt too since they all suckle off those programs.

430 I can't follow truncated links at work, but I assume the "enjoy your smart home" is a link to the story out of Houston where a bunch of people had their smart thermostats jacked up to 80 on a hot afternoon because ERCOT declared a need for conservation?

While I agree that the actions taken by the service provder are absolute GARBAGE, I do lay a pretty hefty amount of blame squarely at the feet of the homeowners.

YOU DIDN'T READ THE E-U-L-A, DID YOU? You signed up for some schlocky "program" because it had a feel-good name, came with being entered in a sweepstakes, and didn't bother to read any farther than "WIN AN X!" This is Houston, which is not short of sanctimonious liberals, so I'm willing to wager that most of the people who signed up (and were impacted) are people who still possess the following political yard-signs:
- Biden / Harris.
- BETO
- Hillary!
...and depending on how long ago they moved here from Cali, possibly a Wendy Davis sign, too.

They employed zero critical-thinking skills, preferring instead to shore up their feelz, and now BLAMMO that self-righteousness wound up making the microcosm of their home suck for a day.

I lol'd. And I'd lol again.

435 Also - just because something *can* be connected to the Internet, does not mean that it *should* be. I have a "smart thermostat" and I have not hooked it up to the wifi. It's not an over-intrustive Nest or anything like that, but it does offer the ability to use the Honeywell app to "monitor and adjust your temperature from anywhere!" and also to use geofencing for it to automatically detect when I'm not home (and thus jack the temperature around).

I do not like any of these features. I particularly do not like the assumption that me being away means it's alright for my house to get up to 80 in the summer. Just because people aren't home doesn't mean pets aren't still in the house. Doesn't mean I don't still have produce sitting out on the kitchen counter. Or 3D printer filament I'd like to keep actually at room temperature.

I've never understood the notion that letting the house grow warmer in the afternoon and then maintaining that temperature really saves anything, especially since you now have to run for an extended period that evening before I get home to bring it back down. As opposed to simply maintaining a lower temp all day...

The first time THE Ohio State University ever played a game of football against an opponent, it was the college that later would be known as The University of Akron. If only the ZIP's reminded them of this every year, it would not be so bad.
But Youngstown, OU, Bowling Green, Toledo, several schools in Cleveland, and Purdue relate the story whenever they meet.
