Supreme Court Rules That the NCAA Cannot Act as a Cartel to Deny Payments to Student Athletes; Notes That There Is No Anti-Trust Exemption for the NCAA

Oh, we're taking anti-trust law seriously now?

Any chance that tech monopolies who are clearly coordinating in a cartel will get a look-see anytime soon?

Anyway, now college players will be paid like professionals. Which is basically what most of the Division I football and basketball players are.

Now, as of yet, the ruling does not go so far as to say colleges can pay their moneymakers a salary. But it does open up the definition of what "educational expenses" schools can pay.

Under current NCAA rules, students cannot be paid, and the scholarship money colleges can offer is capped at the cost of attending the school. The NCAA had defended its rules as necessary to preserve the amateur nature of college sports.

The case doesn't decide whether students can be paid salaries. Instead, the ruling will help determine whether schools decide to offer athletes tens of thousands of dollars in education-related benefits for things such as computers, graduate scholarships, tutoring, study abroad and internships.

I don't really see how you can limit the payments to just "educational expenses." If the NCAA's decree is being struck down as the illegal actions of a cartel, how can you then say "Well they can't impose that decree, but they can act as a cartel to impose this slightly-less-restrictive one?"

That makes no sense. If it can't act as a trust, then it can't act as a trust. Period.

Well, if the Supreme Court thinks the NCAA is an illegal trust which cannot conspire to forbid payments to athletes, wait until they hear about the NCAA acting as a cartel to force schools to let men compete with women.

Nah, just kidding. They'll probably claim there's no standing to press that suit.

Meanwhile, this 42 year old will be competing at the Olympics, because it's perfectly normal for 42 year old women to still be of Olympic power in strength sports.

Ted Cruz asks the right question: If we've decided the woman's category is now intersex, why bother having segregated women's sports at all?

Let them compete with the men generally.

Colleges offer an opportunity to level the playing field with enrollment, and this ruling will improve representation by increasing demand for subsidized compensation.

This is an unalloyed good. For far too long, the oppressive structure in this country has treated minority and female enrollment for athletics as a necessary evil to improve programs, and have used unpaid labor in a manner that is distressingly similar to the slavery system on which this country's founding and development depended. This is a wonderful development in achieving restorative justice in all aspects of our national life.

59 Before everyone starts in on how the NCAA is making all this money off of the student athletes, etc. please understand that the NCAA is a non profit organization that was created originally back in the very early 1900s to provide safety rules and regulations for college football players. At that time, college football was averaging 9-10 deaths a year. The NCAA is made up and governed by ADs, presidents, etc. of all the member schools , which numbers in the thousands in the three divisions it covers. It has an executive director and some adminstration, but 99% of the NCAA is run, governed and rules are made by the above people.

This pay the poor players bullshit was started and fomented by the Democrats. Their entire goal is to remove any and all sports from colleges because it takes time and bodies away from their organizing for power efforts. Besides this latest lawsuit regarding giving athletes all this extra stuff, the player likeness issue is coming up for a vote That is where if a players image is used in any kind of ad or promotion for a school, they must be paid for it. It will allow players to sell themselves to the highest bidder for advertisements by businesses.

I guess that would be nice. But they can pay whomever they please. So long as they never receive another thin dime of taxpayer funding, ever, for any reason. The whole basis for tax monies going to these buffoons is that there is a positive State interest in an educated populace.

The shine wears off that argument when you realize the Universities are worthless, they contribute nothing, they educate nobody, and they in fact produce the most ignorant fuckin' swine on offer anywhere in the world.

Same for the public schools. I'd start by immediately defunding all of it, and then have a national conversation about whether to convert all of the employees into dog food, or just plunge them into the sea.

All because they can throw a football, basketball ,etc. and give their school exposure . Remember the money made from ticket sales, television rights, etc. all goes into a giant pool which then is either sent in membership dues to the NCAA OR is budgeted to pay the government mandated Title IX sports

126 My wife had a full scholarship for track all through school. On days where she had a meet, they gave her $8 for the whole day for food and other expenses. They would also have a crappy sack lunch if you were at the right place early enough.

She is extremely grateful for the experience and she got a great education.

When I hear about how she was basically going hungry during full day meets because her family was poor and she didn't get much from the school for food, it pisses me off.

Oh, and the crappy school doctor who examined her ankle a few times when she was complaining about issues completely missed the fact that she was slowly tearing through tendons. It wasn't until she got a real doctor to look at her that she found out she basically had no tendon left and they had to rebuild her ankle tendons through several surgeries.

This is true. Many of the smaller colleges have a fee they charge all students to help fund the athletic department.:0
Ohio State, the one I'm most familiar with, has made a profit the last few years (except until 2020 due to Covid) That profit was then donated back to OSU's general fund for scholarships for the general student population. Big colleges, like OSU, will separate their athletic dept from the university itself so that the athletic dept. has to maintain their own budget and not drain resources from the main university . Ohio State and Ohio State Athletics are two separate entities, both are 501c3s. My guess is the SC's ruling requiring this increased allowance for educational purposes maintains the line the 501c3s have to stay in.

Someone up thread mentioned correctly that the goodies that would accrue to investors are instead directed towards those within the non profit via salaries, benefits, travel, etc often to an absurd amount. Often the boards of these non profits being businessmen themselves see no problem with outsized salaries and benefits for non-profit executives because they themselves often screw over their putative bosses--the investors.

I suspect (though I don't know, because I don't have any smart home stuff) that the Nest device will work without internet, but only as a dumb thermostat.

The way they managed to make a lot of these inscrutable devices useful is by simplifying them and removing the interface. If you've ever tried to program a traditional programmable thermostat, you know how arcane that crap is.

Instead of dealing that kind of indecipherable brain damage, they created nice UIs that run on your mobile phone. Programming is suddenly intuitive and easy, as is reporting. But it also means that get *anything* to work properly, you have to have a cell phone or tablet to connect to it. And that means that it's online. Even if the device itself is locked out, your app can get the data and then forward it happily along.

In the Seventies the NCAA increased football competiveness by reducing scholarships in a couple of ways. Until then, big schools would sign more top-level skill position high school players than they could reasonably use, just to keep good players out of other schools in their conference.

422 The only way it works to pay college athletes is if you have a ranked pick system. The top high school athlete may be picked by the Akron Zips in the first round over Ohio State. Otherwise schools with money will always lead. So it becomes Ohio State and Alabama and everyone else. If the player declines to sign with Akron, then no pay to him at his choice school. Or Akron gets paid by Ohio State.

Baseball kinda has that problem. I like to watch to study the mechanics of the players: how they throw, how they swing, how they run, etc. It's instructive even to watch less accomplished players, whose mechanical flaws are more apparent.

I don't (and didn't, before BLM) follow any teams, and didn't much care who won/lost, I just watched the game for the above consideration.

There are only maybe two college women's basketball programs which are self-sufficient, and no teams in any other women's sports are. Men's sports outside of football and basketball will be hurt too since they all suckle off those programs.

435 Also - just because something *can* be connected to the Internet, does not mean that it *should* be. I have a "smart thermostat" and I have not hooked it up to the wifi. It's not an over-intrustive Nest or anything like that, but it does offer the ability to use the Honeywell app to "monitor and adjust your temperature from anywhere!" and also to use geofencing for it to automatically detect when I'm not home (and thus jack the temperature around).

I do not like any of these features. I particularly do not like the assumption that me being away means it's alright for my house to get up to 80 in the summer. Just because people aren't home doesn't mean pets aren't still in the house. Doesn't mean I don't still have produce sitting out on the kitchen counter. Or 3D printer filament I'd like to keep actually at room temperature.

I've never understood the notion that letting the house grow warmer in the afternoon and then maintaining that temperature really saves anything, especially since you now have to run for an extended period that evening before I get home to bring it back down. As opposed to simply maintaining a lower temp all day...
