Sefton: sefton at cutjibnewsletter.com | The Supreme Court Ducks Another Foundational Issue By Claiming Obamacare Litigants Have No Standing to SueThe Supreme Court has permitted Obamacare to stand, not by ruling on it by the merits, but by disqualifying a lawsuit filed against it by claiming the litigants had no standing to sue as they incurred no concrete harm. The suit argued -- correctly -- that the only rationale that Bush-appointed liberal Chief Justice Roberts had given to claim that Obamacare was Constitutional was that the entire bill was a "tax," owing to the presence of the individual mandate, and that the power of the federal government to lay taxes as it pleases was nigh-plenary. But then later, the individual mandate was repealed. Leaving Obamacare naked of the one provision that was risibly claimed to render it constitutional instead of plainly unconstitutional. Makes sense. But the bravehearts of the Supreme Court chose to duck the issue by saying that they could not reach the merits of the suit, as the litigants themselves suffered no harm by the repeal of the individual mandate, and thus could not file a lawsuit challenging Obamacare. One actual conservative -- Justice Thomas -- endorsed this perverse logic, agreeing that the states suffered no concrete harm, and so were litigants without a basis upon which to sue. Though he did blast Obamacare -- and the Court, for doing all in its power to "the court has gone to great lengths to rescue the Act from its own text." Alito, joined by Gorsuch, dissented, finding that Obamacare is indeed unconstitutional, writing this "third installment in our epic Affordable Care Act trilogy" uses the pretext of a repealed "tax that does not tax to stand and support one of the biggest Government programs in our Nation's history." Alito also found that the litigants -- here, the states -- did indeed suffer a concrete enough harm to permit them standing to appear in court. If you see the sleight-of-hand that Breyer is pulling there: He says the states suffer no harm due to the non-enforceability of the mandate itself, and therefore the states have no standing to sue. Gorusch and Alito say that the relevant question is if the Act itself causes harm to the states, which it inarguably does -- in a legal sense, at any rate. And so then of course, they should have the right to sue. The majority says the mandate, which is now effectively dead letter, inflicts no harm. The dissent notes that the real question is whether the Act inflicts harm-- which it does. So the question should be reached, and Obamacare should be overturned. But the majority -- alas, including Kavanaugh and Barrett, as well as Thomas -- focus just on the mandate, when the suit itself is whether Obamacare is still constitutional given that the figleaf "tax" which propped it up as constitutional is no longer in operation. Just vote harder, guys. And Build Your Own Supreme Court. Comments(Jump to bottom of comments)1

I'll say this, of all the cases against ObamaCare, I thought this one was the weakest.
Roberts fucked up at least 2 SOLID cases that should have destroyed ObamaCare, this one always was a sloppy second. But its clear to me, the "conservative" SC is just going to take a knee on any tough case where a conservative victory might happen. That's not the only issue that's being avoided.
There was also a 9-0 decision in Fulton vs. City of Philadelphia in which Catholic Social Services won against the City of Philadelphia on Free Exercise grounds that Philadelphia cannot refuse to contract with CSS because CSS doesn't take same sex couples as potential foster parents. Huge religious rights win, right? Sort of. It's 9-0 with six justices joining Roberts opinion, which is a pure attempt to avoid having to address Free Speech and the Smith decision, and Alito issuing a 70 odd page concurrence just annihilating Roberts and Gorsuch also issuing a concurrence where he point blank calls out Roberts because the case was supposed to address Smith and Free Speech. Roberts is doing absolutely everything possible to prevent there from being a direct ruling on Smith. Thomas and now Gorsuch have pointed out that such a ruling is inevitable. I guess I'm still completely lost on Obumbles "Care": If there's no individual mandate, isn't this just an unfunded social program, with no constituents? I mean, they were banking on forcing the young/healthy to fund it with the barrel of a gun. Absent that, the feds just keep pulling money out of their ass? I thought even "they" had to have some kind of budget or paper trail on where the funding (debt) came from.

Posted by: Martini Farmer at June 17, 2021 04:53 PM (3H9h1) Courts do not make what are known as advisory decisions/opinions. The person suing must have a specific, individualized harm. I hate to say it because I loathe the use of standing to avoid decisions, but the individual plaintiffs had no standing. The mandate was repealed and thus the individuals would not have any harm to them. I disagree utterly on standing by the states. The states are still being forced to comply with provisions of the ACA and that does cause specific harm. The public policy reason for must have specific, personalized harm is to keep the courts from being clogged up by everyone suing because they don't like a political action. Basically politics has become a game of hot potato, where everyone keeps trying to shift responsibility for decisions to someone else. This is a better outcome than I expected. The SC said that the ACA is only valid because the penalty is a tax. Congress said, okay, we are going to keep the ACA and drop the penalty.
If the SC found that that makes the ACA unconstitutional, striking the ACA means striking two laws. Just striking the lack of penalty would only strike one law. So thats what I was worried about. What is the layman's version of Smith?
Posted by: Guy Mohawk at June 17, 2021 04:58 PM (r+sAi) Smith, which is a Scalia opinion, is that free expression of religion is not impacted by laws of general applicability. This is the peyote case. Native American drug counsellors were fired because they used peyote during a religious ceremony. They filed for unemployment and were denied because drug use was a grounds for denial of benefits. The ruling was that, in most circumstances, laws of general applicability that impact religious practices are not subject to the compelling interest test. The rational basis test should be used. That's a very low level test that is highly favorable to government actions. It brought back the beliefs/actions distinction. The government cannot tell you what to believe but religiously based actions are not protected unless the law singles out religion. I hate to say it about a Scalia opinion but this is nonsense on stilts. Beliefs are shown by actions. Bluntly (pun intended), the decision came out the way it did because it involved drugs and Scalia had a HUGE blind spot about drugs. Drugs bad, laws against them good. Can't get fired up about this - it's a soft case. Roberts contorted the law like a pretzel in his Obamacare-saving ruling, which was his attempt to keep the court out of politics (by acting politically!) and that's the real problem.
This case going the other way would have been an activist move by the court to correct a prior poor decision. Even Thomas, who rails on about how the court needs to upend poorly decided precedent, didn't go for it on this one, because the case is weak sauce. If you use the definition of harm needed to have standing here, literally anything the Federal government does can be challenged. Hmm, that sounds kinda good...but no. Not a good enough case. The game is rigged.
The act is only constitutional because of the "tax." But repealing the "tax" makes it unchallengeable in court. These asswipes have knowingly created a Catch 22 to take them off the hook of sh!tcanning this pile of garbage. The truth is that the ONLY thing which decided the fate of Obamacare was not the law, or the Constitution, but merely the fact that our elites are embarrassed we don't have the government running and paying for our healthcare system like our foreign allies do. Everything else is pretense. That is where their allegiance lays, and there is no one you can elect, and no challenge you can make that will ever change it. Elections exist only to mollify you and make you think you have some say in the matter, when really, everything is arranged so that the end result will be the same regardless of who you elect or who you appoint. Trump was the one exception to this, and that is why they will hound him until he is dead or in prison. Biden let it slip when he said they don't need your vote. They all know it is rigged. Sure we have tax shelter health saving's plans and we have something called insurance which has crazy rules like "you pay everything until you reach 50 bazillion $$$$$ and then we'll pay some too" it all sucks. It doesn't seem much different from earlier catastrophic plans. No copays nothing. I assume this is never coming back. So why? Corps like the new rules? I have a plan to save the Union, through an Article V Convention to amend the Constitution.
My first Amendment: The Supreme Court will consist of nine individuals selected by a majority of the Governors of the several States, at an annual convention of Governors, and confirmed by a majority of State Legislatures. Supreme Court Justices will serve for nine years, with one being replaced at each annual Governor's Convention, unless a Justice needs to be replaced due to death or resignation. In that event, the Justice selected to replace the departed Justice will serve out that Justices nine year term only. At each annual Convention of Governors, any Justice can be removed by a simple majority of Governors, to be replaced by whomever they select for the remainder of their term, upon being confirmed by a majority of State Legislatures. It's as if a Christian sculptor was approached about creating a statue, only to discover that it would be used in a pagan ritual. Simply offering a preapproved list of sculptures doesn't change the fact that it will be constructed for use in a way which the Christian opposes, and will thus contribute to another person's sin. I think the incompetent conservatives ,not theRINOs , have a mental block about playing by the rules being more important than winning. The problem is that they have created rules where none exist . Currently I just have an indemnity med policy. There is a set amount they will pay me for specific services. You can negotiate on your own with your provider on a price.

But wait! It gets better! Now if an illegal gets into the country, and asks for asylum... even if it is not granted yet, the US Government will now fly THEIR FAMILY here, so they can 'be together', while they await their court dates.
The court dates they will not show up for, now that the US Taxpayer has paid for the family to get here. Posted by: Romeo13 at June 17, 2021 05:38 PM (oHd/0) *** This is just friggin insane. Complete bullsh*t! Posted by: Diogenes at June 17, 2021 05:41 PM (axyOa) 255

Federal Judge Rules That Jewish Baker Must Make 'Death To Israel' Cake For Arab Customer
"The American right to cake is just as sacred as the right to kill unborn babies, choose your own pronouns, and vote by mail without showing ID or proof of citizenship," the judge said in his scathing 12-page ruling. "As such, I decree that Jake Bakes Cakes must bake the 'Death To Israel' cake." Posted by: andycanuck at June 17, 2021 05:45 PM (UHVv4) 269
"Cake shops apparently need to just offer a binder of cake decorating patterns they will do."
A practical solution but a retreat from Religious Liberty and Freedom of Association. Back when I thought I could save liberal lives from Fen's Wrath, I would argue that: "Should a feminist photographer be required shoot a BDSM scene that she feels promotes violence against women? How about a Jewish seamstress forced to sew Nazi Uniforms for the local KKK rally?" But they still don't get it, because as Fen's Law show us, the don't really believe in the things they lecture the rest of us about. Applied here, it means that since they they care about freedom of association, my points above are just selling a hill they occupied. Waste of time and energy, because what this is really about is their hatred of Christians. I stopped supporting homosexual rights because of it. When they show me they can respect the rights of those other than themselves, I'll start supporting their rights again. Same with trans. It's all about THEM, making others deny reality and pretend they are the same as women. SO self-centered. Posted by: Hoyt's Paid Turkish Provocateur at June 17, 2021 05:46 PM (83lwH) 270

Well, I just signed up for Medicare Part A, but am keeping my employer health insurance.
Anybody do research on Medicare? It's great way to go bankrupt. But don't worry, they'll only take $148.50 per month out of your SS check and pay 80% of your medical bills. Hope your teeth don't fall out. Posted by: wth at June 17, 2021 05:47 PM (v0R5T) 272
I figured it was something like that. Really truly sucks.
I think it might still be legal to offer and buy short-term insurance, but that kind of defeats the purpose of insurance too. Posted by: Stephen Price Blair at June 17, 2021 05:47 PM (CX3cf) 273

The "suffered no harm" caveat is one I'd the stupidest things in law when it comes to trying to stop the government. So if the government okays mass arrest of say, the Japanese, you can't stop the clearly illegal and unconstitutional act, until those citizens have already been harmed, knowing full well that it's 100% unconstitutional. Or they won't stop it if you're a concerned 3rd party. So people are okay with watching fellow citizens get hurt or worse, because the Supreme Court has decided that the government can explicitly say they are going to break the law, but we can't take them at their word.
This wouldn't be held up for you or I, as if we made a threat we'd be arrested before we can go through with it, even if a 3rd party heard the threat and made the complaint to police. The government threatens us all with its unconstitutional laws, but it's not until they put its citizens through hell that they can be stopped (unless the SCotUS decides that it's fully onboard edith all the government's unconstitutional laws, like they often do) Posted by: Rbastid at June 17, 2021 06:59 PM (vk2Uw) Posted by: micky at June 17, 2021 07:43 PM (3byMq) 278
Alternate version:
"In a 7-2 ruling today the Supreme Court affirmed that Rule of Law doesn't apply if you're not going to get convicted of anything." They've just legalized all the shoplifting, arson, assaults, looting, and other Antifa and BLM riot actions, since there is no penalty for those actions. According to the Supreme Court, without a penalty, those actions cannot be considered to be wrong Posted by: LCMS Rulz! at June 17, 2021 10:46 PM (K58O6) Processing 0.05, elapsed 0.0591 seconds. |
