Closing the Barn Door – Changes in Voting Laws [Dave in Fla]

These bills are an unmistakable response to the unfounded and dangerous lies about fraud that followed the 2020 election.
-- The Brennan Center

Let’s get it out on the table from the start. Donald Trump won the 2020 election.

Election fraud in Atlanta, Phoenix, Philadelphia, Pittsburgh, Detroit, and Milwaukee allowed a historic turnout and electoral victory to be stolen from Trump. I’m not going to spend time in this post proving this or explaining the evidence (though I may do such a post, if there is interest).

What I want to talk about is the response to the election in the state legislatures.

I know, I know. What is the point? The Democrats stole an election and at least 3 Senate seats, they proved they can do it, with the willing assistance of Republicans at both the federal and state levels. They will just do it again in 2022, and 2024, and on and on for what is left of our Republic.

It’s a good question.

I don’t know what the future holds, but I do know that our political philosophy is the majority opinion of this country and the majority in enough states to deliver over 300 Electoral Votes. The future depends a great deal on whether or not the populations of individual states will enforce their political will on their states and demand fair elections.

So let’s pretend that voting still matters.

In the aftermath of 2020 twenty-eight states have introduced legislation to put additional restrictions on voting mechanisms. Now, not all of these are going to become law. Bills introduced in New Jersey and Washington are unlikely to become law because of Democrat opposition. But there is considerable activity in many of the Battleground states to address the mess from 2020 and to ensure elections in those states are fair going forward.

The legislative remedies run a wide gamut, including limitations on vote by mail, restrictions on automatic absentee ballot mailing, ballot harvesting, voter ID, stricter signature requirements, ballot return restrictions, poll watcher access, and voter roll purging. Let’s take a closer look at what is going on in six states, Arizona, Florida, Texas, Georgia, New Hampshire, and Pennsylvania.

Arizona

These proposals are a concerted effort from those in Arizona — and across the nation — who wish to sow additional doubts about our elections in the minds of voters, and feed into the paranoia that has plagued our political discourse over the past several months"
-- Michael Bidwell, Arizona Cardinals President

Of course the big news out of Arizona is the ongoing audit. In the reporting on the audit you can see how the MSM manages to keep a lid on information. They flood the internet with the same story, all about how insane it is to question the legitimacy of the Arizona vote.

Arizona’s problem plagued audit”
-- CNN
Arizona Republicans flock to fringe conservative media
-- The Hill
Arizona 2020 election Review: Risks for Republicans
-- NY Times
Republicans push to export absurd Arizona style election audits
-- Huffington Post

Finding factual information on the audit is difficult, and the media frenzy over the situation is very much a “Lady doth protest too much” moment. There is also a concerted effort to discredit whatever results are announced with words like “flawed” “troubled” and “partisan” used liberally in all reporting. Also of note, representatives from both Georgia and Pennsylvania have visited Arizona to learn about the process being used.

Outside of the audit, there was one piece of legislation passed. Michael Bidwell’s overwrought response above is to a pretty benign change that was signed into law on April 15, 2021. Arizona has eliminated the Permanent Early Voting List where ballots are sent automatically to voters in every election they are eligible to vote. The new law removes voters from the list if they do not use their ballot for two election cycles. This change has been derided everywhere as “VOTER SUPPRESSION” (apparently a nationwide theme). I have to wonder how many votes Democrats receive legitimately, if a minor change like this amps their rhetoric up to eleventy.

If the audit results in evidence that the Arizona election result were wrong, then expect additional legislation to be introduced. A number of lawmakers have said that they are waiting to see those results.

Florida

If you can’t cast your ballot, or others make it more difficult for you to be able to do, they’re basically impeding your freedom and your voice.
-- Charlie Crist, former Florida Governor, loser, and opportunist

After running the cleanest and smoothest election in the nation, you would think that Florida would sit back and rest on its laurels. You would be wrong. On May 6, 2021, Ron DeSantis signed SB90 into law which took effect immediately. The new law establishes restrictions in areas that are ripe for fraud. Mail-in ballot requests can no longer be requested for more than one general election. Requests for a mail-in ballot must include identifying information, such as driver’s license number or the last four digits of the SSN. Possession of more than 2 ballots in addition to your own is illegal, with very specific exceptions for family members and nursing home voting, in order to crack down on ballot harvesting. New restrictions on ballot drop boxes including expanding the ban on political electioneering to include drop box locations. One lesser noticed provision of the bill is the prohibition of any private entity from funding an election related expense. This provision targets leftist organizations from coming into blue areas and paying to “help” the election, thereby giving those counties an advantage.

With no viable rationale for being elected to replace Ron DeSantis, both Charlie Crist and Nikki Fried have latched onto voter suppression as the cornerstone of their campaigns. Democrat front groups have also quickly filed lawsuits challenging SB90 as unconstitutional.

Texas

The bill would also make it easier to overturn an election, allowing courts to throw out results if enough ballots were cast illegally that it could have made a difference -- despite the fact that there is no evidence of widespread voter fraud in Texas or any other US state.
-- Paul LeBlanc, CNN

In Texas a bill to change election law has passed both chambers, but the Democrats staged a walkout to prevent a quorum from voting on the bill. I’ll be honest, I’m not sure the state of the bill. Governor Abbott is expected to call a special session of the legislature to allow the bill to be voted on shortly. The key provisions of the bill are targeting mail-in ballots and voting procedures that can be exploited:

1) Ban afterhours voting
2) Restrict hours for early voting
3) Prohibit dropboxes and drive through voting
4) Ban sending mail-in vote applications to voters who did not request one
5) Bar counties from helping facilitate distribution of unsolicited ballot requests
6) Require driver’s license number or SSN for both mail-in ballot request and the returned ballot
7) Fines for election officials who do not update voter rolls
Criminal penalties for election workers who obstruct poll watchers

Georgia

Democrats and voting rights groups were outraged by voter ID provisions and changes to mail voting that they believe will make more difficult for some minorities and poorer voters to cast a ballot.
-- CBS News

Ah Georgia, the epicenter of voting controversy. Not only was Georgia outright stolen from Trump, two Senate seats were also stolen. This was done with the active participation of the Republican Secretary of State and the benign indifference of Governor Brian Kemp. However, the Georgia legislature immediately turned around and passed new voting laws, which were signed by Kemp in April, despite the active opposition of the likes of Coca Cola, Delta, and Major League Baseball.

The new law in Georgia makes the following major changes to election law:

1) Expanded early voting in rural counties – bringing them on par with early voting opportunities in the metro areas
2) ID requirements for mail-in voting – the returned ballot must include a driver’s license number or a state ID number. This is identical to the requirement for in-person voting.
3) Drop box regulation – limits to the number of dropboxes, requirements for security of the dropboxes, and limits on when they can be used.
4) Prohibits mailing unsolicited ballots – to get a mail-in ballot you must request one.
5) Prohibits food and drink service to people in poll lines – apparently this was a thing.
6) Removes power from the Secretary of State – election board is now chaired by the SOS, but the SOS does not have a vote. The election board has new powers over local election officials including removal.
7) Reporting requirements – many changes here, but most importantly the total number of votes cast including election day, early voting and mail-in votes must be posted by 10 PM on election day. No more suddenly finding 20,000 votes at 3AM.
Fraud hotline – a hotline must be established for reporting voter intimidation or illegal activity. Also legislatively states that unlimited challenges can be made to a voter’s qualifications to cast a ballot. This addresses the courts that blocked True the Vote’s efforts to challenge to 360,000 voter’s eligibility during the runoff.

New Hampshire

The bill is blatantly unconstitutional...it would create a logistical nightmare for state elections
-- Paul Bergeron, (D) NH House of Representatives

I wanted to talk a little about the changes in New Hampshire. These aren’t sweeping changes such as those in Georgia, but they illustrate that even in blue New England, the states are concerned about election integrity. A bill just passed the legislature and is heading to the Governor for signature. The major changes are requiring a photo be taken of anyone registering to vote without a photo ID and giving political parties access to absentee ballot requests.

While the changes sound pretty benign, and did have bipartisan support, the major controversy was an amendment that passed the House 202-175. This amendment pushes back on the For the People Act stating the New Hampshire will not comply with national election requirements when conducting state and local elections.

Pennsylvania

In Pennsylvania a more measured approach is being taken. Personally, I think this is due to the political realities. There are enough votes to pass any legislation, but they have to get the Governor to sign the bill. More bills were submitted in this state than any other, 14 bills. But they were all tabled and routed to the joint House State Government Committee. This committee conducted 3 months of hearings on a wide range of subjects and issued a report on May 12, 2021.

The report is very comprehensive and if you read past the “nice, bipartisan” language, you can see that they did not shy away from the real problems in Pennsylvania. There are 25 major conclusions including; “Any place where a ballot is being cast should be treated as a polling place, with
meaningful access for bipartisan observers as well as consistent accessibility requirements. The Election Code should provide uniformity in ensuring that all places where voting occurs are subject to the same regulations regarding accessibility, transparency, electioneering, and security.”

I have to admit that taking off my partisan anger over the stolen election, the process used here looks very fair. If we were dealing with honest brokers in the Democrat Party, I would be impressed by the work done. They looked at concerns from both sides of the aisle and made recommendations that both enhance the security of elections and expand voting access. The political reality is that the GOP controls 60% of both the Senate and the House, which is unsurprising given the demographics of the state as I discussed earlier. But the fraud machine makes it easier for the metro areas to dictate state-wide elections, especially for Governor. I feel there is some hope here for legislation to pass. When the Legislature rescinded all of the emergency powers it also rescinded the emergency laws allowing mail-in voting without cause. The election law reverts to the previous version where PA is one of the few states that does not allow absentee voting without having to give a reason why.

Here are some of the highlights I took from the report:

1) Clear and uniform guidance to election officials through statutory language
2) Upgrade systems to support mail-in voting
3) Improve election audit processes using other states for best practices and make them independent
4) Move the voter registration deadline back to 30 days prior to election
5) Follow the Florida model for voting machine certification
6) Allow no excuse mail-in voting but require voter ID with it
7) Consistent election day procedures for all 67 counties
Cybersecurity protections to provide election integrity

I’ve only touched on the surface of this report, and I think it is worth reading. It is clear and avoids legislative language.

There are many other states who have passed or are about to pass new election laws. I am encouraged to see all of the activity going on, and I hope that Michigan and Wisconsin will soon take up legislation. Assuming that our vote ever matters again, these changes are a good step forward, allowing us to cast our vote and be able to trust the results. And the shrieks of “Voter Suppression” from the left tells me that these new laws are cutting into the core mechanisms used for fraud.

21 PA will be the best if they can get Tommy to sign the bill or come up with enough votes to override.

They've got this handled because they've been thinking about this for a long time. The larger urban areas have been more and more the scenes of unmistakable voter fraud. So obvious and blatant that even children can see it.

However because they are polities of their own and very powerful they've been able to resist specific laws aimed at how they cheat. In Pittsburgh and particularly in Philly they run a very tight organization and in Philly Blacks might as well be chained together because of how closely in step they are. Which is so weird cause Philly phucks them over continuously. At least the ones in the hoods.

This time they've gone too far and all the myriad conservative counties are saying "enough's enough". They see how they must take an interest even tho they don't live in the urban shitholes.

They're the tail wagging the dog.

31 Thanks, Dave. I appreciate your analysis and round-up. One part of this really stands out, though:

Bills introduced in New Jersey and Washington are unlikely to become law because of Democrat opposition. But there is considerable activity in many of the Battleground states to address the mess from 2020 and to ensure elections in those states are fair going forward.

What I don't understand - it may just be bitter cynicism, and I acknowledge that - is why this matters. The legislators failed to act last time when it was clear that the elections were hinkey as hell. Why is putt into place more laws relevant when the Left can just break them with impunity while the official opposition Republicans hand-wring about it but ultimately do nothing? How is adding another charge to what they're doing relevant? They clearly don't care.

A really big obstacle is the county control of the Phila collar counties flipped to demonrat during the Trump admin. The dummyrats never came out for the local elections but when TDS took over they came out in force to flip the county. As usual, centrists, libertarians and soft GOPes stayed home because citizens are woefully uninformed about how local government works.

42 Thanks, Dave. A few quick points.

* exhaustively and conclusively documenting the fraud/lack thereof in the official 2020 results remains absolutely essential, regardless of "reforms"

* what the F is "voting access" supposed to mean? For decades, "voting access" has been perfectly adequate. You go vote. Or you register for an absentee, *with strict requirements imposed*. Period.

This really is key. Note the ridiculous "making it harder for you to vote" idiocy from Crist. Voting, in person, on election day, is not "hard". If it is, get an absentee. End of discussion.

Early voting is absurd, indefensible. Yet here we see it being enshrined forever by "GOP" bodies trying to "fix" things.

Maybe. My problem with all of this new legislation is that even if it passes, the bad actors who violated have amply demonstrated that they don't care about the law, and the bad actors who are responsible for enforcing or questioning violations have demonstrated that they don't care upholding the law.

So what use is MOAR LAW when then the Left happily violates the existing ones and the professional pseudo-right happily lets them get away with it?

Without that, everything remains on this absurd childish level of Dems ranting about "voter suppression!", and the GOP passing additional human rights guarantees for the Soviet Constitution (i.e., nice-sounding but in effect meaningless stuff).

And yes I'm joking, but would it kill someone in the GOP to actually directly, conclusively, and vituperatively - and relentlessly - confront the nonsense of "voter suppression", for once? Mock this nonsense, call out the idiots spreading it, don't stop, make it the "news". Jeebus.

Extremely heavy penalties make convicting people extremely difficult.

So, paradoxically, I'd propose penalties that are relatively light, but more likely to be implemented therefor. A year or two in prison would be ideal. (Fines won't work, because Soros & Co. and/or GoFundMe will just pick up the tab.)

While a year or two in prison wouldn't make the slighest impact on career criminals (e.g., the George Floyds of the world), to the typical party apparatchik it would be humiliating and therefore probably effective.

66 Thanks Dave for a great report.
I notice that other than PA, there is little mention of audits. This is a big oversight by the legislators of they are not addressing it.

EVERYTHING is subject to audits, or the risk of audits. For FLA 2000, we had every punch card reviewed by a group of auditors, often with magnifying glasses and on camera. The arguments then was over the rules (hanging chads, etc.) and what districts but it was full audit to make sure each vote was legitimate.
During the hearings, one woman from MI claimed that in the Detroit cities they don't "close out" the ballot boxes, meaning the #of people who voted do not match the #of votes, and they know this on election night so they just accept the vote count and that district is forever immune to audit since, well it never added up so what good is recounting?
The electronic BS adds another layer of audit-proof. This fraud happened on three or four fronts, and all need to be addressed. First the massive mail in BS, then the lack of audits, third the corrupt chicken shit legislators certifying the crap, and finally the electronic voting which rode the other problems to create an unknown amount of fake ballots...

Actually, the last bit would be very good indeed. If it were followed, that would be a good law. Change vote reporting to a binary state: "ready to report" or "not ready to report."

All precincts must be "ready to report" before all figures are released. Votes are tabulated but not released until every single precinct is ready, then the vote is released to the SoS and it is allowed to hit the wires.

70 Voter I.D. constitutional amendment proposed in Pennsylvania
"Time and again, I hear from constituents who want to know why they need identification to buy cold medicine but not to choose their next Senator, township supervisor, judge or president," she said. "Providing voters with the power to extend the need for identification beyond the first time someone votes at a polling place to every time they vote will go a long way toward restoring confidence in our election process."Constitutional amendments must pass in two consecutive legislative sessions before appearing on the ballot as a voter referendum. The earliest the I.D. question could appear before voters would be 2023, if the Legislature acts quickly.

New laws don't seem to stop people intent on murder with a firearm, but at least there is a mechanism for punishment afterwards.
With the vote, not so much.
Especially with society arrayed as it is against anything to the right of Mao.
Using the last election as the template, media covers for what they know is blatant "irregularity". The courts don't allow challenges. Law enforcement agencies claim there's no evidence, so there's nothing to see here, move along.

I suspect that PA is in a perverse way the cause of what I suspect was the hurried emergency plan - to stop everything and coordinate a theft - that delivered the presidency to Biden's cabal.

This might be pretty far out on a limb, but I wonder if Trump's Butler County rally was the tipping point. That was absolutely, unprecedentedly huge and disruptive. The Butler County turnout may well have been the final straw that led to the Left understanding that PA was lost, and if PA was lost then everything might be lost. But even in dumbed-down America, a review of the election showing it likely to certain that Trump actually won it, would be an earthquake. A vitally needed one. People NEED to not lazily/default trust their "institutions" - these institutions are now almost universally garbage, and if they ever are to be fixed, the ugly must be revealed and acknowledged.

127 7) Reporting requirements - many changes here, but most importantly the
total number of votes cast including election day, early voting and
mail-in votes must be posted by 10 PM on election day. No more suddenly
finding 20,000 votes at 3AM.

That's going to make covering Georgia for Decision Desk interesting. Does this mean I can call the state troopers if we don't see results by 10 p.m.?

129 The sad truth is that penalties for proven election fraud are nothing more than a slap on the wrist. The Democrats do not want severe penalties because the overwhelming majority of election fraud cases occur in large urban areas with majority Democrat voters.

I recall one urban area Democrat bragging to a Fox News reporter that she had voted 6 times already. They only showed that interview one time.

His long history of fact-based analysis, openness to debate, posting of sources and complete transparency as to how he arrived at his conclusions. He may not be right (I think he is, on a lot of stuff) but he is credible because he provides the receipts on request or upfront. He draws his conclusions and those are there for you to accept, question or reject - but the work that went into those conclusions is transparent and has been for as long as he's been posting about elections.

136 85 > despite the fact that there is no evidence of widespread voter fraud in Texas or any other US state.

Notice the lawyerly phrasing: "widespread voter fraud". It is true. There was no "widespread fraud". It was concentrated in a handful of swing states and it was confined to the Presidential race. Funny how Biden got all those votes but none of the down-ballot races got checked.
Posted by: SteveS at June 14, 2021 01:52 PM

I do believe that this happened, but are there numbers, for Fulton County for example, that show that the total number of votes cast in the presidential contest exceeded the total number of votes cast in the senate races? And by a margin greater than typically occurs in other years? And lastly, did the number of votes in the senate race increase overnight in proportion to the number of votes that suddenly appeared for Biden? I'm not holding out hope that these questions will be addressed by the Maricopa or Fulton County audits. It seems that they were part of the evidence that was presented and ignored before the election was certified in each state.

138 If you believe the FNM 90% of the eligible citizens in WI voted.

And that's a huge bit of news, that they don't report on as well.

The truth is, they are scared of people noticing two things:

1) Trump got a crapload of votes, even in their fraudulent official count: over 70 million, or over a quarter of the US population and over a third of the voting age population. That's a TON of Trump voters and supporters out there, and the left does not want anyone to realize that or feel as if they are not isolated and alone.

2) The probability that so many people voted in this election is unbelievably low and ridiculous to consider. There are 209,128,094 people over the age of 17 (voter age) in the USA as of the most recent count. We're supposed to believe that all these people are registered, and 155,506,056 of them voted. That's just not realistic in any scenario.

151 Never been to MI.

I do know that their elections are farcical, even by current national (low) standards. Wayne County has zero election integrity. The frivolous recount in 2016 sought by Jill Stein had to be stopped because (as another moron talked about above), *Wayne County precincts could not meet the most basic, minimal test for election integrity - ballots did not match votes*.

I'll say it for the 1,000th time. Many states in the US have election processes that, if they were used in a foreign election in a country under scrutiny, *would not be recognized by the US, EU, or UN*. Due to their lack of integrity. This is absurd. And I'm not sure all the reforms listed do much to change that.

One election day (no "early voting"). In-person voting with ID. Paper ballots (no electronics). Strict (normal, historical) restrictions on absentees. HD video-covered counting process (every single vote counter observed in person by outsiders, every single move video'd). No vote harvesting.

In PA, IIRC, 820 ballots were cast only for Trump; 95,819 were cast only for Biden.

Nothing fishy about that.

After the third week, I sent a letter to them requesting info, because the stupid receipt they gave me had an invalid order number, and I couldn't track it. No response. Two weeks later, the thing shows up, but still no response. I'm glad I eventually got what I ordered, but that shit is rude.

I believe it varies from 3-5%. I believe at least one key state, at one point in the count, had 18% "president only" ballots.

There is not a single historical or statistical pattern, established in decades of presidential contests, that this election followed. AFAIK. Every significant one was broken. From statewide results vs. Dane + Milwaukee in WI, to Biden having widely varying results within the same demos in different states, to bellwether counties, to regional improbabilities (win FL big, lose GA; win OH big, lose PA when that state was bursting with enthusiastic support).

For the benighted left, every source of trusted information lies to them on a daily basis, so it is understandable that their perception of reality is hopelessly skewed. But for anyone with a brain, it is readily apparent we are being lied to so that those in power can justify collecting more power. The same is obviously true with CRT and climate change.

286 "Drop boxes" - another thing to be completely banned.
WTF is wrong with people?

The way elections were run 40 years ago had much more integrity, and it was just as "easy" to vote.

No vote harvesting, no "drop boxes". Election day in-person/voter ID voting, only. Or absentee, with usual safeguards. Paper ballots, video'd counting process, no electronics.
Done.

Completely f***king obvious and irrefutably the way to do it.

If we do not have voting integrity, we then live in a failed state, and the potential for chaos, even if it never comes to full blown civil war, is historic. New voting laws are UTTERLY IRRELEVANT if there is no enforcement.

And what happened? They 'won' the state, and there were absolutely zero consequences for their lawbreaking.

In more cases than not I expect, they are sociopaths. The way they look at it, honest legitimate elections are a "threat to our democracy". You heard it right. That's what they believe. Preventing fraudulent ballots from being cast, running a clean election, that's just dirty pool. They will tell you this if you get enough beers in 'em. Lying, cheating and stealing, that's just politics. They don't care, and in the words of Hairy Reed, "it worked, didn't it?"

And without a virtuous people, enforcement is not possible. We need a change to our country at the ground level in hearts and minds, not changes at the top with laws.

Even if elections were 100% just and honorable, we'd have people like Pelosi and AOC in office because enough of our fellow countrymen are screwed up and our culture is a sewer.

Trump presented 3 years or so worth of good opportunity to finish putting all of your shit in one bucket before the music stopped, while also providing plenty of examples as to why it was needed and that our current clusterfuck was inevitable.

DoD deployed combat formations to nations were weren't even at war with and shot at them without Trump's permission, and hid that they did so from him. For many areas, Trump was never really president in the first place. There was ZERO chance of reform before he even was sworn in.
