Derek Chauvin juror LIED about protest: Cop's hope of appeal boosted after picture emerges of juror at BLM rally wearing 'Get Your Knee Off Our Necks' T-shirt despite telling court he'd never been on a march
Brandon Mitchell was one of 12 jurors who convicted Minneapolis cop Derek Chauvin of the second-degree murder of George Floyd last month
Mitchell, a 31-year-old black man, was photographed on social media attending an August 28 protest in Washington, DC at which Floyd's relatives spoke
Mitchell is seen in the photograph wearing a t-shirt with a picture of Martin Luther King Jr and the words 'GET YOUR KNEE OFF OUR NECKS' and 'BLM'
He is also wearing a baseball cap embossed with 'Black Lives Matter'
Mitchell acknowledged being at the event and that his uncle posted the photo, but claims he doesn't recall wearing or owning the shirt or cap
Mitchell said he answered 'no' to two questions about demonstrations on the questionnaire sent out before jury selection
Legal experts say the revelation will likely be brought up on appeal by Chauvin's attorney, Eric Nelson, who will argue his client was denied impartial jury

Mitchell has admitted the photo is of him from that date, but defended attending the rally, claiming it was not explicitly a protest against police or a commemoration for George Floyd.
That is despite the fact that Floyd's brother and sister, Philonise and Bridgett Floyd, and relatives of other African Americans who have been shot by police addressed the crowd that day.

Americans struggle to understand what is happening because we still regard ourselves as citizens, and imagine that those who run our republican institutions still respect them to some extent. We see persons whom the ruling class favors committing crimes with impunity, and complain of "a two-tiered justice system." But this is not mere corruption. We see corporations wielding government powers and complain that power is being franchised to favorites. But these are not mere favorites of the regime. This is the new regime being itself. Such things are not deviations from republican legality. They are the assertion of oligarchic reality. This is oligarchic justice, oligarchic normality. The republic was yesterday. The oligarchy is today.

Conservatives' congenital mistake is to try conserving something that no longer exists by supporting institutions that now belong to a regime so alien to republican life that it treats attempts at citizenship as crimes against the regime. And so they are. They call today's American regime "our democracy." It is "theirs," all right, but not ours. It is a classic oligarchy.
What’s an Ex-citizen To Do?
First, stop pretending. Begin by rejecting--in heart and mind entirely, and publicly as prudence may dictate--the authority of the oligarchs who now control what used to be our republican institutions. Realize that you enjoy the rights God gave you only to the extent that your fellow ex-citizens recognize them, and that your only hope of continuing enjoyment lies in leaguing with them, on turning your back on the oligarchy and on effectively living republican lives with similarly minded people.
Citizenship is possible only when the many join together in the kind of mixed regime for the general good that our oligarchs rejected. Turning our backs to the oligarchy is possible for the twin purpose of rejecting un-republican rule and as the assertion of a new republican way of life. Citizenship happens when individuals join together under leaders of their choice to achieve common goals, both positive and negative.
Rejection of oligarchy is possible, even easy, if and when large numbers of persons do it together. This goes for ostensibly private corporations as well as for formerly republican institutions now in the oligarchs' hands. The moment that millions of Americans, whether led by actual state governors in league with one another or by prospective presidents, recognize that Twitter and Facebook are enemy institutions, their power ends. The moment that millions are led to boycott Costco, or Pfizer, their officers are fired. The moment that these millions, so led, refuse the legitimacy of anything coming from Washington, its power ends.
Our oligarchs, having seen how easy it was to cower the majority of Americans to agree to the stupid, self-destructive practices of mask-wearing and lockdowns, having rejoiced in ruining the lives of small numbers of individual dissenters, believing that, under the media's cover, their threats to crush opponents as white supremacists will forestall serious resistance, fantasize about applying the tools of the war on terror to America's population.

But no. Their success was due to what remained of the American people's confidence in them. That is now gone. The oligarchs have the FBI and CIA, and the Pentagon's generals. But who will risk his pension, never mind his life, for them? Who will risk anything for Kamala Harris, never mind Joseph Biden?

25 So automatic mistrial on appeal. The Judge and the Jury both gave the defense enough to get a mistrial declared during the trial but the Judge refused.

First the Judge refused a motion to move the trial out of Minneapolis and then went on record basically saying that chauvin could not get a fair trial anywhere in the State and now this. Pretty sure more will come out.

1. Demonstrate to the plebes that the rulers are firmly in charge and they have no chance.
2. Square the circle of outrage by having such an obviously and patently corrupt proceeding (no change of venue, lying jurors, blatant jury intimidation, gross overcharging - this one has it all) that they can walk back if they want or need to through the appeals process, allowing them to say "look! see?! the system works! once the heat of the moment passed, American Justice delivered!"

2.) Last year, Governor Polis commuted the death sentence for Nathan Dunlap.

63 IANAL, but I'll guess that unless that juror provably _lied_ during voir dire, then there is nothing there that Chauvin can use.

As to whether that juror could be impartial, given evidence of his prior beliefs, I don't know how you prove that one way or the other. It would have been extremely difficult to find any jurors in the case who were unaware of the media coverage, and who had not formed some kind of opinion about it. What counts is whether, in fact, a juror can set aside prejudices. We can ask them, but we can't read their minds.

64 No one who watched the voir dire in the Chauvin case is surprised by this juror's lies.

It was obvious that quite a few of the jurors seated were "social justice warriors" or warrior-wannabes. They wanted to be picked, and at least one of them admitted why: they wanted to "be on the right side of justice" or words to that effect. That is not the kind of thing you say when you plan on keeping an open mind, presuming the defendant is innocent, and following the evidence. That is the kind of thing you say when your mind is already made up and you want to be able to boast to your friends that you helped convict that raaaaaacist cop Chauvin who "murdered" St. George.

Take taxes, the most obvious example of "refusing legitimacy." You can do that, but then you'll have the IRS up your ass, which is exactly why most people won't. Yeah, if 50 million households did that all at once, that would have a certain effect, but it's a lot easier said than done. And unfortunately, sullen compliance is a form of conferring legitimacy. It's not the one the authorities probably want: most regimes prefer a measure of genuine consent from their subjects; but they'll take it if nothing else.

So how exactly do we go about delegitimizing the federal government? I haven't seen a specific plan on this yet.

the hardest thing to admit is that at this point in time, there are *no* solutions that we are capable of implementing on our own - that's the bitter pill we all have to swallow. Our only real hope is that things change, things always change, and their massive screw-ups are going to create a crisis that they *can't* manage (several aer fast approaching)
and when that crisis hits, then we must improvise and do whatever we can to hasten the downfall of the regime; and yes, it might mean the dpwnfall of the entire country and the end of what we've known as the United States. But that looks like that would be quite a good change from where we are now.

Did he tell her he'd just seen some fat white guy looking at him, and he was gonna circle back around and pound his pasty-white ass into the pavement?

There had to be some reason the real girlfriend wouldn't testify. My guess is that she knew her testimony would hurt the state's chances of getting a conviction against Zimmerman.

280 I am a trial attorney in the LA area. I have tried several civil rights cases involving police officers. The cases often come down to a black guy's word against a cop's word. When picking the jury during voir dire, they are asked if they are prejudiced, none will admit to being prejudiced against a black guy's word even if they have a KKK hood under their bed. Whereas every prospective black juror freely admits they don't believe a word a cops says. Then they get kicked off for cause, and it is difficult to get a balanced jury.

Rhomboid, I believe the bad news would be that GOP leadership will think that their 'strategy' worked. Let Dem overreach backfire on them, etc. The good news, however, could be that we can put pressure on them to deliver, or at least gum up the works so that things don't get too bad for a President DeSantis or Trump redux. I've been on the 'let it burn' train for a while, but I'm having (minor) second thoughts. We need to have some kind of country for us to rebuild, and if this thing goes too far off the rails, the next real President will need to do some very unpopular things to get us back on track. I'm thinking Volcker-type 1980s things, which would be very hard on us going forward.

Let's just say I'm a 'let it burn, but with nagging second thoughts' type person right now.

This is a weird comparison and you know it. School boards dictate, in part, the education of a generation of youth. One person pushing the breaks on crazy stuff there makes a difference. Two people is even better.

The idea is that more conservatives should get involved in their local government to help direct government that touches people's lives most, especially at the education level.

Planned Parenthood is different, but if we could get conservatives onto that board somehow (which would be nearly impossible since they select their own board as opposed to school boards that are generally elected) then maybe those conservatives could also get Planned Parenthood to stop selling baby parts. It's never a bad idea to get involved.

And the prosecutor in that case knew that the girl who did testify at the trial was not the girlfriend he was on the phone with that night. He should have been disbarred and subject to a civil suit from zimmerman but he lied about it and got away with it.

I understand the need to protect lawyers from angry people who got busted and I get that you cannot have constant lawsuits against prosecutors and judges just because people didn't like the outcome but... maybe the protections have gone too far, since its these people writing and interpreting the laws

He was one of those cops that kept having excessive force complaints and a day off to sit and think about it but kept on the force, from what I read. Maybe people have other info.

339 Internet outage interrupted my dialogue on consequences of '22 House GOP win. We all survived. But net/net, from all responses I saw, was really no change. Senate as now configured can block all legislation other than Budget Resolution and Reconciliation. Filibuster goes, that changes. Dems get up to 59 seats, that changes (very unlikely).

And I also missed the things that make Chauvin look bad. In any case, they're not relevant to the case. It's all there, in video and medical examiner's reports, isn't it?

Yeah, but ... I need more context. Is that a lot or not? To compare, I'd need to know how many such complaints were lodged against other police officers serving for a similar time, in a similar neighborhood, with similar numbers of felony arrests.

Otherwise, it might be a comparison of a long-serving cop patrolling a shitty neighborhood and making lots of felony arrests, with a new police academy graduate who's never made an arrest and who is guarding the Dunkin' Donuts in an upscale area. Exaggerating, obviously, but I think context is needed.

It was a combination of several things. First the cops were surrounded by a loud and hostile crowd. The cops were scared. Second, the cops knew that the fire station was just a couple of blocks away, and they believed that the EMT's were going to arrive any second. Third, the cops knew Floyd had taken a lot of drugs.

On the tape you can hear the cops saying things like "he has passed out" and "he'll be fine" when Floyd stopped moving.
They didn't realize he'd stopped breathing. They thought he'd just passed out from the drug use. When the one cop came over and tried to check Floyd's pulse and couldn't find one, it's not clear if Chauvin heard that or not. But even if he did, police protocol is that they not start CPR unless it's safe to do so. It could be Chauvin thought it wouldn't be safe, given the hostile crowd. And he knew he had a window of several minutes to re-start Floyd's heart.

Murder involves intent. To convict of murder, you have to believe Chauvin intended on killing Floyd, be it pre-conceived (1st degree) or heat of the moment (2nd degree). Minnesota has a special 3rd degree, but even that requires "evincing a depraved mind", or "causes the death of a human being by, directly or indirectly, unlawfully
selling, giving away, bartering, delivering, exchanging, distributing,
or administering a controlled substance classified in Schedule I or II...". So it seems to me that the drug dealer that gave Floyd the stuff is guilty of at least 3rd degree murder. What are the chances he will be prosecuted? I give it near zero.

Whereas people being arrested for felonies would never consider making use of force allegations, potentially as a bargaining chip. Same thing with claiming they can't breathe, which I've read is de rigeur among people getting arrested.
