#MuhJudges: Kavanaugh and Barrett Refuse to Consider Illegal Ballot-Counting Changes in Pennsylvania

Before the inauguration: Not timely

After the certification: Moot

It's almost as if they're willing to resort to claiming any ol' doctrine to avoid saying that you're not allowed to violate the Constitution when you change election rules last-minute.

Alito, Gorsuch, and Thomas dissented.

On Monday, the Supreme Court threw out several of the remaining challenges to the 2020 presidential election as moot, considering that former President Donald Trump conceded to Joe Biden, who has now become president. Yet Justices Samuel Alito and Clarence Thomas dissented, arguing that the Supreme Court should have taken the opportunity to clarify election law, especially in the case of Pennsylvania.

"The Constitution gives to each state legislature authority to determine the ‘Manner’ of federal elections," Thomas wrote. "Yet both before and after the 2020 election, nonlegislative officials in various States took it upon themselves to set the rules instead. As a result, we received an unusually high number of petitions and emergency applications contesting those changes."

Thomas argued that the cases Republican Party of Pennsylvania v. Veronica DeGraffenreid (2021) and Jake Corman v. Pennsylvania Democratic Party (2021) presented "a clear example" of election law issues that the Supreme Court should put to rest. "The Pennsylvania Legislature established an unambiguous deadline for receiving mail-in ballots: 8 p.m. on election day. Dissatisfied, the Pennsylvania Supreme Court extended that deadline by three days."

"That decision to rewrite the rules seems to have affected too few ballots to change the outcome of any federal election. But that may not be the case in the future," Thomas argued. "These cases provide us with an ideal opportunity to address just what authority nonlegislative officials have to set election rules, and to do so well before the next election cycle. The refusal to do so is inexplicable."

I can explain it: the "Shadow conspiracy" article in Time Magazine explained it.

The Shadow Conspiracy article in Time was written to alert the left that these changes were absolutely critical to fake-winning the election, and that therefore, anyone on the left and anyone supporting the permanent corrupt Deep State must fight with all their might to keep these illegal rules in place.

Remember, these last-minute illegal changes were mostly justified by the pandemic threat.

But the left might not have that justification in 2022.

So the people who rigged the election told their stories to Time to let the rest of the left know: Even if there is no major pandemic threat in 2022, you must fight tooth and nail to retail the illegal rules changes we instituted supposedly "because of the pandemic."

Or else you'll just lose.

I guess the Supreme Court figured that much out.


Alito also wrote a dissent, which Justice Neil Gorsuch joined. Alito argued that these cases "present an important and recurring constitutional question: whether the Elections or Electors Clauses of the United States Constitution… are violated when a state court holds that a state constitutional provision overrides a state statute governing the manner in which a federal election is to be conducted. That question has divided the lower courts,* and our review at this time would be greatly beneficial."

"Now, the election is over, and there is no reason for refusing to decide the important question that these cases pose," Alito argued. While a decision in these cases "would not have any implications regarding the 2020 election," it would "provide invaluable guidance for future elections."

By the way, they keep saying that this wouldn't effect the results of the election because they have repeatedly sifted the number of challenges down to the point where we're talking about just a couple of thousand ballots.

They've figured out other ways to ignore the challenges to all the other ballots.

It's like breaking down a cargo into a hundred pieces and saying of each tiny piece, "No, this won't meaningfully affect the ship's seaworthiness. No this one also won't meaningfully affect the ship's seaworthiness. No this one also won't appreciably affect the ship's seaworthiness..."

Yeah but take them all together and the ship sinks.

Let me put this simply:

Teams that are winning and have the advantage in points don't start changing the rules for what counts as a "point" behind-the-scenes.

The team that is behind changes the rules.

Is that a noncontroversial enough take?

Or are we now at the point where we pretend that the team ahead on the scoreboard starts making sketchy rules-changes just to pad their margin?

This is really disappointing because in 2018 the Pennsylvania Supreme Court (5D-2R) stuck it's nose into Congressional redistricting, completely replacing the plan by the legislature with one of their own which gave at least 3 seats to the Democrats. The issue in Republican Party of Pennsylvania v. Degraffenreid (formerly Boockvar) would have ended this practice cold.

Justices Christine Donohue(D), Kevin Dougherty (D), and David Wecht (D) are up for a retention vote in 2025, while Debra Todd(D) and Sallie Updyke Mundy (R) are up for retention vote in 2027. Chief Justice Thomas G. Saylor (R) must step down Dec 2021 and Justice Max Baer (D) must step down Dec 2022 when they reach 75 years old. If the judge is not retained or steps down, the governor, subject to the approval of the State Senate, appoints a temporary replacement until a special election can be held. Governor Wolf (D) is in office till Jan 2023, when term limits preclude him from running again.

I think that 99% of these people are swamp first. They were before, and they were now. It's like a bunch of sleeper cells. They were playing their parts, and when called to SCOTUS they were activated.

They knew how the hearings would go, and while we were outraged at antics of the left, people like Schumer and Ford and the horrible accusations, it was all Kabuki. If we'd have known his true intentions, what might have happened? They all went out for drinks and a laugh afterwards. Trump fell for it too - but then again, I don't think there's a single appointment he could have made that wouldn't have gone the same way.

Where I see a distinction as compared to Bush 43 (for example) is that Trump actually tried to take it seriously and put forth people with real conservative bona fides. It didn't work and those picks have been mediocre at best. Bush didn't even bother trying to do well. Other examples like Eisenhower are even better. Eisenhower didn't care about the Court at all and it showed and he gave us one of the most destructive Courts in our history. Intentions don't count for everything by any means, but they do count for something.

That said, I am increasingly of the opinion that SCOTUS picks are a bad test. Try or don't, take it seriously or don't. It doesn't seem to matter. Once the justice gets into that particular hall of power, he tacks toward "maximizing state power.". This happens quickly regardless. Kavanaugh isn't the exception, Thomas is.

I place the decline at Carter. He was the first President who was not pro-America. Even FDR was pro-America. Now we have a system where the government is united in faction and goal, deciding that they won't fight amongst themselves but rather act contrary to the will of the people.

I'm now convinced that our system has always had an expiration date.

The Ottomans don't become Caliphate till later when they conquered Egypt, and that's more akin to their long acquisition of hats. Practically speaking the Roman institutions of governance would continue for some time with additional Persian influences.

The Ottomans were originally Anatolian beyliks, so greek influence was heavy to begin with. If they weren't Muslim it'd just be another Roman civil war as happened from time to time.

If it devolves into armed conflict here (which will likely look like the Troubles in Ireland), someone beyond our borders is going to decide that the time is right to knock the US out altogether. They could get a free ride here and a willing coalition of West Coast states to support them - and the ChiComs still couldn't project that much force, that far away, for very long. Well, it was designed to do that but inevitable that it would not. If everything was working as designed and intended, the wild excesses of the Supreme Court would be checked by an executive that shrugged at their unconstitutional decisions and a legislature that blocked off the scope of their powers and impeached judges that went off the rails.

Instead, both have figured out that voters might get mad at justices but don't blame either branch for when they go wrong, so its best to just let the SCOTUS rule and then get reelected in your office.

But that date is not '22. They don't need to cheat in '22. And, they may in fact want to see a """GOP""" """win""" in that cycle.

The massive, public cheat in '20 was necessitated by the categorical imperative of removing Trump BAMN. He's gone now.

A GOP """win""" in '22 would mean the same thing it always has: a Kabuki-theater opposition to the big changes from the previous, radically aggressive legislative cycle, that preserves those changes and makes them permanent in practical reality.

But they'd also get the added benefit of saying "SEE! The system isn't rigged! The white supremacists won ANOTHER election!"

I don't see a lot of benefits from openly stealing another cycle at this time. And there are no downsides if they """lose.""" So I don't read it as the scenario where these rules will be needed.

Winner. I always cringe when rock-ribbed Republicans cry out for SCOTUS to preserve this or that Constitutional right. That's Incorporation. And that was never, ever part of the original plan. I honestly don't know what's worse - Blue State Republicans who want SCOTUS to overturn the will of their own State, or Red State Republicans who want SCOTUS to overturn the will of somebody else's State.

484 it's not over yet - it's just the court deciding not to take up the cases - at some point they will have too and it's going to look pretty bad for them when they are forced to. the people can change all of this at any time because even when the supreme court decides against something we can force our reps to represent the people and they will or else. and we're pretty close to or else...
