Sefton: sefton at cutjibnewsletter.com | Trump Submits First Reply to Farcical, Fascist Fake Impeachment ChargesThe former president makes a few extremely salient arguments against the Democrats' impeachment article. In addition to the claim that the Senate cannot convict a former president on impeachment, Trump argues that the Democrats violated his free speech and due process rights in rushing to impeach him and that the article of impeachment is deceptively ed in an unfair manner. Trump also claims that disqualifying him from office would constitute a "bill of attainder," which has been broadly interpreted to mean a legislative act against a class of people that inflcits punishment on them without a judicial trial.Read the whole thing. That's a good point. The fact that Trump is -- was -- president does not mean that the Constitution is suddenly toggled to the "off" position making it legal to criminalize speech and opinions. But they have to claim this kind of bullshit, because Trump never said anything that would be constitutionally unprotected, like "Let's burn this down." That's what the antifa agent provocateur said repeatedly in his own video-- and he's already been released without bail. Update: Some of his lawyers quit due to his insistence on defending his election claims. Lawyers are now refusing to represent clients based on politics and social pressure from the Ruling Class. America is dead. Comments(Jump to bottom of comments)1

In order to get a conviction for seditious conspiracy, the government must prove that the defendant in fact conspired to use force. Simply advocating for the use of force is not the same thing and in most cases is protected as free speech under the First Amendment. For example, two or more people who give public speeches suggesting the need for a total revolution "by any means necessary" have not necessarily conspired to overthrow the government. Rather, they're just sharing their opinions, however unsavory. But actively planning such an action (distributing guns, working out the logistics of an attack, actively opposing lawful authority, etc.) could be considered a seditious conspiracy. : Posted by: LASue at February 02, 2021 04:15 PM (Ed8Zd) 140

ATC,
At this stage, there are not the votes to convict in the Senate which Rand cleverly demonstrated in a test vote. So that leaves the choice of McConnell whipping his caucus into immolation or the failure of the bill of attainder. Assuming the worse and the senate votes to bar Trump from office as a penalty, then if Trump sues to get ballot access for a race, it would force a case. Dunno what the Scotus bench will look like by then so no predictions. Conviction though would destroy the Republican party in Congress--probably by splintering the office holders into factions in Congress until the electorate ratified the split formally. Sniffy, the constitution mentions the CJ only serving when the president is impeached--not a former office holder. It would be as if you asked a judge to preside over the criminal trial of a corpse. idk the legal ramifications, but it seems such a public trial would be a good place to present evidence. -- I could see that a lawyer would want to only prove other things, like that there was no incitement to sedition or to storm the capitol. Posted by: It's me donna at February 02, 2021 04:34 PM (Zmnko) ========== Seems more likely that he's going to hold his caucus together as much as possible against conviction for fundraising purposes while still trying to protect a member of the House leadership. As I've been saying, we're probably not lucky enough to get a conviction in the Senate - the "luck" part being that such a surreal outrage would almost certainly trigger the end of the GOP. Which is in its turn almost certainly the only thing that would raise the prospect of national recovery occurring in a relevant time frame (fairly soon).

272 Mitch is being a bit stupid endorsing Cheney as there is a subtle dislike between the House and Senate members even in the same party. House members, especially rank and file, have little individual power if not in the leadership. Senators, not true, primarily through the amendment process. I think he is now out of his depth in a changed world after Trump.
So a Senator telling house members not do so something is likely to cause them to tell McConnell GFY as it is an internal matter. Same as with Marjorie Green issue. House minority leaders simply do not have the clout that the majority has to control grifting opportunities which is not true for the Senate. The people that will pay attention in the caucus to McConnell are those wanting to run for the Senate themselves as McConnell is the gatekeeper for that. 316 blaster,
If things get as bad as they might by 2022, your choice may be the forlorn vote Rep. to stave off the worst, leave the US, or do the unthinkable. Someone needs to introduce Articles of Impeachment against Gaylord, just for shits and giggles.
_______________ There are a lot more legitimate seditious grounds for impeaching that crooked bastard than there are for impeaching Trump. Hell, there are more legitimate grounds for impeaching Biden than there are for impeaching Trump. Biden's been on the take for almost half a century, and he was part of the attempted coup against Trump and the framing of Mike Flynn during the outgoing Obama administration. Trumps response reminds me of this movie quote:
Posted by: WisRich Ladies and gentlemen, I'll be brief. The issue here is not whether we broke a few rules, or took a few liberties with our female party guests - we did. But you can't hold a whole fraternity responsible for the behavior of a few, sick twisted individuals. For if you do, then shouldn't we blame the whole fraternity system? And if the whole fraternity system is guilty, then isn't this an indictment of our educational institutions in general? I put it to you, Greg - isn't this an indictment of our entire American society? Well, you can do whatever you want to us, but we're not going to sit here and listen to you badmouth the United States of America. Gentlemen! He is also the only American who has had pretty much all of his constitutional rights violated by his own government every damn day of the the last 5 years. Fucking commies. Posted by: Sharkman at February 02, 2021 04:55 PM (r90Sf) 358
I think McTurtle initially wanted impeachment to succeed. He and Suckboy McCarthy made their statements about Trump's responsibility, then they saw the pushback--especially the response to Cheney. That convinced them that prevarication is the better part of valor.

2 hour rush job impeachment, followed by all the D's and 10 R's voting to impeach, followed by a 60 page article of impeachment full of hot air and zero evidence.
Yet every single D will vote to convict, and so will 5 RINO's. The Democrats have NO PRINCIPLES. They respect only Power and brute political force. They are at war with the American People. Posted by: rcocean at February 02, 2021 05:00 PM (evE25) 362

Trump was the most powerful man in the world for 4 years.
________________ In theory, but not in practice. He was dependent on the federal bureaucracy to carry out his domestic orders, a federal bureaucracy that actively opposed him and did everything in their power to thwart him. He was also thwarted by federal judges who routinely invalidated his orders, often on the flimsiest of pretexts. Trump was dependent on the military leadership to carry out his military orders, and they also deceived him, ignored him, slow-walked orders, etc., and some of them even went on t.v. and boasted and laughed about how they had deceived him and refused to do as ordered. Much of Trump's "power" as president was illusory. Biden, even though he is barely sentient and doesn't know where or who he is much of the time, will have a lot more power than Trump did, because Biden's orders won't be opposed and undercut and slow-walked at every opportunity by vicious lefty bureaucrats, judges, generals, etc. Posted by: TrivialPursuer at February 02, 2021 05:06 PM (k4dH2) 367

The Rule of Law is dead, America is on life support. These events were done by and with the assistance of the legal bar, people sworn to defend and uphold the rule of law.
Why hasn't Kim Foxx been charged and disbarred? Why hasn't Perkins Coie been charged under RICO and prosecuted for its role in Russia Hoax, et. al. The GOP and Trump supporters should be going after the lawyers and judges. Without a functioning legal system where the Rule of Law is applied to one and all equally, America will die. Soros recognized the importance of prosecutors while the GOP Trump supporters focused on hoaxes. Posted by: Locke Common at February 02, 2021 05:26 PM (Rlbqb) 371
It just occurred to me that the whole point of impeaching Trump isn't to prevent him from running again (though I think they'll certainly try that as well), but because Biden wasn't actually elected. It is effectively the final nail in the fraudulent election coffin.
