Ready to Regulate Again [KT]

they baaack.jpg

If only they had regulated more back then
maybe Joe wouldn't have to do it now

I was curious yesterday about this title to a piece by I&I: Biden's worst executive order went almost entirely unnoticed. Turns out to be about something quite disturbing. There have been many disturbing executive orders, but this one concerns how the others are implemented:

The order goes by the title "Modernizing Regulatory Review."

Except this order isn't about modernizing regulations. It's about unleashing the regulatory state with a ferocity never before seen in this country.

Biden's order - which didn't get released to the press until late in the evening of his first day - aims to effectively toss the cost-benefit analysis that for many decades has served as at least a modest brake on the ambitions of regulators. In the past, regulations where the cost of compliance far exceeded the benefits could be stymied by the White House Office of Information and Regulatory Affairs.

Biden wants the review process instead to be "a tool to affirmatively promote regulations" and "to ensure swift and effective federal action" on everything from the pandemic, to the economy, to racial inequality, to the "undeniable reality and accelerating threat of climate change." In other words ... everything.

Other actions taken by Biden to re-regulate the economy are also described.

The Trump administration's Council of Economic Advisers calculated that the deregulatory measures taken over the past four years saved households an average of $3,100 a year. And while there's some debate over the extent of the benefits from Trump's efforts, the undeniable fact is that he slowed the regulatory current.

What is Congress doing about all of this?

Our Civilization

I ran across a piece by Daniel Greenfield from 2016 which sort of predicts the flurry of executive orders and so forth which are now coming forth out of Washington. Along with a lot of other cultural phenomena. Worth reading and thinking about, in my estimation. Even though it is kind of long. It's called In the City of the Decadents:

Civilizations go through three stages; Barbaric, Vigorous and Decadent.

The decadents are obsessed with filtering hierarchies of ideas and people. . .

The decadent civilization has a million laws which it applies selectively. Its universal laws, inherited from a vigorous civilization, are buried between equivocation. Decadents don't believe in objective truths and so they cannot have universal laws. Instead they mire them in so many legalisms as to be meaningless. The laws must be interpreted by a specialized caste. Everyone is always in violation of some obscure law. Life depends on a lawless dispensation from the law. Justice is impossible. Corruption is mandatory. The only way for the decadent civilization to function is to bypass its own safeguards through corruption, black markets and lobbying. This is true in all things.

The crucial task of the law is interpretation that keeps everyone from constantly being punished. This task is accomplished by lawyers, lobbyists and the politicians who are constantly adding more laws to fix the interpretations in the old laws creating a complex mass of contradictory information. . .

A snippet concerning non-legal issues:

Despite the disdain for the past, decadent civilizations struggle to do more than deconstruct and then helplessly imitate the past. Chaotic deconstruction of past creative arts is followed by retro copying of them, first ironically and then earnestly. Nostalgia becomes the central industry of a dying civilization mired in irony and incapable of mining its own culture for creative energies.

The central cultural critique becomes updating older works to more politically correct forms. A classic character is remade black or gay. Problems with diversity or sexism are tackled. The critic becomes a commissar whose job is to sanctify the transformation of an old politically incorrect work as politically correct. That is the role of the social justice warrior.

All this energy makes it appear as if there is cultural ferment when nothing is actually being produced. . .

This is interesting:

Vigorous civilizations pursue meaningful risks. Decadent civilizations pursue meaningless ones. For a vigorous civilization, adventure ends with an accomplishment. For a decadent civilization, risk is the accomplishment.

The decadent civilization obsessively manages risk. Its layers of government are mainly dedicated to that task. Accomplishment in a decadent civilization becomes a difficult task because of the many lawyers of corporate and government risk management standing in the way of getting anything done.

Fear is the true currency of the decadent civilization. A corrupted fear that is used to expand a vast bureaucracy that claims to manage risk, but in reality manages who is allowed to circumvent it. . .

He ends with the assessment that "Decadence in a civilization can be reversed." Have you got some ideas concerning how this might be accomplished?

22 "Decadence in a civilization can be reversed".

I'm not sure how, short of the bureaucrats, lawyers, politicians, and lackies being thrown into the sun, but we know how French-style revolutions often turn out. Otherwise, the next step in the normal course takes place: destruction/self-immolation. In the ashes of destruction, there is a chance for the cycle to start anew, but a painful step that takes a long time to get past.

Diminish the influence of the decadent and increase the influence of the risk-takers. In theory, creative destruction accomplishes exactly this. The problem is that all the mechanisms the decadent have built up to protect themselves from consequences have to fail first.

39 Kristi Noem had a nice editorial, some of which was boilerplate, but the main point of which was that the GOP needs to say what it's for, not just what it's against. I agree with this sentiment. If we try to take back the country with "they're bad", we lose. We need to enunciate a clear direction and goals. My two top goals are:1) Ensure election integrity.
2) Break up big tech and its incipient fascist monopoly on speech.Per the discussion yesterday, it's almost certain that achieving these goals requires wholesale replacement of many of the current political timeservers, and putting the fear of God in the rest.

Our type of goverment was meant for a moral people, be so many don't seem to be that anymore. Moreover, so many have been inculcated by leftist propaganda and rhetoric for so long that we now have three generations whose public education tells them the old (moral) ways were immoral and should not only be discarded, but destroyed, along with those that wish to promulgate them. Big hurdle to get over, but what happens when they control the vertical and horizontal in society.

43 Frankly, I despise the cross-dressing ballets...

Handel is sublime, and not very easy to sing well. But I loved singing Handel. My first, and last, professional gig was singing Messiah.

That ballet choreographed for Water Music is lovely. But not accurate, of course. Written to be enjoyed while royalty and their nobles were...boating on the water. Oddly enough.

I think part of the answer is to stop focusing on what's wrong with "the system." I think we're well past the diagnostic phase, and frankly, we're past the point of thinking it can be fixed.

So. The other part of the answer is, to retreat inward. And by that I mean, as others have said many times before, go to work on yourself. Do you, as they say.

One of two things can happen, you become a better you, and screw the rest of the world, or you become a better you, and the world benefits from a mass of people doing so. As sometimes the solutions come from "below," meaning movements organically sprout up from us, and are not imposed from the top down. It's really the ONLY way to change a decadent society.

77 If you're wondering about all the EO's coming from Biden while he has a congress totally behind him, I think I have an answer.

They know everything is going to go to hell. The economy will crash, unemployment will skyrocket, etc.

This is their shield. "We didn't vote for that, it was all Biden with his EO's who did that! You can't blame us for it. So you can totally vote for us. Now, we have to go to his funeral so we'll be going now."

Oh, they want it. They just don't want to take the blame for it.

A blast from the past:

The co-chair of Barack Obama's Transition Team, Valerie Jarrett, appeared on Meet the Press this weekend and used, shall we say, an interesting word to described what she thinks Barack Obama will be doing in January when he's officially sworn into office. She told Tom Brokaw that Obama will be ready to "rule" on day one. It's a word that reflects the worst fears that people have for Obama the "arrogant," the "messiah," that imagines he's here to "rule" instead of govern.

Jarret told Brokaw that "given the daunting challenges that we face, it's important that president elect Obama is prepared to really take power and begin to rule day one."

Social media isn't the primary problem, it's what the social media is used as a front for: unlimited big tech data collection. MySpace was never a threat to anybody because the machinery under the surface did different things, for different purposes; it was what it purported to be. Facebook and Google are just Skynet with trendier UI.

A lot of Americans are going to die in the future as a direct result of the private panopticon dropping dimes on them.

131 Decadent regimes reflect decadent elites who must be removed for it to be reversed. History has several examples where decadent regimes revitalize themselves--the Eastern Roman Empire did it several times, the Western Roman Republic/Empire tried and failed, then there is the Chinese model.
One is conquest from without which wipes out the existing elites and superimposes a top structure of new elites (for example the Moghul Empire) or several different Chinese periods). The other method used in history is a ruthless bloodletting of the political factional leaders--such as Justinian did and making clear to the wealthy that their interference in governance risks their fortunes and lives. Pretty much demands a very strong leader with almost total power over life and death.
You do occasionally get the odd variation like the French Revolution where the revolution got rid of the elites but then got a succession of Napoleon, then outside imposed royalty, then a minor league Napoleon, then finally a Republic.
More usual revolutions get rid of the existing decadent elites but then revert to strong man rule like Mao, Lenin, or a Franco.

If as anticipated the Federal government would retaliate, economically or otherwise, then just secede from the damn union. Have you read the chinese proverb regarding wealth? i don't remember it exactly, but the gist was that it takes 3 generations to go from poverty to riches and back

first generation born in poverty works hard to earn wealth
second spends it and is lazy
third is back in the rice paddies

153 It wasn't just the cost element that was ignored in the disastrous response to C19. It was the complete lack of benefit.

Just as with attempts to show any observed climate change doesn't fit easily within natural variation, there has not been and will be no way to demonstrate *any* benefit from the idiotic and destructive "policies" (lockdowns, masks, etc).

Because there wasn't any.

"Without a control group, it's not science". Well the "control groups" here are/will be jurisdictions that did little to nothing to "fight" the virus (a perfectly illiterate term and concept used from the start), and have results statistically indistinguishable from places that went fully stupid. All cost, no benefit.

154 The description of decadence in civilizations mirrors that of corporations in decline. Having been employed by one company that declined and recovered and observed the auto companies (I live near Detroit) I can only say two things:

- Recovery doesn't last as the regulatory, rule driven and cautious and fear-driven behavior returns quickly. The companies I cite are now back to their old ways based on what I hear from those inside.

- Recovery requires major breakage. Bureaucracies in a corporation are just disbanded, people laid off, and buildings closed. Anything that does not go toward the production of product or billable service is sliced off. Not sure how you can do that with our gummint.

Case in point: because of the shutdown, school districts moved to virtual classrooms are now all-in on having one-to-one technology. That meant Google Classroom. The training for Google Classroom, even if offered through the RESAs or ISDs, included hours of propaganda. All the bells and whistles are Google-compliant, from the materials offered by Scholastic publishing to video-recording extensions.

If someone came up with a great application for ESL students, chances are the users will be agreeing to the Google terms of service.

One-to-One technology is pushed as a measure in a lot of school districts because they take-away from the Wuflu shutdown was NOT students need less screentime. That means Chromebooks for everyone and Google rules. Nevermind that the tech head honchos limit their own children's use of tech or that writing by hand stimulates memory more than typing. Let's take a risk with kids.

If they're smart (they're not), they'll do what some states have done: pass laws mandating things, do nothing to enforce it. The moment they start sending any significant numbers of law enforcement to collect and arrest, you'll see bloodshed. Does the Left want this? Sure, as they control the media, and will hope this won't get out. But the news will get out somehow. I would expect martial law before doing such a grand thing to restrict flow of information.

They planned to steal 2020 only with the mail-in fraud and Dominion computer hackery, but up until 9:30PM Eastern, it was going to fail and spectacularly. What happened after that was the emergency smash and grab, which I think was improvised. They gambled that no one would insist they put the jewels back where they got them and sadly, it was a smart, if not risky bet.

The one thing that must - MUST - be done and immediately is to organize gun owners into, for lack of a better word, cells and then into militias to have a plan when they ultimately have to call out the military to disarm us. At least two thirds of the nation are armed with more than one weapon and significant rounds of ammo. The local cops or even FBI or SWAT will not be able to deal with more than one or two people at most. Not that I am praising or endorsing them, but look what it took to neutralize David Koresh and Randy Weaver. Multiply that by 200 million armed people.

This is why the deplatforming, banning and censorship is happening and will only get worse for average citizens, and not just political leaders on our side.

And how did that work for them in Iraq? The truth was in Iraq, we sided with the largest faction (Shiites--40-50 pct) and were fighting the smallest (Sunnis and others 10-20) with the third faction mainly staying out of it (Kurds 30-40).

In Afghanistan, we allied with the smallest faction (Northern Alliance) and the plurality faction of Pashtuns plus the other ethnic opponents of the Northern Alliance. How did that work out for them.

The dirty secret is that Revolutions do not occur from a vanguard but because popular support wants out from under nasty decadent elites and is willing to take an enormous risk for change (see also Iranian Revolution). Revolutions require popular support, if you have to repress, you do not have it.

--- Decadence ... is the state of decay. My first thought of the meaning though, is more about lavish waste by the elite. But while our elite enjoy lavish lifestyles, their central planners are building a powerful mafia --- the part in decay is The Republic and our liberties. Their Evil Empire is not decaying but growing, building (physical and legal) walls between them and We the People (at the moment, while they still project their "back to normal" lies as smokescreen for the masses).

203 The GA runoffs were a voters' strike, right? I have not seen any serious survey work, don't know if any has been done/will ever be done, to explain the result, but I thought that the GOP vote sagged in the runoff. Which is a bizarre thing I have never heard of, but which makes perfect sense here.

How do 2 very weak/freakish Dem candidates win state-wide races in GA after losing them in the general? I have never heard of a runoff going to the losers of the first round.

The circumstances seemed to point directly at voter fury and despair over GOP fecklessness (certainly the two lame seat-warmer type candidates, and absolutely at the governor, SoS, and national level party). Unless my key premises are wrong, this is as clear and dramatic a rejection of "GOPe" as could ever happen in an election.

Diminish the influence of the decadent and increase the influence of the risk-takers. In theory, creative destruction accomplishes exactly this. The problem is that all the mechanisms the decadent have built up to protect themselves from consequences have to fail first.

The whole Gamestop fufaraw provides a perfect example of this. Hedge Fund Dudes take insane risks built on the assumption that they can crush GME down to nothing and make a gajillion in the process.
Oops, the risk was recognized and exploited, by others taking a risk, in the same way HFs do, ie. by investing.

Hedge Funds lose big! But, now they must be covered by the gov't for their risk taking - which makes it not risk taking at all. They get covered. The Principle of Actions Have Consequences is corrupted, and now everyone poorer than the HFs must pay for their risk.

If Our Betters can never fail and fall, we have a stale dead society.

Pipe tobacco, unless the inside of the humidor gets way too moist (like with fruit slices), is virtually permanent. Cigars, if they are sealed in a box and cared for, are good for an awfully long time. But cigarette paper gets stale and dry, and has to be very gently re-moisturized if the cigarettes are to be smoked. Probably not worth it except extreme duress. Dry, they're awful.

Some Greek and Egyptian cigarettes had magnificent cotton-blend papers, years ago. Pretty much better than their tobacco, truth be told.

223 203 rhomboid,
I have taken a look at the GA data. First, Perdue and Loeffler ignored the elephant in the room regarding the GA vote fraud. Perdue could have challenged the results in the General and probably avoided the runoff altogether. The GOP AG, Gov., Lt. Gov, and Sec. of State all banded together to chant that there was no steal of the election and made every effort to prevent any investigation of it. The GOP in executive offices, mind you, in total control of the state, did consent decrees with Stacy Abram's group that violated state laws regarding voting, elections, and runoffs.

Even with the rural falloff in votes, the GA GOP PSC commissioner won his race but the same midnight trick happened in DeKalb county this time and Chatham instead of Fulton. Similar exhibit of GOP candidate votes disappearing and multiplying ballots left to count. So fraud and depressed turnout.

250 "undeniable reality and accelerating threat of climate change."

Yes, the Earth has slowly been warming for the last 11K years as it entered an interglacial period in the middle of the Quaternary Glaciation (ICE AGE!) that started 2.4 million years ago. This interglacial is caused by the Milankovitch Cycles, which are three variations in the Earth's tilt and orbit, that in turn change how much energy the Earth soaks up over time from the GIANT FLAMING BALL OF FUCKING FIRE IN THE SKY that we orbit around.

Fortunately, the mild warming we've undergone in the last 11K years releases CO2 from the oceans and ice caps, where it is locked up by cold temperatures (in other words, CO2 concentration is a lagging indicator of warmth and not a leading/causal indicator of warming).

I say "fortunately", because of course CO2 is PLANT FOOD, and at the end of the last glaciation 11K years ago the Earth came very close to the level of CO2 in the air that would have meant the DEATH OF ALL VEGETATION AND THEREFORE LIFE on the planet (140 parts per million).

But just ignore me, Paste-Eatin' Joe the "Scientist-in-Chief" and go on thinking that OUR SUVs ARE MORE POWERFUL THAN THE SUN.

Kind of hard to see any path to recovery when you see what happened in GA.

I always found it fascinating that prior to this sea levels were fairly stable for a long period then we started getting 120 m swings as the glaciers came and went. We are near the maximum water level of that umpteen swing. So in over over a dozen glacierizations water levels were never much higher.

When co2 went too low the earth several hundred million years ago life was almost wiped out. Now it is known that plants are, shall we say, blooming, due to the extra plant food. That is science. That the plants like the extra co2 and we have a greener planet because of it.

320 222 Don't believe me? Explain the massacre of the Branch Davidians.
--------
The sad fate of the Branch Davidians was promulgated 26 years ago. It was one of the first warnings that the Democrats and the Deep state were in alliance to rule from D.C. with an iron fist. However, the siege of the compound was the result of a botched operation, not a successful one. The Internet didn't exist back then, social media didn't exist back then, and a citizenry of both Left and Right that distrusts the Government authority didn't exist either. The Deep State isn't as stealthy or crafty as it thinks it is, and the power-drunk Left is just as capable of dropping their pants on live video as they were then. those people can only do Branch Davidian II if they are permitted to.

343 181 The problem of insurrections and repressing them is when the population by and large does not approve of the regime especially when it is regarded illegitimate by a large proportion of the population. This comes from the ill educated idiots of our elites that believe their words and orders constitute action. The whole Gamestop fiasco for hedge funds and even government indicate that they do not have popular support.
======
The only insurrections that were proven unsuccessful in history were those that weren't supported by a majority of the population. If the majority of the population supports it, even passively, the insurrection will gain force and power while the government attempting to stop it flails about in desperation, or packs its bags for Switzerland. The Beltway crowd seems to have dismissed the seventy-five million Trump votes as irrelevant, after having pulled off the steal. that's a mistake, and the votes in question are more distributed than they think. Antifa and BLM were overcounted last year, but the Trumpers were likewise undercounted. We shouldn't fear the Placeholder-Harris administration, for no EO, law, or diktat can succeed if it's not obeyed.

I'm sure that has worked well as a lesson in the various Socialist Worker and Farmer's Paradise states. It was the wrong sort of lesson here. It's either "of the people, by the people, for the people" or it's not. In 1994 the people rebuked the Clinton Administration by giving the House to the Republicans. Now it's 2021 and such ready remedies for overreach aren't available due to reasons we all know. The other remedies are at hand, and the current regime should think long & hard about sending the paramilitary Death Troopers (h/t Lucasfilm) to do their bidding. They won't of course, but the time for easy fixes passed January 6.

"Biden also needs Congress to fulfill his campaign promises to increase the number of insured Americans by strengthening the Affordable Care Act.
His two main measures -- creating a government-run public option and increasing Obamacare's federal premium subsidies -- require approval from lawmakers and already face plenty of opposition.

The President included a proposal to boost Affordable Care Act subsidies so that consumers don't pay more than 8.5% of their income for coverage in his $1.9 trillion relief package, which is already encountering hurdles on Capitol Hill."

Fun fact (probably the subject of a future rant): CO2 was a major constituent of the primordial atmosphere, with only traces of O2 - until photosynthetic organisms evolved, and began polluting the atmosphere with ... oxygen.

At that point the relative abundances of O2 and CO2 in the atmosphere essentially reversed.

I doubt advertisers are paying much to the Dispatch. How much longer will he be willing to pay good money for Jonah to Live His Best Life on Twitter?

Just feign as much ignorance as possible while not giving any information.

If it get's weird, ask them if the chat is being recorded. If they say 'yes', ask if the recording is under the ADA guidelines.

Of course that's nonsense, but it gives you a break in their speech. And a subtle reminder that they might be treading on dangerous ground.

Prolix. That's Ed, all over.

And, these guys are in such a bubble. It's made of iron. They really clearly don't understand that the people they know and socialize with are literally the only people in the whole country who are still loyal to their Party and willing to tolerate their grift anymore.

They just can't see it. And it's not the kind of bubble the real Left is in. To be sure, they are in one too, but at least a little less than a third of the country agrees with Maoism. Nobody - nobody - outside of DC and the Conservative Media Ecosystem agrees with these bloated hypocrites. But they still think they matter. It's bizarre.

The President exercises legitimate authority over two K-12 school systems, the Department of Interior BIE schools and the DOD schools for military dependents overseas. Just mandate that these schools open online branches which employ no faculty, conduct no classes, define courses by their syllabi, admit anyone who applies, license Sylvan Learning Centers and the University of Phoenix to administer course final exams at a fee to be negotiated between the student and the examining agency.

Just 2 weeks! 2 weeks to flatten the, er... deplorables

It has been obvious that they were going to try this since 2013 or so when it became evident they were using the same sorts of network analysis software on us that they'd been using in Iraq, combined with NSA data - to ID targets for IRS, EPA, and other fed agencies.

This is a large part of how the Tea Party was crushed, and why I insisted that the Trump era - be it 4, 8 or however many years long - was just going to be an intermission.

Honestly it's better if they just jump in with both feet and too early. We want them to fuck up, rather than a slick job of putting the chains on us.
