Source for New York Post's Hunter Biden Story Sues Twitter for $500 Million for Defamatory Claim That He's a "Hacker"

Make. Them. Bleed.


A Delaware computer repair shop owner sued Twitter, alleging the social network defamed him by effectively labeling him a "hacker" after his business was cited as the source for info obtained from a laptop allegedly owned by Hunter Biden that served as the basis for several New York Post articles published in October.

In the lawsuit (at this link), John Paul Mac Isaac said he was forced to shut down the Mac Shop, his computer repair business in Wilmington, Del., after Twitter said the NY Post stories violated its "hacked materials" policy and initially disallowed users from sharing links to them....


Mac Issac is demanding $500 million in punitive damages from Twitter plus unspecified compensatory damages and lawyers' fees, as well as an order forcing Twitter to "make a public retraction of all false statements."

...

"Plaintiff is not a hacker and the information obtained from the computer does not [constitute] hacked materials because Plaintiff lawfully gained access to the computer," the lawsuit says. As a result of Twitter's citing its "hacked materials" policy for blocking the Post's articles, Mac Isaac's complaint says he "is now widely considered a hacker" and received negative online reviews and threats against his person and property. He claims he was ultimately forced to shutter the Mac Shop.

Twitter did not immediately respond to a request for comment.

I wonder if he'll be suing Jake Tapper and the CNN/DNC Cartel or labeling him, by inference, part of a Russian disinformation campaign.

Bloom said that the court does not have subject matter jurisdiction to hear the case because Isaac "fail[ed] to allege complete diversity," which means that all the plaintiffs and all the defendants must be from different states. Because Twitter is headquartered in Delaware and Isaac is a Delaware resident, the complete diversity requirement is not met, Bloom said.

So it can be re-filed again with the correct paperwork

He failed to allege diversity of parties, the baseline requirement for the district court to assert jdx. No prejudice-the clerk probably spotted it and dismissed immediately. If there is diversity, it's simple to amend and refile. If there's no diversity, he needs to file in state court.

Yep, Delaware corp is really common. Mostly because it's a tax haven and lawsuits tend to get blown off. Most corporate lawyers MUST be well versed in Delaware corporate/business law. Every corporation I've been involved in was Delaware. Like Las Vegas weddings.

And that is what having the registered agent is for - it gives one address for service of process and other important mailed items. "Notice" is another legal thing that has to be met before your lawsuit can go forward. The defendant has to have legal notice, and mailing to the registered agent is the best way to achieve notice to a corporation which may have operations all over the place.

That isn't true.

Where a case can be venued is very limited. It is usually where one of the defendants "resides" (for a corp., this is the corporate domicile or state of incorporation) or where the cause of action arose. Usually a plaintiff has just one or two options.

This principle is unrelated to diversity in a federal lawsuit, which will stop you before you even get to an analysis of proper venue.

Yeah, this usually applies in contract law...both parties agree and stipulate where they can be sued for breach, libel, etc. and diversity is the issue typically that gets sorted out in the contract. A global entity can declare one state as its US incorporation state and have many other places as its operations, but then, if it they have precedent (ie contracts with clients) that suggest they require to be sued in their incorporation state, they are nullifying their claim to diversity...period, end of story. This happens all the fucking ass time.

If I were the IT guy, I'd try and find somewhere where Twitter suggested in a contract that all litigants use Delaware as the legal state when Twitter is being sued.
