I can't rate this as factually true or false, but I can rate it:

Extremely plausible


Remember, Roberts was initially in a 5-4 majority to rule Obamacare unconstitutional -- until he got phone calls from the Obama Administration (and maybe the media) telling him that if he ruled Obamacare unconstitutional, the court would lose legitimacy in the eyes of the (leftwing) public.

Notice they never care about retaining their legitimacy in the eyes of the right-leaning public.

Those deplorables can fuck right off. Who cares about what Serfs think?

What they're teaching the right is that we will never win -- hell, we won't even be considered full citizens -- until we start rioting, looting, committing arson, and beating people half to death in the streets.

That's the Gordian Knot I keep coming back to. Look - even if we had the power - we're not willing to drive them out of their cities and disperse them. We're not willing to herd them into re-education camps. We're not going to separate them from their children. Roberts may or may not have said this. But if he did, it's just a convenient excuse. The explanation is much simpler: Like Gorsuch, Kavanaugh, Barrett, and many other nominally "conservative" federal appointees, John Roberts is a judge.

And 90% of judges are, for obvious reasons, dedicated to heavy-handed Statism to a degree few other people on earth are. They love State power sexually, and will do and say *anything* to advance it.

With most of these "people," anything they say about originalism, small government, blah blah fuckin' blah, is a smokescreen. They say those things as a path to advancement in the judiciary, and once they hit the federal bench or Supreme Court, they are finally free to let that freak flag fly.

Anybody who counts on a judge is a fool, plain and simple. They really are, as a general rule, extremely evil people. It's why most of them pursued their careers in the first place.

Some few, of course, are decent. But if you were to drag every judge out into the street and gun them all down with firing squads, both as a corrective measure and a warning to future judges, we'd be in a better country.

That's the Gordian Knot I keep coming back to. Look - even if we had the power - we're not willing to drive them out of their cities and disperse them. We're not willing to herd them into re-education camps. We're not going to separate them from their children. And we have no practical means to remove their voting rights - even if somehow we successfully occupied them. Which, again, we not only won't do - we probably can't do.

Bear with me a moment.

In the past, there have always been groups who have been marginalized, disenfranchised, out of power, and oppressed. Native Americans, blacks, women, Chinese, etc in America. Before that it was other groups: Irish in the UK, Protestants in Spain and France, Bretons when the Danes invaded, on and on through history.

Its part of human existence: someone is always getting the shaft, someone is always the low man on the totem pole being stomped on by everyone above (yes I know in tribal mythology the one at the bottom was the powerful one).

In 1948, being a black man in much of America was pretty much trying to stay out of trouble, hoping to find a job, keeping your eyes down so you didn't come across as "uppity", never talking to white women, drinking from the right fountain, riding in the back of the bus, etc.

Someone is always in that place, because we are fallen human beings, sinful, and corrupted by that. Our outlook is selfish, greedy, and cruel where not restrained by the grace of God and social pressure. Its the test of the red light in the country when nobody is around at night. Do you stop because its the law or blow through because there are no consequences?

Very few of us in any circumstances do the right thing when there is no consequence, or avoid the wrong thing when we can gain by it and not pay a price, even if its little stuff like downloading a song off the internet.

And when it comes to society, people form groups and those groups tend to benefit each other, at the expense of those not in that group. In the past that has almost always been the majority faction, the largest or most physically powerful social group. Women pushed down by men. Minorities pushed down by majorities.

Its always been a part of society. It always will be, until kingdom come, except for very brief periods.

Well, its our turn now. White folks, men, we've had the upper hand for centuries in the USA. Now we're the ones being stomped on. This isn't new, its just a different group being stomped and a different group doing the stomping.

The problem is that in the process of making this happen, the people in power have uprooted, upended, and destroyed each and everything that made the US what it is and how it could be. They've destroyed our culture, our traditions, our civics, our laws, our heritage.

And that means that not just we but the entire world is going to suffer from the lack of a clear city on the hill, that beacon of liberty and power in the world to push for peace, freedom, and democracy. While the US was the world power, democracy spread fast and wide around the world. Everyone, everywhere, became richer as our economic system dominated the world and lifted everyone's boat.

And now that's all being torn to bits. Not because white people aren't in charge, but because the systems which white people happened to be following this time are being destroyed. Anyone could and would follow them, but they are instead determined to tear it all down.

And that's the real sad thing. We had a nice run. Now we get to watch sadly as it all is destroyed, everywhere. Its been a very long time since the last time civilization reversed, but here we go. God forgive us for our failure. May our grandchildren and later generations forgive us for what they must face.

There is no excuse for any of the Justices. Thomas' argument is simple, compelling and true. There is no nuance. SCOTUS does NOT have the ability to turn down a case between states.

They could have taken the case and then ruled that one state cannot have any say over another state's methodology insofar as voting goes. A little reasoning on how they reached their holding would have been nice.

In the Texas decision, their use of the risible "standing" argument amounts to nullification. Why would any state have standing in any other interstate case but not this one? The responsibility to adjudicate interstate disputes has been abandoned.

Why is any other part of the Constitution more valid than the one so discarded?

In this nullification, the court has shredded the Constitution, its own legitimacy, and the legitimacy of the US government, which only existed due to the ratification of the now-nullified Constitution.

Remember, as I understand it the SCOTUS only needs 4 votes to force a hearing. So Roberts had to push hard to get at least 2 of the five conservative votes (not counting him) to at least be cowed.

Tom Kratman, an author I rather like has opined more then once that he figures that Roberts has as his primary motivating goal to not ever let the SCOTUS drive a wedge into the country that would cause a civil war.

Its pretty clear that SCOTUS throwing this to the congress, which might well have happened on legal reasons, could do that.

Of course, a majority of the country believing their vote will never count again could do it too.

We'll see I guess.

This is my thought as well: Roberts is desperate to avoid any Roe v Wade type decisions because everything is so fragile. But the problem is that in trying to avoid them, he makes the situation worse. It's a case of trying to avoid pain in the short run, only to create more pain in the long-run.
