Texas Files Lawsuit in the Supreme Court Asking The Federal Courts to Throw Out the Election Results of Pennsylvania, Wisconsin, Michigan, and Georgia

A copy of the complaint is here.

It's filed in the Supreme Court because rhe Supreme Court has original jurisdiction -- that is, the Supreme Court is not merely an appellate court but the original, first trial court -- in disputes between the states.

The lawsuit seeks to set aside the fake election results in these states due to rampant irregularities which make the results unreliable and therefore prejudice the citizens of Texas and any other state which held a clean election.

Julie Kelly discusses the suit here.

In a lawsuit filed Monday before the U.S. Supreme Court, the state of Texas accuses four states currently "won" by Joe Biden of using the COVID-19 pandemic as an excuse to violate the Electors Clause and the 14th Amendment. Texas Attorney General Ken Paxton is suing Pennsylvania, Georgia, Michigan, and Wisconsin for usurping the sole authority of state legislatures to create election law and charges that millions of absentee ballots were unlawfully processed by local election officials.

"They accomplished these statutory revisions through executive fiat or friendly lawsuits, thereby weakening ballot integrity," the plaintiffs wrote. "Finally, these same government officials flooded the Defendants States with millions of ballots to be sent through the mails, or placed in drop boxes, with little or no chain of custody and, at the same time, weakened the strongest security measures protecting the integrity of the vote--signature verification and witness requirements."

The filing asks the court to extend the December 14, 2020 deadline to certify each state's electoral slate noting that the only date "mandated by the Constitution" is January 20, 2021.

Yes, that's correct. The "safe harbor" date -- today -- is specified in a Congressional Act, not in the Constitution.

The bill of particulars against the four rogue states is damning. Unelected bureaucrats such as Pennsylvania Secretary of State Kathy Boockvar and members of the Wisconsin Election Commission changed rules at the last minute and without authority. Local election workers flagrantly violated numerous state election laws; rejection rates for mail-in ballots were far lower than in the primary elections despite the unprecedented volume of absentee voting; and the statistical probability of Joe Biden's victory in those four states as of 3 a.m. on November 4, 2020, given Trump's substantial lead, is "less than one in a quadrillion."

Trump has also filed a lawsuit in Georgia, which wobble-kneed Establishment drull and former Russia Collusion Hoax Enthusiast Andrew McCarthy finds to be strong on its face.**

In the Peach State, the campaign is represented by different counsel than it has been elsewhere. The 64-page complaint is a linear, cogently presented description of numerous election-law violations, apparently based on hard data. If true, the allegations would potentially disqualify nearly 150,000 illegal votes in a state that Biden won by only 12,000.

If you challenge the law before the election, it gets dismissed because the issue is not ripe. If you wait until after the election, then it gets dismissed because you've waited too long.

McCarthy is OK on certain things. Generally, one must first immediately screen his views for legal cult assumptions and distortions. Oddly, he coined one of the best phrases about the lawless SCOTUS, saying the 4 authoritarians "vote, they don't judge". Odd because that very thing, the substitution of lawless, baseless, partisan voting for actual judging, is the root of legal cult damage to the society. I think he coined this term in response to the O-care debacle.

The sword cuts two ways here. We keep saying that in the end the legislature picks the electors via whatever method they choose. Let's say the MI legislature votes to approve the electors. What recourse does TX have? It doesn't matter if every person in the state voted for Trump, if the legislature makes the electors Biden electors. The state legislature is the final arbiter in the matter. SCOTUS is going to tell TX, everything you say may be true. Legally, it doesn't matter.

Yeah, I think this is more right.

Under election law, Texas doesn't have a whole lot to say about how Pennsylvania votes and what their procedures are.

However, under 14th amendment case law (equal protection), courts have been more then willing to say "okay, technically this is Georgia's election to run, but they're running it in a way that discriminates against black people, so we need to rewrite Georgia's laws."

But Texas wouldn't have standing to sue under 14A.

So... I don't know. I think it's a clever way to get a case to SCOTUS, but I think SCOTUS would be following existing procedures and case law to dismiss the suit for lack of standing.

I read an interesting story recently (not related to anything here), about the Australian Cardinal Pell.

Seems this guy has been a vocal critic of financial shenanigans in the Vatican, had a brush with a pedo priest in his early days, but has otherwise been fairly vocal too about rooting out the pedos.

And this guy meets criteria for "conservative" when it comes to the Catholic Church.

So.... they manufactured some pedo claims against him. It appears they were bullshit cases, and yet the courts in Victoria (or whatever, this is Aussie locals), the movement against pedo priests, AND the media all ganged up on him. And he was convicted.

Appeals court upheld the conviction.

Aussie's highest court in the last tossed out the conviction, basically saying there's no evidence to back up this claim from this one dude (and another guy who's dead now), other than him saying it happened in a Cathedral, in public, in broad daylight, with no one else seeing a damn thing.

Bullshit.

Why, it's almost as if the #metoo can falsely accuse Catholic clergy, and everyone rushes to judgment, including zealots in courts.

Law be damned.

Good thing for THIS guy the Aussie Supreme Court seems to have some integrity.

The only thing they care about is getting elected. It's a suicide moment for the US and should be for them too. They have original jurisdiction over a handful of things. Off the top of my head I want to say it's Admiralty law, diplomats, and disputes between the states.

Congress is also allowed to expand that list.

Interestingly, the Constitution doesn't say a whole lot about how the courts should operate -- just that they're establishing a Supreme Court and whatever "inferior" courts need to exist.

So, if Congress wanted to, they could grant SCOTUS original jurisdiction on everything and get rid of all of the lower courts.

I don't know why they'd want to, but it would be constitutional.

By county or federal House District, for example.. Whichever candidate got the most votes in a District, that get assigned an elector for that candidate.

It's not about the issue involved, it's about the parties involved.

From a logical perspective: if NY wants to sue CT over an issue, which court should hear that? The state trial courts in CT or NY? The federal district courts in CT or NY?

Obviously, one state would have a home court advantage.

At least that's how the thinking went in the 1700's.

So in those rare instances, SCOTUS has original jurisdiction.

But if that same dispute was simply between 1 guy from CT and 1 guy from NY, (and the amount in dispute was enough $$), then it would be filed in federal court under diversity jurisdiction, usually in whichever district court is more convenient for everyone, but both sides will likely battle to have the federal court in their state hear the case.

389 They have original jurisdiction over a handful of things. Off the top of my head I want to say it's Admiralty law, diplomats, and disputes between the states.

Congress is also allowed to expand that list.

Interestingly, the Constitution doesn't say a whole lot about how the courts should operate -- just that they're establishing a Supreme Court and whatever "inferior" courts need to exist.

So, if Congress wanted to, they could grant SCOTUS original jurisdiction on everything and get rid of all of the lower courts.

I don't know why they'd want to, but it would be constitutional.

Congress can determine the scope of SCOTUS' appellate jurisdiction, IINM. Both expanding and restricting. So it's entirely possible for Congress to tell SCOTUS, "Hey, this law we passed is not any of your business." I believe they did just that with regards to some of the Guantanamo Bay stuff.

I pretty much only listen to him if I'm driving, and usually it's a guest sitting in. I've got to do some work in the garage, so I'll check out the last few minutes of his show. I've heard him maybe half a dozen times since the election, if that, and never a whole show.

Flynn should have won, but the deep state and the judiciary would have none of it. Trump ended up smashing his fist onto the scale to overcome the chicanery and refusal by his enemies. Well, I think he's right that SCOTUS most likely will dismiss the case for lack of standing.

SCOTUS can, of course, do whatever they want. But either TX is suing in its capacity as state (and has standing in that capacity, but only as an aggrieved state under election law, which is ... well, I don't think there's any caselaw on that) or, it's suing in behalf of people in those states who weren't afforded equal protection, in which case they don't have standing, and the court won't hear the merits of the case.

This is the problem with our side only appointing judges that are "not activists" and believe in "judicial constraint" etc. Because established precedence says that the 14A cases should make their way through the courts like any other case. I don't think our current SCOTUS will create a whole new avenue for states to sue each other over election outcomes.

I was not a Cruz guy during the campaign, but I have to give him loads of credit for being one of the few to hold up his end of the bargain with the RNC. If the RNC provides you resources during the primary, you are obliged to go stump for the eventual winner. All of the candidates who accepted RNC assistance - including Trump - agreed to those terms.

Most did nothing to help Trump win or actively worked against him in 2016. Cruz didn't. He wore out shoe leather and telephones campaigning for Trump after the nomination. He did what he said he would do, even though he found it (quite clearly at the time) personally distasteful.

He went up several notches for me after that.

Which would make him one of the only justices in modern history to have not been.

But hey, Souter broke that mold too! He was on the NH Supreme Court for most of his "judge" career and was only very briefly in the federal system!

I'd say he is qualified. He also would likely issue votes the way we would want. The biggest downside to him being a justice is his long-term temperament. Meaning, he may just get bored and wish to move on at some point. Not sure how well he would persuade other justices either. Anyway, I like him where he is.


He has the chops to make an argument, but he also has political reasons for wanting to do so.

First hand knowledge of this. Recall that most National Guard forces were activated under Title 32 or State Active Duty. T32 is paid for by Federal funds but still operating under the command and control of the State Adjutant General- the 2 star in charge of NG forces for a state- AND the Governor. State Active Duty is entirely under the auspices of the Governor.
The riots et al were under T32 or State Active Duty- and in democrat states. For example, you think Gov Inslee of WA is gonna allow NG troops to pummel his hard core supporters in BLM/ANTIFA. No.

So this has nothing to do with the Federal brass and everything to do with politics being local.

Cruz has already argued 9 cases before SCOTUS...only a handful of active attorneys have argued more.

Not saying his offer here isn't self-serving in some way, but it isn't about fulfilling that dream.

It's a magical spell that accurately summarizes every SCOTUS opinion on the 2020 election before it's written. Not that there will be many opinions. Most of the cases will be thrown out with unexplained orders with only 1-2 dissents to the orders.
