The Morning Rant: Minimalist Edition

There is no American cultural affinity for China or Chinese culture. We have no deep connections to them, unlike the historic connections to Ireland and Germany and Italy and Scandinavia and other sources of immigrants. Sure, there are large populations of ethnic Chinese in America, but the larger cultural connections are shallow.

One can understand the emotional connections of the great-grand-children of Irish immigrants to Eire, because we have assimilated some of what they brought here. Just like the descendants of many other immigrants.

But aside from cold hard cash, what is the allure of China? By no means can one argue for its dedication to its own cultural heritage or support for its expatriates or all the other benign reasons why other countries work to create ties to America. The Chinese government is one of the most repressive in the world, with so little respect for life...that of its people or any other...that their pronouncements on the world stage often sound as if they are bad actors (hah!) mouthing boilerplate lines.

Their goals are clear and unequivocal; world domination via economic and cultural warfare. And how do they acquire allies? With money. There is no waxing poetic about the joys of Chinese-American culture. There is no Chinese tradition embedded in American culture, unlike so many others. There is only cash.

So what does that say about the many servants of Peking (screw their new spelling!) in the newsrooms and statehouses and boardrooms and the federal government?

They are whores. Nothing more. There is no edifying emotional or cultural or intellectual basis for their support of China. Perhaps that is unfair to real prostitutes, whose debasement is personal. The scum in our country who have been bought and paid for by the Chinese Communist Party are doing perhaps existential damage to their country, all in service to their fat bank accounts.

And LeBron James might be the worst of the lot. Imagine using the stain of American slavery (which ended in 1863) as one of the tools to defend his own complicity in the enslavement of millions of Chinese and the destruction of American autonomy! That is breathtaking hypocrisy, rivaled only by the Democrat Party and their adjuncts in corporate America.

We may not be able to boycott all of the many organizations around which the tentacles of China wrap, but we can absolutely defund the NBA and their biggest star!

That's a good start...

This is true to a point, but the US has long been extremely enamored with China, across generations and governments. We have been tilting at the China windmill for a very long time in various incarnations. We've focused on China and influence in China since the early 20th century. China has long been our (or, at least, our government's) white whale.

I don't know if that history has blinded a lot of people to the dangers of China and made them willing to become Quislings for China (as opposed to simple greed and power list), but it may have been an additional factor.

Columbus thought that he had discovered the outer islands of China or Japan. It took him awhile to admit he had not. But he kept that up to secure further funding for future voyages. Then the Spanish discovered Aztec Gold. Later the Euros discovered sugar. Finally, they discovered tobacco. And here we are.

It's not a schism. Mandarin only started becoming the national language in the last hundred years, it used to be the court tongue. China had hundreds of dialects. But deep south China is culturally fairly distinct still, yes.

But while China promotes a romantic version of Chinese history in movies, I think that the disconnect is probably between Chinese culture and the modern Chicoms. I simply can not see a way SCOTUS can rule against Texas here. Thus, they only have two options before them: Side with Texas or find some way to dismiss the the lawsuit on a technicality.

And there again, I do not see how they can dismiss the lawsuit on a technicality, and essentially deny Texas (et al) the chance to go to the one and only non-military option available to them in the Constitution to resolve a state-to-state dispute.

This lawsuit is as close to perfect as one can get. The court must either agree with Texas, or they commit one of two sins: deny the constitution coming (no right to sue) or deny the constitution going (breaking the law is okay). It completely and totally ties the hands of the court.

It feels like Ted Cruz wrote it during a seance with the ghost of Antonin Scalia.

180 if SCOTUS says it is okay for non-legislative bodies to change election laws for a state then all states are injured (not just Texas and those joining them). All states are harmed by the ruling because it sets the precedent that every sec of state, and every supreme court, and every governor can change their election laws at any time without consent of the Constitutionally appointed authorities over election laws.

I simply can not see a way SCOTUS can rule against Texas here. Thus, they only have two options before them: Side with Texas or find some way to dismiss the the lawsuit on a technicality.

And there again, I do not see how they can dismiss the lawsuit on a technicality, and essentially deny Texas (et al) the chance to go to the one and only non-military option available to them in the Constitution to resolve a state-to-state dispute.

This lawsuit is as close to perfect as one can get. The court must either agree with Texas, or they commit one of two sins: deny the constitution coming (no right to sue) or deny the constitution going (breaking the law is okay). It completely and totally ties the hands of the court.

But I have to think that if they're on a platform that's turned so censorious, they're ultimately part of the problem. They're enabling it by providing it content. I think history will eventually see them as Auschwitz's Neighbors -- they knew what was going on, but they looked the other way or even played along.

Honestly? I was overseas in the Air Force, went home to Minnesota to visit and went to the high school choir concert and when the Scandi kids filed in I honestly looked at them all and thought to myself "how do they tell each other apart."

On the other hand, I'd become pretty good at guessing if an Asian person was Japanese or Korean or Chinese because there really are some common differences in appearance.

I also worked with a girl in Minneapolis who was from Puerto Rico and she said that when she moved there in high school she'd panic walking into the cafeteria because she was afraid that she wouldn't recognize the new friends she'd made.

Families learn to tell identical twins apart without a thought because everything the same gets ignored and only the differences noticed. Everyone does that.

We have quite a few grievances against communist totalitarians everywhere, but IMO it'd be unwise to alienate Chinese Americans. If we're ever to have political power in this country again, it would be nice if it was along some axis of "coalition of the useful people who have their shit together."

Yes. It is important to understand what SCOTUS does when it does it. Requests for *preliminary* relief (of which an injunction is one kind) are usually denied if complete relief can be awarded later. IOW, SCOTUS is saying, "call it hell, call it certification, but it's a probable 12 to 7, that we're not going to be bound by whatever shenanigans you put lipstick on"

And of course the smallish Yangtze Patrol to protect US interests in China in that time frame too. But yeah, not much that much interest and contact with China historically.

The level of Chinese immigration into the US pre-1950 tends to get overstated/romanticized. I think was less than 200k total population well into the 20th century, but yeah "they built the railroads" and nearly every Western movie made has a Chinese laundry in town or Chinese cook.

The people, on the other hand, just like any other people, came to this country for a better life. Many who came in the 1860's and 1870's to work on the railroads were treated poorly. Hell, my parents' marriage would have been illegal under California's miscegenation laws had it happened less than two decades earlier, and my marriage would have been illegal under the same laws.
Thank God that many of the laws that unconstitutionally forced political inequality were changed and the doctrine of "separate but equal" was shown for the farce it really was. If people are FORCED to be separate, how can that ever be Constitutional under the 1st Amendment protection of peaceably assembling?

Usually that's true, because getting injunctive relief requires a showing that you're likely to win on the merits, and that you'll be irreparably damaged if you don't get the injunction.

But the injunctive relief requested in the PA case was stopping the certification of PA's electors, which had already happened before the SCOTUS issued its ruling on the request for injunctive relief, so it may just have been a case of the court deeming the request moot, rather than a determination that the petitioners would not prevail on the merits.

As others have said, but not fully:

SCOTUS denied the request for a rushed answer. The reason is because the suit asked them to stop PA from certifying. By the time SCOTUS responded, two things had already happened: PA already did certify and the Texas suit was made.

Texas' suit does the same thing the PA suit does, only it resolves a dispute between states (which takes precedence as it's a constitutional matter that only SCOTUS can resolve), and resolves things between multiple states.

People who get high on doom and gloom are quick to say "this means they won't do anything" but that makes no sense when you consider how the court already signaled they would do something, how outspoken Alito was about doing something in particular. The dismissal of the injection was literally a one-sentence refusal to grant relief. No opinions or dissents. It wasn't even a "decision." It was just "hold on a sec."

Read between the lines: They told PA to hold on because they have a more pressing case that not only resolves the PA dispute, but two other states and, effectively, puts the whole election litigation to bed once and for all.

Whatever SCOTUS says to Texas will be their answer to PA for all intents and purposes.

There was a movie I watched some years ago ("To Live", Chinese language, subtitled) about a rich man who gambled his fortune away just before the Communists took over and his life after the communist takeover. One thing you see in the movie that comes up from time to time is the puppet show box, which to me was a symbol of the culture of China. During the communist takeover, the box was riddled with bullets, the what was inside still existed. After the Cultural revolution, the contents of the box were destroyed, but the box remained. Years after, a little girl, decendent of that man asked what was the box for, and nobody could answer that question. THAT is what the communists did the the culture of China.

What that means is they have no right to say either "you should have waited till after" or "you should have sued earlier." By voting 4-4 they effectively made the issue of laches moot in both directions.

Well, the story of To Kill a Mockingbirg puts the main black character in jail from the start. Not many people have a whole lot of agency when they're being led around in chains all the time. It's one of the reasons that Hitchcock's The Wrong Man works so well. It's a horror story where the main character can't do anything to get out of his situation.

Not true. In 1960, after returning from Taiwan, I lived in Concord, NC. The only Chinese Resturant available to us for 300 miles was in Charlotte. They had exactly one Chinese Resturant. The same was true of Jewish Pawnbrokers as well.

Even the Supreme Court is obliged to follow the Constitution. The system is set up with three equal branches of power, with checks and balances, ALL under the power of the constitution.

If SCOTUS makes a ruling that breaks the constitution and neither the legislature or executive branch/commander in chief of the military fulfil their oath to defend the constitution then we have no constitution, we have no republic, and we are all on our own to throw off shackles and water the tree of liberty.

True, but that case started in the PA courts and had several previous rulings before it got to USCC. Maybe it would have been different if the challenge had been brought by another state and heard originally in USCC. Or, maybe not.

Just wondering why the state vs. state direct-to-USCC approach wasn't tried before the election...since the potential harm to other states posed by unconstitutional election law changes was so obvious.

Marcello, at the end of La Dolce Vita, is partying with a bunch of people, including several very obviously gay men, and the party is a sad display of emptiness. At Satyricon's heart seems to be something similar. The characters are all amoral monsters and no one is ever happy. The advertising makes a concerted effort at pointing out that this was Rome before Christ as well.

Actually I don't watch a lot of movies but by way of anecdote my wife grew up in a tiny town in Saskatchewan, which has long since been a ghost town. She was able to point out the building which once housed the Chinese restaurant.

I haven't seen Casanova yet (two movies away), but I think that's probably a good read of the movie based on what I've read of it.

The irony is that Fellini was a hound dog and was constantly cheating on his wife, Giulietta Masina. I think Fellini knew he was a bad person.

Another common theme in Fellini's work is how people don't change. Combining that with the thoughts on sexual conquest, I think Fellini knew that he was a bad person and that there was nothing he could do about it.

It's a miracle, for him, that Masina never left him. She was too good for him.

There is no reason for anyone would think that the vote counts are true (and then certify it), and every reason to think they aren't. And these machines are in dozens of states. Partisan observers are the only check on it and none of the mail in/absentee votes in PA/MI etc. had them.

Trump claims that the election wasn't run properly and that the risks of voter fraud were increased because ballot drop boxes were not staffed, voting by mail was widely used and voters who said they were indefinitely confined were allowed to cast absentee ballots without showing a valid photo ID.

Essentially, Trump is saying it wasn't voter fraud, rather it was election official fraud, and they did not follow WI election law. WI election law is very strict and different from other states. The team has identified over 200,000 ballots that were illegal because they didn't follow the law as written.

Jack Prosobic of OAN has been on top of this and many experts say this is a strong case. If they get most of those illegal votes set aside, Trump wins WI. We will see.
