Trump Threatens to Veto Defense Spending Bill -- Unless It Contains a Repeal of Section 230

The thread right below it is a Happy Fun Time thread for non-political chatter.

The corporate cucks -- James Inhofe among them -- are threatening to vote to override his veto.

Good. We're going to have to build up a case for primarying these motherfuckers-- they must be put on record servicing their Tech Monopolist Donor Overlords.

We have to make it very clear who they are serving, if we want to boot them out of office.

And we do have to boot them out of office.

They must be made to understand that their Corporate Cronies give them money, but only we give them votes.

And we can withhold those votes, or send them to a primary candidate, or send them to a third party candidate.

If James Inhofe and Mike Lee and Jim Jordan and James Sensenbrenner think they can fucking get hundreds of thousands of votes from Google and FaceBook -- well, let's see them put that plan into action.

You want to override the veto? Good. Put your name on it fellas. Stop just living in sin with your corporate masters; put a ring on it.

Let the voters know who you actually serve.

Meanwhile, Joel Kotkin writes that the real fascist threat isn't Donald Trump.

It's the Leviathan Tech Monopolies who now have complete control over the flow of political information.

Under the kindly gaze of Uncle Joe, we soon may find ourselves living under an updated version of the fascist "corporate state" -- an alliance between political leaders and a handful of ultra-rich, ultra-powerful companies that increasingly dominate the economy and culture. This new American-style corporate state reflects not a conspiracy but the politics of a society with unprecedented concentrations of wealth and power.

These firms, based largely in the tech industry, have benefited massively from the lockdowns and now account for nearly 40 percent of the value of the Standard and Poor index, a level of concentration unprecedented in modern history, As the giants get even more gigantic, up to 30 percent of America's small businesses face bankruptcy and the ranks of the poor have grown by 8 million.

Biden raised record sums from the corporate elite, notably the tech oligarchs and their Wall Street allies. Among financial firms, communications companies and lawyers, Biden outraised Trump by 5-to-1 or more. Besides providing money, the tech giants actively helped direct Biden's campaign and volunteered their digital savvy, with Mark Zuckerberg himself financing election day operations in many critical states, something sure to titillate the tinfoil-hat wing of the GOP.

Like many Americans, tech moguls and elite financiers rightly despised Trump's crudity and nativist memes, but they were more immediately motivated by self-interest--starting with their need to maintain a pipeline of immigrant workers to collusively keep their labor costs down and to keep maintain trade and commerce with China. Biden also had the virtue of being able to stop real progressives, like Bernie Sanders and Elizabeth Warren, who openly challenged oligarchal power.

Not surprisingly the new regime will likely favor controls on information that fit their own interests and inclinations. Despite suggestions to the contrary by the New York Times, history suggests any meaningful effort to rein in the oligarchs is now dead on arrival. There will be little restraint as platforms like Facebook and Google accelerate their attempts to "curate" (read: control) news--or in Amazon's case, remove books or videos--to minimize or exclude those who violate their world-view.

What we see now is something of an American version of the Chinese system of power concentration and control--the leading fascist model of today. In America this will be achieved not through government but by allowing a handful of private companies to control information. Indeed Richard Stengel, head of the Biden transition team for media, has openly advocated controls on "hate speech," a conveniently vague term. Such an approach is widely supported by organizations like the German Marshall Fund as well as prominent "liberal" legal scholars who openly praise China's censorious approach.

This notion of thought control has been emerging for at least a decade on issues like climate change and more recently the pandemic. It also was all too evident during the recent election as platforms like Facebook and Twitter made assertive editorial judgements to cut off stories about Hunter Biden's laptop even as they allowed equally absurd anti-Trump conspiracies to travel widely.

This new emerging American corporate state provides a perfect way for the oligarchs to consolidate power and boost their profits. Corporate lobbyists, working for Wall Street, tech and other giant companies all but assure that Biden, like Barack Obama, will wink and nod as Microsoft, Amazon, Apple, Facebook and Google acquire or crush competitors, continuing the erosion in anti-trust enforcement that's happened under both parties. Monopolistic control is critical to maintaining the enormous profit margins and unprecedented wealth of the oligarchal class.

We cannot hope to have a functional (as opposed to a nominal) democracy when property and information are controlled by a small number of companies tightly allied with political power. This is not either a right-wing issue or a left-wing one, but a matter of protecting our republic before it is too late.

Media would crack down on us even more, because there would be no fig leaf that they are a simply a utility. It would be far preferable to have 230 protections stripped from the specific bad actors like Facebook, Twitter, Google, etc.

A section of the Communications Decency Act passed in '96ish that essentially makes a legal distinction between "publishers" and "platforms" on the internet.

So a news paper is a "publisher." They are responsible for the content they publish. They can get sued for defamation, for copyright infringement, for all kinds of things based on what they publish.

Facebook et al. were typically thought of as "platforms." Meaning, they cannot be sued for content users post. Implicit in that huge benefit granted to them by congress was that they must act like a platform that doesn't take view-point centric positions on what content to allow and what to disallow.

Once they started doing that in a big way (last 4-5 years), they started to look a whole lot more like publishers then platforms. In which case, they don't deserve legal immunity.

No, it would be more of a case of people suing the AoSHQ, LLC (or whatever ace's company is called) for content posted by commenters. And ace would be liable for it.

So if someone called a politician a "corrupt hack" (true or not), ace could potentially be legally liable to that politician. Not that the politician would likely prevail, but it would be a quick and easy way to put ace out of business with legal fees.

The point you are missing here is that AoS can already be shut down very easily anyway. Section 230 is not protecting them from the real threat, which was never scurrilous lawsuits, but their provider being bullied into canceling their service for politically incorrect content.

Certainly most comment sections could do well with being moderated, and the internet is in general a slimy hive of mis/disinformation because no one is liable for what anyone says at all.

Further, shutting down comment sections in many sites would lead to people who are disgruntled taking their energy elsewhere.

Most sites could just start moderating comments and remove any that became the subject of legal inquiry. A smaller site is in a better position because in general, the staff-to-comments ratio gets smaller as the business gets bigger.
All the blogs I've run I moderated comments *anyway* to prevent spam. Editing or putting notes in comments that contained potentially libelous statements might be annoying but it's a price worth paying for destroying facebook, twitter et al.
Any price almost is worth paying for that.

The "notify and remove" stuff comes from the Digital Millennium Copyright Act. I guess you could pass a new law incorporating some of that language in to a thing around libel.

But as of right now, it's actionable as soon as it's posted. Damages are mitigated by removing it as quickly as possible, but there is still a legal action as soon as the words are said (or printed in this case).

New York Times can't post "CITIZEN XYZ IS A PEDOPHILE WHO RAPES CHILDREN" then retract it the next day and think they're going to avoid legal liability.

You're misunderstanding what Section 230 does. It protects entities from being sued when a commenters promotes something illegal. We already would boot people for that. Facebook is less inclined to boot ISIS selling sex slaves than we are, but still enjoys immunity from liability.

That said, what Lee is saying is that we are going after the wrong section, which is concerned with antitrust. He said if we want to sort the real problem, we need to start looking at telecommunications. He agrees there is a serious problem. He just doesn't think we are attacking the right section to get the result we want to have.

Lee is generally a straight shooter, unlike the other bastard who is a Utah senator. His argument sounded logical to me. Maybe the rest of you should take a look at it and see what it sounds like to you.

Libel is illegal, but yes 230 limits liability to the publisher when it comes to libel. It's worth noting an argument can be made AoS doesn't have 230 protection simply on the grounds that we do have moderation.

I largely agree and as a general rule think that the public internet should die in a fire, and I say this having been a poster on and off on sites like AoS and the long fallen LGF and HotAir since just after 9-11. I love to some extent what the public internet has done for me in terms of exposing me to viewpoints and 'unknown unknowns' for almost 20 years. Yet, I think most of this activity could move underground and existing online networks would better serve themselves acting more like the old internet (the true social media) than the clickbait economy.

The Tea Party Wave installed somewhere between 1/4 and 1/3 of the GOP majority that took a pretty good House majority. How did that work out ? They walked away because the GOP said so. Paul Ryan led the failure theater.


Taking over the GOP can't happen. It really can't. You'd have to elect a majority of insurrectionists in the House - and still maintain a Party majority. That's at least 125 or so, all at once. And you have to elect a President against their will as well. Oh - and you have to blow up the Senate - because they only allow one third of their body to be elected at a time.

Nobody is taking over the GOP - because the GOP does not give a fuck about winning or losing. They'll gladly lose, if that's what it takes to keep control of their party. Keep going out there and voting for them to win. They don't care. They really don't give two shits.

ABL, this is definitely a discussion worth having.

I get all the arguments for starting a new party, and I'm quite sympathetic to it. These are my problems with it:

The Bull Moose Party
The Reform Party of the United States of America
The Libertarian Party
The GREEN Party
The Whig Party
etc. etc. etc.

Other than the Whig Party, none of them have had any more than a negligible long-term influence. Perot's Reform party was responsible for getting Bill Clinton elected.

The challenges to setting up a nation-wide infrastructure to get candidates on ballots is significant, and extremely expensive. To get someone on the NY ballot, for instance, is well-nigh impossible. Bloomberg tried, and the only way he was able to circumvent the Democratic Party to get on a ballot was to pay off the NY GOP to do it for him.

You're not getting on the ballots in 50 states without tens of millions of dollars spent on lawyers.

Better to spend that money in taking out 1/3 of the Senators per cycle. Between money for new candidates and funds shrinking for existing ones because the base isn't supporting them, it's a lot easier than the alternative.

My rule here is that if you think the law is protecting you (as a conservative on the internet) chances are you are probably wrong in practice. Any attempt to enforce or repeal 230 would likely impact *everyone* currently on the public internet. It's a matter of the political will to either apply it to big tech and leave small providers alone. This is not equal application of the law, but yet I think with companies that are large enough to wield political power over states or nations, they can no longer be counted as private entities at all. Anyone arguing that facebook is just a private business even though it can manipulate public institutions with ease, is a fool.

I yield to no one in my utter contempt for Facebook, Google and Twit, and I do not have their accounts. That said, what Lee is saying is that we are going after the wrong section, which is concerned with antitrust. He said if we want to sort the real problem, we need to start looking at telecommunications. He agrees there is a serious problem. He just doesn't think we are attacking the right section to get the result we want to have.

If Trump didn't back down I believe the Dems would have absolutely arranged some mid air collisions, or near misses. If they were going to enforce it, it would have happened. But that money, it smells so sweet. All of DC is in their pockets. We've seen the pathetic Kabuki when they trot these vermin out and pretend to read them the riot act while simultaneously shoving their tongues up their assholes.

If this is some more 5D chess, I don't see the endgame. Enforce 230, make them publishers - then amend it at some point for all the shades of gray. Striking a blow to goolag/twatter/fb would also be striking a blow FOR alt tech, who has suffered at the hands of these scum.

One thing that 230 doesn't cover is just how much power the banks wield. Congress had never figured commerce as it is right now. We've seen PayPal, Citi, Cap One, MasterCard, Visa - as well as group funding sites tell alt tech and individuals to GFO, and that effectively stops them from being a business. They need to have laws written especially for them.

That's where Styx's Internet Bill of Rights does make some sense. Perhaps a combination of things. But, it's the fucking 21st century, and we're looking at a quarter century old piece of legislation that didn't foresee any of this.

Hard to say. Voting for Poppy Bush was like trying to pick up a turd by the clean end. Lots of people gave up on him after his read my lips tax increase. And Slick was running as a "pragmatic" southern governor.

I never took Perot seriously like I did DJT. It's really guesswork as to who he impacted more.

They censor now pretty much unabashedly I fail to see how it gets "easier".

On the flip side. If they want to claim to be a public forum of self published content, it would shift the burden of proof to them to prove that as an affirmative defense, instead of upon the plaintiff to prove to a preponderance they aren't based on section 230.

Repealing section 230 is anti speech. It's also a great idea for Trump, who wants his own media empire and wants to avoid people criticizing him. he knows he would have a nice bubble that way.
