The vote was unanimous because the committee Democrats, realizing they could not win the vote and didn't even show up, instead putting up pictures of individuals whom they believed would lose their Obamacare policies should the ACA be overturned. What a bunch of crybabies. So the full Senate will vote on ACB's nomination on Monday. Cocaine Mitch says he's got the votes to confirm, and I believe him. Heck, even the linguini-spined Mitt Romney announced he's on board. Mrs. Barrett was so poised, articulate, and , she may even win over a Democrat or two. And I'm sure all of those harrassing and threatening phone calls to Susan Collins' office are really going to pay off. Well played, Democrats. /sarc But what I actually wanted to discuss is a term that got tossed around in the hearing that I was unfamiliar with, "super-precedent." I had never heard it before, but it apparently it refers to SCOTUS rulings that are so well-established in law that they are considered impossible to overturn. Such as Marbury v. Madison and Brown v. Board of Education. In other words: Super precedents are the doctrinal, or decisional, foundations for subsequent lines of judicial decisions (often but not always in more than one area of constitutional law). Super precedents are those constitutional decisions in which public institutions have heavily invested, repeatedly relied, and consistently supported over a significant period of time. Super precedents are deeply embedded into our law and lives through the subsequent activities of the other branches. Super precedents seep into the public consciousness, and become a fixture of the legal framework.At one point in the hearings, the Democrats on the judiciary committee had on their pouty faces because Mr. Barrett would not agree that Roe v. Wade belonged in the "super precedent" category. That's when I first heard the phrase, and I immediately thought that it sounded like something a liberal jurist or legal scholar invented. But I was wrong. I think. This paper traces it back to it first being used by 4th Circuit Court Judge Michael Luttig (a Bush 43 appointee). But this is something that I think the progressives are going to seize and pounce on and corrupt very quickly. Because they don't like to be challenged on, or criticized for, any of their bullshit. It's why they parade Greta Thunberg around as a climate change expert. If someone points out that she doesn't know what she's talking about, the response is "how dare you denigrate a child, you monster?". Progressives use children like terrorists do, as human shields. They need them to hide their mediocrity. Just as, during the Kavanaugh hearings, they always insisted that Ford made "credible accusations". The extra adjective is important Because if it's just a standard, garden-variety accusation, it's just an alleged accusation. The addition of "credible" was meant to short-circuit any possible objection, to proceed directly to the guilty verdict without having to go through the messy complications of an actual trial. Hereafter, all progressive accusations of sexual misconduct will be deemed "credible." And I think they're going grab onto "super precedent" and do the same sort of thing with it. They will recognize it as a weapon they can use to put their policies beyond any challenge, criticism, change, or appeal. Every time they win an important case, bang, they'll call it a "super precedent." Because what's theirs is theirs and what's ours is up for grabs. It's actually kind of like radical Islam dividing the world between the House of Faith, anc the House of War. And with both radical Islam and the religion of progressivism, we all of us here are living in the house of war.

It's so good that some prominent shareholders are trying to force Disney to put more of their tentpole movies out on the service like they did with Mulan. But if studios owning theaters was bad in the 40s and 50s, studios owning streaming channels is bad in the 2020s. It turns into a racket that cuts out smaller distributors and forces the others to play by unfair rules (which is what led to the Paramount Decrees to begin with). It will happen again. The interesting thing about Brown v. Board of Education being a super precedent is that the left is reimposing segregation on us particularly in the educational area. Because of this, there should be litigation over the meaning of B v BOE, and if so does that now take it out of the realm of being a super precedent.

It's not nothing. It's a promise that, in any similar case, the court will rule the same way so don't expect a different result. The limit is that they only can rule on a case that is before them, and their docket is limited perforce, so it requires the executive to acquiesce for the doctrine to have any power. I don't necessarily agree with this. SD does not override the Constitution. The underlying and future cases must be grounded in the Constitution, but law is built upon law. It is the foundation of our common law heritage. It certainly doesn't mean you don't revisit cases. But my definition of SD is more limited than how the term is thrown around by the left.

The term is being used to avoid having to make an actual argument in defense of the result/policy. But as a purely descriptive matter, Roe v. Wade is super precedent. It will be modified; state laws more restrictive of abortion will be allowed. But conservatives who think the court is going to abrogate Roe v. Wade and allow states to outlaw abortion entirely should gird their loins for disappointment. You can't unlose the culture war in the Supreme Court. Surprising that Oregon Muse had not heard of Supreme Court super-precedents before. The Dems have been pushing Roe v. Wade as a super-precedent at least since Obama's early days and maybe even since George W. Bush.
It makes some sense to give a bit more weight to some precedents, but we should never use a super-precedent as a reason not to reverse a ruling. After all, by the accepted definition, the Dred Scott ruling would have been a super-precedent, and Brown v. Board would have never happened, either, if being super-precedents prevented them from being overturned. Roe v. Wade was an unconstitutional ruling. It should be overturned. I just found out that I am 53 yrs young. Had an eye exam this morning and had to math out my age. Eye doc says I'm young enough that cataracts aren't really to be expected but she had to test for it anyway. Both of my parents had those so I probably will eventually.

Here's the quick-and-dirty explanation for "super-precedents":
A vulnerability (perhaps *the* main vulnerability) of Originalism is that if it is applied consistently and literally, some very old and important cases, laws, and practices would have to be overturned and invalidated. Just to use one example, West Virginia was not created with Virginia's express consent, the Constitution does not permit Congress to create paper money, the Presidential Succession Act is unconstitutional,and Brown v. Board of Education was improperly decided. Overturning those would cause absolute chaos, but they can't be upheld under strict Originalism. The "super-precedent" is one solution (or one way to describe several solutions) to this problem. Basically we find the old cases and practices that would simply be too chaotic to overturn, and we keep them in place. One brilliant way to do this is for Originalists on the Supreme Court to simply refuse to hear challenges to those cases. The Supreme Court's review is always discretionary, so Orginalists can just say "nah, we're not gonna review that" if anyone tries to appeal, say, paper money. In the meantime, the Court can hope that the political branches find a way to resolve those problems on their own. For example, Virginia could decide to formally recognize West Virginia, retroactive to 1860. So for an Orginalist, a "super-precedent" is a case/law/practice that: (1) Would cause absolute chaos if overturned; (2) Is old; and (3) Has been more or less accepted by everyone forever. That means Roe v. Wade is out. The third prong definitely cannot be satisfied, and the "chaos" prong really is in the eye of the beholder. Of course, what the left means by "super-precedent" is "we're slapping this label on cases we really like, and you're not allowed to overturn them." So then Roe v. Wade is super-precedent, but Heller v. District of Coumbia isn't. It's pretty obviously a dishonest power-grab, but leftists gonna left. Update today:
Left kidney was removed yesterday evening. My wife is doing a goos bit better now with it gone. She has started dialysis, to flush thibgs out, and remains on the ventilator, albeit at around half the strength as yesterday. So she is doing well, but still bot out of the woods. Brown vs Board is a "super-precedent" simply because of its societal gravitas. It's often said to be about the only unanimous SCOTUS decision that's ever debated much in academic circles, partially because of its almost complete reliance on an "expert opinion" as the basis for the decision. (Supposedly, for political reasons Warren and others wanted a unanimous vote - and the fact that an expert said "separate is inherently unequal", with this unrebutted on the facts, was the only thing they could all agree on - the rest of the opinion is largely legal window dressing, albeit societally important). Thomas in particular often brings up the over-reliance on "experts" in his opinions.
