The Morning Rant: Minimalist Edition

Civics, American History, Political Science...apparently none are taught anymore, because the level of idiocy, ignorance and flaccid assumptions about our political structure are ubiquitous.

Checks and balances? Three branches of government? A Constitutional Republic vs. a majority-rule Democratic government?

Bueller?

One of the glories of American Exceptionalism (another phrase about which most are ignorant) is the magical balance between competing powers in our government. Sure, it's mostly broken, but even the vestiges of its brilliant design have protected us from some truly horrifying and destructive tendencies.

Of Course We're Not a Democracy

Insofar as “democracy” means “a political system in which government derives its powers from the consent of the governed,” then of course that accurately describes our system. But the word conjures far more than that. It is often used to describe rule by majority, the view that it is the prerogative of government to reflexively carry out the will of the majority of its citizens.
Those who claim to speak and act for "the people' have an alarming tendency to do really bad things. The doublespeak of the totalitarian is filled with vague references to "the people," which conveniently overwhelms the smallest and most important unit of society: the individual.

It is individual rights that are the bedrock of natural and God-given law. That amorphous and malleable "people" are an excuse for the worst tendencies of mob rule. "The People" are the ones rioting in our streets and enthusiastically supporting vicious policies of inequality: affirmative action, reparations, defunding the police, and on and on and on.

That ignorance of history prevents a sober understanding of "the people," best expostulated in post-revolution France. The Reign of Terror was exactly that, and it emerged from direct rule by the people, unfettered by the checks and balances of our Constitution.

It is the individual whom I trust, and American Exceptionalism placed him at the forefront. Just look at the Bill of Rights; its laser-like focus is on protecting the rights of the individual from the depredations of government, and on protecting the individual states from an overbearing central government.

But when the rule of law can be overwhelmed by a simple majority, even the most romantic notions of democracies fail. It is our unique Constitution that protects our rights, and we owe it to our ancestors and our descendants to inculcate them with at the very least an understanding of our political structure, and why it has resulted in the greatest country in history.

That is actually a good point. The flyovers, I think, are mostly for the enjoyment for the fans. Doesn't really make much sense to have them if there are no fans in attendance.

But that is not how Aikman framed his comment. He described it as a waste of jet fuel. And then made a comment seemingly in support of "Harris-Biden" ending the wasteful use of jet fuel in flyovers if they get elected.

So yeah, I don't buy his explanation either. If that is what he meant -- flyover is a waste with no fans in attendance to see it -- he would have said it at the time.

I get a bit agitated whenever I hear about "our democracy" for exactly this reason. When I was in high school, a communist girl wrote an essay for the school paper to deconstruct the Pledge of Allegiance and in response to the "and to the Republic, for which it stands" line, she commented "at least it doesn't pretend we're a Democracy."

I fisked it and sent it back as a letter to the editor. They declined to publish.

Strictly speaking, in a Democracy the "rule of law" *is* the will of the majority. This is why constitutional Republics are a much better concept.

I hope they take away the lesson that massively unrealistic polls that show Democrats winning easily throughout summer just depresses their own base because they don't need to vote.

This was the worst year to do it, too, since so many people were planning to vote by absentee. In many places where you had to request the ballot, they might have just put it off because there was no real sense of urgency because Biden was going to win easily. And then, by the time polls tightened, it was far too late to ask for absentee ballots and they're still too scared to go in person.

Yup, they just redefine words to suite their agenda.

Redefine rights to mean "stuff we are owed by the government."

Redefine Constitutionalism as "believing in the Constitution exactly as written -- and rejecting all amendments made to it."

Claim it's "unfair" that every state gets two representatives in the Senate, completely ignoring the historical reasons why that is vs. the House where representation is based on population.

Words have no meaning to people like AOC, just will to power by playing games, intentionally misrepresenting what is to get what she wants.

My beautiful dream is that another Trump victory fractures the Democrat coalition. They realize they can't win by doubling down on their failed ideas anymore and start blaming various factions. The moderates separate from the socialists, the greens go their own way, and everyone starts trying to rebuild a new party...

Offshore drilling is important to this area, but it feels like super weak sauce in a national election.

A Republic can only exist as long as its power is divided. And as we've seen, any central authority will always pursue - and get - that power. I'm not real optimistic than a Republic can survive long term.

Disagree. The big story the past couple weeks is the media suppressing info to hurt Trump and help Biden. Once the public sees them cutting Trump's mic in an actual debate it's really going to sink in. It's going to piss people off.

I always interpreted that as frivolous or something similar. And it is that, but I have come to understand it means a lot more, too.

83 There was an official US Army field manual definition of "Democracy", prior to WWII and then post war, that shows the sleight-of-hand. Early descriptions said something like

"Rule by the masses. Results in license, agitation, discontent. Attitude towards property communistic. Mobocracy."

After the war, the official description was some vague anodyne nonsense. Aunt Bee running for public office style "The will of the people shall prevail!". Probably vetted by state department goons and that sort. Democracy is poison; more or less. The government was founded on that world view if you read the Federalist and other documents. They divided and separated powers, trusting neither Kings or Dictators, nor the people, at least not directly.

Democracy isn't a goal or destination, it is metely the method by which unscrupulous types gain control of the levers of power. They hate democracy more than anyone, probably.

It is no accident that Democrats are not democratic in the slightest.

This is a problem through all the cartel run narco states, even if they call themselves Republics.

More fundamentally, revenues from this tax will crash every time there is an economic downturn, since even wealthy people tend to have large reductions in income during recessions.

Fred may make $600,000, and pay $9,000 in childcare tax in good times, but if his income drops to $200,000 during a recession, he pays no childcare tax at all.

Yeah, there's a problem in giving the electorate unlimited power to increase taxes on other people.

This isn't the nightmare scenario of a dystopian future, either. The state does this (or can, if it wishes) *today* in the context of family court when it comes to setting alimony and child support.

If you earn, say, $50k but the judge thinks (because of your skills or prior history or whatever) that you could earn $100k if you wanted to and were willing to work for it, he can "impute" your income at $100k and set your alimony and child support based on that. Then you may be in a position of having to pay more than you net after taxes, or land in jail. So you go find a way to earn more, or you check in to the Graybar Hotel.

I think I see the potential reason, although nothing will be certain until after the election. It looks like they rely exclusively on online profiles and online contacts; they do a lot of them, and they do have a reputation for accuracy. But I suspect this causes them to be focused on urban areas and urban voters, and to miss most hispanics and many of the voters who are outside of the 15 high population counties. This screws up pollsters in Texas all the time - the 15 highest population counties might be 60/40 for Biden, that's his base - but the other 239 counties are going to be 80/20 Trump. That's what I think they're missing.

The formation of an abusive administrative state isn't purely a function of size. We can all think of states and even cities where the government is run by a cloistered elite.

Things are entropic, the institutions of man are temporal. Just like everyone else, we'll have to do a new iteration every now and then. We should be looking at what went well, what went poorly, what things are inevitable due to human nature. It may be that we can fix some things but other things we can only delay or ameliorate, maybe planning to make the next reset easier would also be smart.

In that situation, it may occur that the lawyer isn't so much trying to win, as he is trying to create a mistrial, or a situation that is such a mess that it will be seen as inherently biased and its result therefore not a true judgment. If you really get the judge wound up, you can create a good enough record to have the judgment reversed and the judge disqualified. Admittedly its hard to do. Only seen it a few times in decades, but have seen many many hostile judges.

I'm almost through the Constitution 101 and can recommend it. It has filled in some blanks for me that have existed for a long time. For example, all the way back in grade school I couldn't figure out why the French and Indian War was such a big fucking deal only to have the dots connected that by removing a world class ass kicker from being a present danger it enabled the colonists to think "we need these asshole redcoats like a third nut".

There's an extensive study guide which I haven't bought which would make an excellent civics reference book. The course itself is free but I made a small donation.

I think Trump was still not quite over the Chink Stink when he was fighting Biden and Wallace.

I think he knows how they will attack him - Coronavirus failure - and will act accordingly. Just let Biden start rambling and then in no time he'll be sundowning and call time on himself.

Trump can just go right ahead with China, which sequels nicely insofar as Biden called Trump's travel ban racist and xenophobic. Natural in to talk about the graft and when Welker hits the mute button, it'll be the same as Dorsey and Zuckerberg in the minds of most people. I think. I hope.

they're missing.

You are on the right track, but it is a little more complex. It is an artifact of relying on single mode polling (pollster speak for how you take the poll).

I could write an essay on it, maybe after the election I'll beg one of the COBs for a post on why polls are wrong.

In any case, that poll is wrong, and they could have checked against actual early vote results to show the poll is wrong. All you have to do is look at the result you got form people saying they already voted and compare to how people already voted.

That just encourages sock puppetry to be codified. i.e.
:I'm running as a progressive Democrat. That's completely different than running as a Democratic progressive. Just eliminate Jungles all together, and stop confusing or confounding PARTY elections with CIVIC elections. The State (national or local) has no business saying how a party runs it's election. It has every business saying how it conducts it's own.

Small world. I did see that tour play Richfield. So it looks like at least 2 future Morons were in attendance. The Offenbach show was great because in W Germany they still permitted 'festival seating', so I just muscled my way up real close to the stage.

I also look back fondly at road trips from Columbus to Richfield when I was a teenager. IIRC I saw U2 play there, too, back in the early '80s.

Also smaller things like UT Austin is not fully open in person, so lots of students who woudl be harassed to vote and vote dem are elsewhere. Don't know if that changes the outcome but it could be a local factor.

Both plus the historical voting pattern in a state, district, and precinct, give some kind of idea about the "normal" vote. AND each time, special, primary, general election that you vote in, it is recorded on your voter history file.

So, they have a pretty good idea about regular voters who is voting for what. In deep red or deep blue states, where the primary is all of the action, you may see this assumption break down but overall the modeling is pretty solid.

But, these assumptions often get blown in a wave election because of seldom and never voters voting in that particular election. If they stay mobilized for a couple of election cycles, it becomes a realignment.

What is unknown in 2020 is the turnout and voting patterns of the less likely (spotty voting record) and never voted voters. In 2008 they turned out for Obama in many places even without a GOTV or contact. Not so much when the hope was gone in 2012 which was a GOTV and base election which is typical with incumbents.

Even aside from the herd characteristics of the media pollsters who are by and large liberal to ultra liberal, Trump has a personal constituency that makes it hard to model and these particular voters may have no interest in being surveyed. This is certainly more likely for the seldom and never voters that might turnout this election.

I was on planes to/from Denver in the last 2 weeks. Both times on Boeing 777 (yuge planes) and both times full. Airports are getting busier, although not anything like they ought to be. People mostly being polite to each other and putting up with all the mask nonsense in order to get where they want to go.

In the Denver airport, I saw a young man, college age perhaps, wearing an "Oregon for Trump" red hat. He was a big guy, and nobody seemed to notice the hat, or if they did they weren't there in enough numbers to take him on.

I noticed the hat and it made me smile.

They are not really comparable. To take just one example, in 2016, Los Angeles county was almost 75 - 25 for Hillary and against trump. Harris County (Houston) was roughly 54 - 42. So is Houston blue, yes. California blue, no. Bexar (San Antonio) was similar, 54 - 40 roughly. Dallas is closer to LA-like numbers at roughly 60 - 35. That leaves Travis (Austin) at about 65 - 27, which is awful but surprises no one. In Texas, the rest of the state can hope to make up the difference, something that is not true in CA, I don't think.

Truman beat Dewey in 1948 in another wave election that broke quite late in the game.

All states are known within a fraction of a percent through election result history and voter files. There is a service that provides this for all states, including those without registration ID.

So Texas, WI, and MI early vote party ID is known.

507 464 344, TJM, each state has a voter history file which includes which primary ballot you chose in states with open primaries. Some states have formal party registration. Both plus the historical voting pattern in a state, district, and precinct, give some kind of idea about the "normal" vote. AND each time, special, primary, general election that you vote in, it is recorded on your voter history file.

So, they have a pretty good idea about regular voters who is voting for what.

When I moved back to NC from MN, I registered as an Independent. I took a Republican ballot for voting in the primary and, let me tell you, Donald Trump and Thom Tillis know! They had no trouble finding me on direct mail, email, text, etc. But I also get a lot of text messages from liberal groups and DFL campaigns in MN, where I was registered as a Republican. I have no idea what I did to get their wires so crossed up!
