FCC Chairman Ajit Pai: I Intend to Provide a "Clarification" To the Scope of Protections Offered by s.230

The mention of a consumer protection law is interesting -- suggesting that the monopolies might be amenable to suit for violating terms of service, like promising to be the "free speech wing of the free speech party" and then turning into the most egregious mass-censor the world has ever known.

Also: People and corporations who's spent years building up a twitter followership (whatever that's worth) but who are then banned or suspended can have a lawsuit against the company for violating terms of service and publicly-stated claims about being politically impartial.

Remember, Twitter's claims to Congress that their censorship is not politically motivated are made under oath and therefore can be fairly be read into the terms of service. People can rely on the claims they make to Congress, and sue Twitter for violating those contractual terms.

Even if Twitter disclaims any obligation to treat customers fairly in its actual terms of service, people can justifiably incorporate the very public lies they tell in congressional hearings into those terms of service.

60 You can drive a stock price in the gutter by just making the "process the punishment". That is one big failure in my opinion the Trump Administration made, never really taking these companies on and at least giving them major headaches.

I honestly think Trump believed as long as he got to Tweet, it was all fine. You'll notice in the last few months of this term, he started making noises when they messed with his Twitter account.

Big red states like Texas should also pass some laws regulating what these companies can censor and discriminate. They would have to bend the knee with compliance.

It's a simple fix to take away their 230 protection and make them publishers. That opens them to FTC and campaign laws. But it won't stop them from being in the bag. They will just have to be very careful.

Question is, okay. Now they are publishers. Will the FTC do anything when they ratio conservatives into oblivion? How do you prove that without access to their code and algorithms?

I was thinking about this further - Hunter and other screwups are why disownment is a thing. Not quite. Basically, Section 230 of the communications decency act gives protections to internet "platforms" from certain civil lawsuits. You can read the text of section 230, it's pretty obvious what Congress was trying to do. They wanted to say "a website cannot be held liable for the content users post on the website." That, in conjunction with the dmca, set out our current regime of how the internet works.

For example, if I post something that is copyrighted on YouTube, the copyright holder can, under the dmca, send a takedown notice to YouTube, who then takes down the offending video.

That's in contrast, to say, a publisher. If the New York Times publishes something that they don't have the copyright to, a license for, or fit one of the exceptions (like fair use), the copyright owner can sue the NYT for that.

Section 230 protects "platforms" from defamation suits, copyright suits, etc. and courts have continuously expanded the meaning of 230 to basically give a lot more civil immunity to tech companies than any other industry in the country.

Removing that protection is a punitive move. It wouldn't make the services less biased, in fact, it would probably expand their biases. But it would also destroy their business models, as youtube, for example, would have to police every video that is uploaded, or potentially be civilly liable for publishing a video that is defamatory or whatever.

423 I think the way to change the behavior of Twitter and Facebook is to take the responsibility for content monitoring away from them. If they legally are not allowed to be the content reviewers, then they lose the power to do things like this.

The question is who does it then, because clearly there is some content that needs monitoring. But I think there are some analogs out there, such as banks must have 3rd party auditors, and IT system redteaming can't be performed by the company.

It would have the benefit of making the SJWs complain to a faceless bureaucracy, rather than Twitter.

Maybe that stupid trust and safety council they have can be part of the FCC, and Twitter has no say over who is on it.

There is certainly plenty of precedent for regulatory oversight boards. Utilities are regulated this way.

SHIT! I know exactly what scam they're working. They've got a stack of valid driver's licenses that they've collected (dead people? who knows) and everytime an Illegal with no license comes through the drivethru line, they run in and get him a fake ID that they can use so he can cast a ballot.

No.he's a grown adult. He is capable of making choices. He's not some wayward 20 year old, he's 50 years old. He has five kids of his own, has been married twice , lived with a gal for several years and has one of his kids with another. He graduated from Yale Law School and has a law license. He simply is one of those people who continuously squanders opportunities, and looks for the easiest way to make a buck and escape responsibility. Like his old man.
