All of the Dem questioning of Amy Coney Barrett went like this:

Dems: "Do you promise to implement our preferred policies?"

ACB: "No, I'm going to interpret laws according to the constitution."

Dems: "So you hate our policies?"

ACB: "I didn't say that."

Dems: "So you must support our policies."

ACB: "As I've already said, I'm going to interpret laws according to the constitution. That's what a judge does."

Dems: "You hate people and want them to die, don't you?"

Actually, this is not quite accurate. ACB was uncommonly kind and gracious to every single one of those vacuous pudknockers, whereas if it were me, I would've been saying things like eabod, lolgf, diaf, stfu you rat bastard commie, foad, etc. So, much respect to her.

But let's talk about 'originalism' for a bit. I don't understand what the big controversy is. All it is is trying to understand written communication in the way in which the original author intended it to mean. We all do this every day. So when I give Mrs. Muse a recipe to try that I found on the internet, and it says it calls for a tablespoon of butter, that means she should add a tablespoon of butter. She may be able to get by with a tablespoon of margarine, but maybe not, depending on what qualities of butter the recipe is trying to make use of. But she probably will not be able to substitute two tablespoons of diet Coke. That probably doesn't come close to what the writer of the recipe intended.

Or e-mail. When your boss sends you an e-mail and asks you for the status of the Farkle project, you probably do not consider whether this request is racist, or is in service to the patriarchy, and then invent a bunch of woke stuff that isn't there, and than claim that's what the e-mail says. You might get reprimanded, or maybe even fired.

Tax documents, too. If the heard from the IRS about a problem on your tax return and you claimed that the 1040 you sent them was a "living document", they probably wouldn't accept that as an reason for for your failure to disclose some item of taxable income. You'd still owe interest plus penalties.

Some texts can be tricky. Like poetry or song lyrics, where the meaning is cleverly concealed for artistic reasons, or maybe the text is deliberately ambiguous, so there's are more than one meaning possible. Fortunately, the constitution is not in this category. Although to listen to some progressives, you might think that it is.

The constitution is in the other "tricky" category, that is, older texts. Word meanings can change over time, and some words may be unfamiliar to our ears. So it may take a bit of work to figure out what the authors intended by, say, "inalienable" or "well-regulated." So perhaps you need to consult dictionaries from that time (if they exist) or other documents where the same word or concept is used, only the meaning is perhaps more clear.

Whenever the progressive saint Ruth Bader Ginsburg wrote a memo to her clerks and other office staff, I guarantee you she expected them to use the 'originalist' approach to understanding it and carrying out any of her instructions.

'Originalism' just means treating the constitution just like any other document written by humans. In other words, originalism is just common sense.

There is a free online service (run by a Dem firm though, so you get Dem talking points) that tracks early voting in WI and MI by party using this. They are pretty accurate.

This is why you can trust the Trafalgar poll and not the others. Other polls say D/R early vote turnout in MI is 3:1, but actual early turnout is 1:1. Ergo, the polls showing a Biden lead there are wrong. Trafalgar took the time to check their results against the early vote as a validation step.

Shockingly, a lot of polls, even ones in states that provide early vote results by party, don't check their polls against them.

I have read the blue book and the ballot language and the arguments for and against but it still looks ambiguous. I am truly undecided on this one, as we still have TABOR and even if Gallagher is repealed and freezes rates, they still can't go up without another election.

60 anecdotal evidence from early voting in my area (east texas) Long lines at the early voting station, quick drive by, looks like mostly retirees at this point.

Very few were wearing masks!

I've noticed a few Biden signs in my neighborhood, almost no Trump signs, but a lot of American flags. My personal opinion - many Trump supporters think they'll get vandalized if they put out a sign, while Biden supporters know they're safe.

But everyone who believes they're under threat is pissed off as hell because of it.

I lived in CO for 35 years and voted for TABOR and against anything that would gut it. I'm no longer there so I don't have a vote. But with TABOR they left never changes: If the language is deliberately vague, they are coming for your money. It always works that way.
Also, find out who is supporting it. If the media and the usual suspects (chamber of commerce, mayors, school board members) support it, then it's a bad deal.

We have a similar Constitutional Amendment here in Illinois on the ballot this year again.. they tried 2 years ago and it failed.

The wording of the proposal is, at best, misleading.. with promises that only billionaires will see tax hikes.

But the change to the Constitution says nothing about limiting who they can jack up tax rates on going forward.. the Dems are spending millions on TV ads pushing this. I hope Illinois voters can see thru the bullshit.

Sure. And common sense to the Leftists is that 8 year olds can transition. It's all relative.

Let's think of Originalism as we would contracts. The Constitution is a Contract. Expectations of both sides are clearly laid out and agreed upon. You can revise, but only if both parties agree to and sign an amended contract. But you can't just ignore your end of the bargain without expected, and agreed upon consequences. Leviathan is NOT living up to its end of the bargain. The only question is what are we, the plebs, going to do about it?

I just had to watch it. And it came to HBO Max, so I didn't need to expend any extra effort to watch it.

Despite it's rampant awful decisions about making a terrible adaptation of a stupid stage musical, it's remarkably fascinating. It's so earnest, especially in its final number where Judi Dench sings to the camera about how cats are not dogs.

Not recommended, but Jesus, it was fascinating.

I believe Scalia was from a generation which still sincerely believed that Constitutional Interpretation was a purely intellectual exercise that should have no party affiliation. All of the Justices used to take great pride in that, and RBG was a true intellectual, able to express her opinions clearly. She was a good sparring partner for Scalia's intellectual exercises. Nothing at all like Kagan, who is an intellectual lightweight who does't even know how to write a rational, well structured opinion.

The "original sin" of the Constitution has little to do with modern Woke. It's the fact that not only are there no black signatories, but when the signatures were drying on it, blacks were being whipped and having their limbs chopped off and being sexed by the signers.

I can understand it. I know what it is going to do. I just don't know if it is a good idea or a bad one or a neutral one. In essence:
- Property taxes are fixed in ration in CO. 45% of gross revenues come from residential taxes; 55% from commercial taxes.
- The rates were set in the initial amendment, with commercial assessment at 29%
- Over time, residential property has become much more valuable in aggregate than commercial property
- As a result of this shift, residential tax rates have fallen to be lower than many other states, while commercial tax rates have remained static, and fairly high in comparison.

The repeal with end the gross revenue mix requirement by repealing the amendment, and freeze both commercial and residential rates where they are now. Due to another amendment - TABOR - increases still have to be approved by taxpayers.

I get the argument, but it strikes me as potentially a bad solution because if they want to raise residential taxes, they can do it today - by cutting commercial tax rates to maintain the mandated revenue mix.

173 Any CO morons around? I'm soliciting opinions - if any are on offer - about Amendment B, which changes the property tax amendment in the CO constitution. I have read the blue book and the ballot language and the arguments for and against but it still looks ambiguous. I am truly undecided on this one, as we still have TABOR and even if Gallagher is repealed and freezes rates, they still can't go up without another election.

I'm on the fence. What do other CO morons think?

Take Prop 19...

PROPOSITION 19 - Property Tax Transfers, Exemptions, and Revenue for Wildfire Agencies and Counties Amendment

It basically says that people who have lost their homes can buy a new one in Calizuela based on the old tax rate. It also makes it easier to pass on family farms and not get slaughtered by the née tax rate.

Sounds great, huh? Whodathunk this would get on the ballot.

But here is the Trojan horse.

The bill would also limit tax benefits for certain transfers of real property between family members

That means that inherited trusts do not get to keep the old tax rate. It screws over inheritance. That is the big win for those weasels in Sacramento, because they will make a ton more money based on that.

So your old family home that you have lived in and passed down for generations? It has just been reevaluated at Calizuelas ruinous housing market prices.

Regretfully, this will pass. It is another attempt to destroy Prop 13, which has gnawed at the Demonrats for almost 50 years. There is another one in there which also destroys part of it.

So, to answer the question about Colorado and its propositions.

If it is not immediately clear....

The reason has to do with a lot of polls simply are pushed out to create media narratives---not actually to tell you who is winning the race. I can tell you that such early voting/absentee data is used to correct internal polling and where candidates are sent.

When I did surveys for a govt. agency that is nameless for a number of years, there was a master list of all individuals in a particular career in a state. However, individuals came and went due to death, moving to other states, etc. The master list was used to survey folks that they could reach by phone. Then a designated number of geographic blocks were designated in a random pattern that were about 600-700 acres in size. Field folks were then dispatched to do in person interviews within these random tracts to determine the known--unknown which is churn on the master list and used to correct that data. It was and is an expensive gold standard test for adequate understanding of limitation of the primary sample.

But, respondents are not generally coded by precinct in a poll and thus to correct the data, you would need early voting results from that particular poll respondent's voting precinct and replicate that for each poll respondents for minimal error correction. That is much too expensive for anyone other than well funded national campaigns. It is simply easier to call more numbers in an attempt to get a much larger sample than sending people out in the field or crosschecking the data on early voting/absentee.

Dunno what California, Colorado, Oregon, or Washington campaigns do with voting by mail or vote harvesting which is another whole kettle of fish.

I can understand it. I know what it is going to do. I just don't know if it is a good idea or a bad one or a neutral one. In essence:
- Property taxes are fixed in ration in CO. 45% of gross revenues come from residential taxes; 55% from commercial taxes.
- The rates were set in the initial amendment, with commercial assessment at 29%
- Over time, residential property has become much more valuable in aggregate than commercial property
- As a result of this shift, residential tax rates have fallen to be lower than many other states, while commercial tax rates have remained static, and fairly high in comparison.

The repeal with end the gross revenue mix requirement by repealing the amendment, and freeze both commercial and residential rates where they are now. Due to another amendment - TABOR - increases still have to be approved by taxpayers.

I get the argument, but it strikes me as potentially a bad solution because if they want to raise residential taxes, they can do it today - by cutting commercial tax rates to maintain the mandated revenue mix.

I read what you said as a repeal allowing for hypothetically a tax decrease for commercial(without a corresponding adjustment for residential) or a tax increase for residential(without a corresponding increase in commercial). Unless commercial rates are really so damaging that it's driving away investment, I wouldn't risk it.

Part of the problem with pinheads like Woody Wilson is their insistence on scientific analogies of Newtonian physics to the Constitution and Darwinian theory to a living Constitution. I'm surprised they were able to smoke so many people with such spurious, and ascientific, comparisons and that not more people pushed back with "what the fuck are you shitheads nattering about?" I'm sure it was a populist viewpoint at the time and I guess now DJT spearheads a populist response.

I'm in Dallas. Happy that straight ticket voting is gone. The "R" was always the first name listed on my machine, so made it much easier to vote for the R. Wonder how much that impacts votes in aggregate.

We don't know the actual votes. Those aren't opened until election day. States start absentee counting in the morning.

But since we have high confidence that there will be more D>R crossover than R>D, returns showing 1:1 ratio is very bad news for the Dems. 70% of their voters say they will vote early, Dem generally need to hold a 40-50 point lead in early voting to overcome.

I've been taking Hillsdale's Constitution 101 course and they've been talking about the progs lately. Part of the problem with pinheads like Woody Wilson is their insistence on scientific analogies of Newtonian physics to the Constitution and Darwinian theory to a living Constitution. It's not. An attorney trying to sort out the minutiae of our bloated, self-contradictory justice system at the rural county circuit court level has a way more complex job than what SC Justices are *supposed* to do.

What they do in reality makes it seem complex, because they bloviate endlessly as a means of justifying what their actual job is, and it's even simpler than that. For the most part, they just stick their finger in the wind and then rule in whatever way will maximize the power of the federal government, short of a decision that would place their own branch at a disadvantage.

A "living constitution" just means that the constitution doesn't actually mean what the words say, and you can read all sorts of other crapola into it that isn't there (like a constitutional right to abortion) because that is what leftists want the constitution to say and think it should say, but they can't convince enough other people of that to formally amend the constitution to actually say it, so instead they convince leftist judges to infer it (i.e., read it in the invisible emanations from the penumbras).

IOW, a "living constitution" is whatever leftists want it to say, and it changes as leftists change what they want.

360 A quibble about originalism: in a WSJ article this week, Scalia's son said it's not discovering the _intent_ of the writer (which we can't really ever do beyond the words he wrote) but rather the way the words were _understood at the time_ of writing. In fact these two things will usually/almost always overlap, but it's an important distinction.
e.g. in Acts when the KJV has Peter say "God is no respecter of persons," the plain 17th century meaning of that is what we today would render as something like "God does not show partiality."
