The Morning Rant: Minimalist Edition

punk-monkey.jpg

I cannot imagine a more unserious use of a state legislature's time than debating and voting on such an obvious dilution of our political structure. The intent of the Constitution seems clear to me -- though I am not a Harvard-educated attorney and constitutional scholar -- and the National Popular Vote Interstate Compact destroys the purpose of the electoral college, not to mention that it also subverts the will of the voters.

And of course that is the whole point. Bring the tyranny of the majority to America, and the blue cities will rule forever.

The Big Test of Electoral College Is Yet To Come

Now that the Supreme Court has vouchsafed the power of a state to require its presidential electors to vote in line with their state's popular vote, a new question glimmers in the constitutional mist: Could a state require its electors to vote against the wishes of the state's own voters? That might seem a ridiculous question. Feature, though, the National Popular Vote Interstate Compact.
Et tu, 14th Amendment? Although I absolutely love the example in the article from the 2004 election, which would require NY to vote for Bush, even though they chose Kerry by 16%.

Is this the inevitable result of our education system, which has carefully destroyed basic civics and political science, preferring to teach multicultural blather and thinly-veiled anti-Americanism?

Probably. Just wander over to a bunch of teenagers and offer $50 for a halfway decent explanation of our government, or even just the electoral college. Odds are that you will keep your money.

Yes. And this decision makes it possible for the state to simply remove electors who refuse to defy their population. I do not like the decision, I think it was poorly considered and not based on the ideas of the founding fathers.

21 You do well to point out the problem with the state compact; it surprises me that so few people on either side have grappled with the only way it can be resolved.

If an Election is decided by any state going against it's popular vote, then obviously the losers take this to the Supreme Court, on grounds that this violates the 14th Amendment. Then, the entire country will sit in suspense until the Supreme Court chooses the next President without any need to consult the public at all.

This in fact is the desired end-game for the Deep State - a Supreme Court made up of Deep State loyalists, appointing a President who will be a Deep State loyalist, to run a Bureaucracy which IS the Deep State, and no need or opening for pesky "voters" to ever be involved in the process again.

that's what they're shooting for.

No swing state would ever want to sign onto this, effectively nullifying their ability to influence elections, and it's obviously a partisan thing, so red states are going to be very hard pressed to decide that it's the right thing to do.

And that doesn't even address the constitutional questions. I imagine it wouldn't survive a challenge. Completely overturning how elections are done seems like the kind of huge change that terrifies Roberts.

+++++++++++++++
It's the *huge* breakdown in civics. There are two arguments to be made for the "national popular vote." Both are wrong in my opinion, but one is wrong fundamentally.
1. The electoral college is unfair. I disagree with with this, but it's at least an argument.
2. The electoral college disregards the will of the people in the selection of the president. This one is flat wrong, and it comes from what is *wrong* with civics education.

The people don't elect the president. The states do. Federal power is rooted in the states, not the other way around. Since the states devolve power to the federal, the states elect the president. Nobody teaches governance in schools, they teach mealy-mouthed "fairness" and "rightness" and "justice" and whatnot.

That whole culture of names annoys me because its contrived and silly. Names bother me a lot, the way they are used today. Children are tagged with awful, bizarre names because parents insist on being "creative" or "fresh" with ideas they came up with when they were 13 and doodling in the back of a textbook in middle school or writing in their diary about the child they would have with the latest pop star.

A name is very important. It marks you for life. Its part of you for your whole existence on this earth, and it shapes how people react to you. Playing cutesy games with a child's name is abusive and cruel. Creating dumb names to make a statement is as well.

47 Despite Trump's electoral landslide victory, his margins in key states was pretty slim. He now has a solid record, and the left has gone insane, so Trump should win again. Congress though, also needs massive transformation, including the GOPe. It is the Establishment and BigMoney engineering the chaos, so voters don't unite against their cartels.

In time "we" need to win more of the masses, and that will include the "Hispanic" population, and blacks. Trump does this, and that is why the Dem Agitprop is directed so fiercely at him with "Racism/Hate" propaganda. The lamp of Liberty, patriotic message is still a winner ... but needs to be taught more broadly. WokeKorps is solidly pandering to the America Haters, along with most schools ... WAR will require some new asymmetric warfare ... like blogs and frogs and memes, I suppose.

It's always struck me as darkly amusing that people like to quote "First thing, let's kill all the lawyers" without knowing it's context.

Jack Cade is a criminal, a ruffian, the proto-marxist BLM leader of his day, talking to his followers about how they plan to destroy all authority and take over. Dick is one of his henchmen.

"JACK CADE. I thank you, good people; there shall be no money; all shall eat and drink on my score; and I will apparel them all in one livery, that they may agree like brothers, and worship me their lord.

This one I find puzzling, and maybe my experience is completely exceptional. When I was in college and took the "US History Until 1865" survey course, they talked about the 3/5 clause accurately: to reduce the representative distribution for slave states, since slaves are not full citizens. And this wasn't that long ago (less than 20 years) and in a *very* liberal/left-wing college.

Was my experience exceptional, or did this pivot happen in 2008 when the universities went completely bonkers?

If, in the very next election, a Democrat gets a majority of the popular vote, the very same left-wing judges will deem the National Popular Vote Compact perfectly legal and sacrosanct.

Look what happened in Massachusetts, which had a series of US Senatorial vacancies. The Massachusetts legislature kept changing the rules on who got to appoint the new US Senator, depending on whether the governor was a Republican or not. You think they have any sense of shame?

Posted by: The ARC of History! at July 07, 2020 11:21 AM (I2/tG)

76 States can make their own rules. Remember for the first few elections there was no vote in most states. The legislature selected electors. So disenfranchising voters is not a new concept. If OH wants to give its electors to someone OH voters did not vote for, go for it as far as I am concerned.

94 It's the *huge* breakdown in civics.

Posted by: Joe Mannix (Not a cop!) at July 07, 2020 11:15 AM (hYcqw)

There is not a single argument in favor of a National Popular Vote made today, that was not made at the Convention in 1787. New York and the large states wanted it just as much then as they want it over.

My view is that, if they want to change the Constitution that much, then the Compact is over, and we go back to being 50 independent governments. If some of them want to get together with each other to make new organizational units, fine.

105 Nebraska and Maine allocate their electoral college votes differently from the winner-take-all model.

The two (Senatorial) electoral votes go to the winner of the overall state winner. Each of the (Congressional) electoral votes goes to the winner of the corresponding congressional district.

In theory this would tend to preserve some electoral say for rural districts, rather than having the big cities dominate. Gerrymandered congressional districts could potentially introduce other variables.

126 The National Popular Vote Interstate Compact, though, is a scheme under which states agree to instruct their electors to ignore what their own state's voters want and, instead, vote for the winner of the national popular vote. The compact goes into effect when it has been ratified by states whose combined electoral vote count is 270, i.e., enough to choose a president.

So far, some 15 states, with a total electoral vote of 196, have signed the confounded compact.

I used to argue this with people, not worth it anymore, too many words. But the clear wording of the 14th Amendment, as applied in Wong Kim Ark, 1898, is what did this. There was no national definition of citizenship before the 14th amendment; you were a citizen of the US only if you were a citizen of a State. (which is part of the reason that the Dred Scott decision held that runaway slaves were not US citizens, and thus had no rights under US law.)

The 14th amendment is the amendment that effectively re-wrote the entire Constitution and turned the nation into something it had never been before.

People are attracted to dictatorship because that is the proper way to run any organization that can't destroy people's lives. It's amazing how few news outlets mentioned that the guy who hit the women was a black East African immigrant. They even avoided giving the guy's name, since it was obviously an African name.

NPR failed to give the guy's name or race, but did mention that he was driving a white Jaguar (trying to give the impression that a rich white person had done this).

The NPR report then had this outrageous paragraph:

Since nationwide protests erupted in late May, there have been reports of at least 50 vehicle-ramming incidents - many of which were suspected attacks by right-wing extremists targeting Black Lives Matter protesters.

Frankly, the (North) Korean Central News Agency provides more accurate reporting than our "mainstream" media does.

193 Of course, the National Popular Vote Interstate Compact is another way to rig elections against Republicans. California & NY will never cast their electoral votes for an R if the R wins the popular vote but would otherwise lose the electoral vote. Th media would suddenly declare a constitutional crisis and all well-trained GOP squishes would agree that the NPVIC cannot be enforced if it hurts Dems. Therefor, with the NPVIC there are four outcomes to elections, three of which work against Repubs:
1) Republican wins popular vote & electoral college: GOP President
2) Dem wins popular vote & electoral college: Dem President.
3) Dem wins popular vote but would lose electoral college: Dem President because of NPVIC
4) Republican wins popular vote but would lose electoral college: Dem President because the NPVIC is suddenly problematic and unconstitutional.

The 14th Amendment makes an appearance. This is the first time I have seen anyone mention Section 2 of that Amendment, which says to the extent that a state voids its own citizens' votes through shenanigans (paraphrasing), that state loses the same percentage of its proportional representation in the House as the percentage of voters disenfranchised. Democracy works great in systems control. You get an odd number of input plants providing data to a system that it would use to control something. Some of the inputs might be whack so they vote and the winning consensus is what is provided to the controller. Lots of aircraft systems work this way. Multiple redundant systems voting on what to do. So I think it would work really well if all you had was wittless thralls.

Sandbags, the vast majority don't know shit. I got dudes with harleys that don't even know there is a frigging shutoff for the gas. We learned that shit as kids. I can't tell you how many tried to change their own spark plugs and fucked that up. There are 2, and they are right out in the open, and yet if I pull them out they are gapped wrong, or different from each other. I pulled a set last week, not only were they a chevy plug which isn't even the same style, but one was gapped at 32, the other at 26, and they were supposed to be 40. That generation is screwed.

Prediction - although the "Night of Rage" will start near the courthouse, they will quickly march away from the courthouse and start trashing things elsewhere, since the authority of the Federal cops is limited to the area near Federal buildings.

There are a few other Federal buildings in downtown Portland other than the courthouse, and there is leased Federal office space (for example, the headquarters of the Portland District of the US Army Corps of Engineers is downtown in leased space), so it would be hilarious if the Federal cops assumed jurisdiction over all of downtown Portland.

Given how much graffiti there is downtown saying that the mayor should be killed, Portland city government is likely to acquience.

273 Thanks for the help, guys. I sequestered the cats (which I can tell they just loved), then opened the back door and the fireplace door. Birb wasn't leaving, so I picked it up and took it outside. Misted it down with the hose a bit, it was coated with soot and its eyes weren't open while it was in the fireplace. After it was suitably watered, I put it over in a shady corner of the garden. It was definitely favoring a wing and a leg, so it might've been injured, but I'm not a birdologist or a birdonomer, so it's kind of on its own at this point.

One issue is when you try to change the first one, you discover that the manufacturer-supplied tire wrench will not supply enough torque. You then call AAA and wait two hours. Then you either 1) buy a cross-bar tire wrench; or 2) say to yourself that two wasted hours isn't that bad.

In fairness, that is also when "no user-serviceable parts inside" started becoming common. If your toaster fails now, the odds are good that it's a circuit board or an IC that can't be obtained anymore and if you don't know how to do surface-mount soldering/desoldering, you can't fix it anyway. Their dad knew the older one needed a car, but also that they would tear it up, so he made a deal that he would buy them any car they wanted as long is it didn't cost more then $500, and it had to last a few months. They went through a lot of cars. I remember when was a weird old Plymouth with a push-button transmission on the steering wheel; but only 1 and 3 worked. No 2, no R, so when you parked, you HAD to be sure you could pull forward, or else everyone had to get out and push.

312 In schools and colleges in this country, the goal is no longer to turn out knowledgeable citizens capable of self governance but instead to inculcate a hodgepodge series of political slogans rattling around an empty head. In our elite schools, former core bodies of knowledge have been replace by picked courses to supplement ignorance and misunderstanding. This has trickled down to the other schools as learning centered education.

Instead courses emphasize, "Change", "End of History", "Progress", "Equality", "Systemic", "Bias", and so forth with whatever current political slogan added to the stew.

Very few students know anything about logic, economics, government institutions and law, etc. other than "good things", "bad things".

To some extent, the year zero has been achieved with young people where they know nothing of the past and thus do not know that many of the political ideas they hold dear have led to disaster in past human societies because they do not match how humans actually behave in social relations. Instead, courses aim at feelings over knowledge with a Romantic notion that feelings and desires trump facts and history. If one quoted Kipling's various poems, one would hear shrieks of outrage and hurt feelings because of the cognitive dissonance to what they have been taught. Their heads would explode with considering his Gods of The Copybook Headings poem and they would go the easy route of disqualify rather than deal with his unsettling ideas. They would not like "If" or "Requiem" either.

When rational discourse is no longer possible, we must recognize that the Enlightenment is over and now we are in the Enclownment era.

Now, the Feds have seized all the phones of the people they've arrested as evidence (something that the Portland cops never did), and are doubtless using those phones to track the rioters social networks.

So, now you have frantic appeals on Portland Antifa Twitter telling everyone to only use burner phones at the riot, to store your burner phone away from your regular phone, to lock down your social media accounts, etc.

360 I had a history prof that made an argument that you rarely hear but made some sense to me. So many call the 50s generation the "last conservative generation" and it all went downhill from there. But her argument was that the 50s generation was the radical generation. The generations of the 20s, and 30s were radical and many were good time charlies. The 50s was a radical change for the nuclear family and traditional values. Then we had the 60s.
again, generations can be interesting to study but of course the question is who or what defines a group like that? People talk of the 60s generation as if it was a monolith, but nothing could be further from the truth. If any modern generation was at each others throats, it was that one.

But it is still worth talking about, there are still interesting things you can glean from the discussion.

Part of it is something you have, or don't. One of my grandfathers was a germanic mechanic (i like the way that sounds) but he never talked much to anyone, including his son, my Dad, who was quite artistic and a great speaker, but who really never had a clue about anything mechanical. I, on the other hand, was a throwback, and by the time I was 15 I was already following behind my Dad, fixing anything that he had tried to fix but had given up on.

have you seen The Ice Storm? scarily accurate

my parents split up when ol Dad hit his midlife crisis, as did many many of my friends' parents

one of my friends caught her dad having an affair and he was so horrified at being caught by his daughter he had a cardiac event. he passed away.

we were a mess because our parents (Silents?) were self obsessed and determined to destroy their "too boring" adult lives with terrible decisions. leaving us at home when we were small to be latch key, then literally leaving us for much younger second wives later on.

I had to work thru college to pay for my mom's lawyer so she could get SOME alimony

hence the problem with even discussing generations. I think the media has decided what generations stand for. But something is off today. It is that a certain percentage from various generations have done something for us to reach this point.

Hell they had commies, anti-Americans, what have you many decades ago. But they did not affect the society in the same way. They were simply not as effective in changing the nation. At some point you have to look at the results and go from there.

If they continue to pay teachers to not go to work and colleges continue to charge full tuition and get it even though no one is on campus, this will go on forever.

Yeah. I thought about this a while last night, as I often do when I can't sleep. Am I wrong about this? Is Trump really the monster that so many say? At times it feels like EVERYTHING AND EVERYONE is against him, and any sane person at that point starts to wonder and consider their position.

I thought about John Bolton, who this blog used to love and revere. The Stache. He turned on Trump, but he was so good in the past, maybe he knows something?

But then I realized that he's been caught reversing himself on several issues, blatantly making crap up, and acting like a jackass generally. And I thought about what Trump has actually done while in office. Not all of it I necessarily agree with, but at no point and in no way has he ever displayed the characteristics of a bloodthirsty crazed evil tyrant.

Everyone needs to have that ability to question their position, reconsider, reexamine, decide if its valid. If you cannot, or will not do so... there's something really wrong with both you and your positions.

I mentioned to one of the GOPe cruise brigade of NeverTrumpers that one of the key virtues of a true intellect is to ask yourself "what if I'm wrong?"

I'll give you my stab at what's going on - elements in Society have been doing everything they can to eliminate Religious Faith and Practice for 50 or 60 years now. Even many supposedly Christian churches have been become toothless, faithless imitations of what they were supposed to be.

Presumably those who orchestrated this thought that Society would be So Much Better if religious faith was expunged (just like Stalin and Mao thought) but now, they've got an entire generation that has nothing to believe in, no actual moral framework, but still has all the need for Religious beliefs and practices that every generation has had.

and they are filling that need with nonsensical fanaticism and pure emotion, rejecting all logic, all notions of tolerance and civilized behavior, and bringing back all of the most terrible practices of the past that we thought we had put behind us forever. Witch Burnings, pogroms, auto-da-fe's, they're all back on the table, and the savages are dancing around the bonfires shrieking and howling for more victims.

I wouldn't bet on that. The rot is creeping in everywhere, just as it is in other places, like Texas. Don't forget that Beto came close to beating Ted Cruz last time, when it should have been a blowout for Cruz.

But here in VA, we have cities sprinkled all over that vote blue, and we have a lot of colleges with kids who persuade other kids to change their voter registration to that part of Virginia while they are there, resulting in blue victories in what would normally be a red town. I'm sure that goes on elsewhere too.

459 Yeah very few young people are political at any level, they just take cues from their surroundings. And culturally, they've been taught to disbelieve and suspect anything someone older than them thinks, rather than consider experience, age, and wisdom as something they should respect and use as a tool to shape their ideals.

I wouldn't bet on that. The rot is creeping in everywhere, just as
it is in other places, like Texas. Don't forget that Beto came close to
beating Ted Cruz last time, when it should have been a blowout for
Cruz.

But here in VA, we have cities sprinkled all over that vote blue,
and we have a lot of colleges with kids who persuade other kids to
change their voter registration to that part of Virginia while they are
there, resulting in blue victories in what would normally be a red town.
I'm sure that goes on elsewhere too.

Posted by: bluebell at July 07, 2020 12:18 PM (/669Q)

yeah, the original idea that made sense even a few years ago was to give Nova (Arlington and Alexandria City) to DC and throw in Prince George's County and Montgomery County. It would have made one deep blue state and two red states. Today you really can't tell with Virginia.

At this point I say let Virginia counties join West Virginia. If nothing else, fewer would live in a place that doesn't respect their values. And there is a precedent for this.

My grandparents were born in the 1910s. They lived through the advent of airplanes, WWI, WW2, computers, space travel, television, movies, and the internet. They were at the beginning of cars.

That made me amazed. ALL THE THINGS THEY KNEW. I saw older people with this deep level of reverence and respect.

As I get older, that is less true, because the older people are less... respectable. You see some white-haired granny now and she probably has tattoos and nipple bars, and had an abortion after an LSD-fueled orgy at Woodstock.

I imagine that when the general public was first allowed to vote for President they actually voted for individual Electors who pledged to vote vote for a particular individual Presidential candidate or type of candidate. A state would then often if not always split their Electors pledged party preference by this mechanism. Then the first round of popular vote 'winner takes all' buy voting en masse state wide for all the Electors in a lump sum. At some point the States decided the names of individual Electors is irrelevant so you vote for the Presidential Candidate now.

Anything better than sandpaper and a metal file I should be using?

Advice much appreciated.

Sounds like the sort of thing they'd do. My Mazda uses regenerative braking to charge a capacitor to run the hotel loads (AC/radio/lights) at a stop for a couple minutes. Doesn't shut off the engine, just decouples the alternator from those loads. And it's a 2016. Mazda does a lot of little slick engineering tricks and puts them under a silly marketing name like "i-ELOOP", and then nobody ever hears about it.

567 "by placing 1 cylinder at TDC with a fuel charge and hitting the spark when the engine needed to re-start."

It would have to be after TDC, probably by a significant amount. The compression would all leak out after a second or two, and the only combustion air would be the volume above the piston, at ambient pressure. Then you hit it with the direct injection and spark, and bang-zoom.

The "climate" nonsense relies entirely on implausible and completely baseless hypotheses about unknowns - this "crisis" is seeing something that's worse, in a way.

DICK. The first thing we do, let's kill all the lawyers."
