George W. Bush's Legacy, the Liberal Chief Justice John Roberts, Again Sides With His Liberal Allies, This Time Invalidating Louisiana's Abortion-Restriction Law

We need to stop saying "he again joined with the liberals."

He is a liberal, period. He very rarely -- increasingly rarely -- defects from the liberals to join the conservatives.

Heckuva job, Bushie!

BREAKING NEWS: Supreme Court strikes down abortion restrictions in Louisiana with Chief Justice John Roberts joining liberals in another blow to Donald Trump

Chief Justice John Roberts joins with liberals to strike down restrictive Louisiana abortion laws in a 5-4 ruling

Louisiana had tried to make doctors at abortion clinics have admitting privileges at nearby hospitals

But Roberts ruled the restrictions were so identical to a similar law in Texas

...

Ruling with the court's liberal wing is the latest by Roberts who was part of 6-3 majority on gay civil rights and 5-4 ruling against Trump abolishing DACA

And that's that.

Go long on brass because unless RGB or Souter shuffle off in the near future and Trump can replace them in short order, I don't see us ever having and working conservative majority on the SCOTUS, ever.

We all have a hard time admitting the obvious - I know I've had a hard time doing it, but I'm there.

Our Constitutional system has broken down, and it is not going to be repaired. Congress is dead, it's just a Kabuke theater that does nothing except try to convince the peons (that's us) we still have a voice. We Don't.

The SCOTUS, all appointed for life, never to face any election, has now taken over all serious Legislative functions. They make all new law, they decide whether any old laws stay in effect or not. Congress likes it that way, because it lets them focus on the only thing they want to do, which is stuffing their pockets full of cash.

And everything that isn't big enough to go to the SCOTUS gets handled by the Bureaucracy. This system will now last until it either collapses of its own weight or is overthrown. Those are the only two endgames left.

Yup. This is the "cost/benefit" problem in crime. If you're committing severe crimes - like child molestation - crimes you commit in pursuit in that crime are less important to the bottom line. For crimes with the death penalty, any other crimes you commit in pursuit of the crime have zero cost. They can only kill you once. They can only imprison you for life once. If you're playing in that space, subordinate crimes are free.

186 OT,

Seattle Mayor Jenny Durkan's house gets picketed:

from King 5

Seattle City Councilmember Kshama Sawant joined a large group of protesters outside the CHOP zone who marched to Durkan's house on Sunday afternoon.

One of the demonstrators said, "We came down to Jenny Durkan's mansion to bring the demands of the movement and of the families who have been impacted by police violence to her doorstep as she seems to not be able to hear our demands any other way."

The mayor's office shared the following statement Sunday night:

"Seattle has a long tradition of peaceful protest and advocacy for progressive change, and Mayor Durkan strongly supports those rights. Mayor Durkan will continue to listen to leaders in Seattle's Black community. She is working hard to translate the calls for change into real, tangible systemic changes to policing and all the other systems needed for strong and healthy communities. She has prioritized these as Mayor, with investments in housing, education, youth opportunity, and economic equity. She proposes investing an additional $100 million into the Black community.

Mayor Durkan and her family are in the state program to keep their address confidential because of the death threats mostly related to her work as Seattle's U.S. Attorney under President Obama. Instead of working to make true change, Councilmember Sawant continues to choose political stunts. Tonight she did so without regard for the safety of the Mayor and her family. The Mayor was not even home - she was working at City Hall. Seattle can and should peacefully demonstrate but should not put families and children at risk."

The Founders never predicted that the Congress would become totally corrupt, focused only stuffing their own pockets with cash, and that the voters wouldn't care and would keep sending the same class of grifters back, election after election.

Congress is the body that has the power to change everything about how the Courts work. Congress is also the body that loves things just they way they are right now, because it takes all the pressure off of them to make hard choices.

The anti-federalists did, in general.

It all comes down to this - rules don't constrain power. Power dictates the rules. There was never any chance of binding anything under the chains of the Constitution. That's just not how things work.

It sucks. It means you can't have powerful organizations to do good - because that power will always turn to doing bad eventually.

But there it is.

272 It's a fundamental corruption of the concept of a Republic to be ruled by judges, but as long as we are, we're constantly going to be challenged, not just by who gets to appoint said judges, but by the rather natural tendency of people in power to want to consolidate their power.

Which means sliding left.

And it doesn't help when you have a judge who is apparently compromised by whatever sexual kinks he has, with knowledge of said kinks in the hands of people who would control how he votes.

I'm not sure if Roberts is gay or furry or into kids, but it might just be that he touched himself when he looked at a naughty movie once when he was alone in a hotel room, and he just doesn't want the wifey to find out.

Yes. They gave up before it even got going. The first debate was in my neighborhood. About 3 weeks before the debate, the Obama campaign plastered the neighborhood with signs. Went door to door distributing yard signs, put signs along the highway, signs on closed shops (because 4 years of Obama economy). Plastered.

I contacted the Romney campaign twice, told them they need to get out and do the same, or people arriving to the debate will get the impression there was no enthusiasm for Romney. No. Scratch that. There was no enthusiasm *from* Romney. They never posted any signs. They never bothered.

I also ordered magnetic bumper stickers and some pins from the campaign. They arrived the DAY AFTER the election. How can you take over a month to fulfill a simple order like that???

Stare decisis has its place, but if a justice of the Supreme Court believes that a prior case was wrongly decided on the law, as Roberts' dissenting opinion in 2016 indicates he did, then he has an obligation to correct that mistake when the opportunity presents itself in a subsequent case. To do otherwise would be unprincipled, and suggests that the justice is more interested in the politics of the ruling than in the law.

I've never understood the reverence for "law".

Its gonna' be law in my lifetime, at the rate we're heading, where I have to write a check to a minority in the form of reparations. And that law will be duly passed, duly upheld, and duly enforced.

And it won't make me feel a damn bit better about it just because it's "law". History is full of shitty law.

Law, a lot of times, is simply when the government shows you the courtesy of writing down how they're going to screw you.

Yup. The way the CFPB's leadership and funding are structured, it's flatly illegal. The department should have been eliminated in its entirety. This would have two great benefits:
1) The CFPB - also known as "Dem Party Shakedown Organization" would vanish
2) Elizabeth Warren would cry on national television

344 Three bad decisions. What's the point of being able to appoint justices
when they run over and join their buddies on the Marxist side?
As I've said before, we have what I call "blue team" justices that rule on the side of the progressive machine. Every time. Without fail.
We need red team judges who do the same thing. Without fail.

Being a "constitutionalist" isn't enough. The Constitution is whatever those nine nimrods say it is now, meaning it's utterly worthless. They're a super legislature.

And our side sucks at the lawfare that allows Proggies to run up the score and thwart the will of the people.

Let's face it, America as we knew it is done. Like they did with Boy Scouts and every other institution in this country, the progressives are now doing this with the whole country:1. Identify a respected institution.
2. kill it.
3. gut it.
4. wear its carcass as a skin suit, while demanding respect

Roberts was put into place to protect the Establishment's coffers and for no other reason. Abortion isn't a real issue with me, but many, many people who are in the Republican coalition are there in no small part to see abortion eliminated. The specific law and facts are just inconvenient obstacles in the way of getting the decision you want, and the

The high court on Monday declined to hear an appeal involving construction of 145 miles (233 kilometers) of steel-bollard walls along the border in Arizona, California, New Mexico and Texas.

The Center for Biological Diversity, the Animal Legal Defense Fund, Defenders of Wildlife, and the Southwest Environmental Center had challenged a federal law that allows the secretary of Homeland Security to waive any laws necessary to allow the quick construction of border fencing. The groups had argued that violates the Constitution's separation of powers. But a lower court dismissed the case.

The media calls it "growing into the position". It is the art of being elected/appointed as a conservative, and then as your term goes along, you "grow" which in their eyes means you become much more leftist.

For an example, Jesse Helms was always referred to as a "firebrand" or "obstructionist" because he maintain his conservative policies. John McCain "grew" into his Senate seat when he went from conservative to a suck boy for the Democrats.

2) Putting a mask on a face with a full beard looks too much like a 1970s ad for woman's underwear.

Maybe in terms on votes in individual cases one could claim this. But Scalia was important in a way that no other justice on the court has been since Brennan. Scalia was the anti-Brennan and more or less was the judicial figure articulating a basis for a conservative counter-revolution on the Court (counter to the Warren court's liberalism). Alito's nickname was "Scalito." Imperfect as he may have been, Scalia created an army of conservative lawyers and jurists.

Abortion has been legal since 1973. Do you notice a DECLINE in leftists?

Turns out that the right does the duty of having kids and then the left just perverts their minds.

To say that leftists will always raise leftists is absurd, and you're saying that the babies that would have grown up to disagree with their parents should be killed with all the others, and they're just collateral damage. They are acceptable losses.

The left may have given up on biological procreation, but they know WAY BETTER than we do how to propagate an idea. So that's what they do.

Because that was the 'rationale' behind both this, and the Texas decision.

It's probably most or all of those possibilities.

Is there any doubt Epstein was filming and blackmailing for the Deep State? That doesn't necessarily include Roberts, but it shows blackmail is employed.
Posted by: Trump poisoned my cat at June 29, 2020 12:57 PM (puu6v)

I doubt we'll ever get a true accounting of who/what Epstein was/is.

I think "intelligence asset" is a fairly good bet.

Asset for whom? One or more of our alphabet agencies? Israel? Someone else?

Doubt we'll ever know.

But yeah, the control exerted over politicians and bureaucrats is very likely coming from a well ordered operation that knows everyone's kinks.

Yeah, it's impossible to be clued in and NOT sound like a conspiracy theorist these days. People who DON'T believe in conspiracies (this, that or the other), those are the folks I assume are either willfully ignorant or just aren't paying attention.

Or, it's like a throwaway vote in the House or Senate, you know the bill will pass easily, so you vote against it knowing your vote won't make a difference.

Posted by: Romeo13 at June 29, 2020 01:03 PM (NgKpN)

Many reasons, but one significant one is that abortion is a simple procedure that is not challenging in the least. It is boring medicine. Another is that while many physicians support legal abortion, they want others to do it because it is both unseemly and disreputable to be an abortionist. It is the low end of the medical spectrum.

It's not "unseemly and disreputable". It's horrific. It's reprehensible to specialize in elective abortion. Only psychopathic personalities will do it.

There are distinct gradations in culture as to specialities.

Abortion docs are orthogonal to that system.

486 111 I don't see a solution to the judicial supremacy problem other than limiting the courts' jurisdiction through legislation. And I know that's never likely to happen.

Posted by: Meade Lux Lewis at June 29, 2020 12:12 PM (sWM8x)

*****

I don't think that would work either. I forget the exact case, but during the GWOT when Bush was president, there was some case regarding GITMO came before the court.

Congress had passed some law saying that the issue of the case was outside the jurisdiction of the court.

And the court just ruled "Nah, brah. We got this."

So...as I see it there are a couple of things that can be done to challenge judicial supremecy.

We all know about impeachment and what not.

And some have talked about how we need to openly defy the courts.

But there is another way.

The Louisiana legislature had their law overturned, right?

I say they should just go right ahead and pass the same, exact bill again. Word for word.

Put the court on notice that a pushback has begun...and that they had better think about treading more cautiously, before more *aggressive* measures are taken.
