It was written by Rao and joined by Henderson. Wilkins, the Obama appointee who repeatedly injected Black Lives Matter agitprop into his hypotheticals, dissented. You may have heard that there were arguments about how large a role the judge is to have in cases of a motion to dismiss. Such motions are granted "by leave of the court" -- with the judge's permissions -- and yet the decision to charge, not charge, or dismiss is given entirely to the Executive. Rao's decision clarifies why "leave" is required in these cases: to protect the defendant from a harassing prosecution. Prosecutors will sometimes repeatedly indict someone for charges they cannot actually prove. Then they go to court to dismiss the indictment. Then they come back months later an indict again. And so on, and so on. Double jeopardy does not prevent this because jeopardy does not attach until there's actually the start of a trial -- when a jury is empaneled, jeopardy attaches. So the leave of the court provision exists so that the judge can protect a defendant from this sort of prosecutorial harassment -- the judge can refuse to dismiss, if the defendant objects to the dismissal. In that case the judge would be saying, "Either finally put on a case against this man or I will dismiss the charges, with prejudice, forever." Somehow Sullivan and the various #Resistance lawyers on Twitter and MSNBC and CNN have interpreted this limited power to protect a defendant from prosecutorial abuse as a license to conduct his own illegal prosecution, violating the Constitution by assigning Article II prosecution power to himself, an Article III judge. Sullivan (or his taxpayer-paid lawyer) repeatedly claimed "abuse of prosecutorial discretion" gave him authority to conduct his own prosecutor -- again, overlooking the fact that the abuse of prosecutorial discretion that was contemplated in the "with leave of the court" permission had to do with a vindictive prosecutor harassing the defendant. Sullivan turned this defendant-protecting clause into a license to bring his own slate of charges against a defendant. The court disagrees with this and said so:The circumstances of this case demonstrate that mandamus isThe District Court ruled for Flynn on two of his motions: To dismiss the amicus hearing, and to order Sullivan to dismiss the charges. It ruled against him as far as getting his case reassigned to someone other than this God-complexed imbecile. But reassigning the case might have been a mercy to Sullivan -- now he's forced to dismiss the case himself. People are wondering if this idiot is going to show "defiance" (as Andy McCarthy called it, I think) to the District Court's order and still hold his own hearing (without amicus involvement). He is ordered to dismiss the case; but the court didn't specify "immediately." He could continue campaigning for his job as a CNN legal analyst by fulminating for several days about government abuse and who knows, maybe even nooses he saw on his tie rack. Sullivan can hold court and it's meaningless. He has no authority to do so. If the executive branch in the form of the DoJ refuses to prosecute, there is no case. Something about this case is holding the Trump team hostage. I do not knjow what it is or what they are holding back for but they waited until the prosecution dropped its case to announce and start vigorously moving on the Deep State. Then when the judge refused to drop the case and tried to find a way to keep it going, the Trump team became quiet again.

When a 3 judge panel makes a ruling, any active judge on the full court (currently there are 11 active judges on that circuit) can ask for a vote to rehear the case en banc (meaning all eleven of them) without any need for any appeal to be filed. It takes 6 votes out of the 11 for the case to be reheard that way, and any one of the 11 can ask for it without providing a specific reason. (one of the perks of being a Judge on that level) The odds of whether this will happen depend on whether the full DC Circuit is political enough to want to keep this going on, or whether they decide it's a shitshow time waster that they can be free of if they just ignore it from here on out. Ideology vs. Self Protection and Sloth, which will win out on the DC Circuit? We soon shall see. Also, looks like Judge Sullivan has 7 days before he has to comply. I'm not an attorney but it would seem to me this is done, there is no valid appeal to make. Who is the aggrieved party? The Justice Department favors dismissal and so does Flynn? The Judge has been ordered to dismiss and his Amicus buddy and his involvement dismissed with the order. There are currently 11 active Judges on that Appeals Court. In order to handle more cases, they choose at random 3 out of the 11 to hear any particular appeal, that's why there were 3 judges hearing this case; Rao, Henderson, and Wilkins. The Circuit Court has the authority to sit "En Banc" and have all 11 of them hear, or rehear, any case that comes to them whenever they want, although it is not done very often. So, the 3 Judge Panel hearing this case made it's ruling, by a 2-1 vote. That should be the end of it, *Unless* 6 of the 11 Judges on the circuit disagree with it enough that on their own, they choose to rehear and reverse it. No one needs to "appeal" for this to happen, it's a feature of Courts at this level, they are very powerful and mostly write their own rules. That's the remaining risk we're worried about. I have no idea what he thinks now because as of 8 weeks ago, he and his wife let his friends know that they were locking themselves inside their house and not seeing anyone or leaving to go *anywhere* until this virus thing was done completely, NO new cases at all, anywhere. They get their money from a direct deposit retirement check each month, and they get groceries dropped off on their doorstep by gloved deliverymen who they never see, never talk to.
