DC Circuit Court of Appeals Rules in Favor of Flynn, Directing Rogue #Resistance Judge Sullivan to Grant the Government's Motion to Dismss the Charges
Decision here. It was written by Rao and joined by Henderson. Wilkins, the Obama appointee who repeatedly injected Black Lives Matter agitprop into his hypotheticals, dissented.
You may have heard that there were arguments about how large a role the judge is to have in cases of a motion to dismiss. Such motions are granted "by leave of the court" -- with the judge's permissions -- and yet the decision to charge, not charge, or dismiss is given entirely to the Executive. Rao's decision clarifies why "leave" is required in these cases: to protect the defendant from a harassing prosecution. Prosecutors will sometimes repeatedly indict someone for charges they cannot actually prove. Then they go to court to dismiss the indictment. Then they come back months later an indict again. And so on, and so on. Double jeopardy does not prevent this because jeopardy does not attach until there's actually the start of a trial -- when a jury is empaneled, jeopardy attaches. So the leave of the court provision exists so that the judge can protect a defendant from this sort of prosecutorial harassment -- the judge can refuse to dismiss, if the defendant objects to the dismissal. In that case the judge would be saying, "Either finally put on a case against this man or I will dismiss the charges, with prejudice, forever." Somehow Sullivan and the various #Resistance lawyers on Twitter and MSNBC and CNN have interpreted this limited power to protect a defendant from prosecutorial abuse as a license to conduct his own illegal prosecution, violating the Constitution by assigning Article II prosecution power to himself, an Article III judge. Sullivan (or his taxpayer-paid lawyer) repeatedly claimed "abuse of prosecutorial discretion" gave him authority to conduct his own prosecutor -- again, overlooking the fact that the abuse of prosecutorial discretion that was contemplated in the "with leave of the court" permission had to do with a vindictive prosecutor harassing the defendant. Sullivan turned this defendant-protecting clause into a license to bring his own slate of charges against a defendant. The court disagrees with this and said so:The circumstances of this case demonstrate that mandamus isThe District Court ruled for Flynn on two of his motions: To dismiss the amicus hearing, and to order Sullivan to dismiss the charges. It ruled against him as far as getting his case reassigned to someone other than this God-complexed imbecile. But reassigning the case might have been a mercy to Sullivan -- now he's forced to dismiss the case himself. People are wondering if this idiot is going to show "defiance" (as Andy McCarthy called it, I think) to the District Court's order and still hold his own hearing (without amicus involvement). He is ordered to dismiss the case; but the court didn't specify "immediately." He could continue campaigning for his job as a CNN legal analyst by fulminating for several days about government abuse and who knows, maybe even nooses he saw on his tie rack. I'll post more as I read more of the decision.
appropriate to prevent the judicial usurpation of executive
power. The first troubling indication of the district court's
mistaken understanding of its role in ruling on an unopposed
Rule 48(a) motion was the appointment of John Gleeson to
"[resent arguments in opposition to the government's Motion." Whatever the extent of the district court's "narrow" role under Rule 48(a),
see Fokker Servs., 818 F.3d at 742, that role does not include
designating an advocate to defend Flynn's continued
prosecution. The district court's order put two "coequal
branches of the Government … on a collision course." Cheney,
542 U.S. at 389. The district court chose an amicus who had
publicly advocated for a full adversarial process. Based on the
record before us, the contemplated hearing could require the
government to defend its charging decision on two fronts--
answering the district court's inquiries as well as combatting
Gleeson's arguments. Moreover, the district court's invitation
to members of the general public to appear as amici suggests
anything but a circumscribed review. See May 12, 2020,
Minute Order, No. 1:17-cr-232. This sort of broadside inquiry
would rewrite Rule 48(a)'s narrow "leave of court" provision. And we need not guess if this irregular and searching
scrutiny will continue; it already has. On May 15, Gleeson
moved for permission to file a brief addressing, among other
things, "any additional factual development [he] may need
before finalizing [his] argument" and suggesting a briefing and
argument schedule. Mot. to File Amicus Br., No. 1:17-cr-232,
ECF No. 209, at 1–2 (May 15, 2020). The district court granted
the motion and then set a lengthy briefing schedule and a July
16, 2020, hearing. See May 19, 2020, Minute Order, No. 1:17-
cr-232. In his brief opposing the government’s motion, Gleeson
asserted the government's reasons for dismissal were "pretext"
and accused the government of "gross prosecutorial abuse."
Amicus Br., No. 1:17-cr-232, ECF No. 225, at 38–59 (June 10,
10 2020). He relied on news stories, tweets, and other facts outside
the record to contrast the government's grounds for dismissal
here with its rationales for prosecution in other cases. See id. at
43, 46–47, 57–59.

Sullivan can hold court and it's meaningless. He has no authority to do so. If the executive branch in the form of the DoJ refuses to prosecute, there is no case.
Sullivan cannot be judge, jury and executioner. Maybe he has a shot in CHAZ/CHOP but not in the real world.
Then again, we are about to become CHAZ/CHOP any day now...

I'm inclined to think that he's not entitled to any kind of rehearing, because he was not a party in the first place. The DOJ is the only party that could ask for an en banc. And we know they won't. That isn't to say there aren't Hawaii Judges out there who might try to spin up a reason. But I don't think it can happen.

When a 3 judge panel makes a ruling, any active judge on the full court (currently there are 11 active judges on that circuit) can ask for a vote to rehear the case en banc (meaning all eleven of them) without any need for any appeal to be filed. It takes 6 votes out of the 11 for the case to be reheard that way, and any one of the 11 can ask for it without providing a specific reason. (one of the perks of being a Judge on that level) The odds of whether this will happen depend on whether the full DC Circuit is political enough to want to keep this going on, or whether they decide it's a shitshow time waster that they can be free of if they just ignore it from here on out.
Ideology vs. Self Protection and Sloth, which will win out on the DC Circuit? We soon shall see.
Also, looks like Judge Sullivan has 7 days before he has to comply.

Right now, we can't be sure that won't happen. It's still up in the air. The question is, do they want to take such a huge risk on facts that are so weak? I suspect some of them are pissed that Sullivan pushed them all so far out on the ledge here, by trying to take over Prosecutorial control directly. Flynn just needs 2 of the 7 dems to feel that way.

Yep, the real scandal here is what Obama (and Biden) did.
As the outgoing president who disliked the incoming president and held a personal grudge against the incoming president's NSA, Obama issued the order to sic the FBI on Flynn.
What was Flynn's supposed crime? He made a phone call to the Russian ambassador. As incoming NSA, that was his damn job. And there was nothing in that phone call that was inappropriate, let alone criminal. Yet Obama's minions in the FBI ginned up a phony criminal prosecution against Flynn anyway, and kept it going for years, bankrupting Flynn in the process.
We now know about the massive and ongoing fraud, perjury, and other crimes that the Obama-controlled FBI and DOJ committed during the Flynn prosecution.
But the real story here, and the one the MSM will never tell, is the corruption of Obama and Biden. They couldn't stand Trump, and didn't want him to be president, so they weaponized the federal bureaucracy against him, used it to illegally spy on his campaign, and then used it to destroy the life of Trump's NSA Michael Flynn through a thoroughly corrupt federal criminal prosecution for a phone call that they knew all along was not a crime.
It may not technically be treason, but it was certainly an abuse of power on a scale like we have never seen before, and it was and is a serious threat to our republic and the smooth transition of power.

Parler might take off better if people could browse around and get a feel for it before signing up. They should make it to where non-members can read posts too. While I also think the poll trolls are idiots, I also think it's not wise to see the problem areas we've got. I personally know far too many over-70 retirees who are terrified of Covid, after all of this, and who think Trump doesn't take it seriously and is trying to kill them by wanting the economy to open back up. Of course they make their money from a check in the mail each month, so they don't give a shit about jobs. That's a huge group that gave Trump a lot of support that is going soft right now.
I don't think they're lost for certain, but Trump has got to start working to get them back, and he's got to do a lot more than he's been doing.

Sullivan's actions in this case (and that other moron's actions in the Roger Stone case) have been so shocking and against all ordinary legal procedure and precedent, that I say this with the warning that: who the hell knows what is even going on anymore, BUT:
This is a writ of mandamus, which is a mandamus is an order from a court to an inferior government official ordering the government official to properly fulfill their official duties or correct an abuse of discretion.
This one is complicated because the government official in this case is a federal district court judge and it is being issued by the circuit court. Usually it is a district court judge who is issuing the writ of mandamus (say to an agency head), which the elected official could then appeal to the circuit court.
Additionally, the district court is usually bound by a decision or order from the circuit court and doesn't have a right to "appeal" it. That's why some people are bring up Sullivan asking for an en banc rehearing (all 11 judges on circuit court would hear it -- right now DC circuit has 4 Obama appointees, 3 Clinton appointees, 2 Trump appointees and 2 GWB appointees). But, there is no obligation for the circuit court to grant a rehearing, just because someone asks for one (so it's not an "appeal of right").
So again, I go with: who the hell knows what is going on here.

What could happen next gets into the weeds of some peculiar procedures that are only available at this level of the Appellate process. There are currently 11 active Judges on that Appeals Court. In order to handle more cases, they choose at random 3 out of the 11 to hear any particular appeal, that's why there were 3 judges hearing this case; Rao, Henderson, and Wilkins. The Circuit Court has the authority to sit "En Banc" and have all 11 of them hear, or rehear, any case that comes to them whenever they want, although it is not done very often.
So, the 3 Judge Panel hearing this case made it's ruling, by a 2-1 vote. That should be the end of it, *Unless* 6 of the 11 Judges on the circuit disagree with it enough that on their own, they choose to rehear and reverse it. No one needs to "appeal" for this to happen, it's a feature of Courts at this level, they are very powerful and mostly write their own rules. That's the remaining risk we're worried about.

I was posting the other day of one man I know personally who I had thought of as a conservative and an ally.
