A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn.

Before this crazy case where a federal judge tried to appoint his own "prosecutor" I would have corrected you that a judge cannot appeal -- he isn't a party to the case. This went to the Circuit court because *Flynn* filed a writ of mandamus.

However, who knows what the f**k is going on anymore.

The press angle is a bit new, but not really. A failed railroading is absolutely "unusual." The norm is that the organs of state "justice" grind their opponent down into bankrupt dogmeat and gets a crappy plea deal that ruins the target's life.

This is weird. And that is a problem. Not that Flynn got off finally and after the biggest legal battle of the past couple of decades, but that it took such an incredible effort. Railroading is normal. The entire system is corrupt, and it eats the innocent and the guilty alike (when it isn't actively conspiring to free the guilty, anyway). The system is entirely broken. Don't kid yourself. What Flynn went through *is* the norm. The only abnormality is that he's free.

- Divide every FBI function into "law enforcement" and "intelligence" groups
- Rank each function in each group from most important/vital to least.
- Transfer the top 10 LE functions to the Marshalls

Yeah, what a damn nerve she has, ordering that a blatantly bullshit case concocted by some lying FBI agents be dismissed.

The FBI agents themselves admitted, in their own damn writings, that Flynn did not lie to them. They also admitted, in their own damn writings, that the entire purpose of questioning Flynn was to try to trap him in a lie or get him fired by Trump. The corrupt Obama DOJ prosecutors had these exculpatory FBI writings but refused for years to turn them over to Flynn's lawyers, as required by law. The corrupt Obama DOJ lawyers repeatedly lied to the judge and said they had turned over all these Brady materials. The corrupt Obama DOJ prosecutors also threatened Flynn's lawyers (with some bullshit FARA charges), and threatened to prosecute Flynn's son (again, on some bullshit FARA charges). The corrupt Obama DOJ prosecutors used these threats to coerce a guilty plea from Flynn, but then they failed to inform the judge of the side agreement not to prosecute Flynn's son in exchange for the guilty plea. The prosecutors were legally obligated to tell the judge about the side agreement, but instead they swore to him, under oath, that there were no side agreements.

This case was nothing but corrupt, from start to finish. And when an independent Inspector General investigated and found all the evidence that the Obama FBI and DOJ had hidden and/or lied about, the Trump DOJ asked the judge to dismiss the bullshit charges against Flynn. But the judge, an Obama-boot-kissing friend of Eric Holder, refused.

But yeah, it's obviously the appellate judge Rao who is the problem here. Not the blatantly corrupt Obama FBI, not the blatantly corrupt Obama DOJ, not the blatantly corrupt Judge Sullivan, but Rao.

Any appeal would have to go En Banc first, but this is a weird case, and I don't know of any authority for a Judge to appeal a ruling of a higher court against him. Parties to the case can appeal, but not Judges.

It's kind of like if you're at work, and you get a bad performance review. Can you appeal to the CEO to get a better one?

I was curious about this too but upon reading more on it, he was only devistating after the DOJ discovered the malfescense through a whistleblower in the department. That layed out all the details and basically gave him no choice.

The Judge has no appeal rights in this case because he was not a defendant, he was the Judge.


He was party to no suit either criminal or civil. Those are the only people that have appeal rights.

Now they may try and make some fake $hit up and run it up the flag pole but if they do this will go directly to SCOTUS and I don't think they want that because this is settled case law and has been for decades.

It isn't over yet. The judge still has to sign the order to dismiss charges. Until that happens, it isn't over. If it isn't dismissed "with prejudice" then the state can bring the charges again in the future.

Until the ink is dry on dismissal, it ain't over. Now, that *should* be a formality at this point, but these ain't normal times.

This is a little too far in the procedural weeds - even for me - so I don't know. I just trust some of the "conservative" experts who have been on Flynn's side to say what is possible - not that it should be possible.

Your reasoning of course makes complete sense - it is how a 10 year old would understand separation of powers. And I say that in a good way, not a bad way. Only adults (liberal adults) can muddle the separation of powers in such a way as to give the executive law making responsibilities and the judiciary proprietorial responsibilities.


Should he be able to appeal - I think not. Can he - sounds like yes. Will it be accepted - I think there is a good chance for that.

What exactly is he going to appeal?

His bosses ordered him to comply with the decision made by the DOJ to drop the charges against Flynn and he refused to do. Flynn's lawyers went to his bosses and they ordered sullivan to comply.


He can't appeal an administrative decision made by his bosses because he has ZERO appeal rights as he was never charged with anything and was not a party in any way.


As I said above, not going to say it doesn't happen, but they will have to make up some pretty convulated $hit that won't go anywhere.

It's unusual because it is rare that the government's malfeasance is so shockingly overwhelming, that it was ordered from the President himself, and that it is revealed prior to sentencing.

Since this was such a high profile case and the Left was so sure of the result, Powell had time to get to the bottom of things. And it helped that Mueller and Horowitz's reports contained clues that Powell could follow to the truth.

I think precedence does allow for an appeal - that doesn't mean it should as precedence is often wrong.

Regardless, I am less certain of your prediction on DC circuit and SCOTUS. Why wouldn't the 4 liberals on the Court want to touch this. Even if they lose, they can say the Court politicized an outcome. This certainly isn't justice, but I feel more procedural delays are coming - even if I am more certain that the outcome will be positive.

The reason I think not is that higher court justices are huge sticklers for proper procedure, it's the one thing that they absolutely do know the minutia of more than anyone else. And this case has got it's procedural basis screwed up more than any I have ever seen at any level. That alone screams for it to be tossed out.

Yes it can be appealed because under court rules it is a final order or judgment. However, there is no right to have the appeal heard by the US Supreme Court unless that court decides to hear it.

So at the very least, this would be a slim hope for Sullivan.

405 Look - Sullivan did not have the power or ability to take on the role of prosecutor, and yet he did. He would not be appealing the verdict, he would be appealing the writ decision which he definitely IS a party to.

The 3 judge panel could have decided on the writ absent allowing a written response from Sullivan, and absent allowing a hearing in the courtroom to send the message that he had strayed outside the bounds of the judicial mandate

Instead, they said interesting argument, we will listen to it. Which legitimized the position by stating that it was at least arguable.

The decision could easily have gone 2-1 the other way. People who suggest that the rules matter here are not paying attention. Sullivan isn't following the rules, The DoJ and FBI weren't following the rules, and so far they have gotten away with it.

She is a graduate of the University of Michigan and Wayne State Law School Affirmative Action works!

In that course, there were explanations of phonetic pronunciations of English, but they were all based on British English.

We got into a bit of a fight with our instructor, who was an older Italian woman, about the proper pronunciation of the word "bottle".

Don't know who that was.

I myself was afraid it wouldn't be. Appeals courts don't normally like to meddle with cases in progress unless the situation is dire. So if we had one dissenter (which we did) and one "nah brah, appeal the verdict when you get one" Then you get nothing.

I feared that was a real possibility.

The panel isn't going to do it.

I'm not sure if Sullivan can appeal this (probably/likely) but even if he can't any Judge can request an en banc hearing on the matter.

So, we'll get a Stay issued by the Circuit and a re- hearing most likely via a request from a non-panel Judge for en banc.

The issue is where the error could be found in the Order granting the Writ. It's very solidly argued and Sullivan's case is absurd and asks for an extreme change in the current understanding of the Separation of Powers.

But I think the Judges will want to have their time in the sun on this. And as always orange man is vert very bad.

We have months left to go on this, I think.
