Appeals Court Orders Lawless Lunatic Emmet Sullivan To Explain His Erratic Actions in Flynn Case
[A] federal appeals court Thursday accepted Michael Flynn's request to have the district judge overseeing his case removed and has ordered that judge to explain why he has gone to such great lengths to avoid the Justice Department's request to dismiss the case. A special three-judge panel has been appointed to review the matter. A June 1 deadline has been set to respond to the request.The motion to dismiss Sullivan as having taken off his judicial robes to act as an active litigant in the case was said by Flynn's lawyers to be as like "an umpire who has decided to steal public attention from the players and focus it on himself. He wants to pitch, bat, run bases, and play shortstop." This recent piece from shipwreckedcrew at RedState says that the DC Circuit has recently made several rulings about the powers the deranged megalomaniac Sullivan is claiming, and those rulings all say he can't do what he's trying to do.
[T]he answer to the question before Judge Sullivan is quite simple, and it was provided by the Court of Appeals for the DC Circuit just four years ago in its decision in the case of United States v. Fokker Services. There will be efforts to "distinguish" Fokker -- to say it's not a sufficiently similar case to control the outcome here -- and efforts to point to other decisions in the DC Circuit or other Circuit Courts of Appeal which point in a different direction for an answer to the Rule 48(a) question. But that's all a distraction and a waste of time because Judge Sullivan cannot escape Fokker. A District Court judge in the District of Columbia is obligated to follow the rulings of the Circuit Court for DC -- he does not have a choice. He cannot "dissent" and reach a decision based on his own views. He might not like or agree with the outcome that is dictated by the Fokker case, but in order to respect the oath of his office, he is duty-bound -- bound by the Constitution -- to respect and apply the law as it is established by a court of a higher status than the Court he presides in.Update: Sydney Powell seems to think the appeals court is taking this very seriously indeed.

Sullivan's problem is that he's got to explain himself based on Law and Precedent, and Law and Precedent are against him on this one. Last thread it was noted that he explained that he got the power to do what he was doing from the "Inherent Power of the Court."

In crazy liberal land, the Sullivan amicus request is due to Sullivan's belief that the DOJ erred due to political malice by dropping the charges.
Jeffrey Toobin has a New Yorker article that spells this out, this is the same thing that Sullivan did when the DOJ handled Steven's case. Sullivan created a special counsel, if you will, that reviewed the DOJ's malfeasance.
Here, the DOJ is so infected by Barr=Trump=Orange=Bad malfeasance that the amicus briefs he's received don't even bother to explain how the facts of the case illustrate a public interest in keeping the Flynn case going.
I could go on but the upshot here is Sullivan/Gleeson/Protect Democracy/Toobin/every other nutball think this could be impeachment 2.0 where they get to fact-find why the DOJ was so infested by Barr's evil that they chose to drop the rock-solid case against the clearly evil liar, Flynn.

In fact, the idea that Sec 1001 wouldn't apply to flynn because there was no valid reason to interview Flynn they dismiss with the idea that as a law, the FBI has a clear mandate to be nationwide truth detectors.
plus, russia is a clearly hostile force, so any contact with Russia is a clearly malice-aforethought action. So, Flynn assumed the risk by talking the hostile foreign power.

The difference is between the DOJ pursuing a case and the DOJ dismissing a case. The standard is the presumption of innocence of the defendant. That is the judge's job to make sure the defendant is provided that standard , not the opposite. Sullivan is attempting to be the prosecutor. That's not his job.

An alternative writ of mandamus means the mandamus was granted pending the judge having a good fucking reason for acting like tool. Since that is absent in this case, he will likely receive a peremptory writ, telling him to stop fucking around in no uncertain terms.
Just having the petition for writ granted is a major win, and indicates the DC Cir is inclined to believe that Sullivan is out of line.

I think that is probably likely. They are going to review and make a real hash out of typical judicial behavior. Another loss for the Rule of Law.
Sullivan is really out of control, and should be reprimanded, but my guess is that he comes out of this smelling like a rose.

It would just be removal from the case - but that would be a huge slap, I can't remember the last time that happened to a Federal Judge. It's a clear vote of No Confidence from the Court above him; but no Federal Judge can be removed except by Impeachment. Or Sweet, Merciful Death.

The difference is between the DOJ pursuing a case and the DOJ dismissing a case. The standard is the presumption of innocence of the defendant. That is the judge's job to make sure the defendant is provided that standard , not the opposite. Sullivan is attempting to be the prosecutor. That's not his job.

But what is really going on in Sullivan's mind here is what I'm saying...the DOJ commmitted evil by dropping the Flynn case.
Gleeson will be Mueller 2.0 and get to the bottom of the evil malfeasance of the Trump admin in dropping the Flynn case.
The protect democracy amicus shows that crazy insane libs think the miasmatic haze of orangemanbad is so pervasive that any accusation of bad-doing-stuff against Barr's DOJ is by definition proven. It's in the 'public interest' to not drop the flynn prosecution.
sullivan agrees, he created Gleeson who will be a factfinding judge/prosecutor who will get to the bottom of all this in a few years time.

Most judges, when faced with an alternaitve writ, will withdraw the offending order. That's unlikely here, given what we have seen from Sullivan, but he cannot ignore the order. He is bound by DC Circuit commands.
Mandamus is a command from a superior tribunal to an inferior one. Sullivan's only choice is to have someone contest the issue (I've never seen a judge do it himself) or withdraw the order.
Failure to do so would constitute contempt of the DC Circuit and might devolve into jail time for Sullivan, depending on the federal contempt statute for appellate courts (which I am not familiar with)

Sullivan is accusing Flynn of perjury for reversing his position regarding his plea. But Sullivan did exactly the same thing by denying amicus briefs earlier in the proceedings and now allowing them. So, is Sullivan going to prosecute himself for perjury? Will he be the judge in his own case?

The idea that Flynn perjured himself in admitting guilt is, of course, fucking stupid.
Also, if you read the plea bargain statement of facts, what flynn admitted to doing is 2 sentences long. more or less, whatever.
The DOJ's point is that even if everything else about malfeasance on the part of VanGrack is swept aside, these factual statements don't count as a 1001 violation.
Of course, there's case law saying that no, the judge doesn't prosecute perjury and it's not within his contempt powers.
so that's that.
But it does show his state of mind. He's crazy. He's invited every crazy lliberal to come in and express their latest insane conpiracy theory that Flynn=Barr=Trump=Orange=Bad and therefore the DOJ misbehaved in dismissing Flynn's case.

Well, the penalty for ignoring a court order is a contempt citation, and that is what he would be facing if he attempted to ignore it.
There's no way to ignore it, though, since the presiding judge of the DC District Court would remove Sullivan (as is his or her right) if he attempted to litigate the case further.
The system gives judges a lot of power, WITHIN THE SYSTEM. Once judges start freeballing it, they are as moral as we . . . . .

Yes, if anybody ever had their civil rights violated it's Michael Flynn.
All this guy did was do his job, and say that he was going to do what the rest of us have been begging for somebody to do: return some sanity and accountability to the federal government.

As I understand it, the Judge Sullivan is doign this:
When the prosecutor and defense both want to drop a case, usually that ends it. But, as I understand it, at the federal level, the judge can choose to keep it going if they wish to (but almost never do). This option exists for obvious reasons: politics might drive a prosecutor to drop a case (Hillary) or corruption (mob cases).
The judge then can appoint another prosecutor to try the case, but he has to give good reason and have a reasonable justification for doing so. Hence, Sullivan found a friendly wokester judge to look over the case and declare that it should continue (the "amicus" guy).
With that justification he then can pick someone to carry on with the case even after the DOJ dropped it and explained why with very good cause.
But he's deliberately slow walking this, saying it will be September before the prosecutor is ready etc. Why? If Trump loses well its game on baby! Plus, this might delay some actions by the Trump administration and further carries the Flynn thing over into the late election season which might hurt Trump.
So its all grossly, clearly political, and Sullivan obviously has a blatant bias and even hatred toward Flynn which he shows each day.

The Government cannot produced the transcript of the Phone call in question. They say they don't have it.

As a practical matter, yes, but that's not entirely true. THere are two kinds of writs issued in response to a petition for mandamus. Alternative (gay, lol)and peremptory. Peremptory is simply a flat order to do what the writ commands, no chance for argument. Those are only issued in the most clear-cut of circumstances. Arguably, this is one of those, but since it is high profile and politically charged, they give the parties below a chance to argue the merits of the writ.
Alternative writs are typically worded, "either do X, or show cause why not within __ days." It's really a halfway victory for Flynn already.

Even more basic, perjury is a criminal offense. Although a judge can cite someone for contempt of court (not abiding by court rules, orders) he/she can't prosecute and sentence someone for a criminal matter, even if it happened in their courtroom. All the judge can do is refer the criminal case to the DOJ or other law enforcement.

They are. In this case, my gut feeling is that Sullivan has gone so far outside of the norms - trying to usurp the authority of both the Attorney General and the entire DOJ - that the Appeals Court is going to shut it down, just for so nakedly dragging the entire Judiciary into disrepute.
It's one thing for a Judge to try to assert authority over some small time local DA - but to try and assert his authority over the entire Federal Executive Branch? I don't think they can go for such a naked power play; it risks ALL of their power being scaled way back.

Therefore, the DOJ, to them has no leg to stand on, it's just Barr and Trump criminally overstepping their bounds, for purely personal gain, to do evil and Sullivan needs to come in and figure out why.
Gleeson will use his inherent prosecutor/judge powers to depose Barr and the President, and use his inherent contempt powers, that he receives from sullivan through a legal conduit to do so.

Yeah he wrote a story about a good man in awful places doing the right thing, the mystery was just a reason to write about him. The Big Sleep pretty well forgets about the mystery entirely for most of the book, and some of it is never resolved. But its still magnificent.

Now Marlowe is a sarcastic asshole who basically insults almost everyone, all the time. He's also written as being VERY handsome...so lots of women make passes at him.
So he has this thing where he'll flirt with girls, then shove them away (sometimes literally) if they respond. He'll kiss women, then treat them like shit. And God help any attractive, single woman who invites him over for some saucy puppet show action, he treats them like whores.
So it's this constant push/pull thing going on and it's sorta pissing me off. If he's not interested, fine. Plenty...well not plenty...but there are detective characters who don't have any sex in their stories.
I can see why folks can make $ writing ABOUT Marlowe and his hangups.

Actually the order was given "Per Curiam" which means the entire Appeals Court, acting together. Now 3 Judges from that Court have been named to consider the Writ and rule on it, after reading Sullivan's explanation of his actions.

A lot of prosecutors are very good. They move on into civil practice or move up the political chain.
Many prosecutors coast along, using the coercive power of the state to force plea deals and avoid going to trial. Because of case load, few are able to ever get more than a cursory level of involvement into a case unless it is a major one (murder, organized crime, large conspiracies or fraud).
Patterico played the odds on the mandamus filing and lost. Most of them are denied summarily. This kind of petition, after the USSC's recent 9th Cir reversal, the DC Cir cases, and the publicity involved, got much more attention.
He made a foolish statement, and is rightly paying for it in ridicule.

Rule 48a has a "public interest" exception, and it's clearly within the public interest to get flynn.

Flynn already plead guilty so there can never ever be a do-over.
All that new evidence about Brady rules and Giglio? That's just mumbo jumbo that has nothing to do with Barr=Trump=Orange=Bad and plus, hey, did you know that Flynn pled guilty?

What happens to a lot of guys who have decided to work on only the government side of cases - since its already set up for you to win, you don't have to think much, you can be lazy as fuck, and just rest on plea deals and helpful judges.
It leaves a lot of people like Frey and White making dumb predictions on high profile cases where the defendant is motivated and well defended. Something neither of these losers are used to, nor should they be in a court of law when it happens.

There has to be some sort of process, since it is legal for the federal judges to continue a case if the prosecutors decline to. Hence, it has to be legal and possible (and likely, has been done in the past).

The only thing Sullivan will face is being told he's wrong. Judge SUllivan can't "replace the prosecution" CRT, he can only disqualify he particular prosecutors. He cannot appoint one he likes better. DOJ can send whoever they want back to confirm the motion to dismiss, up to and including Barr.
What Sullivan can't do is find a law firm to prosecute the case privately, or allow amicus to argue substantive points of law that the parties do not themselves present.

This is a criminal prosecution.
Criminal prosecutions are ALWAYS the State vs someone.
This Judge wants to pick his own prosecutor, who will NOT be representing the State.
He will be representing the COURT.
Separation of Powers says, Nope.
Please show me a case where the Judge replaced a Prosecutor when they didn't want to prosecute?
Now, he can just rule that he is not going to take the recent pleading, rule Flynn Guilty, and sentence him.
But it will be appealed and overturned in a heartbeat.
But the real 'tell' here is the Judge is threatening the find Flynn in Criminal Contempt of Court, for changing his plea, as more evidence has come to light.

I am far from an expert here but from what I read, he can appoint a new prosecutor, the DOJ is not the only game in town. But again, that's just what I read.
And yeah Chandler was a roaring drunk. The story of how he was to work with when helping to write the screenplay for Double Indemnity is hilarious. Both he and Wilder were a huge pain in the ass that clashed immediately but put out a masterpiece in the end.

Flynn was probably the most senior intel community person Trump could get to join his team.
Flynn knew what's what and would've sniffed out FISA stuff and other Russia Hoax things quicker.
What scares me about Trump and Pence is that they let Flynn go.
I ascertain affair la-Flynn went like this:
FBI talks to him, he says something like "meh, you have the call with kyslyak, whatever."
FBI spends a month trying to groom the 302 into something perjurous. But in the meantime Comey goes to trump and says "hey, bro, bad news, dude lied, broke the law."
At this point, Flynn should've said "hey fuckers, this is an operation, something is going on" but instead, Pence/Trump were convinced Flynn lied to them, probably because of WaPo leaks.
So, instead of listening to Flynn, trump fires Flynn, talks to Comey, Comey pretends this could be obstruction, and so on.
3 years later, still no original 302's, van grack refused to hand it over, we have strozk texts. blah blah blha.

Not sure what you are reading, but only the DOJ can bring Federal Criminal Charges.
He can kick an individual prosecutor off the case, but he would then be replaced by someone from the DOJ, ie, the ones brining the criminal charge.
Civil cases are different.
But when the Case is US Government vs. Flynn, then the US Government must be the prosecutor.
Now, I could potentially see a case where a County Prosecutor did a crap job, so the Judge would ask the State to get involved, but both would have been prosecuting under State Law.

Well, to be fair, that is how they often win. escalation. They escalate until we give up or give in. Trump's power is he forces then to keep escalating until they seem unhinged. It's one of the reason's they hate him so.
Imagine a poker player (progressives) that does nothing but bluff, all the time. In fact they always bluff. In fact they have done it so much they don't even know how to play cards any more. And imagine an opposing player (conservatives) that always folds when the stakes are raised. They keep losing, and cursing their luck that progressives always seem to have the winning hand. That has been the last 30 years.
Now imagine an opposing player (Trump) that either calls each raise, or raises them back. At the end of each hand the progressives keep having to show their cards, and over and over we see it was just a bluff. And progressives realize they have forgotten even how to play poker.
The other players (conservatives) are slowly realizing the progressives NEVER have shit in their hands. And the progressives are at a loss as to changing their method of play.

He's got Karen Henderson, a 75 yo white woman who was appointed to the federal bench by Ronald Reagan, then to the appeals court by Bush, Sr.
Neomi Rao, a 47-year old white woman appointed by Trump.
And Robert Wilkins, a 56-year old black man appointed by Obama.

2) Sullivan to appeal for an en banc review by the entire DC Circuit which is majority Democrat appointed, forcing
3) an appeal to the Supreme Court by Powell on behalf of Flynn.
If the Democratic leader of the DC circuit had given them a 2-to-1 Democrat panel, their denial of the Writ would've allowed Powell to go right to the Supreme Court without the en banc review.

Yes, the interest is often in those cases of continuous charging of the defendant on the same crime or very similar crimes, then dropping them and retrying them on another case very close - ie just torturing the defendant by redoing prosecutions over and over again hoping for a guilty plea - that's when the Supremes stepped in and said, no way - you can't drop the case, have to finish the prosecution right now and get your ass kicked.

Possible Outcome 1 on a Writ: Peremptory denial. In this instance the Court either decides it's premature to get involved (let the process play out and then consider on appeal if there is still an issue) or that the Petition for the Writ is so clearly without merit that there is no reason to consider. This outcome is common.
Possible Outcome 2 on a Writ: Grant the Writ in the first instance. In this instance, the Court concludes that the issue is so urgent and error so manifest, that the Court can't even wait to let the Trial Court file a response and grants. This sometimes happens if there is zero room for argument that the Trial Court is wrong AND it would be hard to un-ring the bell later on appeal (e.g., the Trial Court ordered a document produced that is protected by a privilege - you can't really unsee the document, so an emergency fix is needed). This outcome is rare.
Possible Outcome 3 on a Writ: Grant the alternative Writ. Usually a Petition for Writ asks the Court of Appeal to grant the Petition in the first instance OR issue and Order to Show Cause why it shouldn't be granted. The "Show Cause" just means submit a brief arguing against the outcome. This happened here. The issuing of the alternative Writ is a good sign for the Petitioner (Flynn) because it means in the initial workup of the Petition the Court (probably research attorneys consulting with the Judges assigned to a Writ panel) though there was a solid argument of error that needed early (pre-appeal) attention. This is not a slam dunk win, but it is a good position to be in (the Petitioner is often arguing from a position of strength). Sometimes it telegraphs a difference of opinion in the Judges on assigned to the matter and they want more briefing to see if it sways one side or the other. It's definitely better than a peremptory denial. Note that you can still lose once the Court considers all the arguments.
Appeals versus Writs: The press is bad about correctly characterizing legal terms of art. In appellate court parlance, appeals are (generally) available as a matter of right when a case is concluded (like a trial is concluded or a summary judgment motion is granted) or a complete part of a case is concluded that doesn't depend on or impact the rest of the case. Writs are viewed as cutting in line by the court of appeal. You need to explain why you can't wait until the trial court is done to take a normal appeal. Writs are typically by permission, not as a matter of right. When the Court of appeal orders briefing to show cause why it shouldn't grant the Writ, it has basically given permission to the petitioner to cut in line and have their issue heard early (before a normal appeal could be taken). Just to add an extra bit of detail, appeals are usually matters of right to an intermediate court of appeal, but state supreme courts and the U.S. Supreme Court usually only hear "appeals" on a permission basis (there are some narrow exceptions like death penalty cases, but the general rule usually applies).

The clue is that they did this just before Obama's term was up and he wouldn't have any reason for this meeting.

Sullivan is going to have to grant the government's motion to dismiss the Flynn case, no matter how much he'd prefer not to.

I'm trying to catch up. This article is good but it leaves out important details such as Flynn's New position in the Trump administration as DNI(I might have put the wrong dept). This is why it's confounding to us ordinary folk. When they skip what his new position was and that is NORMAL AND EXPECTED to speak to foreign dignitaries in that position it makes it look like Flynn was a rogue and that the Russian ''interference" was real, but that's not the case at all.
