County Judge Rules That Oregon Governor Kate Brown's Covid Restrictions are Unconstitutional

She had no legislative authority for these diktats.

More and more, the left is straight-up endorsing tyranny.

A county judge has declared Oregon Gov. Kate Brown's coronavirus restrictions "null and void" because she didn't have her emergency orders approved by the Legislature following 28 days.

Baker County Circuit Judge Matthew Shirtcliff made the ruling Monday in a lawsuit brought by churches who had sued saying the social-distancing directives were unconstitutional.

The suit had also argued that emergency powers only last for a month and after that Brown would have needed legislative approval. The judge agreed.


Brown said she would immediately appeal the ruling to the state Supreme Court to try to keep the emergency orders in effect.

The Wisconsin Supreme Court invalidated the liberal Democrat governor's illegal covid decrees last week.

On May 13, 2020, the Wisconsin Supreme Court issued its decision in Wisconsin Legislature v. Secretary-Designee Andrea Palm, et al. and declared the state's Safer at Home Order unlawful, invalid, and unenforceable, creating a rush by local jurisdictions to issue orders to prevent the spread of COVID-19, resulting in uncertainty for businesses as to how to operate.


The Wisconsin Legislature, led by a coalition of Republican lawmakers, argued that Governor Tony Evers, by designating Andrea Palm, the secretary-designee of the Wisconsin Department of Health Services (WDHS), could not continue to extend stay-at-home orders indefinitely without seeking approval from the state legislature through rulemaking procedures under Wisconsin Statute § 227.24.

Today, the liberal Democrat/fascist governor said he would stop trying to force further lockdowns, because hey, democracy and the consent of the governed can be a real pain in the ass, you know?

Wisconsin Gov. Tony Evers said Monday that he's given up trying to push through any more statewide restrictions to slow the spread of the coronavirus because he thinks rival Republicans emboldened by a state Supreme Court decision erasing his stay-at-home order would never allow any.

Minutes after his administration scrapped plans for a new emergency rule, Evers told reporters during a teleconference that ing rules would be a waste of time given the GOP opposition. His stance leaves local health officials on their own as they wrestle with whether and how to maintain social distancing mandates.

"The Republicans made it very clear they don't believe a statewide approach is the right way to go at this point in time," Evers said. "It doesn't make a lot of sense spending a lot of time doing something we know isn't going to be successful."

Oregon votes by mail so many ballots were already in. Once he won, he resigned. She was re-elected after that.

Both WA and OR used to have some Republican governors. Both states had shady elections (Gregoire in WA) and Democrats have held power since.

It's Dems, DB. They haven't bothered with actual charges AFAIK. But for some reason they felt obliged to notify SCOTUS that there is an "ongoing impeachment inquiry". It seems they're trying to pry some documents out of the Mueller team. Don't know if they have anything specific in mind or if it's just another fishing expedition.

Supreme Court of PA shot down a number of lawsuits already. For a while (probably still) PA was the only state to shut down real estate businesses. That was one of the suits...they shot them all down, however, saying what Wolf is doing is perfectly constitutional.

About timing and square footage paying out - it's a dance, you adjust cost per sq/ft by the hour, earlier, its less busy in NY so your staff is less and you bump the bar - later, in the middle, you need every table full, staff is up to full strength, and the menu needs to be priced well to cover the floor and ops cost, and lastly, late at night, only the bar and late staff is needed...but you will never get this dance orchestrated at 25% or 50% occupancy - it will be a shit show from beginning to end, costing that owner a ton every night he is open.

One thing I might suggest for the restaurant owner - keep open well past 1 AM if you are in NY, NJ or lower CT if they give you a 50% open rate - they know this though - they won't be surprised at the cliental they'll get then after 1 AM...

I made into Costco without a mask a couple weeks ago. I had a bandana tied around my neck. When they offered me a mask to wear instead, I said, "thanks I'm fine." I never did put my bandana over my face and no one said anything. I only saw one other unmasked person in the store. He had his mask hanging off his ear.

Next time I plan to say, "Sorry, I can't wear a mask." We shall see. If they don't let me in, I will go somewhere else. (I have heard that if you say you can't wear a mask for medical reasons they won't question it.)

I wouldn't go looking for them, and certainly would say a vaccine is a good idea but where you have them and how bad matters. Had a patch 20 something years ago (cause I'm only 29) and it sucked.

A lot,

From time to time the area (not a small patch) still gets sore, tender and a little painful but it isn't the worst thing I've ever experienced.

Still, I'd advise avoiding at reasonable cost (or just short of extreme, whatever that may be, fish tank cleaner maybe. )

A governor can declare martial law within the borders of the state. POTUS can do it on a national level.

There is a distinction between true martial law and just using the military to enforce law. Under the former, the civil courts are suspended, and trial is by military tribunal. That is true martial law.

And again, POTUS can short circuit any of that by federalizing the Guard (or any state force, I think), and ordering them to stand down.
