The Morning Rant: Minimalist Edition

Amazing that at long last, after we claw our way out of this self-imposed depression, that we will have to fight once again with the mandarins who live to tell us what to do and what not to do. Government regulation is at the core of so much that prevents American business from innovating and growing and succeeding, but in this case it is quite simply insane.

I have never understood the need for the ADA, as so much of its demands are simply anti-free-markets. Well, to be fair, I do understand that much of it is driven by the plaintiff's bar, who salivate at the often unachievable demands and byzantine requirements of its thousands of pages of dense regulation.

Stores That Reopen Face ADA Compliance Puzzles*

Around much of the country retail stores and small businesses are struggling with how to reopen, or carry on operations online, consistent with public health recommendations on social distancing and protection of customers and workers. And as they do they find their task complicated in many ways by the requirements of the Americans With Disabilities Act (ADA) and related state laws.
What's the over/under on the first lawsuit filed because some SJW vegan/fatty/furry/non-binary/soy-eater is offended by some terminally embarrassed coffee joint employee politely asking to take its temperature, or some wheelchair-bound "activist" being forced to wait outside in the rain while his pancakes are cooked?

If there is sufficient unmet demand that it is economically viable to satisfy the minuscule population of these people, then the free market will satisfy that demand. Anything else is anti-competitive and anti-freedom.

21 Mrs. Muse and I watched the Clarence Thomas documentary last night, which didn't come on until 10pm out here.

On the whole, it wasn't worth staying up for. Not because it was bad, it was actually quite good, but we are familiar with Justice Thomas' story, so we really didn't learn anything new. But they did show some of the 1991 confirmation hearings and I got mad all over again. At one point, Thomas remarked "the thing that's so hard about these hearings is that you have to sit there attentively and listen to these guys who have no idea what they're talking about." And then they immediately cut to a clip of Joe Biden babbling on about natural law and positivism like he's trying to convince Thomas and everyone else who's watching that he's some big intellectual heavyweight. But it's hilariously obvious that he's not, he's just throwing words around that he just learned that day. Joe hasn't changed in 30 years. He was a babbling idiot then and he's a babbling idiot now.

A local restaurant was hit by an ADA vigilante a few years ago. The sinks in his public bathrooms were an inch high or low (I forget which) and he nearly lost his business over it. No complaint, nothing. Just a lawsuit one day. Apparently the guy who filed the suit drives around and goes into restaurants with a tape measure to clandestinely look for ADA violations that he can then litigate.

44 Speaking of which, I suspect some of these stores restricting entrance and exit may be in trouble.

Local Safeway has handicapped parking at either door. But they have made one side entrance only and the other exit only. You can't park in handicapped parking without having to walk across to the other door at some point. It just negates having handicapped parking. (Yes I did survive, mainly because I wasn't wearing a mask.)

49 IN our neighborhood we alread hat the ramps at 45 degrees to the sidewalk corners. I don't know why they were all torn up but for one to make ramps that go 90 degrees to each other. These cost a lot more I would estimate ten times the 45 degree ones.
Then the best was an ADA state inspector comes out to make sure these super expensive ramps are in specification. Guess what one was out of spec to some fine detail that my engineer brain could not see so they had to rip that ramp up and redo it. I noticed no difference between new and old out of spec ramp.

Not just humble beginnings. But from there to campus radical to hard worker to conservative jurist. I was struck by what he gave as the reason for his transformation. I am going from memory from several months ago, but it was along the lines of, "I wanted to know more about why we have this government. Why this government and not a monarchy? Why not an oligarchy? Why not a dictatorship?"

That took him to the source materials and related research.

I can't believe her doctor didn't suggest she lose considerable weight before trying to conceive.

I was older than her when I was pregnant, and was fit and trim. She's at high risk of developing diabetes, etc.

It appears the Governor is realizing his Executive Orders are not laws and they violate people's Constitutional rights.





What is the norm in Illinois when elected officials get exposed for violating the law? Change the law.





In this case, change the rules and make criminals out of the very people that are the economic engine in this state.





Not only do these new suggested rules invoke criminal penalties, but
they also are to last 150 days and are being pushed through in an
Emergency provision for such rule changes, meaning the public has little
say about it. Let that sink in. Under these proposed rules it appears
the Governor intends to continue with his oppressive overreach and lock
this state down into the middle of October.








Fines and jail time for business owners as the state lets criminals go including murders. Today, I heard the sheriff of DuPage county said he will no longer enforce the lock down. Fatso will have to send state police to arrest people. That is if they can be pried away from their speed traps

The problem is there use to be two or three spaces that were handicapped--and they weren't always taken.

Now there's like ten spaces and they are ALL taken.

I've said for a while that she was never very good at politics.

It helped her greatly that she raised a lot of money for Democratic house members so they felt fealty towards her and that her opposition wasn't much of an opposition.

But she was never very good at building coalitions in any other way than through brute force, and it never worked on anyone who didn't rely on her for money.

The idea was to move their business office into one of the store fronts and a karate studio they also ran into the center area. That area was currently accessed by a loading dock that they intended to build stairs and a ramp. The city arrived and said that the ramp was too steep and they would have to install an elevator, not a chair lift, but a full size elevator so people in wheelchairs could access a karate studio. That area of the building was never utilized. Needless to say, they never made any money on the building acquisition and loat significant money on the sale.

Not to mention that the states encourage disability fraud and will help you commit it.

Disability is federal. Welfare is state. If you're on welfare, you'll find plenty of resources to help you "navigate" the disability system. Every person that can be transferred from welfare to disability is moved off of the state rolls and onto the federal roles.

Disability fraud is a huge problem, not only because it consumes money and encourages bad behavior, but also because it delegitimizes the program and leads to people to question if you're *really* disabled.

137 ADA compliance remediation has been very good to me. That's part of my work, going around to various stores owned by a major corporation and fixing their problems.

I will grant that some of the regulations seem stupid. But having been confined to a wheelchair, albeit temporarily, I can definitely see where some of the rules came from. Like the five foot clear radius so a disabled person has room to turn around. Or the clear space in waiting areas labeled for ADA. There's also the maximum slopes rules for any ADA access in a parking lot. I could go on.

Public accommodations... one of the more insidious concepts that has taken hold in society. There's almost no such thing as private property anymore, and if they push through this tracer business, your home won't be either.

He was running low on fuel for his motorcycles, so he had to expend half his force with gas cans, fanning out looking for trucks and tractors from which to siphon fuel, instead of dealing with Meade's missile batteries.

Disability fraud is big business. We had one Doctor in Kentucky who bilked the system out for over $500 million. He finally got caught and was out on bail and fled the Country. They finally caught up to him in Central America and brought him back.

He got 27 years for the fraud and 15 years for fleeing the Country.


He was scum and quite a few people who got disability through him killed themselves after he was arrested and charged. SS turned off everyone's disability that had used him until they could sort out who was really disabled.

It fits with my observation that the DNC takes turns with it's marketing generally through six people (the Obamas, Hillary, Pelosi, Kerry, Romney). These are the "current" DS politicians with which the public are most familiar.

By having one of those six speak the buzzwords, they easily generate headlines filled with them. That's how *we* end up being exposed to them.

Their buzzwords are short standout phrases designed to persuade on an emotional level - making their enemy seem weak or their position seem strong. Trump as "morbidly obese" paints a strong mental picture, especially in contrast to the slim Biden. It also magically turns Biden's thin frailness into a strength against Trump.

A few weeks ago I got a note from the property manager here, one of these "out of an abundance of caution"/"in these troubling times" notes, saying they were pushing back the date to turn on the A/C from mid-May to mid-June.

Not only does this make no sense, but in Denver it's completely retarded.

It got over 90deg in here for the first time yesterday. Will call to cajole. Then to complain. Then, if necessary, to threaten. But I don't wan't don't want to buy a couple of A/C units I'll use for a month and then never again. They need to turn it on.

He only has them for 30 which expired at the end of April. The Republicans are in a super minority and pretty useless no matter what. That's similar to here. The guv can declare a state of emergency, but needs legislative approval if she wants it past 30 days. When her 30 days were up, Karen just extended it on her own authority, and that's what triggered the lawsuit. The state supreme court is a 7D majority, so she may get away with it.

There's a reason why Texas Oil is a thing.

Plus, the Confederacy had the dreadnought USS Texas there in the Gulf to protect the port in Houston. The big mistake there was that they never surged the battleship out into the Atlantic to break the Union blockade.

My wife has a deadbeat friend who she inflicts on herself to offset the wonderfulness of being married to me. She has a rare autoimmune disease that was probably made much worse by not getting off her dead ass to go see the doctor about it initially because she's cheap and lazy. When she gets her treatments it's pretty bad, even I'll admit and she deserves her special tags. But at other times of the month she's just as mobile and pain free as anyone else.

There's no real practicable way to effectively give them out in an as needed manner. Which is why Karens should STFU but that's why they're Karens.

You have no idea how embarrassing it is for her when we go to a restaurant or other place of business and there is not a bathroom she can use or she cannot get into the place with her chair. While the ADA can be taken too far, there are some very good things about it that allow my wife to keep her dignity and be able to join the rest of society. Without the ADA her options would be much more limited.

Yep. They've built up Chattanooga quite a bit, so the locations of battle sites are sometimes hard to find, but you can get a sense of the terrain. It must have been horrible, assaulting those positions.

Up on Lookout Mountain though, the trenches are still visible... and again, you look out over the landscape, and you can "see" what those boys had to face. Astonishing courage... on both sides.

Yep. My brother in on it because he had a heart attack on the job. He still has cardiac issues from that and will never work again but he has to constantly go back to the SS Doctor's to "prove" he is still disabled.


Yet I know a woman who got SS disability because she was a crack whore. She can work but they still give her that check every month.

276 Please don't assume the ADA is completely trash. My wife is "bound" to a wheelchair due to paraplegia and the amputation of her right leg. You have no idea how embarrassing it is for her when we go to a restaurant or other place of business and there is not a bathroom she can use or she cannot get into the place with her chair. While the ADA can be taken too far, there are some very good things about it that allow my wife to keep her dignity and be able to join the rest of society. Without the ADA her options would be much more limited.

My very elderly mother finally was unable to walk more than a few steps at a time in her last few years and ADA compliant restrooms, doorways, ramps, etc. allowed her to be able to leave her home with us, go to restaurant celebrations, visit the doctor, actually go to a grocery store where she could pick out her own groceries, etc.

There are many paraplegic individuals, ( including a lot of military vets) who could not function on their own without ADA compliant elevators, doors, etc. I've seen individuals get out of their properly equipped vans, wheel themselves into Cabelas, and be able to not only zoom around to shop, but be able to go to the second floor, etc. Sure they often need help getting items down from shelves, etc. but then , so do I,LOL.

Greg Abbott is a great example of someone whose ability to function in a wheelchair and run a state . I'm sure his life is made a little easier by the ADA.

Also, the ADA has provided an amazingly horrible grift for a certain class of evil shakedown artist litigators - because even the most scrupulous small business can NEVER afford to comply EVERY single little nitpicking regulation in the ADA.

Businesses that are in most ways easily accessible to the handicapped are still usually in violation of SOMETHING.

And these guys know the law back-and-front, and will file suit after suit after suit shaking down these business, and often shuttering them.

They should all be keelhauled.

Saw that at the Bunker Hill Monument in Boston (which is of course, actually Breed's Hill). Going up the hill it actually doesn't seem too bad. The last 100 yards are gonna be a bitch though, because in that case, the hill gets steeper near the top.

What really surprised me is turning around and looking down the hill. That showed just how commanding a position it was, how difficult the last stretch of an attack would be, and why the position was so important.

He said he was enjoying his break, and that his wife had said, "We're doing okay, why don't you just retire?" He said he didn't like to leave his customers of many years in the lurch, and overburden his business partner.

352 I visited Fredericksburg last year. It boggles the mind that they would even attempt that attack. The ridge the Confederates occupied was steep. Really, really steep. Not 90 degree angle steep but it might as well been. Plus all that open ground leading to that ridge. Most of the open ground is a neighborhood now but not back then. Nuts, just nuts. On top of that ridge, the land flattens out a bit. There is a large cemetery there now. Full of Union dead. Saw lots from my home state of PA.

It's a stain on his legacy, and after Chancellorsville, he was well up to the task of preventing further damage, and slid back into a division command, with honor and distinction.

The business has to pay for their own ADA compliance upgrades. Case in point would be CVS corporation. They were sued several years ago and have been in the process of upgrading all of their stores.

Obviously, new builds have ADA compliance built in to the plans, but not all the stores they bought out over the years do.

My daughter has 1 employee ( not counting her and her husband), and she now has to daily take his temperature, and also hire a liaison to instruct the employee how to report her if she fails to protect him,etc. my son is a millwright, so he has to have fewer employees in order to meet quartile guidelines, they also have to take temperatures, and wear masks and shields! They both are aware now of what I've been saying about you don't appreciate freedom until it's taken away. My dad used to say pigs get fat, hogs get slaughtered. I think the rules-which are mandatory and must be obeyed-Gretchen has put in place will slaughter our dem governor.

I don't think Plinkett was nitpicking that much. He was explaining how the intricate plotting of the show made absolutely no sense, how the show was devoid of any character, and then how it didn't seem to have anything to do with the entire franchise that came before Discovery while also touching on the fact that Patrick Stewart probably shouldn't have had any creative control of the show.

He even used bits from the Next Generation movies (which he doesn't like and doesn't consider canon) in support, saying that even they got it right.

It all ended with a nice few minutes of clips from the old shows demonstrating what it was in Star Trek that he loved.

I think it was a multi-faceted critique that really took Picard apart well.

Didn't help that according to legend, Gen Hooker was passed out drunk through a good part of the battle. Don't know if the legend is true, but he DID have a reputation of running his headquarters like a saloon with his drinking buddy Dan Sickles (a notorious party-boy).

Ironically, Sickles was pretty much the only Union general who really had his shit together at Chancellorsville. Saw what Lee was doing and begged in vain for reinforcement to stop the coming disaster.
