Oh Wow: Devin Nunes Says That Criminal Referrals Are Coming.
Not Just for the FBI/CIA Coupists.
But for Mueller's Team of 13 Angry Democrats.

I'm experiencing so many emotions over this.

I guess I'm currently feeling a mix of skepticism, of intrigue, and of erection.

The top Republican on the House Intelligence Committee said criminal referrals are coming for members of former special counsel Robert Mueller's team who investigated Russian interference in the 2016 election.

"We're looking at doing criminal referrals on the Mueller team, the Mueller dossier team, the Mueller witch hunt, whatever you want to call it. That'w where we are now in our investigation," Rep. Devin Nunes told Fox Nation’s Witch Hunt.

"We're doing a large criminal referral on the Mueller dossier team that put together a fraudulent report -- that knew there was no collusion the day that Mueller walked in the door," the California Republican added. "They set an obstruction of justice trap. There's no doubt in my mind that we will make a conspiracy referral there."

Let me point something out right now:

The liberal media and their NeverTrump allies -- who are also the liberal media, so why bother making the distinction -- will point that we are now in very dangerous territory which legitmately may end the American Republic.

Surely it will end the peaceful transfer of power, with one party knowing it might be criminally investigated and imprisoned if it loses an election or gives up power -- so of course no one will give up power.

And that of course is why there are no stable, long-term democracies in most parts of the world. People caught on the fact that the moment they peaceably departed from the presidential palace they'd immediately be sent to the prisons or gallows, and so stopped peaceably departing the presidential palace.

So yes, this is dangerous.

Nice of you to notice... now.

Four years into your coup.

But here's the thing, Fuckers:

You should have thought of that before you sought to undo 244 years of peaceful transitions of power, before you weaponized the intelligence and law enforcement capabilities of the United States against your political opponents.

But now you wanna cry because Andrew Weissman and James Comey and John Brennan and Peter Strzok and (gasp!) maybe Barack Hussein Obama himself might find themselves prosecuted?!

Funny, you didn't worry about these things when you were giggling and gloating over throwing Trump allies in jail.

You sowed the winds -- now you will reap the whirlwind.

So fuck off, and if this is in fact the end of the peaceful transition of power -- this be on YOUR heads, not ours.

But we will not be subject to rules that you are not also subject to.

And if we are now to be prosecuted when there's a change in administration -- so will you.

You made the New Rules.

You will now be made to suffer by the New Rules.

By the way, since we're going big here -- maybe it's time to put the media under criminal investigation for accepting and publishing classified leaks, huh?

Obama did it.

And so shall we.

I want to know who leaked the Pee Pee Dossier briefing to Jim Sciutto at CNN.

Just kidding, I already know. Almost everyone does. Including Barr and Durham.

I just want to see Jim Sciutto prosecuted for accepting the leak.

I mean, it is illegal to accept receipt of classified information, right?

It sure was for James Risen, when Obama got mad at him.

And so it's illegal for Fake Tapper and Jim Sciutto and Glenn Simpson's partner in crime Evan Perez, too.

Lawyer up, sweeties!

The system of two tiers of the standard of justice, the system of two tiers of citizenship, can only survive until the group forced to live as second-class citizens objects and rebels.

We object.

We rebel.

++++++++++++++++++
This. This is absolutely fucking key and it is a point that doesn't get made often. There is a lot of bad shit going on here. The weaponization of federal agencies. The weaponization of the intelligence apparatus. The judicial corruption. The congressional corruption. The proescutorial corruption. The railroading of innocent men. The list goes on.

But all of that is in service of something, of a greater purpose. And that purpose was to forbid the peaceful transition of power that - along with the constitution that lays it out - is *the* cornerstone of our Republic.

This is about eliminating the transition of power in the federal government. All of the malfeasance, all of the evil, all of the corruption has been in pursuit of that goal.

Or is there some connection where this DOES make sense?

I mean Holder got a referral to the DOJ for contempt of congress (I think...details are fuzzy) ... so that would be something that I guess would need a referral from congress.

Is there something similar going on here?

With all respect JJ (and I mean that), I disagree on the cause.

I think that Trump will pardon Obama and might do so preemptively. It isn't because he's black or because he's popular, it's possibly to try to set right exactly what Ace outlined in the post. I think Trump will let him go for transition-of-power reasons. On the flip side of this same coin, living in fear of prosecution for crossing someone on the "other side" once that other side comes into power will make transitions less smooth in the future.

I am not sure I agree with this argument, but I think it might be made.

Judge Sullivan has now appointed a retired judge to look into "whether the Court should issue an Order to Show Cause why Mr. Flynn should not be held in criminal contempt for perjury." Thus, the court is not only considering denying an uncontested motion for dismissal but...

...but considering a new charge based on Flynn's effort to withdraw his plea. Consider the implications for many cases where defendants seek to withdraw pleas due to prosecutorial abuse. It would create a threat of a judicial charge even when prosecutors agree with defendants.

Hell, everything is so polarized right now that it might not be possible to get an honest jury *anywhere.* Best case scenario is hung jury after hung jury, continuing until everyone involved is dead of natural causes.

The judge also said the churches' "interest in communal services cannot outweigh the health and safety of the public."

The people can not be all, and always, well informed. The part which is wrong will be discontented in proportion to the importance of the facts they misconceive. If they remain quiet under such misconceptions it is a lethargy, the forerunner of death to the public liberty.

And what country can preserve it's liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance? Let them take arms. The remedy is to set them right as to facts, pardon and pacify them. What signify a few lives lost in a century or two? The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants. It is it's natural manure.

If Sullivan goes ahead and tries to prosecute Flynn on a contempt charge using some non-DOJ prosecutor that he hand-picks, then Sidney should file an interlocutory appeal, because that rule that allows the judge to appoint his own prosecutor is clearly unconstitutional. The constitution vests the authority to prosecute federal cases in the executive branch, and only the executive branch. The judiciary can't usurp the executive branch's constitutional power by way of a criminal procedure rule. Even John "it's a tax" Roberts would have a problem with that.

Judge Sullivan was previously criticized for suggesting that Flynn could be charged with treason. He is now allowing third parties to make arguments in a criminal case on an unopposed motion. In addition, he is exploring a charge that he might be able to bring against Flynn...

...These extraordinary moves by the court are increasingly discomforting. This is a single charge where significant jail time was neither warranted nor expected. The Court's effort to import arguments and explore new charges could be raised on appeal given the prior record...

...there comes a point where the Court appears too invested in the punishment of a defendant and too active in creating alternatives to dismissal. As a criminal defense attorney, I find these moves unnerving, particularly when prosecutorial abuse has been raised by DOJ and others

293 It would create a threat of a judicial charge even when prosecutors agree with defendants.
Posted by: Tami at May 13, 2020 08:23 PM (cF8AT)

When the prosecution withdraws for reasons the court readily recognizes (ie the withholding of evidence to the defense that would have caused no plea arrangement in the first place) and no one is left on either side to insist that sentencing go through, then the judge, who is supposed to be an impartial arbiter in the case, has no other option but to grant the motion to dismiss and vacate the plea - he doesn't have a choice in the matter. Except that Judge Jackson has decided to carry out sentencing without either party's consent or desire...he's trying to avail himself of a little used SCOTUS ruling that when both sides withdraw but the defendant is self-evidently guilty, the judge may pass sentence anyway.

This is not the case here, both sides are agreeing that the defendant is INNOCENT, not guilty and so Sullivan loses his sentencing upon appeal and he knows it . Why he is doing this, when it does not further justice or his court's reputation is up to anyone's guess...

I also mentioned that a month before he died, I hung out with him and he told me he was now on the Atkins/Keto diet, on doctor's orders. He told me "I'm going to get so ripped even you'll want to fuck me."

I later found out that the doctor's orders had to do with his heart murmur or whatever, and he was ordered to lose weight due to his heart defect.

It is not a surprise that it would up killing him. He had just had some sort of incident where he passed out due to his heart not pumping enough blood like a month before.

Hell, everything is so polarized right now that it might not be possible to get an honest jury *anywhere.* Best case scenario is hung jury after hung jury, continuing until everyone involved is dead of natural causes.

When I was playing baseball in college and got elected co-captain with a buddy, we had some freshman idiot on the team that couldn't get up for work outs and missed practices. But he hit 325 and had 15 dingers by the end of his first season...the team came to us captains and complained that Smedley here wasn't showing up enough for practice and meetings. We made a mistake and went to the coach with that and he told us that exact quote.

We wound up assigning the worst guy on the team to get Smedley to the practices and if he didn't like it, he could improve his game and we'd get the next rotten guy to do it...it worked.

If it were up to me, no prosecution or pardon for Obama. Either would bring closure.

I don't want closure, I want him hanging and twisting in the wind for the rest of his life.

A
full and complete exposure of all that was illegally done, especially
his part in it. Never ending. The big spotlight on his petty ego.

But no prosecution to make a martyr of him, no pardon to absolve him.

Make him the greatest laughing stock of history.

well, not totally quiet, but obviously you don't write about being diagnosed with a congenital heart defect in your magazine. I mean, people do write about battles with cancer, but not about a heart defect you just discovered.

I had a wacky theory back in October 2016 that explained why Comey went out and semi-exonerated and semi-damned Hillary Clinton.

Comey, who like everyone else, was certain of a Clinton presidency, was sending Clinton a message: We can destroy and you had better remember that.

No, Clinton wasn't going to fire Comey. I don't think she could if she wanted to. Comey and his pals would never allow it.

JackStraw, I'm normally with you 100%, but not on this one. I've posted before that there had to have been hundreds of people involved, given the magnitude of the operation (rhomboid disagrees with me). Agents, analysts, translators, technicians, supervisors, clerical and support staff. Every single one of them knew that the real target was Donald Trump, regardless of whose name was on the authorization.

I put them in four groups: (1) the true conspirators, the "small group" who knew the Russia hoax was BS, but were pursuing it for ideological reasons; 2. the easily fooled, who thought the Russia story was true. mostly because they were ideologically and culturally predisposed to believe it; 3. the overly trusting, who believed the President was a Russian stooge because their chain of command told them he was, and they were not in the habit of questioning the chain of command; and 4. the careerists, who knew the story was BS, but went along because Hillary was going to win, and no one wanted to be on her team's bad side, and then when Hillary didn't win, they had to protect themselves.

I'm sure she's book smart. And street stupid. She was a willing dupe in a show trial. That's not smart.
_________________

I very much doubt that General Flynn was willing to flee the U.S. to a country without an extradition pact with us, in order to avoid facing charges that he knew were politically-motivated bullshit.

I also doubt that Flynn (or anybody else) could have foreseen how long this persecution would drag on, or how ruthlessly corrupt the players (e.g., his own initial lawyers at Covington, van Grack, Judge Sullivan, etc.) would be.

In any event, the client is the decision-maker ultimately in the case. It is his freedom on the line, not the lawyer's. The lawyer advises, but does not decide, if the client accepts a plea deal, or goes to trial, or chooses to testify in his own defense, etc. Those decisions are the client's to make. And there was never any "show trial" in Flynn's case, because there was no trial, so obviously Sidney did not participate in one. She did her job, and she did it well, which is a lot more than anybody can say about the lawyers from Covington & Burling, who soaked Flynn for millions of dollars in legal fees while conspiring with van Grack to screw Flynn and deceive the court. If you want to be disgusted with crooked lawyers, you'd be better off directing your ire at van Grack, and the Covington lawyers, and Sullivan. They, not Sidney Powell, are the corrupt, incompetent lawyers in this case.

I want the horror of it to be a deterrent forever. I want it to terrorize the dimwitted purple haired people who remain who had even a thought of rising up against this democracy, our Constitution and Bill of Rights and our Republic to harm its citizens and rob them of their freewill. I have loved ones who died to protect all of this for me and my descendants. And if the terrorists who infiltrated the highest levels of our government to destroy what the best of us bled and died for DO NOT lose their life, this country is truly dead. If justice does not end the lives of the traitors and terrorists, America died with the men and women who lost their lives to save it.

486 >>JackStraw, I'm normally with you 100%, but not on this one.

Why did there have to be hundreds of people who knew what the real mission was? There were about 20 of them at the senior levels of the FBI/DOJ and they were involved in both the Clinton email scandal and the Trump Russia crap.

They ran both of those ops out of the HQs not the field offices which is totally not standard. They had the support of the White House and the senior levels of the entire Executive branch.

Why did the need FBI field agents? They didn't. In fact, the whole point was not to have them so they could control the information. They weren't doing things by the book intentionally and keeping everything they were doing close to the vest.

Are there probably a handful who knew something was up or suspected. Sure. But did the field agents in Des Moines know? Of course not.

Besides, given the skepticism that anything will happen that is fairly common, would you risk your career if you thought it nothing would happen?

I think it is unlikely that an organization can be that corrupt at the top without being corrupt all the way through.

So while I agree with Jack Straw that this was probably closely held, I can not believe that such a thing could exist if the culture was right. The carreerists would turn thinking that it was worth trashing their career for a higher purpose. After it became apparent, (like three years ago) insiders would be data mining and leaking to save the organization.

They are the Federal . . . Bureau . . . of . . . Investigation and the Central . . . Intelligence . . . Agency. I would hope that they could figure out what the hell was going on when they were investigating people close to the Trump campaign, then the transition, then the White House or, as I mentioned, handling the documents. It's not like this was done in secret. It was all out in the open. Wiretapping Trump Tower? Now some of it was more hush-hush, like planting the money on Papadapoulos and then being there to arrest him at Dulles Airport, or Azra Turk, whoever she was, but when Halper sent a report to his multiple handlers, a lot of eyes saw it. But just for one detail, that money planted on Papadapolous was obtained with a voucher from somewhere, and someone had to sign off on it, and someone had to report to someone else why we didn't get it back. And no one asked any questions, because anyone with half a brain could figure out what was going on. And I'm betting that people involved in sidebar activities like that bragged about it. This was much bigger than the core group.

Very little.

The cases brought by the DoJ will be few and unimportant. They'll be intended to paint this as a renegade cadre headed by McCabe (or Strzok, even) when it is exactly the opposite of that; it's systemic corruption from the nose to the toes.

The coup plotters will walk. The vaunted Hero Rank and File Thugs of the FBI will continue on unreformed, and unabated in their corruption.

But, at least if Nunes refers the bigshots it'll be on record... useless from a practical standpoint, but out in the open. For once.

After it became apparent, (like three years ago) insiders would be data mining and leaking to save the organization."

Can't and couldn't speak for Jack, but the "small group" concept was to avoid leaks and detection. I do agree with you about the culture of the FBI being utterly corrupt, but this could happen in a squeaky clean environment if you had enough rotten apples with enough discretion. It would be more difficult but if people kept quiet and held things close to the vest it could be pulled off.

What really caught my attention were the reports a week or so back that there hadn't been any whistleblowers whatsoever come forward from the FBI, from field agents to the top brass. That speaks to the corrupt culture there.

580 Then again, Serbs of the Black Hand didn't exactly have a reputation for restraint.

Princip and his co-conspirators were Bosnian nationalists recruited by the Black Hand, a terrorist group funded and controlled by the Serbian Army.

The actual assassination plot had already failed. Princip and several other terrorists were following the agreed upon abort procedure; blend into the crowds and slowly walk away.

The failed attempt caused the grand duke's security team to the motorcade route at the last minute. Not all the drivers understood the new routing. The lead car made a wrong turn onto the street Princip was using to walk away. The grand duke's car followed. The motorcade stopped to reverse and the grand duke's car stopped unexpectedly right in front of Princip. He had, maybe 5 seconds, before it would start going again. He stepped toward the car, pointed his pistol at the grand duke, and fired twice. One round hit the duke in the throat, the other hit the duchess in the stomach. Both bled to death in the next few minutes.

Under the law, he was too young for a death sentence. He was serving life when he died of tuberculosis.

620 While I would not directly encourage anyone "out there" (much less from within Teh Horde) to go Full Vigilante, I do think the following idea might contribute to the Public Good?

Some intrepid soul needs to set up a series of blogs, one each, dedicated to Brennan, Clapper, Comey and each and every "player" that's been mentioned here in Ace's post, and all 500+ comments, thus far.

Each blog will feature the 'round the clock surveillance and posting of locations, travels, habits, routes and such of the Traitor in Question.

No suggestion of ill will or foul deeds to be mentioned on those pages, of course.

Just make every possible moment of their day, week, month, year, a matter of Public Notice.

It'd be a pity though, if some Vengeful Rando took it upon themselves to render Vengence as an independent, ad-hoc spontaneous action.

The kind of spontaneity which comes only through detailed study and advance planning.

Truly, it would be a pity were that to happen.

I'll be the first advertiser on those blog pages though, selling 1oz bottles of Alligator Tears.

637 What's happening to Flynn is like something out of a Franz Kafka novel. He's trapped in a corrupt system where everybody is in on the scam, and he can't get out. The judge is crooked, the prosecutor is crooked, his own lawyers are crooked and working against his interests -- while billing him millions of dollars in fees.

Flynn hires a new lawyer who is not in on the frame-up, but no matter how much evidence she manages to dig up proving Flynn's innocence, the crooked judge won't let Flynn withdraw the guilty plea that his former crooked lawyers talked him into. Then the prosecutor gets publicly exposed as a liar and a crook who has been hiding exculpatory Brady evidence and who perjured himself to the court when he swore that there were no side deals in the plea agreement, and so the prosecutor gets replaced.

The new prosecutor asks the judge to dismiss the case, as it is clearly a frame-up and should never have been brought, but the crooked judge says "no way, f*ck you, I'll appoint my own prosecutor to screw this Flynn guy!"

And the sickest part of all this: half the country, and all of the media, cheer on the crooked judge.

Even Kafka wouldn't have believed that last part.

647 Some thoughts about the Flynn situation after taking a long walk:

Judge Sullivan is trying to force Flynn into really perjuring himself. If Flynn has to claim he was pressured into pleading guilty on the lying to FBI charge, in exchange for no charges against his son, Flynn knowingly perjured himself on the plea agreement he signed. That agreement said all deals between him and the Government were detailed in the agreement.

DoJ also doesn't want to go there. The judge could ask the new prosecuting attorney, "Did van Grack AND YOU knowingly hide this agreement from the Court?" That's a place Barr doesn't want to visit. (van Grack is disposable.)

And a prediction: Starting tomorrow there will be incessant Dem-Media Complex demands that Barr recuse himself from everything related to Flynn and the Mueller investigation, and that DoJ appoint a Special Counsel to investigate how the Flynn case has been handled since Barr was sworn-in as Attorney General.

A decent argument can probably be made that it wasn't put right, just put back.

This is where we're headed now, too. Even without a bunch of violence, we have two options. Obama is untouchable, or we are a nation of laws, not men. Either path will damage the republic and the peaceful transfer of power. The only choice we have is what's best for the republic, and that means we need to remember we are a nation of laws.

694 677 DoJ also doesn't want to go there. The judge could ask the new prosecuting attorney, "Did van Grack AND YOU knowingly hide this agreement from the Court?" That's a place Barr doesn't want to visit. (van Grack is disposable.)
__________________

We know that van Grack and the Covington lawyers for Flynn did exactly that. It's why van Grack had to withdraw. He perjured himself when he swore to the court that there were no side agreements. (He also withheld Brady materials, also highly unethical conduct).

And yet, Sullivan isn't demanding that van Grack be criminally prosecuted. Odd, isn't it?

Posted by: TrivialPursuer at May 13, 2020 09:55 PM (k4dH2)

Flynn also doesn't want to say his plea was coerced because that publicly opens the can of worms about what his son did that Flynn wanted to not be prosecuted. The Dem-Media Complex would pursue that story relentlessly when given permission by Obama or Soros or whoever.

Thing is that people are riled up already because of the Dem govs keeping them cooped up. So even though many are unaware of the deep and wide corruption related to Obamagate and the implications from Flynn's case, they are p*ssed and mad as hell.

So if they think no one pays a price--well, let's say this is not the best time to let all the perps avoid any perp walk.

The left has already gamed this out, of course, and the press is a devoted asset. Looks like more move/counter-move to me.
