LUNATIC LAWLESS "JUDGE" EMMIT SULLIVAN ENLISTS HIS OWN PRIVATE PROSECUTOR TO PRESS CASE AGAINST FLYNN;
CONSIDERS IMPOSING HIS OWN CHARGES OF PERJURY AND CONTEMPT ON FLYNN

This must not stand.

This will be the end of things if he is not rebuked -- he is claiming hitherto undreamt-of powers that judges just do not have, and is pursuing his own personal vindictive prosecution against a man the DOJ says is innocent of a crime.

This is a private prosecution by a lawless former judge who has declared himself Tyrant -- and if this is permitted to stand, the American experiment in Democracy is over.

A federal judge is signaling that he may pursue perjury or contempt charges against former national security adviser Michael Flynn over his effort to abandon an earlier guilty plea to a charge of lying to the FBI.

Sullivan said he's also asking the retired judge, John Gleeson, to recommend whether Flynn should face a criminal contempt charge for perjury--apparently for declaring under oath at two different court proceedings that he was guilty of lying to the FBI, before he reversed course an January and claimed he had never lied.

The very fact he's bringing in another judge to recommend perjury charges shows that he's aware that he is no longer objective in this case and so he cannot impose perjury penalties without "making it look good" by bringing in a third party.

But if he's no longer disinterested and neutral -- if even he doesn't trust his own decisions on Flynn -- he has no choice but to recuse himself.

And if he won't do that, Chief Justice Roberts has no choice but to reassign another judge to this case.

You will respect his authoritah. He has decided you are guilty, and if you protest his decision -- you are guilty of perjury and contempt.

By the way: The below florid, deranged Tweets, alleging all sorts of conspiracies and Russian kompromats, were posted by the one of the people calling themselves "Watergate Prosecutors," who Sullivan lawlessly permitted to file a third-party motion in this case.

Sullivan must be disciplined immediately by Roberts and removed from the case for obvious emotional involvement with Getting Flynn that makes him a litigant in this matter, Flynn's actual prosecutor, rather than a judge.

And then he must be impeached by the Senate.

Oh Wow: When I searched for "John Gleeson," I came up with a blistering Washington Post op-ed claiming the Flynn case was clearly a case of "political interference."

I assumed this must not be the same John Gleeson that Sullivan appointed to "judge" this case -- surely he would not appoint someone who had already publicly declared his verdict.

Or so I thought.

Because, Surprise!, Sullivan's hiring a "judge" who will give him the answer he wants. He knows what the answer is -- he read it in the newspaper already.

this doesn't sound right to me. I imagine a judge can impose misdemeanor contempt on you, but I think for a crime, you'd have your right to a trial by jury of your peers.

At this point the animosity of the judge towards one of the parties is so cartoonishly obvious that a recusal request should be made, and if denied appealed. Likely it would be granted. Now, why would anyone do something so weird? One answer - he wants to drop the hot potato in someone else's docket. Another answer - there is plenty of material on him and he is being blackmailed into this. A third - because he is a perverse old so-and-so and enjoys the righteous fury.

And the same applies to these former "Watergate" prosecutor hacks. They don't work for the DOJ anymore. I do wonder who would be tasked to conduct the prosecution if both the DOJ and the defendant support dismissing the case and the judge denies the dismissal. That would be interesting.

Doesn't hold up. Even if there are concerns about the dismissal being "politically motivated" in the press - or even in reality - it doesn't hold up. They withheld Brady material. Flynn was connect by his politically-connected (to *their* side) lawyers. They threatened to go after his kid to cut a side-deal that they then didn't disclose in yet another violation.

There is so much prosecutorial misconduct on this that there's no conflict.

Even if Flynn gets a Presidential Pardon the second the judges sentenses him to prison, that judge (and I use that term advisedly) would still be an instant HERO to the left, and would probably be on the short list to being promoted should we get that left wing president and a left leaning senate.

And...Trump has been reluctant to stop this sort of stuff in the past. None of the other defendants in this corrupt-ass Russiagate phony trials have gotten pardons or any sort of clemency. He lets the process grind out.

Which...may serve a purpose. Maybe it makes their eventual acquittal via appeal or what not more ... "legitimate" in the public view. I don't know.

Remember, the expansion of civil asset forfeiture in the 1980s was presented as being for the express purpose of stripping defendants, specifically drug dealers, of assets so that the defendants could not afford to hire lawyers to defend themselves.

The colloquy on guilty pleas is designed to give the defendant a chance to tell the court that he was being forced to take a plea. It's not ANOTHER FUCKING PERJURY TRAP. What galls me about all of this is that there are specific procedures in place which allow for the withdrawal of a guilty plea. If doing so opened one up to charges of criminal contempt, then, well, types and deletes.

I'm desperately unhappy that I'm going to end up being right about Sullivan doing anything he can to avoid dismissing the charges.

332 When you reach a plea agreement, one part of it specifies that you confess your crimes. Flynn did exactly that. If Flynn now claims he didn't do it, or was tricked into it, well, technically he did perjure himself (he said he did something that he didn't).

However, if the government can be shown to have coerced you into that confession, the judge will typically toss out the perjury charge. And I think the case is very strong that has happened here.

It's confusing as hell, actually. One of the problems is that the names they have for things don't jibe with the same-sounding names we have for things. So when they call someone a "judge," what they really mean is "prosecutorial investigator," and so forth. They have a different word for what we would call a "judge -- something like a "magistrate." I can't keep it straight. And also it's different in France from Italy - they're both fucked up, but in different ways.

As I understand it, only the defense can do that. But I believe that the prosecution can get the trial in a different location based on the location of the crime being committed and who it impacts.. Going back -- the 6th Amendment provides for a jury trial ONLY if the punishment is GREATER THAN 6 months.

42 USC 1995 gives judges that little loophole over the 6th Amendment by saying that if they decide to imprison someone for greater than 45 DAYS the accused has a right to a new trial before, not only a new judge on the matter of contempt, but a jury to decide their guilt or innocence. This is why you will almost NEVER see a judge go beyond 30 days for a contempt charge because it removes that power from their courtroom and places it in another court and before a jury.

And I believe the court/Sullivan got tired of getting this piece meal...one document at a time. And said..."stop sending me this stuff one document at a time. Wait until the prosecution / government has finished its release...and then send all the relevant documents to me in one filing."

It seemed reasonable to me. I also suspect Powell liked doing it piece meal because it is a way of keeping this case in the media.

I suppose if the defendant falsely admitted to the crime, this could be the basis of a perjury prosecution since the defendant is supposed to be telling the truth to the court.

The government seriously fucked this whole thing upside down and backwards, but so did Flynn's lawyers. If he had never plead guilty, the whole thing would be over. But since he did plead guilty, then technically, he is guilty in the eyes of the law, or he committed perjury. But Sullivan's solution seems idiotic. he could:

1) Ignore the governments withdrawal of the case, but sentence Flynn to time served. Flynn could then appeal (and easily win, given in the new trial, the government then decline to prosecute), or just walk away.

2) Cut Flynn loose of his plea deal. Have Flynn elocute being coerced, then start ripping with the contempt charges to any and all member of the government that attempted to prosecute this guy.

His current option, hiring another retired judge to mount a pseudo prosecution is a joke. This 100% gets turned over on appeal. I can imagine the appeals hearing, where the government says we fucked up and he should have never been prosecuted. And Flynn says he is innocent. Then they look at Sullivan's antics, and poof, done deal.

If Flynn is smart he'll have a massive lawsuit against his former law firm, and easily win that too.

537 See, Roberts has made several rulings and decisions that the left hated. His vote was in on several of the Hawaiian judge overstepping cases. Stuff the left didn't like. But none of it really huge like ACA, where they got to him by convincing him that if he ruled the "wrong way" then forever after the Roberts Court woudl be tainted by this decision and his legacy would be ruined.

We literally saw the arguments and pressure being brought against him along these lines, the op eds, the talking heads on TV, the internet discussions by lawyers. They knew what tactic to take because Roberts had spent his entire life working to this point and had made it clear in the past he was concerned about his legacy.

So they grabbed that lever when they needed to and yanked. They can't use it too often, or it stops working, but on key cases...

Lying to the FBI is only a crime if it results in obstructing an ongoing investigation. The declassified notes this week showed that the case against Flynn in relation to the Russian collusion case had been resolved in his favor. That was when they decided to try and go after him for the Logan Act and set up the interview in which he purportedly lied. Of course the original 302 has been "lost" so at this point they can't even prove that. But the bottom line is that the interview was not in relation to collusion, but the Logan Act. The charge against Flynn was that his lie obstructed the collusion investigation.
When Flynn pleaded guilty before the Judge, the Judge is supposed to ascertain whether the prosecution made their case but the Judge never asked the prosecution how the lie obstructed their case. Seeing as their was never any collusion , the charege never should never have been brought. The story I read said the case would be overturned because of this.

It is not the plea that is the problem, but the elocution. That is a requirement of plea deals - the defendant stands up in court and swears he's telling the truth and further swears he is not being coerced. If Flynn says he was lying during the elocution, then he committed perjury. No question. however, most judges, sane ones anyway, will allow the defendant to withdraw from their plea deal, and just ignore the perjury that was committed, or even hold the prosecution accountable for it. But Sullivan gotta Sullivan. idiot.

Even if you want to pretend the case against Flynn is legit (it's not) nobody on either side is really claiming he committed treason. Just that he lied to a bureaucrat.

Pleading is not testifying. Pleading not guilty just means that you're not admitting to the charges and you intend to put the prosecution to its proof.

When you factually admit to a crime as part of a plea deal, this is supposed to be the truth and the court is relying on its truth in approving the deal.

606 Well, the case would need to be reassigned by the Chief Judge of the District. That would be Beryl Howell, an Obama appointee. In fact, better than three quarters of the judges on the court were appointed by Obama or Clinton. Not a single Bush appointee. The Chief Justice will not reach down into the district court's administration to reassign a case.

And the Senate cannot impeach the judge, the House would handle any impeachment. The Senate could then remove him after trial. That's not gonna happen, unless the GOP wins control of both houses, and perhaps not even then. I don't think there has ever been a judge removed just for being a bad judge. Crimes, felonies, usually are required.
