Government Not Persuaded That Flynn Interview Was "Conducted With a Legitimate Investigative Basis"
Well, I already had a post ready to go (see below), but now that's been superseded.

he Justice Department on Thursday said it is dropping the criminal case against President Donald Trump’s first national security adviser, Michael Flynn, abandoning a prosecution that became a rallying cry for Trump and his supporters in attacking the FBI’s Russia investigation. The move is a stunning reversal for one of the signature cases brought by special counsel Robert Mueller... In court documents being filed Thursday, the Justice Department said it is dropping the case "after a considered review of all the facts and circumstances of this case, including newly discovered and disclosed information." The documents were obtained by The Associated Press.Elizabeth Vaughn of RedState wrote a couple of days ago that things were looking bad for Brandon Van Grack. He was required to release all so-called Brady material, whether exculpatory or inculpatory, to Flynn, and yet did not release key documents.
In repeated filings, Van Grack has maintained that he's fulfilled his obligations. In an October 2019 filing, in response to Flynn attorney Sidney Powell's request for Brady materials, he stated that the government "has complied, and will continue to comply, with its discovery and disclosure obligations, including those imposed pursuant to Brady and the Court's Standing Order." He denied that they had "affirmatively suppressed evidence." The government had not concealed Brady material, he wrote, nor was the government "aware of any information that would be favorable and material to [Flynn] at sentencing." Except that they had and they were. ...So, does Brandon Van Grack think that he can argue to a judge that he obeyed the judge's orders and was not in criminal contempt? Not sure. But he's withdrawing from the Flynn case and all other cases he's been assigned. Almost as if he knows the thunder's coming.
How would Van Grack characterize the FBI's January 4, 2017 Closing Communication which recommended the FBI close its investigation of Flynn, as its exhaustive search through government databases "did not yield any information on which to predicate further investigative efforts?" How about FBI agent Peter Strzok's instructions not to close the case yet because Flynn might have violated the 1799 Logan Act? Flynn was the incoming National Security Advisor for goodness sake. He had every right to speak to then-Russian ambassador Sergey Kislyak.

I'm not sure, just something I've always wondered about. An acquaintance once told me that he was found not guilty of a crime once but they kept him one more night in jail because they got back to late to out-process. I never really believed him but now who knows. If they tried that with me I'd pick up real charges.

Absent follow-up prosecutions or sanctions for the gross misconduct of the whole thing, and/or absent any valedictory flaming by Judge Sullivan, with specifics related to DOJ misconduct, likely that's what most people will hear.

Judge Sullivan can and should refer van Grack (and also the Covington lawyers who participated in the fraud) to the bar associations for investigation and disciplinary action. These are serious offenses, and should result in the lawyers being disbarred. No excuse for this kind of conduct. It's grossly unethical.

What cards was she holding? Flynn's previous law firm was hiding thousands of pages of material from her. The DOJ attorney was also withholding exculpatory material from her and lying to the court about it. Her client had already pleaded guilty. Hell of a poker hand there, and yet she ran the table. Someone had to be helping her from the inside, and my question from a week or two back still stands - who the heck is paying her?

Yes, not only were the Covington lawyers for Flynn ragingly ineffective and incompetent, they were also unethical (they stood by silently while van Grack perpetrated a fraud on the court by perjuring himself about there being no side agreements in the guilty plea deal). And on top of all that, they had serious conflicts of interest.
For Flynn's sake, I hope Covington has some huge malpractice insurance limits, because they are going to need to pay Flynn big bucks before this is over.

I was too dry with my sarcasm aimed at Abbott and Company. I like Abbott's policies and politics. I agree with freeing Luther. The point I was trying to make is that if Abbott issued an order he didn't want enforced at any level, why did he issue the order?
If every small business can re-open before official permission from Abbott, and only pay a $100 fine, as the Lt. Gov. said today was an appropriate punishment for Luther, why the hell is the Order still in place at all? Or why didn't Abbott and Patrick wink and tell the owners weeks ago that they can "illegally" open and they'll only have to pay a nominal fine? That would have saved the bacon of a lot of people who now may never successfully re-open their businesses.
I was was trying to point out they are doing a lousy job of governing the Great State of Texas on this one. IMHO.

In a prior administration, McCabe had been accused in an EEOC complaint of some impropriety (I forget the details) by some woman underling, and Flynn had testified for the woman. That pissed off McCabe big time, and he saw his chance to get revenge on Flynn when Flynn joined the Trump administration. This entire bullshit prosecution of Flynn was McCabe's doing.

Funny, I don't remember Rosie asking for Eric Holder to be removed when he dismissed the Default Judgment against the Black Panthers.
Default Judgment meaning that the defendants didn't even bother responding, so the government won by default. So instead of enforcing the judgment, Holder dropped it.

So just, possibly, a 'sign of disagreement'. Nothing about him withholding documents and lying about it to the court like a trooper.
It really will take a criminal conviction of a Van Grack to get some honesty out of the AP and fellow degenerates. And I may be wildly optimistic here.
