Why does a man who knows he's innocent have to send lackeys to check, and perhaps alter, the evidentiary record?
Reade has demanded he release his Senate records for review from the time. The papers, 1875 boxes full, are being held by the University of Delaware “until two years after he retires from public life.” But the University has refused to reveal the nature of the agreement with Biden and Biden has done nothing to comply with requests to release the papers or clear up the issue, prompting people to question why. Now there's more that doesn’t look good for Biden. Turns out not only is he refusing requests to release the papers, but the campaign is clearly curious about what’s in the records and dispatched operatives on at least one occasion to look through the records, according to the Business Insider.Since mid-March of 2020 no one's been inside -- but they were pawing their way through the records before then. And while Tara Reade didn't offer her testimony to Katie Halper until March 25, Tara Reade had been trying to get the media and #MeToo organizations interested in the story well before then. She went to Halper only after everyone else told her "Go away, we have an election to rig." So yeah -- Biden's people knew damn well that Tara Reade was ready to tell her story well before mid-March. Whoops: Chi-Town Jerry reminds me that Tara Reade had been complaining of Joe Biden's sexual harassment (though not sexual assault, yet) since spring 2019, after Joe Biden denied/ignored complaints from seven women who came forward to complain of inappropriate touching.
Andrea Boyle Tippett, a spokeswoman for the University of Delaware, confirmed to Insider that individuals from the campaign have accessed the collection since Biden announced his presidential campaign in the spring of 2019. She added that the University of Delaware's library closed in mid-March due to the coronavirus, and that no one from the Biden campaign has gone to the library since its closure.

It's a good question. Columbo's proofs are clever but sometimes they seem like they'd be pretty shaky in a real trial.

He only suggested after he got new attorneys that he had second thoughts - AFTER the judge already gave him his right to withdraw his plea and he refused. His right to with draw his plea left with that hearing...now Powell has to pull a rabbit out of her hat - she has to convince the court at sentencing that it was all mistake - he should have withdrawn the guilty plea - THAT is where we are in this case.

yes, sometimes he did. Probably half the time. But the other half of the time, the episode just ends with the criminal silent and stunned at having been caught.
The silence says "Yeah I'm guilty, you got me," but of course no court would allow you to enter your interpretation of silence as evidence.
In those episodes, you wonder if he was able to fight the evidence later or get pled down or whatnot.

Yeah, that's how it works. The Prosecutor and Defense come together, come to an agreement, and present it to the judge. The Judge usually approves the deal, but before its finalized, there's a whole little speech they give thats basically summed up as
"Do you understand what's going on here? Are you drunk or on drugs? Other than the plea deal, was anything else promised to you in exchange for your guilty plea? Do you understand that by pleading guilty, you get no appeals process?" etc.
I don't see it being overturned.

Looks here like we have a festival of guvamint abuse, from the "investigation" right through to the prosecution/blackmail involving threat to persecute Flynn's son.
There's a related if separate gigantic problem of federal prosecutorial power that seems to have made actual prosecution and proving a case almost a novelty and quaint throwback, in all kinds of cases.
Would one of the many ways to start fixing that be to make if OK for defendants to publicize any extortion, er, deal-making actions and offers and threats by the prosecutors? I think so. Ought to be as public as anything that goes on in court. In writing.

I'm a broken record, but its pretty clear Judge Sullivan is corrupt. He sat on a plea deal for over 2 years, holding off sentencing because he knew he was going to get in trouble. He didn't recuse himself after accusing Flynn of treason. And now he's issued an order basically telling atty Powell to shut up

Everything they filed with the court is a complete fabrication, so I think they will really kill my kid if I don't take the deal. So, no, nobody offered anything in exchange for the plea.

There's been case law on this, as you can imagine. I don't remember all of the details, but basically -- yeah.
You can say "yes, I'm under duress, they threatened to do [xyz]" then the judge will not approve the plea. But if you say "no, I'm not under duress" or whatever, you can't later claim you were because you previously swore in court you weren't.

The Judge usually approves the deal, but before its finalized, there's a whole little speech they give thats basically summed up as
"Do you understand what's going on here? Are you drunk or on drugs? Other than the plea deal, was anything else promised to you in exchange for your guilty plea? Do you understand that by pleading guilty, you get no appeals process?" etc.
I don't see it being overturned.

I mean, that's probably why the judge is even entertaining this. If the entirety of the plea deal was not disclosed to the judge, he may have some more wiggle room than usual. But, again, it's standard practice for a judge to ask a list of questions including basically 'were there any promises made that I dont know about?' and if Flynn answered "no" when the correct answer was "yes," then he's saying "I lied to you when I plead guilty." ...

That's a pretty neat trick. The prosecutors and his lawyers agreed to keep the deal quiet to evade court rules and if Flynn broke the deal and told the judge the prosecutors would go after his son. And now Sullivan knows as we all do that the entire prosecution was a setup and there was zero criminal conduct.
I know judges don't like to overturn a plea. They also don't like being lied to and played for a fool. This is far from a normal situation.

Part of the problem is that for a lawyer to get ahead in any local DA office or DOJ district office, he/she needs to win cases, and the bigger the cases the better. Unfortunately, I don't know how else to incentivize the workers and winnow the high-performers from the low-performers.

Yeah, I don't know the answer either. I interned in a prosecutors during law school, and at least in my (limited and anecdotal) experience, most of them seemed like pretty fair people.
There's not really a huge downside to dropping a case, or offering a good plea deal. But as you say, that win ratio in court is very important for everyones career.
Which is part of the reason prosecutors love plea deals. I don't know the stats off the top of my head, but I'd guess over 90% of the felony cases in the jurisdiction I worked in were either dropped or plead out. Very few cases actually went through the whole trial process

Prosecutors, particularly federal ones, are the weak link in our constitutional republic. There's a reason the DOJ wasn't created by the Constitution and don't get me started on what the founders would think about a special counsel. Being able to bring the full power of the feds against a private citizen is an abomination.

A few years ago, my mother had 1000-to-1 odds against surviving surgery (according to her surgeon) and she lived long enough to see my first grandchild, who was born in early December. Newsom was supposed to close all state beaches. Instead, he decided that he was only going to close Orange County beaches. Good luck enforcing that since both the Sheriff and the County have said that the Sheriff's Office will not be enforcing any of the state's closure orders.
I hope there are even more people out on the beaches tomorrow.

What about the DOJ failing to turn over Brady evidence? Apparently it's not an automatic dismissal, but it seems to me that while you weren't drunk or coerced, you weren't aware of things you were entitled to be aware of when you submitted your plea.
All this said, I'm not sure why a man of such sophistication and experience agreed to the FBI interview in the first place. I'd like to think I also wouldn't have pled guilty to a federal felony I didn't commit.

I was completely separate, but interacted with them, one time the #2 came to me and asked my advice, as I'd worked in furrin' policy for a long time. He thanked me later and we laughed about it a few times as developments illustrated the wisdom of their decision.
They'd been approached to become reps for one of the more dubious, verging on odious, foreign regimes at the time (not a US enemy, but nasty).

Sidney Powell was on Liz MacDonald's show. She said he had no idea the interview was about him. He thought it was just a couple of FBI guys just having a meeting with him. And the FBI purposely kept it that way so he wouldn't spook and clam up. He even was giving them a tour around the WH when the 'meeting' was over.

Again, it's ludicrously hard to walk back a guilty plea.
As for talking to the FBI? I certainly wouldn't have. But as I understand it, Flynn was under the impression it was some kind of routine counter intelligence stuff. Like "welcome to working for the government, we're just crossing t's and dotting i's" and had no idea he was the subject of a criminal investigation.

I seem to remember when this first started that the judge asked him whether he wanted to withdraw his plea and, with Powell standing there, he said no.
On the other hand, the judge has delayed this time and again. There could be enough misconduct here for the judge to dismiss, or sentence him to a one dollar fine or something. who knows.
One thing is for sure. Everybody on the prosecution side should be disbarred and the FBI agents prosecuted.

Sorry to hear that. However, they told my wife she had stage-4 cancer in lungs, liver, and pancreas. Post surgery (when they did true biopsy) they said it was only in pancreas and removed it. It's been a year since surgery and she's still here. Prayers up, chavez.

They fly in packs from garden to garden around here, pecking tomatoes. I've found there always seems to be a scout bird that arrives before the pack. When I shot that one, the rest moved on. .177 pellet works fine for me and is quiet.
