Sefton: sefton at cutjibnewsletter.com | As Biden Continues Shielding His Records From Public Inspection, He Sends His Operatives and Minions To Grope Their Way Through ThemWhy does a man who knows he's innocent have to send lackeys to check, and perhaps alter, the evidentiary record? Reade has demanded he release his Senate records for review from the time. The papers, 1875 boxes full, are being held by the University of Delaware “until two years after he retires from public life.” But the University has refused to reveal the nature of the agreement with Biden and Biden has done nothing to comply with requests to release the papers or clear up the issue, prompting people to question why. Now there's more that doesn’t look good for Biden. Turns out not only is he refusing requests to release the papers, but the campaign is clearly curious about what’s in the records and dispatched operatives on at least one occasion to look through the records, according to the Business Insider.Since mid-March of 2020 no one's been inside -- but they were pawing their way through the records before then. And while Tara Reade didn't offer her testimony to Katie Halper until March 25, Tara Reade had been trying to get the media and #MeToo organizations interested in the story well before then. She went to Halper only after everyone else told her "Go away, we have an election to rig." So yeah -- Biden's people knew damn well that Tara Reade was ready to tell her story well before mid-March. Whoops: Chi-Town Jerry reminds me that Tara Reade had been complaining of Joe Biden's sexual harassment (though not sexual assault, yet) since spring 2019, after Joe Biden denied/ignored complaints from seven women who came forward to complain of inappropriate touching. But now it is literally just no big deal for individuals - as long as Dem, racist/authoritarian, non-white, (add categories as needed) - to do just about anything, commit any crime, lie clumsily and be caught at it. No consequences. No press. And even where reality "leaks" around what passes for a press, half or more of the electorate - meh. Or "one of ours", or right skin color, or whatever.

I listened to a podcast going through the columbo episodes, and the last question in each show was, "Did the killer go to jail?" Meaning, did Columbo's contrivance of proof hold up at trial? it's the other ones. Posted by: Braenyard at April 30, 2020 06:34 PM (+Dp5p) I think they're trying to verify that she complained of sexual harrassment then was subsequently fired for it. Which, incidentally, is illegal. But again... why would we think Biden would keep any copies of any records of any of his employees complaining about his behavior? And why do we think there would even be records? And I'm still not following how this would work on a practical level. If Joe Biden sexually assaulted me, I wouldn't go complain to Joe Biden or his chief of staff about it. It's not like Joe Biden is going to fire Joe Biden. I have to assume there's some kind of Senate-wide HR people or whatever to complain to, no? And that any complaint would be a government record, and therefor, presumably, would not be "disappeared"? Because if we're all banking on Biden staffers complaining about Biden to other staffers, then those other staffers taking written records of those complaints, and those written records still existing 25 years later, then... yeah, don't have high hopes for any of that. Yep. They probably realize the small number of Bernie Bros. who won't vote for Biden will become a large number if Biden is shoved out and the old Bolshevik isn't put into the catbird's seat. By the way - I hear a lot about Judge Sullivan and how his been in on this...I asked my wife (she worked 25 years at a top ten law firm) and my best friend who was a form US attorney in the Eastern District - Flynn's real lucky this judge is even entertaining this at this point - this was pled, asked if it was to be revoked, denied by the defendant, went to sentencing, AND then this showed up. It's damning, I get it, as so does Sullivan - but its not his problem. He did every thing that was suppose to be done.
The riot act he read the defendant? That's just par for the course for a convicted felon - Flynn should have been told that was coming when he pled. Justice is probably going to get done here because of Trump - but if Sullivan vacates the plea? He should get some real accolades because as a judge, this was not for him to sort out - Flynn and the DOJ presented this crap in his court.... Biden's family roots are in northeast Pennsylvania probably the most corrupt local government this side of Chicago. We have judges in jail for selling minors to private jails and every attorney in the area knew about it. It took a US attorney to stop it. Afterward they indited over 2 dozen local politicians on other corruption charges and got convictions on everyone. Biden breathes corruption. It's in his DNA.

yes, sometimes he did. Probably half the time. But the other half of the time, the episode just ends with the criminal silent and stunned at having been caught. The silence says "Yeah I'm guilty, you got me," but of course no court would allow you to enter your interpretation of silence as evidence. Well Judge Sullivan's "brand", kinda, is ass-whoopin' prosecutorial abuse. Flynn's lawyer even wrote a book about it.
Looks here like we have a festival of guvamint abuse, from the "investigation" right through to the prosecution/blackmail involving threat to persecute Flynn's son. There's a related if separate gigantic problem of federal prosecutorial power that seems to have made actual prosecution and proving a case almost a novelty and quaint throwback, in all kinds of cases. Would one of the many ways to start fixing that be to make if OK for defendants to publicize any extortion, er, deal-making actions and offers and threats by the prosecutors? I think so. Ought to be as public as anything that goes on in court. In writing. Why not? Sunshine, and all that. Posted by: rhomboid at April 30, 2020 06:58 PM (El6T/) 265

I wonder if Joe's handlers will attempt this dodge:
Announce that no records can be publicly released due to the privacy rights of people other than Biden and Reade. BUT...Joe is going to let a person of his choosing, one with an impeccably non-partisan reputation, review the records for anything relating to Reade's accusation. Someone like...Bob Mueller. Or any one of the horde of supposedly apolitical and impeccable reputation people in DC. (We only need one guess about the results. And this plan minimizes the risk of someone on the outside learning that records about Reade have been removed from the archive.) The Media would immediately buy-into this plan. The prosecutors and his lawyers agreed to keep the deal quiet to evade court rules and if Flynn broke the deal and told the judge the prosecutors would go after his son. And now Sullivan knows as we all do that the entire prosecution was a setup and there was zero criminal conduct. I know judges don't like to overturn a plea. 328 Jack, that's what I was referring to up above. And making a general point about all prosecutions.
Why not make any prosecution deals - every bit of them, including threats - part of the public record? Oh, it will hamstring prosecutions of obviously guilty and baaaad people, you say. Huh. Too bad. Get better prosecutors, or ones willing to work harder. Posted by: rhomboid at April 30, 2020 07:10 PM (El6T/) Part of the problem is that for a lawyer to get ahead in any local DA office or DOJ district office, he/she needs to win cases, and the bigger the cases the better. That's a pretty neat trick.
They also don't like being lied to and played for a fool. This is far from a normal situation. Posted by: JackStraw at April 30, 2020 07:15 PM (ZLI7S) Agreed. Posted by: Gref at April 30, 2020 07:16 PM (AMIL/) Yeah, I don't know the answer either. I interned in a prosecutors during law school, and at least in my (limited and anecdotal) experience, most of them seemed like pretty fair people. There's not really a huge downside to dropping a case, or offering a good plea deal. But as you say, that win ratio in court is very important for everyones career. Which is part of the reason prosecutors love plea deals. I don't know the stats off the top of my head, but I'd guess over 90% of the felony cases in the jurisdiction I worked in were either dropped or plead out. Very few cases actually went through the whole trial process Posted by: Harry Paratestes at April 30, 2020 07:20 PM (ZkXld) 392

The first clue that the judges (or many of them) are corrupt came in the hillary email case, where immunity was given to all witnesses, who then took the 5th, and the presiding judge thought that was fine, and then sealed all the records.(the whole point of immunity is you can't then take the 5th, and records are sealed only in very rare circumstances.)

Which is part of the reason prosecutors love plea deals. I don't know the stats off the top of my head, but I'd guess over 90% of the felony cases in the jurisdiction I worked in were either dropped or plead out. Hiring C&B doesn't surprise me. High-profile politicos of both parties are often partners in all the prestige firms. Some have more a one-party coloration.
But C&B, Williams & Connolly, those places usually had people of varying reputation with both colorations. For one gig I was housed in the offices of a firm led by a pretty famous former senator, there were former Hill types of all kinds there. I was completely separate, but interacted with them, one time the #2 came to me and asked my advice, as I'd worked in furrin' policy for a long time. He thanked me later and we laughed about it a few times as developments illustrated the wisdom of their decision. They'd been approached to become reps for one of the more dubious, verging on odious, foreign regimes at the time (not a US enemy, but nasty). "Not with a 10 foot pole" was my reco. Posted by: Blonde Morticia at April 30, 2020 07:28 PM (G51Gf) Sidney Powell was on Liz MacDonald's show. She said he had no idea the interview was about him. What about the DOJ failing to turn over Brady evidence? Apparently it's not an automatic dismissal, but it seems to me that while you weren't drunk or coerced, you weren't aware of things you were entitled to be aware of when you submitted your plea.
All this said, I'm not sure why a man of such sophistication and experience agreed to the FBI interview in the first place. I'd like to think I also wouldn't have pled guilty to a federal felony I didn't commit. Posted by: Blonde Morticia at April 30, 2020 07:26 PM (G51Gf) Again, it's ludicrously hard to walk back a guilty plea. As for talking to the FBI? I certainly wouldn't have. But as I understand it, Flynn was under the impression it was some kind of routine counter intelligence stuff. Like "welcome to working for the government, we're just crossing t's and dotting i's" and had no idea he was the subject of a criminal investigation. Posted by: Harry Paratestes at April 30, 2020 07:33 PM (ZkXld) 457
I have great sympathy for Gen. Flynn. But, he made bad decisions at the beginning. He failed to realize that he was a target from the minute he accepted the NSC job. He managed to get on the wrong side of Mike Pence. He talked to the FBI without legal advice - nobody in the WH does that - nobody. He didn't vet the law firm he hired. Did he, or somebody else pay their bills? We will never know. Who really knows what the hell he was up to with the Turks. Whatever it was, he should never have involved his son in it.
I seem to remember when this first started that the judge asked him whether he wanted to withdraw his plea and, with Powell standing there, he said no. On the other hand, the judge has delayed this time and again. There could be enough misconduct here for the judge to dismiss, or sentence him to a one dollar fine or something. who knows. One thing is for sure. Everybody on the prosecution side should be disbarred and the FBI agents prosecuted.
Posted by: artemis Second clue was the FISA Court judge being lied to and when it was determined, didn't do shit. Posted by: rickb223 at April 30, 2020 07:33 PM (2VADA) 459

I'll hire a well known law firm, they'll sort all of this out for me." "I just need to talk to the prosecutor, once he hears my side of the story, he'll say 'sorry, it was all a big misunderstanding...'" Then ace did a link about crows recognizing and remembering human faces....and holding grudges. Every single time I do go out to run them off, they call to each other and a whole gang of them show up. And caw and mock me. My husband's like, "Get the BB gun." Me, "The Karens will report me." as long as most morons are here, here's the scoop. i have lesions in my brain, cancer in my belly, groin, chest, and some other places that i don't recall. it's bad. i'm fucked. that's life. my wife is a mess. keep the faith if you can.
Posted by: chavez the hugo at April 30, 2020 07:05 PM (KP5rU) ------------------------------------ Sorry to hear that. However, they told my wife she had stage-4 cancer in lungs, liver, and pancreas. Post surgery (when they did true biopsy) they said it was only in pancreas and removed it. It's been a year since surgery and she's still here. Prayers up, chavez. Cats. Three or four good size Tom cats will take care of the problem, I think.

Have you tried one of those fake owls? People down here put them on their docks to keep the seagulls and other nitwit birds off their docks and boats.
Posted by: Jane D'oh at April 30, 2020 07:41 PM (ptqGC) I looked those up yesterday but people said that once they figure out the owl isn't moving, they get use to it. I suggested one of those 'raise the roof' guys that you see out front of a grand opening. Posted by: Tami at April 30, 2020 07:48 PM (cF8AT) 518

BUT...Joe is going to let a person of his choosing, one with an impeccably non-partisan reputation, review the records for anything relating to Reade's accusation. Someone like...Bob Mueller. Or any one of the horde of supposedly apolitical and impeccable reputation people in DC. (We only need one guess about the results. i'm guessing joe has a lot of records about yoga and baking cookies. Oh, chavez. Such crappy news. Prayers offered, of course for you, and your wife.
Sometimes Blessings are realized when life throws you a curve ball you don't expect. Your eyes are opened to what really matters. Be Strong, and know that God listens. Prayers ARE heard. I pray that His will matches what you need most. Posted by: My life is insanity at April 30, 2020 07:54 PM (tiJzb) 522

Anyone here ever do battle with Starlings? My husband is about to go nuclear on their asses and I'm worried he's gonna end up shooting a neighbor! j/k...sorta. They fly in packs from garden to garden around here, pecking tomatoes. I've found there always seems to be a scout bird that arrives before the pack. When I shot that one, the rest moved on. .177 pellet works fine for me and is quiet. Posted by: dartist at April 30, 2020 07:56 PM (K22Va) 524

Newsom was supposed to close all state beaches. Instead, he decided that he was only going to close Orange County beaches. Good luck enforcing that since both the Sheriff and the County have said that the Sheriff's Office will not be enforcing any of the state's closure orders.
I hope there are even more people out on the beaches tomorrow. Posted by: Ghost of Lee Atwater at April 30, 2020 07:25 PM (nu45M) Who does New some have to enforce the order? CHP? Posted by: Fox2! at April 30, 2020 07:57 PM (jbFVL) 527
