Judges Rule Against Tyrannical Shutdown Orders in Illinois and Virginia

In Illinois:

Clay County Circuit Court Judge Michael McHaney ruled against Pritzker's executive order, granting a restraining order to temporarily block the stay-at-home restrictions set to take effect Friday, according to local reports.

"We are certainly going to act in a swift action to have this ruling overturned," Pritzker said in his daily coronavirus press briefing Monday.

The ruling comes after Republican State Rep. Darren Bailey of Xenia filed a lawsuit in Clay County Circuit Court claiming Pritzker has exceeded his authority and is violating the civil rights of the state’s residents. Pritzker on Thursday extended his stay-at-home order through May 30 as the highly contagious COVID-19 continued to infect thousands in the state.

"Enough is enough!" Bailey said in a statement. "I filed this lawsuit on behalf of myself and my constituents who are ready to go back to work and resume a normal life."

A judge has also halted Governor Blackface's unconstitutional order to shut down gun ranges:

A circuit court judge in Lynchburg, Virginia has overturned a portion of Gov. Ralph Northam’s executive order that declared indoor gun ranges “places of amusement” that are non-essential and must shut down during his state of emergency. Judge F. Patrick Yeatts declared in an order on Monday that Northam's actions are likely to have exceeded his constitutional authority, and declared that the portion of the governor’s executive order on essential businesses that deals with indoor ranges not be enforced while the litigation continues.

Yeatts noted in his decision that the Virginia state constitution declares that “the body of the people, trained to arms is the proper, natural safe defense of a free state.” Since that is the case, clearly the right to bear arms includes the right to train with them. Since gun ranges provide a place where that training can take place, they are protected under the right to keep and bear arms.

Meanwhile, the elites fret about "quarantine fatigue" as the peasants begin ignoring unjust laws and petty tyrannies.

Researchers tracking smartphone data say they recently made a disturbing discovery: For the first time since states began implementing stay-at-home orders in mid-March to limit the spread of the novel coronavirus, Americans are staying home less.

The nationwide shift during the week of April 13 was relatively slight. However, any loss of momentum, particularly when stay-in-place orders remain in effect across most of the country, has some public health experts worried about "quarantine fatigue." Any increase in travel, they say, is premature when staying home remains the most effective way to limit the spread of the virus until widespread testing and contact tracing become available.


"We saw something we hoped wasn't happening, but it's there," said Lei Zhang, lead researcher and director of the Maryland Transportation Institute at the University of Maryland. "It seems collectively we're getting a little tired. It looks like people are loosening up on their own to travel more."

The daily press conference was supposed to start at 5pm.

47 This completely makes sense - all a permitted business needs to do is take any shut down orders from the local police to the local judge - there the judge will ask the DA what statute is being involved to revoke, even temporarily, the business owners permit to operate, and at this point every local DA, every fucking one, is stuck - because emergency orders from the governor are limited by the statutes they involve and are narrow, very narrow in scope - typically surrounding the national guard and safety issues as far as marine and road access...and then it stops.

how do they know this? I don't think having the entire well population under house arrest is working well, at all.

seems like the vulnerable population was still vulnerable, and in fact died scared and alone, instead of being cared for by their family members, due to the lockdowns.

we've been forcibly separated from each other, which WEAKENS us, not only physically (harms immunity to be shut indoors and sedentary) but emotionally and mentally (can't commiserate with each other or connect or talk even).

this whole thing stinks to high heaven. the lockdowns were a drastic, terrible method. I don't even think they WORKED - at least not for viral mitigation. I guess they worked as a psy op.

It is my understanding that neither NY nor NJ has needed the additional bed capacity built for Covid. Specifically, Javits and Comfort never got more than a handful of cases. They were still wise to build that capacity, and I'm thrilled it wasn't needed.

That's true, but it's a qualified sort of truth. A lot of people with non-COVID respiratory problems that would have ended up in the ICU in January were discharged to their homes so beds could would be available for COVID patients. I think they would have run out of ICU beds (but not vents) if they hadn't changed procedures.

I don't mind seeing the government try to address quarantine related costs. But I don't see why people in Florida should have to pay for Illinois's decades long criminal stewardship of its pension system. Or for the spendthrifty ways of the legislature in CA where I live.

Outside is the only place you can be, particularly if you are a child. If my grandkids want to do anything, it can only involve a bike ride or a hike. All other options are closed to them, even going into the grocery store. Even going into the parks. They haven't been in a store for 5 weeks. Haven't been to church in six. There are only so many hikes you can go on in any particular day.

No problem with testing in general, of course diagnostic, and given the amazing instant innovation that has produced quick tests. It will be useful in dealing with the psychological issues (fear) for employers, institutions, group events, etc.

But making "re-opening" contingent on an arbitrary level of testing is not linked to any medical or epidemiological science, unless this virus is much deadlier, and much better understood, than appears to be the case.

411 My office plans on reopening next Monday. They will have procedures in place to "Be Safe." If one of those procedures involves wearing a mask, then I'll just stay here at home for the time being. My workstation is running very well - my son set us up with outstanding internet.

I hate the mask protocols. I believe it's more about making the person next to you feel more safe, and far less doing any actual good. I wore a mask once since this whole thing started, and that's when we had to take our kitty to the vet to be put to sleep.

But, in all my wanderings to stores and other places, nobody has batted an eye. It's confusing, to be honest.

I used to work at a large mobile phone company. Believe me, the whole burner thing just gives you a false sense of security. Your phone habits are like a fingerprint, and I worked on a system that would match those fingerprints to particular people we had on file.

In our case the goal was to find people using someone else's documents to open an account and not pay. Back when service was more expensive we used to get a lot of that - people would open a new account under someone else's name, not pay, and then open the next new account when we shut them off for nonpayment. Eventually we had fraud investigators onto repeat offenders in about 24 hours.

But I know for a fact the government is doing the same thing - I remember reading an article about a drug bust where the gang had burner phones, and it took the DEA only a day or two to match phones with identities.

Two, they still don't have enough information to pin down the mortality rate on this thing within an order of magnitude. That's important information when you're trying to decide how far you're willing to go to keep people from being infected.

I go to an Albertsons here in AZ, and although they put up those stupid clear plastic spit guards in front of the cashiers, most of the customers in the stores (including me) are still not wearing masks. Until about a week ago, most of the employees were not wearing masks either, but when I went in a couple of days ago, they were all wearing them, so I suspect that they were ordered to.

Meanwhile, we have 275 WuFlu deaths in a state with a population of @ 7.5 million, so a death rate of a whopping .00366, almost all of them old people. Hospitals here have plenty of capacity, only about 20% of our available ventilators are being used, and 2/3 of our ER beds are empty (all according to the state dept. of health). And temps in the desert regions are now in the high 90's or triple digits, so more than hot enough to kill the virus outside.

Time for this quarantine bullshit to end. Enough is enough.

Depends. As I understand it, unless it mutates pretty drastically there will now be a threshold for immunity, particularly as mild cases with low load continue through the summer somewhat. With the lockdown, with any luck any affected people adjacent to a "supernode" person in contact with dozens upon dozens or hundreds will have failed to propagate along that person's connections and make for as-rapid spread. And a lot of those supernode people will have had it.

Not really that different than forest fire. Seasonal risk, but burnout has its effects.

Whenever you call someone the call metadata (your EID, the other person's EID, where you are, how long the call lasted, etc) goes into a database that they can use to ferret out your social network. That is, if Alice calls Bob, and Bob calls Charlie, Alice and Charlie get associated. That's enough to throw up a flag when Alice calls Charlie even if it's the first call. The math gets a little hairy, but social networks are pretty stable, and just moving around will not save you. Even if you all get burner phones our software could match you to previous accounts pretty quickly.

If you really want to stay out of the all seeing eye's gaze, the right way to use a burner is to make one call and then get rid of it. It's probably too expensive for anyone but actual drug dealers.

If you don't call the people you need to call, you're not going to find your phone very useful. And yeah, while we at the phone company didn't care if you made one call and then went dark, it's probably something the DEA looks for. They're still going to have a hell of a time proving it's you, though they can probably tap your call if the person on the other end of the call isn't also using a one time burner.

The scary thing for criminals is a stinger. They can record every call in your neighborhood if they really want to and can get a judge to sign off.
