New Jersey's Fascist Liberal Governor Phil Murphy: I Wasn't Thinking About the Bill of Rights When I Ordered Churchgoers to Be Arrested En Masse

Full video here. As Tucker presses him on what legal authority he has to overrule the Bill of Rights, Phil Murphy keeps saying "science."

But then, it turns out he's also unable to answer very, very basic questions about the "science" he's citing as his authority to repeal the Constitution.

He also can't explain what "science" says that it's safe for people to be in close contact in a liquor store, but not in a synogogue.

Liberal Democrats always want to appear "tough," especially because they are notoriously weak on crime and foreign policy. Given that they never crack down on crime or foreign enemies, that leaves one group left to target for "tough" handling: law-abiding American citizens and, increasingly, churchgoers.

"You say that you were not thinking of the Bill of Rights when you ordered churchgoers to be arrested, and this begs an additional question. When *do* you think about the Bill of Rights, governor? When does the Bill of Rights enter into your proposal or decision-making processes?"

Posted by: Joe Mannix (Not a cop!) at April 16, 2020 01:36 PM (hYcqw)

47

There is no provision in the Constitution for the suspension of basic rights in an epidemic.

The police power (passing laws to secure health safety and welfare) is nigh unlimited in states and local jurisdictions. That is why we still have blue laws in some places. Under the police power, individuals can be quarantined if they pose a threat to the safety of others as evidenced through the traditional English powers exercised in events like the plague of 1665 and earlier outbreaks. They can quarantine a family who is sick. They can shut down marketplaces. They can do lots of things PROVIDED they bear a reasonable relationship to the stated goal.

There is no rational basis for half of these absurd rules going on right now. Even quarantining sick individuals power theoretically should be accompanied by notice and an opportunity for hearing under our constitutional concept of due process, but a statute can certainly convey the basic authority to quarantine.

Witless Whitmer and this asshole mayor think that they can make any rule at all and say "COVID" and make it OK.

All I can say in response is: "That's real retarded, sir."

-------------

Well see the very 1st A says we have the right to freely exercise our religion. Most sane reasonable people would conclude that means we have the right to go to a church. Now Obama seemed to think that is all it meant. Now we know the left doesn't want to allow that. So per the left, you don't have the right to practice your faith outside of church, nor do you have the right to go to church. So some of us believe this is a restriction on our God-given right that our enshrined in the BOR. Now I know it says Congress , but the 14th A said all people have the privileges and immunities of being Americans ... this means the 14th A incorporates the 1st Amendment.

All being said, it is not the BOR that gives us this protection.

It is a God given right.

155 Obesity does not mean that you have diabetes. My late husband weighed 350 and was not diabetic. We would have to explain that to the doctors every damn time we went in. He had afib but did not need meds for it. He had limited mobility due to the second hip replacement, so yeah, his weight affected his hips. And they were so busy focusing on the stuff he didn't have that they missed the liver disease.

We would do a lot better if we stopped believing some of this nonsense that doctors tell us. Every time we change insurance, we have to do this fitness assessment. They always tell you to do a low salt, low fat, high carb diet. We know that's wrong and have known it for over ten years now. Yet that is still their advice. There are some areas that the medical profession does good work in and other areas where they are terrible. And this blind spot about obesity is one of the areas they are bad at. Look at the real underlying risks and stop looking at what they weigh on the scale.

We might have gotten the ACA if the 17th were repealed right before hand because it included a whole lot of money for states.

The 17th's legacy is horrendous, effectively cutting off the vertical checks and balances of the federal system by depriving the states of their direct say in the federal government.

168 Christians and Jews don't fight back.

That's why. Cowards persecute the helpless.

It matters not. As Tertullian noted when the government used to shove Christians in a ring to be tortured and killed, the blood of the martyrs is the seed of the church.

You can kill us, but it only multiplies us. Your plan will not work. You only make brave role models out of faithful men before the world.

Ticket me. Fine me. Throw me in jail. Lock the doors of my church. Drag me through the streets behind a pick up truck as my body parts rip off on the asphalt. You only make me more certain of my convictions.

I will not stop worshipping.

The enemy of our souls and his earthly minions in government can suck it.

170 I don't see how states like New Jersey or New York avoid mass civil disobedience. They are now implementing lawless, post constitutional fiats at whim. There is no legal grounding for what they are doing. The virus is simply what they believe to be a perfect pretext. They are using the liberal argument that "the greater public good" gives them relief from any law or constitution. Their stacked courts will rule the same. It's time to wipe this doctrine of despotism off the map.

173 I think we know now why the Jarrett Administration tooled up all the local police forces with serious ordnance for eight years. The plan was clearly to have them be the enforcers of any "new normal" which might conveniently spring up under The Hag.

And yes, I am roughly 60% certain this was going to occur under the Hag. Probably during the election year (now) to keep any upstart Republican Challenger indoors, and give reason to enforce sweeping internet speech controls ("if stopping Russian Disinformation saves just one life...") and a brand new commie normal for '20-'24.

I think it's been planned quite a long while. If China had been winning against Trump, they may have held it back until the next D president was in place. Sorry, that's where I am right now.

Facially neutral laws of general applicability can impede or infringe upon religious free exercise if meeting a rational basis and provided the law does not interfere with another fundamental right under the hybrid rights test of Smith v. Employment Div of Oregon.

If there is a hybrid rights situation, then the law must meet the "compelling interest" test, a sort of heightened scrutiny that requires the law to be narrowly tailored to avoid infringing on free exercise wherever possible.

257 hear ye hear ye, from a site called "ourdocuments dot gov":

Congressman John A. Bingham of Ohio, the primary author of the first
section
of the 14th amendment, intended that the amendment also nationalize
the Federal
Bill of Rights by making it binding upon the states. Senator Jacob
Howard of
Michigan, introducing the amendment, specifically stated that the
privileges
and immunities clause would extend to the states "the personal rights
guaranteed and secured by the first eight amendments." Historians
disagree on how widely Bingham's and Howard's views were shared at the
time in the Congress, or across the country in general. No one in
Congress explicitly contradicted their view of the Amendment, but only a
few members said anything at all about its meaning on this issue. For
many years, the Supreme Court ruled that the Amendment did not extend
the Bill of Rights to the states.

Chinese loans fund infrastructure projects in over 100 developing nations across Asia, Africa, Europe, and Latin America through the BRI, an initiative estimated to be worth $8 trillion.

Troll or not, that is a correct statement of pre-14th amendment constitutional law. States had established churches prior to the Civil War, and would not have thought twice about imposing any sort of ridiculous law on their citizens (and did so!). States were thought to be mini-national entities, and the vaunted "Bill of Rights" was considered by many anti-Federalists (nowadays extremely limited govt conservatives) to be an unnecessary spelling out and limitation of our God-given rights.

I've read so many stories of Senators receiving instructions to vote a certain way and disagreeing. It would play out one of a few ways. Either the senator would comply and keep quiet, or the senator would resign, or the senator would do what they wanted and the state legislature would recall them and replace them.

Since absolutely none of the latter two happens now, I attribute that largely to the 17th Amendment.

First, that's 3% of those known to have the virus, and we know at least as many get it and are never symptomatic enough to show up. So halve that number, and that's your absolute ceiling.

Also, that's assuming everyone is going to get the virus, which they're not. So cut that number way down again.

And then factor in that the mortality rate can be mitigated even further with Vitamin C and D to boost the immune system, and then if you still get it, take HCQ and other drugs which will usually knock it out.

All of which is to say, shut up.

I don't know when NJ will stop electing rich Goldman Sachs alumni.

Murphy was essentially a back-slapping sales guy who became significantly rich and then carpet-bombed the state with ads for over a year before the Dem primary.

He's not very bright. A lot of the bigger decisions and deals seem to be made by Senate President Sweeney and I don't really know what Murphy does all day besides really cling to lefty goals like $15 an hour. (My teenage daughter's friends with jobs ALL work under the table - nice lesson to learn.)

So of course he will probably be re-elected if he doesn't stand down due to his kidney cancer.

The sad thing is NJ has a lot of blue believers. My neighbors on both sides are huuuuge leftists. We left our church after the umpteenth sermon espousing gun control. (True story - our pastor was on the side of the Baltimore rioters). To me, keeping people out of there is not a disservice.

I am so done and with Murphy's move to vote by mail (once you go absentee you are vote by mail for life unless you go through a process with your county clerk, which I did because it pissed me off so much) Dems will rule until the state is a bloated carcass in front of Pennsylvania.

407 370 Have people wear masks in public and keep doing all the other things. Open up all businesses as long as they can maintain social distancing.

I know people hate the idea of mandatory masks. But there's a psychological element to this. If people feel they are protected, they'll start to get on with their lives. They may have to do some sort of risk mitigation for businesses (maybe insurance).

Potential problem I see with masks is it might give false sense of protection to the people the high risk factors who really should continue to self isolate. But, I still agree that the benefit as a "crutch" to get back to normal is worth it.

I could well be mistaken but I think it was "science" that led authorities to kill dogs and cats during the bubonic plague because they thought they carried the disease.

Science did not exist during the 13th century. Recall that people then were still practicing alchemy to turn base metals into gold.

Science only began with the Enlightenment.

"science"/magic/alchemy/sorcery were all functionally the same until the systemization of the scientific method during the Scottish Enlightenment of the 18th and 19th centuries. Even as late as the cholera epidemics in London, you still had a large contingency of "doctors" believing in the miasma theory of disease.

Change my mind.

With tinfoil hat still firmly sitting atop my head, I am sticking with my original theory that this was/is a Deep State-China joint black operation.

--- Deep State wants Trump gone
--- China wants Trump gone (bad trade agreements, etc.)
--- China wants their Hong Kong problem gone

This virus gives everyone cover. It's really no worse than influenza virus, but the reporting on it is completely different.

Consider how the reporting would be of a virus that kills 60,000 people in the USA within a year --- influenza --- where there were 20 million infections and 800,000 hospitalizations.

60,000 deaths = 164 per day / 5,000 per month
20 million infections = ~55,000 per day / 1.6 milllion per month
800,000 hospitalizations = 2,200 per day / 66k per month

Imagine if the media were reporting that data of infections and hospitalizations and deaths due to seasonal flu as breathlessly and hysterically as they are doing with COVID-19. Would it be any different than what they are doing now?

Nope.

But what about the drastic measures being taken by China with their people? Well, they have a protest to put down, right? So they use the excuse of the virus and take all the extreme actions they want. Just like our totalitarian Governors are doing here with banning anything and everything they feel like. Only with China, they go to extremes and just kill people who aren't following the rules.

Then you had Event 201 that war-gamed a pandemic. And within a month, a virus is released to start a pandemic.

And we have social media being used to either ban or correct "false information"... just as suggested in the Event 201 war-gaming.

And then there's Bill Gates who is against herd immunity and wants massive testing and vaccinations... who just happens to be in the business of tests and vaccinations.

And then there's Birx and Fauci connected to the Deep State.

And China and Gates control the WHO.

And Birx's relative who is involved with the Gates Foundation.

Yeah, maybe the last 5 weeks of working from home and dealing with Half-Whitmer and her army of Karens is heating me up and afixing the tinfoil a bit tighter to my head --- (I can see you all looking at me like Mel Gibson looking at his kids in Signs when they were wearing the tinfoil looking at the aliens book) --- but...

... if someone came on here last year and said that the entire nation's economy was going to be deliberately crashed by our own government by making the deliberate decision to shut everything down and keep people hostage in their homes, I likely would have been laughed off the blog. And yet, here we are...

480 "science"/magic/alchemy/sorcery were all functionally the same until the systemization of the scientific method during the Scottish Enlightenment of the 18th and 19th centuries. Change my mind.

Science is the application of the scientific method to acquire new knowledge, the testing of hypotheses by recourse to experimental observations as opposed to received truth or tortured "reasoning."

Farting around with retorts to transmute metals was not science. Alchemy etc. produced precious little new knowledge apart from strictly serendipitous discoveries.

And besides - have you not seen how this works yet ? Give in on the masks - and the National Karens will simply go to their next demand. They don't stop.

This. And when the lockdowns start coming to an end, the Doomers (perhaps a better term than "Karens") are going to want to take it upon themselves to enforce and expand upon whatever limits are in place (masks, distancing, etc.)

I do not want to see people in permanent lockdown. They have folks completely freaked out over this. Every time the President tries to be optimistic, we get this "we're all gonna die" nonsense. Placebo effect is very real, even though the pill does nothing. What will happen with mandatory mask wearing is that it will be enforced for a bit, and people will start to ignore it, especially when we get to hot weather. If it gets the economy going again, we should do it.

Great Depression 2, American Bugaloo!

It's fairly well admitted in economics circles that Federal Policy not only made the Great Depression worse, but also made it much longer than it should have been.

Those Federal Policies were all based on Government control of the economy. Of the Government 'taking care' of people.

Now, doesn't that sound really familiar?

The Stress Pandemic

Deliberately closing down the economy, which has never been done before, has created a more infectious, possibly more lethal disease than COVID-19. Let's call it the Stress Virus. For the Stress Pandemic there can be no vaccine. There is only one cure -- more jobs, more economic growth. Federal, state, and local governments should immediately begin to open the economy. Conditions in states, cities, localities vary. State and local officials should act accordingly with a clear goal: remove restrictions as fast as prudently possible.

...

The Wall Street Journal, in a recent article headlined "The Struggle to Cope With Depression Amid Coronavirus," noted:

The pandemic is upending everyone's lives. But it has been particularly destabilizing for the millions of people who deal with depression and anxiety. ... The stress of job losses and the shredding of routines and support systems can exacerbate symptoms and make relapse more likely, says Charles B. Nemeroff, chair of the department of psychiatry at the University of Texas at Austin's Dell Medical School. The National Alliance on Mental Illness says calls and e-mails have increased 40% in the past two weeks. ... The Crisis Text Line has seen demand in the U.S. rise by 40% since March 16.

I bet it's more like 50 plus percent by now.

Get help if you need it, guys. There's no shame.

The country is going to open up as soon as Trump rolls out the plan. It will be soon. But in the meantime...

500 A method of facilitating back to work would be to increase business hours or go to 12h days with fewer people each day.

I spent my life at hospitals and there are way more people around 9-5 than the rest of the day. Attendings go home, and the floors are crawling with administrators, social workers and misc clerical people (billing, supply, laundy)

There is no law that says attendings must blow outta there by 5 ish and social workers and billing people could enter data at any time of day. One of the best surgeons I know used to book ORs exclusively after 6p. There was no pressure on space and the evening and night staffs were less stressed by the numbers of people arriving post-op to the units. And who would not rather have an attending or two around at 10p rather than a resident?

A lot of the nursing and assistants work 12h days and only three days a week. While you always need an adequate number of these, you could "distance" better if the other shifts (even if this was in ad administrative building) were utilized by non healthcare regulars. Computers still work after 5p

Trump plays the game better than all his opponents combined.

This movie is playing out exactly like the sequel to 2016. 2016 was a young upstart hero with all the odds stacked against him, winning the fight against all comers, with a ridiculous seemingly impossible to overcome obstacle at the very end (the pussy tape) before finally vanquishing the big baddie The Hag.

2020 is the sequel. Which is basically the same movie again, but with the stakes raised to even more unbelievable levels, with greater odds stacked against, and finishing with an even more impossible escape...

Why would they give up keeping the population in abject fear, and under the thumb of government at all possible levels? It would mean they skipped like 20 steps on the way to their commie utopia.

Hell, it's not like they'd be worrying about future elections. Those will become just like the ones in Iran etc where the Democrat wins 100% to 0.

550 The way it's been explained here many times, is that the mask keeps you from spreading it.

-----

Wont do that if you dont remove it and dispose of it without contaminating everything.

Was out walking the dog the other morning. Watched a man with his mask not covering his nose go into a grocery store. He takes it off when he go to the door, wiped his face and hands with it, stuffs it in his jacket packet, then proceed to handle three carts until he finds one without the wobbly wheel.

Yeah.... I feel safer already.

557 It strikes me that the different responses between the "stay shut for your own good" states versus the "we're opening up and accepting the risks of corona" states may well be the "divorce" opportunity that Ace has looked for. If the stay-shut states block themselves off to others, they will essentially be cutting themselves off from the US of A in practice...and the longer it goes on, the more "normal" it will seem. But I'm confident once the open bloc opens, then the pressure inside the shut states will be too powerful to resist, they will open up like the Soviet bloc did after the Hungarian domino fell in 1989...with complete disgrace for their dead-ender leadership.

Trying to explain this to my buddy in CT who is a Trump hater and a democrat.

He either refuses to think anything bad is going to happen to the small business people or his Trump hatred blinds him to what is happening, I am not sure which it is.

Gave him the example of the tire store owned by one guy who has 2 other guys working for him.

Nobody is buying tires right now the only thing his shop is doing is flat repairs. He doesn't make enough to keep three people working with that so he let's his two guys go and is going it alone.

He still is not making enough money to pay his bills. Mortgage, Insurance and utilities still have to be paid and now he is dipping into his savings to pay them. Eventually he will go bankrupt if this lasts much longer than the next few weeks.

My buddy says he will be OK because the government will loan him money to stay afloat. I say fine, but he has to repay that money on top of his current bills and he was just getting by and able to put a little away every month, he really can't afford a loan payment, plus it's going to take a long time for his business to get back to where it was.

The smackdowns of Pelosi and the press are *extremely* important. Trump didn't get where he is by accident.

If you don't keep bashing the press and Pelosi, they will eventually wrest away the narrative and provide their own *convincingly*. Pelosi was trying to act like she's his boss just yesterday. That's really important for persuading people. For making Trump appear weak or not in control.

He needs to appear in control. Like Republicans are in control, not Democrats. Shit, half of good leadership is appearing to be in control. It's an election year. This stuff matters bigly.

OK, Galileo remains the outlier, always. The "scientific method" would probably be a better parameter for debate than "science", since observational theories (as opposed to experimental attempts), since we had Archimedes and Pythagoras in ancient times, too.

Since we are just fucking around here, it's not like there's any real clear line but certainly the late 1700s saw a change in quality as to what constituted "science." Even so, there remained serious resistance to the new methods until the late 19th century.

Our notion of what constitutes valid science has always puzzled me, especially now with the widespread adoption of "modeling" as a substitute for hard, reproduceable experimentation.

702 Trump isn't punting anything.

From the get-go, the governors have made the actual calls. As they pretty much corresponded to the task force recommendations, there wasn't any squabbling. Squabbling was about resources, not "lockdowns".

At least 4 or 5 different categories of states based on conditions. Policies will correspond to those varied conditions - or not - but not a blame game.

Moreno Valley is marginally better. Riverside is a complete shithole. My husband and I drove past our old high school, and all we saw were tons of Mexican girls pushing strollers (apparently there's a day care at the school now).

709 This is again only to make it seem like it's Democrat leaders who are in control, like Trump is sidelined because he can't handle anything.

Especially when the recovery starts, they want it to seem like they "managed" us to a recovery. When you hear Trump say things that sound weird, put it in this context and it will make sense. That's what his challenge of the 10th amendment last week was about. Staying top dog.

The rationalism that led up to Bacon and Newton was the peak of epistemology. The topic should have been closed because everything that came after--especially those German assholes starting with Kant--was backsliding.

This is why our Founding Fathers appear to us to be intellectually omniscient. In a way they were because they had access to all the goodness of rationalism before it was ruined. The French were not so lucky.
